If you believe Tinubu did not forge his certificate, why are you afraid of new evidence? Odibembem: This is to educate us all so some don't start abusing the Judges when they deliver their judgment based on the constitution. Section 232 subsection 2 of the Nigerian constitution says and I quote verbatim:
"Provided that no original jurisdiction shall be conferred on the Supreme Court with respect to any criminal matter".
Now forgery is a criminal matter and Atiku is asking the Supreme Court to accept his evidence from d Chicago depositions and documents to conduct a criminal trial on President Tinubu and find him guilty of forgery and then disqualify him on that basis. But the constitution specifically divests such powers from the Supreme Court, they can't do any original criminal trial except on appeal hence they will throw out Atiku's motion. The constitution has tied their hands so don't abuse them.
What Atiku needs to do is to gather his evidence and approach the Nigerian Police who will assign an IPO to the case. The IPO will do his report and with it prosecute Tinubu in a magistrate court and find Tinubu guilty of forgery. If Tinubu doesn't appeal, Atiku can now take the judgement to the Supreme Court as evidence and have them disqualify Tinubu on that basis. Unfortunately for Atiku, Tinubu as president has immunity from prosecution, his option is to wait till 2027 if Tinubu loses reelection and another person is sworn in or wait till 2031 when Tinubu would had completed two terms and cease to be President. This is the bitter truth, it doesn matter how much people abuse or mock people, even Atiku's lawyers know and they have told him but he has told them to still go ahead, a typical Nigerian politician is incurably optimistic, it's like a form of cocaine they inhale. |

We have long predicted this god-servants relationship between this resplendent oaf and his servants (AKA Obidient IPOB) would come to a crashing end soon, with both entities turning sworn enemies, just like they did with Reno.

The constitution said anyone that presents a forged certificate. Here, the drafters of the constitution are not only looking at profiting from forgery but also looking at acts of dishonesty. A dishonest person should not be allowed to manage public wealth and thats who a forger is. garfield1: DSS is not an issuing authority but they are constitutionally empowered to investigate criminal acts and forgery is a criminal act therefore the court cannot discountenance their findings. The supreme court has stated in agi vs ayade 2015 and APM vs abiodun 2019 that mere forgery of document is not disqualification but the forged document must be part of the one mentioned by the constitution or without that forged document, the candidate ceases to be qualified.in order words, the forgery must have given him undue advantage |

It is not what qualifies him but what disqualifies him. Anyone that presents a forged certificate to INEC stands disqualified. This has nothing to do with DSS because they're not the issuing authority. Why do you think the country has been going down from beginning? Because we bend the constitution to suit us irrespective of what is true and right. garfield1: 1) DSS countered nysc thereby creating reasonable or probable doubt 2) nysc said he actually served and two files were opened for him. 3) nysc is not even a constitutional requirement for the forged document the constitution is contemplating doesn't include nysc. 4) without nysc, the governor is still qualified |

