The Supreme Court on Friday finally laid to rest the trial of a Senate President, Dr. Bukola Saraki, on assets declaration and sundry charges instituted against him before the Code of Conduct Tribunal. A five-man panel of the apex court led by Justice Dattijo Muhammad unanimously upheld Saraki’s appeal, by dismissing the remnant three counts, declaring the evidence led by the prosecution as hearsay. The Danladi Umar-led CCT had, in June last year, terminated the trial upon an application by Saraki, by dismissing the entire 18 counts preferred against the Senate President. The CCT’s decision was based on the grounds that the prosecution, with its four witnesses and 49 exhibits tendered, only led hearsay evidence which could not be the basis to link Saraki to the 18 counts preferred against him. However, the Court of Appeal in Abuja ruling on December 12, 2017, in an appeal filed by the Federal Government against the decision of the CCT, restored three out of the dismissed 18 counts and ordered Saraki to return to the CCT to defend the three charges. While Saraki had appealed to the Supreme Court against the part of the Court of Appeal’s decision restoring three of the 18 counts, the Federal Government had cross-appealed against the part of the decision affirming the tribunal’s dismissal of the rest of the 15 counts. However, in its lead judgment on Friday, Justice Centus Nweze upheld Saraki’s appeal and dismissed the Federal Government’s appeal. Justice Nweze agreed with the CCT that the evidence led by the prosecution at the tribunal was entirely hearsay. He held that the Court of Appeal was wrong to have restored three out the 18 counts earlier dismissed by the CCT when it agreed that the evidence led by the prosecution was hearsay but went ahead to isolate three of the counts as having been proved. Justice Nweze quoted a part of the Court of Appeal’s judgment where it held that “the prosecution failed to call those who have direct knowledge of the facts sought to be proved, to testify”. Faulting the Court of Appeal’s turn around to restore three of the counts based on the evidence it had declared as hearsay, Justice Nweze said was “equivalent to judicial equivalent of a forensic somersault”. Three state governors elected on the platform of the All Progressives Congress on Thursday met behind closed doors with President Muhammadu Buhari. They, however, refused to disclose the agenda of the meeting to reporters. The meeting was held inside the President’s office at the Presidential Villa, Abuja. State governors who attended the meeting were Abdulaziz Yari of Zamfara State, Abubakar Badaru of Jigawa State and Abubakar Bagudu of Kebbi State. The Chief of Staff to the President, Abba Kyari, led the governors to the President’s office for the meeting. Kyari was again seen at about noon, leading them out of the venue. The governors refused to talk to State House correspondents. The meeting was held barely 24hours after some aggrieved members of the APC formed a new faction, the Reformed All Progressives Congress, fuelling speculations that the meeting was about the development. When reporters pushed further to know if the meeting was about the factionalisation of the party, Yari simply replied, “It was a private business. It had nothing to do with the APC.” Alhaji Buba Galadima, from Gashua, Yobe State, and former secretary of the defunct Congress for Progressive Change was introduced as the National Chairman of the RAPC on Wednesday. The World Bank has announced the approval of $2.1bn loan for seven projects to be executed in Nigeria. A statement issued in Abuja on Thursday said the loans were approved in Washington on Wednesday and are for seven projects to support Nigeria’s investment in nutrition, access to electricity, states’ fiscal transparency, polio eradication, women’s economic empowerment, public finance and national statistics and reducing vulnerability to soil erosion. World Bank Country Director for Nigeria, Rachid Benmessaoud, was quoted to have said, “The Federal Government of Nigeria’s Economic Recovery and Growth Plan identifies human capital investment, restoring growth, and building a competitive economy as its key pillars. The projects approved by the International Development Association, the bank’s low-interest arm, are expected to support Nigeria’s economic growth plan. Growth rates in Nigeria have bounced back since the third quarter of 2016, when a recession, its first in 25 years, bottomed out. Growth returned largely due to higher oil prices, with the country relying on crude sales for much of its revenue. However, growth slowed again in the first quarter of 2018, as the country’s non-oil sector struggled. The government expects growth to rise to a pre-recession level of 7 percent by 2020. The World Bank said more than half of the loans would be used to fund power and climate change projects and boost fiscal transparency. It also approved a $7 million grant for nutrition. Nigeria privatised most of its power sector in 2013 but retained control of its dilapidated monopoly transmission grid, often blamed for hobbling growth. The country intends to raise $2.8 billion of debt offshore to help part-finance its 2018 budget and plans to explore all options to lower costs, the debt office head told Reuters.
