A former Attorney General of the Federation (AGF) and Minister of Justice, Chief Michael Aondoakaa (SAN), has maintained that before a candidate can be declared winner in a presidential election, that candidate must score 25 per cent of the votes cast in the election in 2/3 of the 36 states and the Federal Capital Territory (FCT), Abuja.

This is coming as a constitutional lawyer, Prof. Mike Ozekhome (INEC), faulted the Independent National Electoral Commission (INEC) for going ahead to declare Senator Bola Ahmed Tinubu of the All Progressives Congress (APC) as the President-elect, having not scored the required 25 per cent in the FCT.Aondoakaa, who stated this while appearing as a guest on ARISE NEWS Channel programme, maintained that this requirement had been the law and has not changed since the pronouncement of the Supreme Court in 2008.

There have been mixed reactions by lawyers on the issue since Wednesday when Tinubu was declared the winner of the February 25 presidential election by the Independent National Electoral Commission (INEC).Tinubu secured 8,794,726 votes to defeat Atiku Abubakar of the Peoples Democratic Party (PDP), who polled 6,984,520 votes, while Mr. Peter Obi of the Labour Party scored 6,101,533 votes.

While Tinubu and Atiku won 12 states each, Obi won 11 states and the Federal Capital Territory (FCT), while Kwankwaso defeated the three only in Kano State.Of the three leading presidential candidates, only Obi won the FCT, which is believed to be a very strong constitutional requirement to become the President of Nigeria.

Obi scored 281,987 votes or 62 per cent of the total votes cast in the FCT, while Tinubu scored 90,902 or 20 per cent.On his part, Atiku scored 73,743 votes, or 16 per cent of the total votesWhile the 1999 Constitution states that a presidential candidate must secure the highest number of votes cast at the election, it further added that the candidate must also secure not less than 25 per cent of the votes cast in at least two-thirds of all the states of the federation and the FCT.Though Tinubu scored the highest number of votes cast at the election and also polled at least 25 per cent of the valid votes in at least 24 states in line with the Constitution, the former Lagos State governor did not secure 25 per cent in the FCT.

Specifically, Section 134 (2) states: “A candidate for an election to the Office of President shall be deemed to have been duly elected where, there being more than two candidates for the election: (a) he has the highest number of votes cast at the election; and (b) he has not less than one-quarter of the votes cast at the election in each of at least two-thirds of all the states in the federation and the Federal Capital Territory, Abuja.”

But while noting that the matter is already in court and, as such, he would not dwell deeply on it, the former AGF recalled that the Supreme Court had in 2008 in a suit involving the current President, Muhammadu Buhari, and the then President, Alhaji Umaru Musa Yar’Adua, resolved the issue of the 25 per cent in 2/3 of the states of the federation and the FCT.

“It’s a very difficult situation, but the matter has been interpreted before, around 2008, in a matter involving the current President,” he said, adding that “the pronouncement then was that the ‘and’ is used conjunctively; that was the interpretation then.“Maybe the Supreme Court may have another look since it was a long time ago, but as of now, that is the interpretation.“The interpretation was that the states and the Federal Capital Territory shall be construed conjunctively. In order words, you must get 25 per cent in 2/3 and 25 per cent in the FCT if you go by the interpretation of the Supreme Court in 2008.

“But I know the Supreme Court has a right to depart from his previous decisions if the justices of the case demand so.“I don’t know if confronted with a similar situation they will follow their own decision or depart from it,” he added.Meanwhile, a constitutional lawyer, Prof. Ozekhome (SAN), has faulted INEC for declaring Tinubu as the president-elect having not scored the required 25 per cent in the FCT.

“The Constitution says you must get 25 per cent in 24 states, and in FCT, Bola Ahmed Tinubu did not score 25 per cent in the FCT, and since he didn’t score 25 per cent in the FCT, he should not have been declared president as INEC wrongly did,” he said.While claiming that the February 25 presidential election was not free, fair, and credible, Ozekhome pointed out that Tinubu would continue to “carry a very heavy, strong burden of legitimacy and lack of it on his neck like an albatross; it doesn’t require demonstration or protest on the street; the issue is a moral burden on him.”

