As the deadline for the suspended Chief Justice of Nigeria, CJN, Walter Onnoghen, and acting CJN, Tanko Mohammed by the National Judicial Council, NJC, to respond to petitions against them expired yesterday, the Attorney General of the Federation and Minister of Justice, Mr. Abubakar Malami, SAN, has challenged the powers of the National Industrial Court, NIC, in Abuja, to stop the suspended CJN from facing trial over alleged failure to declare his assets. Malami, SAN and Onnoghen Onnoghen :

The AGF maintained that the NIC lacked the jurisdiction to interfere in the ongoing criminal proceeding the Federal Government initiated against Justice Onnoghen before the Code of Conduct Tribunal, CCT. He, therefore, raised a preliminary objection to challenge a suit the NIC relied upon to order the Mr. Danladi Umar-led CCT panel to halt action
on the planned arraignment of the suspended CJN.

This development came on a day former president of the Nigerian Bar Association, NBA, Dr. Olisa Agbakoba, asked a Federal High Court sitting in Abuja to declare that the suspension of Justice Walter Onnoghen by President Muhammadu Buhari, sequel to an ex-parte order of the Code of Conduct Tribunal on January 25, 2019, was unconstitutional. It will be recalled that the NIC had on January 14, ordered the federal government not to proceed with Justice Onnoghen’s trial, pending the hearing and determination of the suit lodged before it by a rights activist, Mr Peter Abang. The court further issued an interim injunction that barred the tribunal from entertaining any application for Justice Onnoghen to step aside from his position as the CJN, until all the legal issues were resolved. The order came on a day the CCT panel slated to commence the trial. However, following the absence of the Defendant to take his plea, the tribunal, which insisted that it must proceed with the case, re-summoned Justice Onnoghen to appear before it on January 22. The CCT Chairman, Mr. Umar, contended that under the 1999 constitution, as amended, the NIC shared coordinate jurisdiction with the tribunal, and, therefore, lacked the vires to issue a binding injunction against its proceeding. In a counter move, the NIC, a day before the tribunal’s return date, in a delivered by Justice Sanusi Kado, re-activated all the interim orders that stopped further proceedings on the charge against Onnoghen. Following an ex-parte application that was brought by FG, the CCT, on January 23, ordered Justice Onnoghen to step aside as both the CJN and Chairman of the National Judicial Council, NJC.

Based on the said ex-parte order, President Muhammadu Buhari, on January 25, suspended Onnoghen and swore in the next most senior Justice of the Supreme Court, Justice Tanko Muhammad, as the Acting CJN. Meanwhile, at the resumed sitting of the NIC, yesterday, the AGF, aside from challenging the jurisdiction of the industrial court to meddle in the non assets declaration charge against the suspended CJN, also applied for all the interlocutory injunctions to be set aside. The AGF also urged the NIC to hands-off the suit which he said was grossly incompetent. Other Defendants in the matter are the CCT Chairman, the Code of Conduct Bureau, the NJC, the Federal Judicial Service Commission, the Inspector-General of Police, and the Senate President, Dr. Bukola Saraki. All the defendants were absent at the resumed sitting, apart from the AGF who was represented by Mr. Dauda Lamiri.

Mr. Lamiri told the court that all the parties were duly served with the AGF’s motion. Counsel to the Claimant, Mr. James Igwe, SAN, acknowledged that he had been served by the AGF, saying he was not aware why all the other defendants were not in court. Before he adjourned the case till March 14 for hearing of the substantive originating summon and all pending applications, Justice Kado directed that hearing notices be served on all parties and proof of service kept in the case file. The Umar-led CCT panel had last Monday, adduced reasons the suspended CJN must be arraigned to enter his plea to the six-count charge FG levelled against him. The tribunal maintained that it was legally wrong for Justice Onnoghen, to stay afar and query the competence of the charge, as well as jurisdiction of the CCT to entertain same. Umar relied on previous decisions of the Supreme Court and provisions of the Administration of Criminal Justice Act, ACJA, 2015, to contend that a Defendant in a criminal matter must, first mount the dock and enter his plea to the charge, before any application could be heard. The panel, therefore, directed the suspended CJN who was absent for the third consecutive time, to appear before it next Tuesday to be arraigned over the allegation that he failed to declare his assets as prescribed by the law, as well as, operated foreign bank accounts, in violation of the code of conduct for public office holders.

Meanwhile, former President of the Nigerian Bar Association, NBA, Dr Olisa Agbakoba, SAN, has asked a Federal High Court sitting in Abuja, to declare that the suspension of Chief Justice of Nigeria, CJN, Justice Walter Onnoghen by President Muhammadu Buhari sequel to an ex-parte order of the Code of Conduct Tribunal on January 25, 2019, was unconstitutional.

