Socio-Economic Rights and Accountability Project (SERAP) has called on the leadership of the Senate to “immediately withdraw the unwarranted and unconstitutional ‘summon’ of Professor Itse Sagay, Chairman Presidential Advisory Committee Against Corruption to appear before the Senate committee on ethics, privileges and public petitions” over his comments. SERAP in a statement signed by its executive director, Adetokunbo Mumuni said that, the Senate’s decision to summon Professor Sagay simply for exercising his right to freedom of expression was arbitrary, a travesty, mala-fide, and cannot withstand constitutional scrutiny. “Suppression of freedom of expression and public discussion is inimical to peace, order, good governance and the rule of law, and patently inconsistent with the Senate’s law-making and oversight functions,” it said. The statement noted that Senate is not above the constitution simply because it’s a law-making body. “In fact, the Senate has neither special immunity from the operation of the constitution nor special privilege to invade the constitutionally and internationally guaranteed right to freedom of expression of Professor Sagay or other citizens for that matter.” “The framers of the Constitution of Nigeria 1999 (as amended) would never have contemplated a legislative power without responsibility, and the Senate can’t continue to carry on in a manner that implies its law-making and oversight powers are not open to question. “Therefore, its powers under the constitution ought to be exercised reasonably and responsibly, consistent with the fundamental notions of peace, order, good governance and the public interest.” “The human rights of Nigerians are secured against not only executive lawlessness but also legislative excesses. To trample on citizens’ freedom of expression is to thwart the ideals of representative democracy and the rule of law.” “The National Assembly is constitutionally empowered to make laws for the peace, order and good governance of Nigeria but recent events in the Senate would seem to stir the public anger. It seems curious that the Senate will be giving a raw deal to the heads of the two leading anti-corruption bodies in the country-Ibrahim Magu of the Economic and Financial Crimes Commission and Itse Sagay of the Presidential Advisory Committee Against Corruption.” “All public institutions and figures are legitimately subject to criticism and political opposition. The Senate in particular and the National Assembly as a whole would do well to respect the inherent rights of Nigerians that are so fundamental to our constitutional structure. “Democracy, constitutional supremacy, and the rule of law require no less. Indeed, no principle is more basic to any proper system of law than the maintenance of the rule of law itself.” It would be recalled that Professor Sagay’s comment was a reaction to the Senate’s refusal to proceed with confirmation of 27 persons President Muhammadu Buhari nominated as Resident Electoral Commissioners. The lawmakers stopped the confirmation in protest against the refusal of the President to sack Ibrahim Magu as acting chairman of the Economic and Financial Crimes Commission despite his repeated rejection by the Senate. The Nigeria Police on Wednesday arraigned the National Commandant of Peace Corps of Nigeria, Amb. (Dr.) Dickson Akoh before an Abuja Federal High Court. His arraignment is coming 11 days after Akoh was detained at the Special Anti-Robbery Squad (SARS) unit of the FCT Command. DAILY POST reports that, Akoh was detained on Sunday, 19th March 2017, when he turned himself in, having heard that the Police was looking for him. All entreaties by well meaning Nigerians for Akoh to be released, proved abortive. Meanwhile, the Police had earlier sued the National Commandant with a 90-count charge, bordering on extortion of money, wearing of uniform, hoisting of flags, money laundering and running an outlaw organisation, the suit which was first allocated to Justice Gabriel Kolawole. It was, however, disclosed thereafter, that, the Chief Judge of the Federal High Court, had transferred the case to Justice J.T. Tsoho’s court. DAILY POST recalls that, Akoh was first arrested on February 28th, 2017, along 49 others, on the day the National Headquarters of the Corps was launched. They were detained at the Force Headquarters for 3 days and later released after “some female Journalists protested that, the nursing mothers among the detainees be released to attend to their babies after 3 days.” Irked by the seemingly violation of their fundamental human rights, former Attorney-General of the Federation, Chief Kanu Agabi (SAN), slammed the Police and DSS with a N2bn suit, challenging the arrest, harassment and detention of Akoh and others. Consequently, Justice Gabriel Kolawole issued a 12-day ultimatum