The senior lawyer noted that in seeking 25 per cent in 2/3 of all the states of the federation and the FCT, the Constitution clearly distinguished the FCT as a separate entity or a special territory, wherein the presidential candidate needs to obtain at least 25 per cent of the total votes cast in the election.“The framers of the Constitution certainly desired for Nigeria a President that is widely accepted with a national spread and not one that has only the support of his tribe or region. Hence they provided in the Constitution the sections relating to the election of the President because of our peculiarities as a multi-diverse and multi-facetted nation.

“The provisions contained in Section 134 of the Constitution are meant to reflect this. In the same light, the framers of the Constitution viewed the FCT as a melting pot, a sort of mini-Nigeria. Thus, as a commentator posited, the position or status of the FCT assumes that of a compulsory question that a presidential candidate must answer in the electoral examination.

“The only logical conclusion is that sections 134 and 299 are not mutually exclusive or contradictory. Rather, Section 299 supports and complements section 134. To show this distinctiveness, FCT has never conducted any elections, either for gubernatorial candidates or state Houses of Assembly members, as done by states. Rather, under Section 301 of the Constitution, the FCT is governed by the President with an appointed Minister as his proxy in the form of Minister of the FCT. Likewise, the FCT does not have its own state House of Assembly but legislates through the National Assembly. This, therefore, speaks to its distinct status, which is not affected by section 299.

“Whether Abuja is regarded as a full state, pseudo-state, quasi-State, or semi-State, is immaterial. Even if it is none of these, the intention of the Constitution-makers matters if in their wisdom, they decided to reckon with the votes cast in even a single LGA in Nigeria, along with votes cast in the 36 states recognised under the 1999 Constitution, to decide the winner of a presidential election, then the six Area Councils in the FCT cannot be treated lesser or ignored,” the senior lawyer explained.

You must win 25% of the States and the FCT put together. Anyway you will understand better as the day goes on.
Suddenly you have remembered you are a lawyer and knows the law. Please oga charge and bail lawyer, what did the law say about transmission of election results?

Since yesterday you have been mute on the debate on election transmission from the polling unit thru BVAS and suddenly ran out from your shell to come and start defending the indefensible.

The law must must be obeyed in totality or the entire exercise will be in futility. Nobody will spend all energies and resources only to come now and swallow a demonic excuse by INEC. Its not possible and no reasonable lawyer would be able to defend and win this anormally.

The Federal Government’s economic diversification programme may have recorded a head-start as investment groups gather for the ground breaking ceremony of the Enpower Free Trade Zone (ENPOWER FTZ) scheduled by the end of this month with a target to attract N240 billion Foreign Direct Investment (FDI) and 20,000 jobs.



Governor Ifeanyi Ugwuanyi who consolidates on foundation efforts of former Governor Sullivan Chime on the project, was quoted as saying in a statement at the weekend that the ground breaking ceremony for the facility would bear the first set of investment fruits which will give highly needed momentum to his government’s economic diversification programme.

According to him, “Enpower FTZ has put in substantial efforts into attracting specific, targeted high-profile investors right from the outset. These anchor investors play an important signaling role to other potential investors, and we expect them to attract a network of suppliers and partners.”

The ceremony which holds at the Akanu Ibiam Airport site of the Free Zone is expected to attract up to $500 million (N240 billion) worth of foreign direct investments (FDI) from leading global manufacturing companies.

Activities of the industrial clusters hosted in the free zone are also expected to create over 20,000 jobs across three major regions in the country.

Licensed by the federal government to operate as a free trade zone in December, 2015, ENPOWER FTZ is a Public-Private initiative with the Enugu State government offering international and domestic investors the benefits of connecting to business opportunities from the South-Eastern cluster, which according to Canback & Company and the McKinsey Global Institute, is the second largest economic cluster in Nigeria, outside of the Lagos Cluster.