Agbakoba is contending in the suit that the suspension or removed from office of Justice Onnoghen, except on the recommendation of the National Judicial Council, NJC, or the President acting on an address supported by two thirds majority of the Senate, was null and of no effect. Defendants in the suit are the Attorney General of the Federation and NJC. He is praying the court to declare whether by the combined interpretation of Section 153 (1)(i), Paragraph 21 (b) of the 3rd Schedule and Section 292 (1) (a) (i) of the Constitution of the Federal Republic of Nigeria 1999 as (amended) the CJN, Justice Onnoghen, could be suspended or removed from office except on the recommendation of the National Judicial Council, NJC, or the President acting on an address supported by two-third majority of the Senate. He is further praying the court to declare that by the combined interpretation of Section 153 (1)(i), Paragraph 21 (b) of the 3rd Schedule and Section 292 (1)(a) (i) of the Constitution of the Federal Republic of Nigeria 1999 as (amended) the CJN, Justice Onnoghen cannot be suspended or removed from office except on the recommendation of the NJC or the President acting on an address supported by two thirds majority of the Senate. He is praying for any such further order or orders as the court may deem fit to make in the circumstance. Agbakoba in an affidavit he deposed to in support of the suit, averred: “I know that January 25, 2019, President Buhari pursuant to an ex-parte order of the Code of the Conduct Tribunal purportedly suspended the CJN, Justice Onnoghen, and purportedly swore in Justice Tanko Mohammed as the acting CJN. “I am aware that there is public outrage as a result of the suspension of Justice Onnoghen. I also know that there are different views about whether the President of Nigeria can suspend the Chief Justice of Nigeria as he did. “I know that the Constitution of the Federal Republic of Nigeria 1999 provides for removal of the CJN and that the CJN can only be removed based on the recommendation of the NJC or an address by the President supported by two third Majority of the Senate. “I am fully aware that contrary to the provisions of the Constitution, the President suspended the CJN, Justice Onnoghen, based on an ex-parte order from the Code of Conduct Tribunal on January 25, 2019. “I am aware that the NJC will on February 11, 2019, determine petitions on the suspension of the CJN, Justice Onnoghen and the swearing in of Justice Mohammed as the Acting CJN. “The decisions of the NJC are purely administrative. I believe it is in the public interest for the court to declare the law as relates to the suspension or removal of the CJN

The Economic and Financial Crimes Commission (EFCC) has traced a deposit of $30,000 by Joe Agi, a senior advocate, into the bank account of Walter Onnoghen, the embattled chief justice of Nigeria (CJN), TheCable understands.

It has emerged that Onnoghen also failed to disclose that he has an account at Heritage Bank in his asset declaration form — another violation of the code of conduct law.

Agi is one of the senior advocates defending Onnoghen in his asset declaration case before the Code of Conduct Tribunal (CCT).

TheCable was informed that Agi was also the guarantor when the justice opened the account at Standard Chartered Bank.

The fresh allegations form part of the report sent by the EFCC to the National Judicial Council (NJC) for disciplinary action to be taken against Onnoghen, who has been suspended as CJN by President Muhammadu Buhari.

Buhari said he was acting based on an order issued by the CCT, although observers have accused him of not following due process in his action.

Onnoghen is currently being tried by the CCT over allegations of non-declaration of some of his assets, although he said it was an oversight.

He also said he made money from agriculture and forex investments.

NJC sources told TheCable that the $30,000 deposit was made sometime in 2009 while a series of “suspicious payments” were also traced to Onnoghen’s accounts between 2011 and 2013 during elections petition cases.

In a previous case, which was eventually dismissed, Agi’s firm, Messrs Joe Odey Agi, reportedly paid a total of N160 million to the account of Adeniyi Adetokunbo Ademola, a justice of the federal high court.

The case filed against him for “gratification” was dismissed on technical grounds, although many lawyers argued that it was a professional misconduct which should have been punished by the Legal Practitioners Privileges Committee.

Efforts by TheCable to reach Agi were unsuccessful as his phone rang out. he has also not responded to text messages.

Same PMB regime that took over and completed ZOBE dam in Katsina state awarded first during OBJ mitary regime..Tomorrow, some people will come and claim the bragging right to the project.

What is giving DSTV edge is that they have around for a while and have financial muscle to outbid others especially when it comes to broadcasting rights like Premiership and La Liga

I don't know much on this issue. But if I understand the issue surrounding DSTV well, once any company acquire broadcast right to certain matches, they become the sole provider for such matches e.g zEpL matches. By extention, you having s right to a programs should preclude others from broadcasting such programs e.g. nta having exclusive right to nationat matches shouldnt prevent others from accessing same matches.

We thank God for LADOL's survival PMB's support definitely confirms the Tinubu connection. While INTEL might be more competent in the field, I am not aware of their staff composition but I guess it will be mostly "expatriated".