to the Nigeria Police, to advance reasons for such treatment. The Police has, however, reacted to the ultimatum in a counter affidavit deposed to, on 22nd March 2017; denying harassing the Akoh and 49 others. At the resumed hearing on Wednesday, the Prosecution Counsel, A.K. Aliyu asked that the 90-count charge be read to the defendant. Though the Presiding Judge demanded that the count charge be compressed, to enable the court take all while the defendant also take his plea; but Aliyu objected to it. A National Leader of the All Progressives Congress, APC, Bola Tinubu, has claimed that critics failed to create enmity between President Muhammadu Buhari and his Vice, Yemi Osinbajo. The APC leader while speaking at a colloquium held to mark his 65th birthday in Lagos, on Tuesday said Buhari and his Deputy have exemplified teamwork and the true meaning of unity of purpose. According to the former Lagos State governor, “Before we go further, I give special thanks to Vice-President, Osinbajo. “Leading a group of fellow commissioners who worked together during my time as governor of Lagos, Yemi and this creative group have turned this event into an annual reality. “Each year, they assemble creative minds to address the issues that stand in the way of our national greatness. As a result, the colloquium gets better by the year. “In this and so much else, the VP has proven himself a true servant of the Nigerian people. While our dear president had to be away, the VP performed admirably as his loyal subordinate. “Try as critics might, they could not create any space between the president and his deputy. Barely 2 weeks after the Senate rejected the nomination of Alhaji Ibrahim Magu as the Chairman of Economic and Financial Crimes Commission (EFCC); the red chamber has also rejected the nomination of 27 Resident Electoral Commissioners (REC) of the Independent National Electoral Commission (INEC). President Muhammadu Buhari, had written to the Senate, seeking the confirmation of appointment of 19 RECs and reappointment of 8 others. This is, in accordance with sections 14(3)(a) of the Third Schedule to the Constitution of the Federal Republic of Nigeria, as amended. Immediately the motion was moved for the confirmation of the nominees, on Tuesday, the Senators took to their turns to lambast what they described as “affront” on the part of the executive. Senator Peter Nwaoboshi (Delta North), who led the debate on the motion, accused the executive of looking down on the legislature. The lawmakers were specifically pained that, the EFCC boss, Magu, was still being allowed by the President to act as Chairman of the anti-graft agency, even when the Senate had long rejected him. They argued that, the principle of separation of powers was under threat and there was urgent need to put things in the right perspectives. Speaker after Speaker, the lawmakers vowed not to confirm any of the nominees, until their decision on Magu was duly implemented by the President. The Senate President, Bukola Saraki, however, saved the day, when he interceded that the confirmation should rather be stepped down and not total rejection, until the executive would be adequately briefed on the recent workings of the Senate. With the deputy Senate President, Ike Ekweremadu, corroborating Saraki’s stance, the Lawmakers, therefore, resolved to step down action on the confirmation for 2 weeks, until when the President would fully implement their earlier decision. A man identified as Gambo Saeed has been sentenced to nine months imprisonment for insulting and defaming the Governor of Katsina State, Aminu Masari. A Katsina Chief Magistrates’ Court sentenced Saeed for insulting and defaming the character of Masari on social media. Saeed resides at Muduru village in Mani Local Government Area of the State. The Police Prosecutor, Insp. Isa Liti, told the court that Saeed was arraigned following complaints received from Mansur Ali Mashi, Senior Special Assistant, SSA, to the Governor on Radio Monitoring. The prosecutor added, “Mashi said the accused person abused Masari and called him names on social media. “He said the accused person posted on the media that it was Gov. Masari who influenced the impeachment of Speaker of Katsina State House of Assembly, Aliyu Muduru.’’ He following the reports, police arrested the accused person and arraigned him for intentional insult, defamation of the governor’s character and inciting disturbance. He added that charges were in accordance with sections 399, 392 and 114 of the Penal Code. Liti further explained that the accused person confessed to have committed the offences. Ruling on the matter on Monday in Katsina, Chief Magistrate Abdu Ladan, pointed out that the court has found the accused person guilty of the said offences; and that each charge attracts three years imprisonment.