FROM A SAN'S BIRD'S-EYE-VIEW
PRESIDENT TINUBU'S CERTIFICATE AND THE CHALLENGES BEFORE THE SUPREME COURT. AFTER PUBLICLY RECEIVING THE DEPOSITION FROM CHICAGO STATE UNIVERSITY (CSU), ATIKU HAS FILED SAME AT THE SUPREME COURT.
*CHALLENGES* *AHEAD*
1. THE SUPREME COURT IS A COURT OF APPEAL FROM JUDGEMENT OF PEPT OF 6TH SEPTEMBER, 2023 AND AS SUCH IT IS NOT A COURT OF ADMISSION OF FRESH EVIDENCE IN ELECTION MATTERS. THE PEPT WHICH IS THE EXCLUSIVE COURT TO ADMIT EVIDENCE, BE IT OLD OR FRESH IN ELECTION MATTERS, HAS HEARD ATIKU'S PETITION AND SINCE DELIVERED JUDGEMENT.
2. ATIKU THROUGH OUT THE HEARING OF HIS PETITION NEVER ADDUCED ANY DOCUMENTARY EVIDENCE CHALLENGING TINUBU'S CERTIFICATE AT THE PEPT. HE IS THEREFORE APPARENTLY FORECLOSED FROM BRINGING ANY EVIDENCE, WHETHER "FRESH " OR "OLD" TO THE SUPREME COURT, IN AN ELECTION MATTERS WHICH IS TIME BOUND.
3. AND THE QUESTION IS: EVEN IF IN THE UNLIKELY EVENT, THE DEPOSITION IS ADMITTED, OF WHAT LEGAL CONSEQUENCE WILL SAME BE TO PRESIDENT TINUBUS'S PRESIDENCY? ABSOLUTELY NONE!!! THE ISSUE AT STAKE IS FORGERY, WHICH IS A CRIMINAL OFFENSE. ATIKU HAS TO PROVE BEYOND REASONABLE DOUBT THAT TINUBU FORGED HIS CERTIFICATE; AND SUCH PROOF MUST BE THROUGH THE CALLING OF ORAL EVIDENCE AND NOT BY AND/OR THROUGH WITNESS DEPOSITIONS ON OATH.
4. THE SUPREME COURT IS NOT A COURT OF TRIAL AND OF TAKING ORAL EVIDENCE IN ELECTION MATTERS. ATIKU HAS TO CALL THE 'CSU' REGISTRAR AS HIS CRUCIAL WITNESS AND HE WILL HAVE TO BE CROSS EXAMINED BY TINUBU'S COUNSEL.
5. BASED ON THE DECISION IN 'IKIE V SHERIFF, ATIKU HAS TO ALSO PRODUCE BEFORE THE SUPREME COURT, THE REAL PERSON (A FEMALE ACCORDING TO HIM), WHO HE CLAIMS PRESIDENT TINUBU STOLE THE IDENTITY OF, ON THE SAID CERTIFICATE.
6. THE LAW IS AXIOMATIC ABOUT THE FACT THAT THERE CANNOT BE A CRIMINAL TRIAL AND CONVICTION, WITHOUT FIRST HEARING ORAL EVIDENCE FROM THE PARTIES; AND NEEDLESS TO ADD THAT THE SUPREME COURT IS NOT THE ARENA TO HEAR ORAL EVIDENCE. 7. CONVERSELY THEN CAN ATIKU INSTITUTE CRIMINAL PROCEEDINGS AGAINST TINUBU IN A REGULAR COURT OVER THIS ISSUE? YES, ATIKU COULD HAVE BEEN ABLE TO INITIATE A PRIVATE PROSECUTION AGAINST TINUBU, AS IT IS OBVIOUS THE LAGOS STATE GOVERNMENT WILL NEVER PROSECUTE PRESIDENT TINUBU EVEN IF THE CERTIFICATE WAS FORGED. HOWEVER, AFTER GANI FAWEHINMI'S BOLD EFFORTS TO OBTAIN A FIAT TO PRIVATE PROSECUTION OF ALI AKILU AND TOGUN, OVER DELE GIWA'S DEATH IN 1986, THE LAGOS STATE GOVERNMENT HAD EXPUNGED THAT RIGHT FROM HER LAWS.
8. EVEN IF, FOR ACADEMIC PURPOSE, ATIKU OBTAINS A FIAT TO PRIVATELY PROSECUTE TINUBU IN A REGULAR COURT, THE QUESTION IS: WILL SAME HAVE JURISDICTION TO TRY SUCH A MATTER? THE CONSTITUTION HAS GIVEN PRESIDENT TINUBU (IMMEDIATELY HE WAS SWORN IN), IMMUNITY AGAINST ANY CIVIL OR CRIMINAL PROCEEDINGS AND THAT NO WRIT OR SUMMONS CAN BE SERVED ON HIM UNTIL AFTER THE EXPIRATION OF HIS FOUR YEAR TENURE. SO, NOTHING LEGAL CAN BE DONE TO REMOVE PRESIDENT TINUBU, EVEN IF HE FORGED THE SAID CERTIFICATE.
*QUO VADIS* THE ISSUE AT STAKE IS PURELY LAW AND LAW ONLY! IT IS THUS NOT A SOCIAL MEDIA AFFAIR. THE LAW REQUIRES PROOF BEYOND REASONABLE DOUBT AND LAYS DOWN RULES AND PROCEDURES FOR THE ADMISSION OF EVIDENCE TO PROVE A MATTER. IF YOU FAIL TO STRICTLY FOLLOW THOSE RULES, AND ESPECIALLY IN AN ELECTION (A TIME- BOUND MATTER), YOU WILL LOSE YOUR CASE NO MATTER HOW GOOD SAME WAS OR IS.
THUS THE QUESTION ARISES AT THIS JUNCTURE, WHY DID ATIKU NOT PRESENT THIS CRUCIAL EVIDENCE FROM THE DATE THAT TINUBU SUBMITTED HIS FORM TO INEC. WHY WAIT TILL AFTER THE PEPT DELIVERED JUDGEMENT?
THAT 'CARSUS OMMISUS' (OR 'COSTLY OVERSIGHT') IS ATIKU'S SELF INFLICTED LEGAL NEMESIS. IT IS THEREFORE LIKELY TO BE A QUICK ONE FROM THE SUPREME COURT. A VERY QUICK ONE!
DISSEMINATION BY: DR MUDIAGA ODJE, SAN OFR, CENTRE FOR THE ADVANCEMENT OF THE RULE OF LAW.
Additionally, atiku introduced the forgery and also the citizenship case at the tribunal out of time so it is dead on arrival. Secondly, according to rule2 (12) of the supreme court, there are three conditions for accepting new evidences 1) as at the time of the trial, the evidence could not have been available or was not in existence...(this settles the matter as the evidence could have even been gotten last year or long ago)
2) it must be necessary and cogent. 3) it must be incontrovertible ( obviously it is not incontrovertible)