So LADOL shd be good for local content if we look at that. However, LADOL's technical competence "might" be creating issues. I wont be surprised if SHI is trying to edge out LADOL only to later re-merge with INTEL.

A more homogenous solution might be a merger of the two on this projects so that tasks are shared based on technical competence et al. i.e less complex jobs for LADOL and more knotty ones for INTEL. Till LADOL "comes of age" fully

Every barrel of crude oil produced and exported out of Nigeria is now being tracked by the Federal Government in collaboration with the Economic and Financial Crimes Commission, the Minister of State for Petroleum Resources, Ibe Kachikwu, declared on Tuesday.


Kachikwu said the government and the EFCC recently commenced the tracking of vessels lifting crude oil from Nigeria. He spoke at the ongoing Nigeria International Petroleum Summit in Abuja while responding to a comment made by a delegate at the summit.

The minister said, “Now let’s take the tracking that he mentioned. Today, for the first time, whatever you are producing in this country, as per when it is being produced – barrel for barrel, we can tell. We can also tell where it is going to for the purpose of discharge.

“So, one of the things that they (Department of Petroleum Resources) have been able to set up, which they are finalising now, is a forensic analysis that shows you things. We can see every vessel for the first time that comes in into Nigeria. We can see their activities.”

Kachikwu added, “I remember when they were presenting this to me about a month ago, one of the things that was exciting was seeing a couple of vessels that were doing some run around in Nigeria. They (vessels) go to a location to pick a million barrels, then they go somewhere else, then they come back to the location when they should be heading to Port Novo or the United States.

“So, one of the things we are trying to do with the EFCC is to be able to gather these data month-by-month and say let’s track these particular vessels; who are the owners, why did they make this stop, what happened when they went there?”

He said the government, through the Federal Ministry of Petroleum Resources, would also extend the tracking to the downstream sector.

“So, for the first time, we are going to soon be able to tell on a day-by-day basis the funny activities that took place by those operating in the crude environment and where they went with it. And we are also going to extend this to the downstream sector,” Kachikwu added.

On the recent moves by the House of Representatives to investigate the minister over allegations that had to do with funds generated from oil licences renewal, Kachikwu stated that he was looking forward to being probed as he revealed that the Federal Government had generated about $1.5bn through the process.

He said, “I see the House challenging me and they say they are going to investigate me and I’m looking forward to that investigation because it is part of their duty. But if you have nothing to hide, you should actually see it as a platform to tell your story. The reality is that we started early renewal in this country to generate money.

“At the time we came in 2015, there was insufficient money even to meet salary payments and we created an ingenious way of trying to generate money. Some people went for the purpose of taking loans from international institutions; others asked what could we do better within our system to generate immediate cash?

“So, we said rather than wait for leases that are going to be renewed in 2021 to start, let’s give them incentives to start on an early renewal basis. I can tell you that as we speak today, the funds that have been generated out of early renewal is between $1.3bn and $1.5bn and still counting; and the process is very straightforward.”

This case will likely be resolved by negotiated settlement. There is no way the NJC can push Onnoghen's interest too hard and too far because of the criminal aspect of the issue which the executive will fastidiously pursue should the NJC be perceived to be partisan. The criminal aspect is even far more grievous than that which people chose to currently engrossed themselves with because it will lead to disrobing, sacking, undergoing criminal trial which on conviction will result in forfeiture of the undeclared sum, and imprisonment

Lauretta Onochie, a media aide to President Muhammadu Buhari, has said that people have changed her principal’s name to #BabaTooFast following the suspension of the Chief Judge of Nigeria Justice Walter Onnoghen whom the Code of Conduct Tribunal (CCT) on Monday adjourned his trial indefinitely, pending the determination of an interlocutory appeal against the decision of the tribunal. The suspended CJN is standing trial at the tribunal on allegations of non-assets declaration. He had however, approached the Court of Appeal urging it to bar the tribunal from trying him pending the determination of his appeal against the tribunal to try him. Lauretta Onochie on her Twitter handle said...

Recalled that the tribunal had on Jan.14 ruled that it had original jurisdiction to try the defendant. Mr Danladi Umar, Chairman of the tribunal said it was obligatory for the tribunal to respect the “order of stay’’ made by the superior court. “Following the Jan.24 order made by the Court of Appeal to stay proceedings here, the trial is adjourned sine die’’, Umar said. The tribunal had earlier ignored three restraining orders from the Federal High Court, FCT High Court and the National Industrial Court. The orders were given sequel to pending suits that prayed the courts to bar the President, Attorney-General of the Federation, the Chairman of CCT, Chairman of CCB from taking steps against Onnoghen. The plaintiffs of those suits had urged the courts for temporary restraining orders to first allow their actions to be determined