Governor Ugwuanyi and his government’s private project developers are positioning the free trade zone project as the biggest private sector investment support to the government’s economic recovery efforts.
Enpower is affiliated, as a full voting member; to the Dubai-based World Free Zones Organisation (WorldFZO) and the Africa Free Zones Association (AFZA) respectively. It intends to function as a certified SMART-SUSTAINABLE & SAFE free trade zone.

According to the statement by the investment promoters intend to provide uninterrupted power supply via an embedded power arrangements, certify the free zone’s infrastructure and operations to globally accepted standards, operate the free trade zone as a one-stop investment destination by integrating all free zone operations with the documentation and cargo handling, customs, immigration administration processes to achieve an Ease of Doing Business rating equivalent to that of Dubai.

Besides, the ENPOWER FTZ is to host Africa’s first ever Nigeria-China “Dragon Market”, the second such manufacturing and wholesale centre, after the famous Dubai Dragon Market. Dragon Mart Dubai is the largest trading hub for Chinese products outside mainland China. The industrial park also gives access to markets covered by the Economic Community of West African States (ECOWAS); South East Asian countries including China, India and Malaysia; the European Union including Czech Republic and Germany; and the untapped industrial heartland of South-Eastern Nigeria especially the commercial cities of Onitsha, Nnewi and Aba.

ENPOWER Free Zone is designed to accommodate up to 500 companies located in two Free Zone Areas at The Ninth Mile industrial area and the Akanu Ibiam international Airport.

Abbi community in Uzo-uwani LGA Tuesday night (9th February, 2016) and slaughtered two Ajona-ogbo viillagers in cold blood.

As of the time of filing in this report the identity of the Fulani herdsmen are still unknown. But the Police
assured "they are on top of the situation".

The villagers only offense is that they told the herdsmen to stare clear of their farmlands.

THE MYTHS:

As a boy growing up on the street of Port
Harcourt, I was told so many horrible things
about Igbos:I was told that Igbos were planning to push Rivers people to Abia State for the people of Abia to inhabit Rivers State because of our resources.

I was told that Igbo people enslaved and ruled
over my people in Bori the traditional
headquarters of Ogoni Kingdom.

I was told that Odumegwu Ojukwu, Onyeka
Onwenu and other prominent Igbos brazenly
rejoiced over the execution of my uncle Ken Saro Wiwa because of the role he played during the Civil War.
I was told that it is better to be slaves to Hausas than to be brothers to Igbos because, Igbos are worse than Hausas.

THE EFFECTS:

These things made me to terribly detest Igbos
beyond what you can imagine, I was always
skeptical, cynical and suspicious while dealing
with Igbos. It also affected my friendship with
Igbo guys, I was always careful not to be a victim, no matter how they value the friendship, as long as they are Igbos, they were bad eggs to me.

It also severely affected my relationship with Igbo girls, 70% of the girls I have seen are Igbos girls but I have never treated any of my Igbo girlfriends fairly because, I programmed my mind not to be interested in anything beyond the fun
attached to the chemistry of boys and girls stuff while dealing with an Igbo girl, I didn’t want to make the mistake of dating an Igbo girl to the extent of marrying her.

THE DISCOVERY:

I was posted to Akwa Ibom State for my national
youth service in November 2013, there I made so
many Igbo friends, almost 60% of Akwa Ibom
corps members are from Igbo extraction, mainly from IMSU, FUTO, ABSU, UMUDIKE, ESUT and IMT.

There I saw how determined a typical Igbo youth is, there I saw the natural tendency for economic success in a typical Igbo guy, there I saw the reason why Igbos are entrepreneurs allover the globe, there I saw that God specially gave them the metaphysical eyes to see money in things and
where you don’t even think of smelling money, there I saw that even though the Igbos have had severe political travails and marginalization, they will forever remain the economic salt of Nigeria.

While we were serving, those of us who are Port Harcourt breed UNIPORT/RSUST corps members were always complaining that Akwa Ibom is beautiful but not groovy like Port Harcourt, we were always complaining that the town is dry with no night life like Port Harcourt. But our friends from the Igbo extraction were seeing things
differently, they saw Akwa Ibom as a beautiful
virgin land highly in need of economic
exploration, they saw huge business
opportunities in where we saw boredom.

