Former Senate President and two-term Kwara State Governor, Dr Bukola Saraki, has urged the Federal High Court in Lagos State to dismiss a suit filed by the Economic and Financial Crimes Commission praying for the permanent forfeiture of his Ilorin houses. Saraki described the suit as an abuse of court processes and a move to scandalise him. He argued that it was a ploy by the EFCC to review the July 6, 2018 decision of the Supreme Court “discharging the applicant from culpability arising from the same money and houses which are the subject matter of this action.” The EFCC had, in the suit filed before Justice Rilwan Aikawa, claimed that the houses – Plots No. 10 and No. 11 Abdulkadir Road, GRA, Ilorin, Kwara State – were acquired with proceeds of unlawful activities allegedly perpetrated by Saraki while he was Kwara State Governor between 2003 and 2011. Justice Aikawa had on December 2, 2019, ordered the temporary forfeiture of the houses to the Federal Government. The judge adjourned for Saraki to appear before him to give reasons why the houses should not be permanently forfeited to the Federal Government. In response, Saraki, through his lawyer, Kehinde Ogunwumiju (SAN), filed a preliminary objection, challenging the territorial jurisdiction of the court to entertain the suit. Ogunwumiju said the new suit by the EFCC was an abuse of court processes because it was filed at a time when a suit on the same subject matter was still pending at the Federal High Court in Abuja. According to him, in the Abuja suit, Justice Taiwo Taiwo had on May 14, 2019, made an order for parties to stay action on the subject matter pending the determination of an originating motion on notice. “Despite the pendency of the above-captioned suit, service of the originating processes and the subsistence of the aforesaid order of this court, the respondent surreptitiously commenced Suit No. FHC/L/CS/1867/2019 between the EFCC v Dr Bukola Saraki on 14th October 2019 in this court where it seeks orders aimed at neutralising the order of the Abuja Division of this court,” he said. The ex-Kwara State governor said the new EFCC’s suit was meant to “irritate, annoy and scandalise” him and urged Justice Aikawa to dismiss it. The judge, on Tuesday, adjourned till February 5 to take arguments on Saraki’s objection. The EFCC, in the suit, told the court that it received “a damning intelligence report, showing monumental fraud perpetrated in the treasury of the Kwara State Government between 2003 and 2011,” when Saraki was the governor of the state. An operative of the EFCC, Olamide Sadiq said, “Whilst investigation was ongoing several fraudulent transactions were discovered. “I know for a fact and verily believe that our investigation has revealed the following mind-boggling findings, among others: “That between 2003 and 2011, Dr Olubukola Abubakar Saraki was the Executive Governor of Kwara State. “That whilst he held the aforementioned position, the common pattern was that after payment of monthly allocation by the Federal Government to the Kwara State Government, a cumulative sum of not less than N100m will be deposited into the Kwara Government House account. “That upon the payment of the said N100m, same will, in turn, be withdrawn in cash by one Mr Afeez Yusuf from the Kwara State Government House, Ilorin’s account in bits and brought to the Government House.” https://punchng.com/seized-houses-efcc-scandalising-me-saraki-tells-court/ |
Nobel laureate, Prof. Wole Soyinka, has come down on ex-governor of the old Kaduna State, Alhaji Balarabe Musa, over his comment that the Western Nigeria Security Network code-named Operation Amotekun would lead to the declaration of Oduduwa Republic. The security task force was initiated by the six South-West governors to tackle kidnapping, banditry and ritual killings bedevilling the region. Many leaders from the region supported the initiative with some northerners kicking against it and the Federal Government through the Minister of Justice and Attorney General of the Federation, Mr Abubakar Malami, SAN, describing it as illegal. Balarabe had said during an interview with a national daily (not The PUNCH) that Operation Amotekun would lead to the declaration of Oduduwa Republic. But Soyinka in a statement, on Tuesday, said Balarabe was sadly wrong with his position on Amotekun, adding that he hoped he wasn’t tragically wrong. Soyinka said, “Balarabe is sadly but I hope not tragically wrong. I invoke the tragic dimension here because the making of tragedy, especially for nations, often begins when fears are mistaken or promoted as facts, and governments either by themselves, or together with interest groups, are enticed by fears into embarking on precipitate, irrational, and irreversible acts. “Such acts turn out, in the end, to be based on nothing but fears, sometimes generated by guilt over past injustices, such as inequitable dealing. That is the basis of tragedy, towards which nations are propelled by a partial, or wrongful reading of socio-political realities and- history. I would like to see this nation avoid such a blunder. So, I am certain, would Balarabe Musa. “Raising the spectre of secession is a facile approach to the dangerous, self-evident lapses in governance which Balarabe himself acknowledges in his response to the Amotekun principle made flesh. The midwives of Amotekun have repeatedly acknowledged that theirs is only a contribution towards a crisis of escalating proportions. Other states should be encouraged to emulate, not misread such initiatives, then demonise them by false attributions. The Rivers State Election Petition Tribunal has sacked Nyesom Wike as the Governor of Rivers State. The Governorship Election Petitions Tribunal for Rivers State on Saturday nullified the election of Gov. Nyesom Wike of Rivers for non-compliance with the provisions of the Electoral Act. The Tribunal, sitting in Abuja, ordered the Independent National Electoral Commission (INEC) to conduct fresh governorship election in the state within 90 days. The three-member tribunal, presided over by Justice Suleiman Ambursa, gave the orders in its judgment in a petition filed against the election of Wike by the All Progressives Congress (APC) and its candidate in the April 11 election in the state, Dr Dakuku Peterside. In the judgment, which was read by Ambursa for about three hours, the tribunal held that the petitioners successfully proved their case that the election was conducted in total disregard to electoral guidelines. Specifically, Ambursa said that the process of accreditation for the election was compromised with the use of incident forms rather than adherence to card reader. “It is the view of the tribunal that the election was held contrary to guidelines. “While we agree with the second respondent’s (Wike) position that card reader was just introduced, but the usage of the card reader is to complement voter register. “The election was in total disregard to guidelines, the issue of accreditation in election cannot be compromised. “Even, some of the witnesses of the respondents said they were not aware of the use of card reader for the election,’’ he said. Ambursa said the tribunal also hinged its decision to annul the election on contradictory position by the second and third respondents (Wike and PDP). According to him, some figures given by the witnesses of Wike contradicted the figures presented in the documents tendered by PDP while defending the case. Ambursa also said that the tribunal was not impressed with the way the witnesses of the respondents presented themselves during cross-examination by the petitioners. Ambursa said some of the witnesses of the respondents, who had written their evidence and tendered them before the tribunal, claimed that they could not read when they were confronted with INEC results sheets during cross-examination. “We are in agreement with the petitioners that the evidences presented by the respondents were unreliable. “The respondents on their part were unable to defend the allegations in the petition. “The petitioners have proved their case as required by the law that the second respondent was not validly elected ,’’ he said. Meanwhile, Counsel to the PDP, Chris Uche, (SAN) has said that the decision of the tribunal was “unacceptable’’ and it would lodge an appeal. Uche, who spoke to newsmen after the judgment, said by the provision of the law, the decision of the tribunal notwithstanding, the governor would remain in office pending the decision of the appeal court and the Supreme Court on the matter.