You're a clown emkz: Notice that Peter Obi never referred to President Tinubu as "President".
If Peter Obi does not accept Tinubu as President, then why does he expect President Tinubu to do what he wants?
He calls on Tinubu to come out and tell Nigerians his real name, date of birth, schools he attended, and where he did his youth service.
But in the unlikely event Tinubu does this, will Peter Obi's mob believe it? He has told us he attended CSU, and the school has confirmed same. They chose not to believe.
Why are they now doubting all David Hundeyin's fabrications?
I now address the President's media team led by Chief Ajuri Ngelale. I know Ajuri's people are reading, and this is useful because it concerns the image of the President.
Ajuri, you people have allowed the Office of the President to be commonized by election losers. Since 1999, no one born of a woman insulted the CinC the way these election losers are doing. Therefore, it is time to ACT! It is time to clip the wings of the opposition. If you think these evil mob leader and his master Atiku would stop, they won't! It is time to start a sustained media attack on Peter Obi and Atiku.
Atiku has a lot of corruption materials in the public domain, especially using his ex-wife, Jennifer Douglas to launder money into the United States from Nigeria. There is a whole report on that. There was also a US Senator sent to jail for Atiku's activities. Remind Nigerians of that report. Also his activities in the sale of FG assets should be released.
As for Peter Obi, he is already a celebrated failure. Release details of his Pandora dealings to the public.
Ajuri, you are too gentle for the job. Therefore, get FFK and Bayo Onanuga and let them face Atiku and Obi.
President Bola Tinubu GCFR, cannot be defenseless against Atiku and Obi. He was a man of courage, but now he is demonstrating needless weakness that may ruin his administration.
Let us forget about 2027 for now. Even if Bola Tinubu sits as President for one week, you guys MUST MAKE IT COUNT!!!
It is time to bring down Atiku and Obi; they don't mean well for the country. They just want to rule. |

Have you forgotten how the former DSS boss laid seige on the National Assembly and was later fired by Osinbajo? That even got Osinbajo in trouble in the eyes of Bubu. DSS is a criminal organization bamideleafolabi: Presidential Election Appeal: DG SS Not Blackmailing S'Court Justices' - Investigation
...Report figment of Ude's imagination - Intelligence Sources
Reports alleging that the Director General of the Department of State Services (DG SS), Alhaji YM Bichi, is blackmailing justics of the Supreme Court to tilt judgement in the pending appeal in favour of President Bola Tinubu, are false, baseless, and a figment of the imagination of the purveyors, investigations have revealed.
Highly-placed sources at the DSS, who spoke in confidence on the matter, accused Mr. Jackson Ude of "peddling dangerous falsehood", which consequence may be grave.
Recalls that Jackson Ude had recently alleged that Alhaji Bichi, was blackmailing justices of the Supreme Court to tilt judgement in the pending appeal in favour of President Tinubu
Speaking in confidence with our correspondent, one of the intelligence sources said: "The general public is invited to note that the allegation against the DG SS is not only spurious, but a figment of the imagination of Jackson Ude.
"On my honour, I make bold to say that Alh. Bichi, the DG SS, has a record of an unblemished carrier, which does not allow for institutional interference of any form whatsoever.
"It is, therefore, unthinkable to make such allegations, more so that the DSS under the leadership of Alh. Bichi, has continued to nurtur the culture of the rule of law across all facets of the agency.
"As journalists, I plead that you ignore reports from Jackson Ude and his ilks, as they serve no purpose other than to mislead the undiscerning public, and heat up the polity.
"Let me close by saying that Nigerians are too sophisticated for the likes of Jackson Ude to hoodwink them, or pull the wool over their eyes". |

accordadoga26: This thread aim to delve into a complex and often controversial comparison – the similarities between Hamas, the Palestinian political organization, and the Biafra secessionist movement in Nigeria.
Here are some of the similarities between Hamas and Biafra
1. They don't strategize before they attack
2. They start what they can't finish.
3. They attack first and when they are at the receiving end they play the victim card.
4. When they launch an attack, destroy and kill others, their people/supporters rejoice but when the reverse is the case, they suddenly remember human rights.
5. They are emotional forgetting to always apply logic and wisdom
6. They lack weaponry so depend on financial supports from external sources to procure arms and ammonitions
7. They still rely on their so called enemies for food, electricity, water and shelter