We were complaining of the insufficient N19,800 ‘alawi’ (allowance) while they were seeing it as
potential small scale business capital. We used our alawi to club in one night because, we didn’t see it as good enough to help us, while our Igbo friends inject it into their small scale businesses.

We were always going to Tropicana to see movies while our Igbo friends are busy going to Lagos to bring wears and jewelries for us to buy. We were always calling home for money but our Igbo friends were sending money home instead.

At the end of my service year, I said I was going back to Port Harcourt because I believed Uyo was too dry for me to hustle, but my Igbo friends stayed back because they saw Uyo as a land lacking business and as such, it’s good for them to
make money through the introduction of
different businesses.

THE REVERSAL:

I came back to Port Harcourt then pondered on my experience with these Igbo brains, I then realised why people hate them, I felt bad
seriously for wrongly hating them all these while, I decided to love them because, they have the kind of zeal I’d love to emulate.

THE CONVICTION:

When I was fully convinced that the Igbos are not only my role models but my blood was when they went against all odds to make Goodluck Jonathan
their own, they loved him even more than some us from the South South, they gave him their full support at the poll not minding the
consequences. Ever since, I couldn’t stop loving Igbos but to love them even more.

THE RECOMMENDATION:

Igbos drive the economy of every towns and cities in Nigeria, nobody can change that, so instead of hating them for doing business in your place, I’d advise you compete with them even if you know you can’t beat them because, it is your land that is benefiting economically and otherwise with such
healthy competition, it is a win win situation.

IN CONCLUSION:

Igbos are subject of hate in this country,
apparently due to wrong perception, but I
personally think Igbos are cool like any other
tribe, and bad like any other tribe too. Though my main problem with them is that, they never admit their flaws no matter how glaring but they are always quick to lampoon the slightest folly of other tribes.

If you want to be successful economically, think like Igbos!

Whenever the citizens of Nigeria complain of the difficulties they're facing, the SQUEALERS are quick to dismiss the Wailers and remind them of how "worse" things were during the previous administration and how the present government can never be as bad as the former one.

The Squealers come across as arrogant with the way they handle certain issues. To them, we are expected to always be grateful and never complain, act like a zombie. Tufiakwa!

Welcome to the beginning of a New Year of the continuation of CHANGE in our beloved nation. I am aware that Nigerians have experienced a number of significant hardships over the past months. Living in the State House has not alienated me from your daily sufferings. I am aware of the lengthy queues at fuel stations and of the difficulties businesses have faced in acquiring foreign exchange.

These challenges are only temporary; we are working to make things better. When I presented myself to you as a presidential candidate and asked you to vote for me, I wanted to be a leader who keeps his promises. I wanted to be a leader who restores the people's hope in those elected to serve them. I wanted to be a leader who initiates positive and enduring CHANGE.

I am still totally committed to being that kind of leader. Unforeseen circumstances and other distractions notwithstanding, I shall still do my utmost best to keep every promise I made to Nigerians during my election campaign. In the past seven months since our inauguration on May 29, 2015, my administration has focused on laying the right foundation for the CHANGE you voted for during our historic presidential election. The effective and efficient implementation of our 2016 budget proposals will address many of the socio-economic issues that are of current concern to our people. One area in which Nigerians, especially those in the northeast, have already begun to experience major CHANGE is in the war on terror. I commend our Armed Forces for significantly curtailing the insurgency which has ravaged the northeast of Nigeria over the past few years.

However, there is still a lot of work to be done in the area of security. Our Armed Forces will maintain, consolidate and build on their successes in the war against Boko Haram and violent extremism. This government will not consider the matter concluded until the terrorists have been completely routed and normalcy restored to all parts of the country that have been adversely affected by the Boko Haram insurgency.

Our crackdown on corruption will continue to be vigorously undertaken. I urge the courts to support our efforts and help in the recovery of stolen funds by speedily concluding trials and showing that impunity no longer has a place in our country.

There is much work to do in other areas as well and I have charged all my ministers and other appointees to ensure that Nigerians experience positive changes in their lives in 2016. We must reduce our country's reliance on oil. We must diversify our economy.

