Why then did the Abuja High Court gave it’s verdict if it wasn’t proven?

She doesn’t appoint herself to preside the panel, the CJN did; And this was based on ranking and seniority! The woman was just one out of 5 judges.

Once election concludes, all pre election cases are overtaken by election tribunal.being sworn in does not give them immunity from electoral cases.going by records,it is time the supreme court rescinds its decisions.that time is here.the pressure is much

Forgery in its entirety is a criminal offense. PDP only used that as a bait to sought the disqualification of the APC candidates.
What pressure? Was there no pressure on Imo judgement too? We can’t be too sentimental about this my brother, the law of the land prevails!

I beg to disagree. In the case of Yahaya Bello. He ran even without a deputy because Faleke refused to run with him. The same Supreme Court upheld that election and said it is the party on the ballot and not the Candidate. The Governor elect then nominated a deputy who was never on the ballot. But like you said it is the Supreme Court.

In the case of Yahaya Bello vs Faleke, why did APC insisted on submitting Faleke’s name alongside Bello to INEC despite the fact that Faleke refused to ran with him(Bello)?

https://nigeriancurrent.com/2015/11/28/apc-picks-bello-retains-faleke-as-running-mate/

It’s a testament to the fact that no candidate can run for a gubernatorial election without a deputy. In the eyes of the law, Faleke was Bello’s I running mate in that election. Btw, the Kogi incidence was never envisaged by our law, hence the lacuna!
PDP would have done well if they challenged Bello’s nomination in court knowing fully well he wasn’t a registered voter in Kogi as at that time. But then, fate has it ways of smiling at people.

My point exactly!

mushystuff:
I wonder though whether Falana averted his mind to the fact that after the conclusion of a case there is a right of appeal which must be exercised within a certain timeframe after which the principle of effluxion of time comes into play.

A pre-election matter doesn't suddenly become a post-election matter just because an election has taken place when the appellant party still has a cause of action and has not run out of time to file an appeal. The law does not say that the court of appeal is the court of final judgement rather it is the Supreme court on pre-election issues.

The mere conduct of an election does not override the right of appeal of any party.

Even an illiterate won't act the way mary odili did.

Supreme court don't originate cases, rather they inherites them from lower courts.

Nonsense mary odili gave a verdict on an election matter that was never existed anywhere.

Mary Odili was given a little test, but she didn't only failed woefully, but also exhibited her devilish attitude.
Too bad.

Why single out Mary Odili? There were 5-members on that panel and they ALL gave a unanimous judgement.
The same Mary Odili didn’t fail woefully and exhibited her devilish attitude when she gave a favorable judgement for APC on Kaduna and Nassarawa gubernatorial cases? Why are you people like this? angry
It’s your personal decision if you have issue with the Bayelsa judgement, but stop the (blame game) hypocrisy!
This singular act won’t grow and strengthen our democracy.

The must be a clear consequential order to not just disqualify the deputy but also the candidate

Oh well, that would definitely be explicitly dealt with in the SC judgement review. The joint-ticket ish must have emboldened the PDP to approach the court for the disqualification of APC deputy governorship candidate. They (PDP) carefully waited for the INEC substitution window to elapse before they took it up at the court of competent jurisdiction.
Let’s not forget these politicians knows themselves. Dem be padipadi smiley

State the electoral act that supports the removal of a elected governor because his deputy wss disqualified?

Yes, it does because the Appeal court already passed a judgement in favour of the APC before the election.

I am not a lawyer, but do well to read section 36 of the electoral act. Yes, he was elected but the joint ticket only cease to bind them after they’ve been sworn in. Even though you and i know that it would be impossible for anyone to instigate litigation against the governor and the deputy because they enjoy immunity.

Meanwhile, the same right the APC has to appeal the High Court’s judgement is the same right PDP has to appeal the appellate court’s judgement at the Supreme Court. After all, it wasn’t a post-senatorial election matter that only ends at the Court of Appeal level.

Even if the SC erred on there judgement, I’m afraid it might not be upturned as there was no precedence in that regard. But then, anything can happen. We can only keep our fingers crossed as events unfolds in weeks to come.

