Good and fine. Since he is accusing INEC of rigging the election for Tinubu, he should prove it beyond reasonable doubt. The objection by INEC is mainly based on the fact that his claims in the petition are too vague. Didn't you read their objection? Why are you pained? Don't they have the right to object to his claims?

Whatever explanation or example I'd give will has to be within the context of the subject matter. That said, the constitution says:

...25% in 2/3 of the states AND the FCT.

Neither did it say...

...25% in 2/3 of the states and IN the FCT

Nor...

...25% in 2/3 of the states OR the FCT.

Base on the above, I will explain as you requested. In the first phrase, AND joins the 36 states with the FCT, a territory that has to be mentioned separately because of its unique status. This simply means that FCT might help a candidate to meet the requirement as a part of the sum, e.g., Abuja and 23 other states.

In the second phrase (which is not the case in the constitution), AND IN simply implies that 25% in 2/3 of the states and 25% in the FCT. In this case FCT becomes mandatory.

The third phrase, implies either 25% in 2/3 of the states or just 25% in the FCT.

This is just a normal loophole lawyers explore to back their argument. Such argument can only work if the judiciary is willing to play a wily game of swinging the law in favour of the petitioner on technical ground and who is in the best position to play such game if not the ruling party?

The petition is the most useful. The only strong argument is the Abuja argument all others are to score cheap social media points.
I don't think the FCT issue is even any strong. Lawyers are politicizing the issue even though the language is clear. 25% in 2/3 of the states and FCT simply means 2/3 of the 36 states and FCT, meaning FCT might complement the number of states to achieve the 2/3.

The constitution didn't say ..."in 2/3 of the states and IN FCT. That 'IN' in bold would have made it clear that aside from 25% in 2/3 of the states, a candidate must also have 25% in FCT.

Some people would say ... but the lawyers who argue in favour of the 25% requirement in FCT aren't fools. Of course they aren't fools; it is normal for lawyers to explore technicalities in language to swing a case in their favour even if the implicit meaning of the language or clause is well understood

I have studied presidential election petitions and courts judgements since 1999 and discovered that 2023 petitions are the most worthless and useless of them all. It cannot upturn local government chairman election. The petitioners went to court on 4 grounds.
1. 25% in FCT. Supreme Court past ruling, all Nigerians votes are equal and so no golden votes. FCT is just one of states in nigeria as it relate to election and stated in theconstitution.
2. Tinubu indictment of drugs: Supreme Court past judgment, only Court of competent jurisdiction indictment can prevent a candidate. Tinubu was never arraigned or indicted by any court.
3. VP elect double nomination: VP name was never sent to INEC as a Senate candidate. Mere expression of intention is not equal to nomination.
4. Non transmission of results real time: There's no existing law make transmission of results real time a compulsory for INEC.
INEC substantially complied with electoral act.
There is also the 5th one which has to do with number of lawful votes. In this, the petitioners are claiming that APC rigged but they shot themselves in the leg by joining INEC as one of the defendants on allegation of subtracting a candidate's votes and adding them to votes of another candidate (funny).

The umpire body has substantial evidences and materials to defend itself in the tribunal. It would have been a different case if INEC was to be a mere witness at the tribunal and not a co-defendant on the case of lawful and unlawful votes.

Furthermore, APC had agent in all the PU's and has its evidences intact unlike LP which had no agent in many PU's

Prince Bolasodun Adesumbo Ajibola was born on March 22, 1934, in Owu near Abeokuta, to the Owu royal family of Oba Abdul-Salam Ajibola Gbadela II, who was the traditional ruler of Owu between 1949 and 1972. He attended Owu Baptist Day School and Baptist Boys’ High School both in Abeokuta between 1942 and 1955. He obtained his Bachelor’s degree in Law, LLB, at the Holborn College of Law, University of London between 1959 and 1962 and was called to the English Bar at the Lincoln’s Inn in 1962.

He returned to Nigeria to practise law, specialising in Commercial Law and International Arbitration and soon added the high professional plume of Senior Advocate of Nigeria, SAN, in 1980. It was largely due to his efforts during that period that the practice of Arbitration and Alternative Dispute Resolution, ADR, became composite parts of Nigerian legal practice.

By 1984, the task to lead the Nigerian Bar Association, NBA, naturally fell on him. His brilliant performance as NBA president caught the attention of the then military President of Nigeria, General Ibrahim Babangida who appointed him Attorney General and the Minister of Justice of Nigeria from 1985 to 1991. In his six years tenure as minister, Ajibola was reputed as the only public servant that never collected salary from government. While serving as Attorney General, he appointed Professor Yemi Osinbajo, now Vice President of the Federal Republic of Nigeria, as his Special Assistant.

Thereafter, he threw his wig into the highly competitive ring for a seat on the International Court of Justice, World Court. Prince Ajibola went through the laborious selection process and became a judge of the court from 1991 to 1994. He had actually threaded that road behind late Justice Teslim Elias whom he understudied as a guide. It is on record that he was in the habit of writing not less than 80 pages of judgments per night as a world court judge. As a judge, Ajibola had his way with words and was also a maverick of idioms and proverbs. Oftentimes, his judgments and opinions were backed by the rich Yoruba proverbs.

Ajibola exited the international court and took up a position in 1994, as a member to the Permanent Court of Arbitration with respect to the court’s deliberations on the land dispute between Nigeria and Cameroon. Not surprisingly, it was only him and Justice Koroma of Sierra Leone that ruled favourably for Nigeria out of 15 Judges when judgment was passed on October 22, 2002.