And we must do all we can to promote job creation. Our challenges are many but our determination to succeed is strong and unshaken. So too is our confidence in God. I wish you all a very

excessive hunger and difficulties, Squealer (the clever pig) would tell them that things were much better than the time of the humans (when Mr Jones was in charge).

He also would go on to say to them that no matter how difficult things might
get, it will never be as bad as when Mr Jones was in charge of the farm. The majority of the animals were very dumb (especially the sheep) and believed everything Squealer told them."

Whenever the citizens of Nigeria complain of the difficulties they're facing, the SQUEALERS are quick to dismiss the Wailers and remind them of how "worse" things were during the previous administration and how the present government can never be as bad as the former one.

The Squealers come across as arrogant with the way they handle certain issues. To them, we are expected to always be grateful and never complain, act like a zombie.

In my next life, I wil still be Igbo. They worship no human.

APC, PDP resume Twitter war

The opposition Peoples Democratic Party has
launched a fresh war against the All Progressive Congress-led government on Twitter, saying the only thing it has capacity for is distraction.

Tweeting on Sunday, the PDP lamented that the present administration was at a loss on how to fix the problems confronting Nigeria. It said the ruling party had resorted to distractions instead of proffering solutions to prevailing challenges in the polity.

In a series of tweets, it identified petroleum
product scarcity, falling naira and rising inflation as some of the key economic challenges Nigerians expected the government to tackle head-on.

“A dollar is N260, yet they (the APC) do not see any urgency in attending to the economy.

They are still crying about former President Goodluck Jonathan’s government. Get to work. Work!

“It has never been this bad before. They have no economic direction. They have no plans. They have no solutions but only distractions.

“The real issue is that $1 is now N260. Our
economy is in great danger. Food prices have
skyrocketed. There is fuel scarcity. Nothing seems to be working,” it tweeted.

Earlier, the party challenged the government to hand over for prosecution individuals indicted for stealing money meant for arms while it faced the economy. It noted that the economy was in dire need of attention.

It posted, “All their posts on the former National Security Adviser, Sambo Dasuki, are diversionary and falsehood. If they have proofs, they should take Dasuki and others to court.

“But they should focus on the economy. Focus on the economy; fulfil campaign promises; start generating electricity and continue all our ongoing projects.”

While the government is going after those
accused of taking part in the arms deal, the APC is seeking an online support for President
Muhammadu Buhari’s resolve to end corruption.

Apart from its tweets, the party’s social media
team spent a good part of the weekend
aggregating tweets by Nigerians who are furious over the amount of money said to be involved in the allegations.

It retweeted, “With these dizzying figures shared by the PDP bosses, anyone defending them online without a house in Banana Island should slap him/herself.

“The PDP is shameless. The money its members shared is what is causing shortage of cash now; hence the Federal Government is finding it difficult to pay salaries.”

Individually, members of both parties have also been trading blame on social and traditional media over the scandal as well as other related issues.

Recently, the Governor of Edo State, Adams
Oshiomhole, went after the former Coordinating Minister of the Economy/Minister of Finance, Dr. Ngozi Okonjo-Iweala, demanding an investigation
into her role, especially in the “questionable
disbursements” in the last dispensation.

The governor said, “You look at the total number of expenditure on subsidy, which the World Bank has just released. I am shocked. I have been talking about it. I just said to a couple of persons that the government has to go the whole hog because I know, as a governor, that no money
gets out of the treasury without the approval of the commissioner for finance. So, the probe should go into whether these funds are
appropriated.

“The Minister of Finance under the rules must
endorse before money gets out of the treasury, before the Central Bank of Nigeria approves.

So, for the ministers, including Okonjo-Iweala, I don’t care what people say because you cannot be coordinating a corruption-ridden economy and you pretend to be an angel. You cannot selectively deal with issues. You must deal with all involved in the conspiracy.

“In criminal law, when two to three people are involved in an act of criminality, all of them are charged with conspiracy.”

But Okonjo-Iweala said she followed due process in her official capacity. She has posted a letter she sent to the former president seeking an approval
to release the fund.