Politics / Re: Edo Decides: More Momentum As 19 Support Groups Dump Obaseki For Ize-iyamu by donpapa(m): 12:02am On Feb 23, 2020
Typical APC propaganda! cheesy

torgod:

The gubernatorial ambition of Pastor Osagie Ize-Iyamu has continued on an upward swing as more support groups loyal to the Obaseki Shaibu joint ticket has thrown their support for the RCCG Pastor.
The past few weeks has seen a massive boost in the political train of Pastor Osagie Ize-Iyamu as more groups have come out openly to declare their support for him.

Last week saw leaders from the 18 LGA council of the state urging Pastor Ize-Iyamu to contest for the seat of the Executive Governor of Edo State.
In what can be described as forward ever and backwards never another 19 support group have thrown their weight behind the aspiration of Ize-Iyamu.
The group, Edo State Liberation Network,ESLN an amalgamation of 19 APC support group has endorsed Paster Osagie Ize-Iyamu for the APC governorship primary.

The support group who before now were in support of Obaseki's re-election bid explained that they took the decision because “the government we put in place has failed and continues to fail our people and we cannot continue to reinforce failures.”
According to the coordinator, Jude Ikponwonsa, the group as consulted extraordinarily with the electorates and has come to the conclusion that Ize-Iyamu is not only the most credible candidate amongst all the aspirants but also the most sell-able.

They recalled the sacrifices Ize-Iyamu has done for the APC in the past and the role he played as the Director-General of Adams Oshiomohole's reelection campaign.
It urged the APC national committee to give Pastor Ize-Iyamu the APC ticket as he represents the hope Edo people are looking for.
They frowned at the slow pace in which Obaseki is tackling insecurity in the State and the lack of development presently witnessed.
"If we must be truthful to ourselves the state has completely derailed from its master plan,
Edo is meshed with a multitude of challenges and instead of the Governor to squarely address these pressing issues he is busy hunting down political opponents.

But sadly enough the state is comatose under this present government which affirms it is clueless. We strongly believe that under Ize-Iyamu, our economy will be revived and returned to the path of progress.”
Pastor Osagie Ize-Iyamu is presently the favourite to pick the APC ticket due to his grassroots network and famed integrity laced with a passion to serve.

First of all, the federal high court judgment which the supreme court upheld never removed the governor, it only disqualified the running mate.

Wasn’t it a joint ticket? The electoral act was so clear on that.

Secondly, PDP only appealed the case after the Election not before. Apc actually won the appeal in the Appeal court.

Does that change the fact that it was a pre-election matter?

Politics / Re: The Tragedy Of The Abba Kyari Surrogate Presidency By Farooq Kperogi by donpapa(m): 4:50pm On Feb 22, 2020
Farooq was only reiterating what we already know a long time ago! It’s a pitiable situation we found ourselves because of some microscopic few that are only after the share of the spoils. It’s shameful that the politicians of APC extraction wouldn’t see anything bad in the excessive misrule of Buhari/Kyari regime to call a spade a spade, instead they would turn a blind eye and castigate people that hit the nail on the head to tell them the truth.
It’s contemptuous to see that some nitwit still supports this government. What has changed since Buhari’s ascendancy to power in 2015?
• Insecurity in the country is on a high.
• There is no precedence to the kind of nepotism we’re experiencing today.
• Corruption fight is more like Rudeboy’s audio where they go after dissenting voices.
• Looted funds recovered by EFCC are being re-looted.
• No improvement in education sector as their wards go abroad to study.
• The health sector is abysmal, even the president visits UK for medical tourism every now and then!
• The power situation is as erratic as the previous administration.
• Citizens no longer has the right to protest without them being shot by the military. They might even pick you up for treason. That’s if they don’t pay some jobless youths stipends to organize a counter protest to support the government! If i register my grievances on the internet they might arrest and charge me for cyber-stalking or insulting the president!
• The judiciary ceased to be the last hope of the common man under Buhari and the national assembly has been pocketed. We’ve never had it this bad in this country, Never!
If this is the change they preached to us, then NIGERIA IS INDEED STUCK! Because the surrogate president would still be around till 2023 and beyond (as they’re in power to handpick their successor)!!!

A judge recused himself from a case having been accused of possible compromise to give a bias judgement, the appellate court in it’s wisdom ordered that the case should be returned to him for continuation of the trial.
Oh well, i don’t know how these things works, isn’t it in the best interest of both parties that the case should be assigned to another judge?

Justice Okon Abang? I have nothing to say to him. This one the SC is short of judges, i won’t be surprised if he’s elevated to the Supreme Court someday. cheesy