Deeper and deeper into International Law practice and juridical concerns, Prince Ajibola grew into a somewhat global phenomenon holding revered positions such as President, The World Association of Judges; Member, Council of African Bar Association as well as International Bar Association, Association of World Lawyers, Commonwealth Law Association; Vice President, Institute of International Business Law.

At a time, he was also President of the World Bank Administrative Tribunal. He was at several times, Judge of the Constitution Court of Bosnia and Herzegovina (1994-2002); Member of the International Centre for Settlement of Investment Disputes, (ICSID); Arbitrator/Commissioner, Eritrea/Ethiopia Boundary Commission; Member, Permanent Court of Arbitration and Chairman, Cameroon-Nigeria Mixed Commission. He was also a member of the Permanent Court of Arbitration (The Hague); member of the International Chamber of Commerce Court of Arbitration; member of the International Maritime Arbitration Commission, Paris; member of the Panel of International Arbitrators of the London Institute of Arbitrators; member of the International Advisory Committee of the World Arbitration Institute, U.S.A.

A former Judge of the International Court of Justice, Hague, Netherlands, Prince Bola Ajibola, is dead.

Ajibola, who was also a former Attorney-General of Nigeria, died at 89.

Ajibola, the founder of Crescent University, Abeokuta, died on Saturday midnight after a long-time illness as a result of old age.

The eldest child of the late jurist, Segun Ajibola, SAN, disclosed this in a statement, on Sunday in Abeokuta.

He wrote, “With very deep heart and gratitude to Almighty Allah.

“Our Dad, Prince Bola Ajibola, departed this world over midnight. May Almighty Allah bless him with Aljanah Firdaus.”

He is bold, outspoken, courageous and kind-hearted. His leadership and human relations skills are without compare and his patriotism and nationalism are beyond reproach. This unique role model whose life is a study in academic, brilliance, courage, perseverance, persistence, patience, patriotism, enterprise, focus, humility, selflessness, modesty, human decency and moral rectitude is indeed a book for all ages and all generations. He was the editor of Nigeria’s Treaties in Force from 1970 to 1990 and All-Nigeria Law Reports from 1961 to 1990. He has authored over 20 books and various papers and articles on a range of legal subjects.

In an attempt to give insight into what royalty really means, an unknown author once wrote: “A crown! What is it? It is to bear the miseries of a people. To hear their murmurs, feel their discontents, and sink beneath a load of splendid care.” That insight perhaps is the closest description of the man, Prince Bola Ajibola. Though born into royalty, the Olori Omo Oba of Owu Kingdom has spent virtually all his royal life serving humanity and dispensing justice.

Prince Bolasodun Adesumbo Ajibola was born on March 22, 1934, in Owu near Abeokuta, to the Owu royal family of Oba Abdul-Salam Ajibola Gbadela II, who was the traditional ruler of Owu between 1949 and 1972. He attended Owu Baptist Day School and Baptist Boys’ High School both in Abeokuta between 1942 and 1955. He obtained his Bachelor’s degree in Law, LLB, at the Holborn College of Law, University of London between 1959 and 1962 and was called to the English Bar at the Lincoln’s Inn in 1962.

He returned to Nigeria to practise law, specialising in Commercial Law and International Arbitration and soon added the high professional plume of Senior Advocate of Nigeria, SAN, in 1980. It was largely due to his efforts during that period that the practice of Arbitration and Alternative Dispute Resolution, ADR, became composite parts of Nigerian legal practice.

By 1984, the task to lead the Nigerian Bar Association, NBA, naturally fell on him. His brilliant performance as NBA president caught the attention of the then military President of Nigeria, General Ibrahim Babangida who appointed him Attorney General and the Minister of Justice of Nigeria from 1985 to 1991. In his six years tenure as minister, Ajibola was reputed as the only public servant that never collected salary from government. While serving as Attorney General, he appointed Professor Yemi Osinbajo, now Vice President of the Federal Republic of Nigeria, as his Special Assistant.

Thereafter, he threw his wig into the highly competitive ring for a seat on the International Court of Justice, World Court. Prince Ajibola went through the laborious selection process and became a judge of the court from 1991 to 1994. He had actually threaded that road behind late Justice Teslim Elias whom he understudied as a guide. It is on record that he was in the habit of writing not less than 80 pages of judgments per night as a world court judge. As a judge, Ajibola had his way with words and was also a maverick of idioms and proverbs. Oftentimes, his judgments and opinions were backed by the rich Yoruba proverbs.

Ajibola exited the international court and took up a position in 1994, as a member to the Permanent Court of Arbitration with respect to the court’s deliberations on the land dispute between Nigeria and Cameroon. Not surprisingly, it was only him and Justice Koroma of Sierra Leone that ruled favourably for Nigeria out of 15 Judges when judgment was passed on October 22, 2002.

Deeper and deeper into International Law practice and juridical concerns, Prince Ajibola grew into a somewhat global phenomenon holding revered positions such as President, The World Association of Judges; Member, Council of African Bar Association as well as International Bar Association, Association of World Lawyers, Commonwealth Law Association; Vice President, Institute of International Business Law.

At a time, he was also President of the World Bank Administrative Tribunal. He was at several times, Judge of the Constitution Court of Bosnia and Herzegovina (1994-2002); Member of the International Centre for Settlement of Investment Disputes, (ICSID); Arbitrator/Commissioner, Eritrea/Ethiopia Boundary Commission; Member, Permanent Court of Arbitration and Chairman, Cameroon-Nigeria Mixed Commission. He was also a member of the Permanent Court of Arbitration (The Hague); member of the International Chamber of Commerce Court of Arbitration; member of the International Maritime Arbitration Commission, Paris; member of the Panel of International Arbitrators of the London Institute of Arbitrators; member of the International Advisory Committee of the World Arbitration Institute, U.S.A.
