The Economic and Financial Crimes Commission has begged Justice Abdulaziz Anka of the Federal High Court in Lagos not to give Chief Mike Ozekhome (SAN) access to his account in Guaranty Trust Bank which has a balance of N75m.

The anti-graft agency claimed that the money, which was paid to Ozekhome as legal fee by the Governor of Ekiti State, Mr Ayodele Fayose, was part of the N2.26bn arms procurement fund, which a former National Security Adviser, Col. Sambo Dasuki (retd.), allegedly looted.

The EFCC claimed to have traced N1.22bn out of the N2.26bn Dasuki loot to Fayose.

The anti-graft agency claimed that Dasuki routed the money to Fayose through a former Minister of State for Defence, Musiliu Obanikoro.

The EFCC said this in a counter-affidavit it filed in opposition to an application by Ozekhome seeking the unfreezing of his account.

Ozekhome’s GTB account, having a balance of N75m, had since February 7, 2017, been frozen by the EFCC on the order of Justice Anka.

But Ozekhome had approached the court stating that the EFCC misrepresented facts to obtain the freezing order and urged Justice Anka to lift the freezing order.

The SAN had contended that the action of the EFCC was unconstitutional, had no legal justification, and was a gross violation of sections 36, 37 and 41 of the 1999 Constitution.

In response, however, the EFCC, in a counter affidavit deposed to by one of its prosecutors, Idris Mohammed, lamented that though it had earlier secured an interim order from Justice Mohammed Idris of the Federal High Court in Lagos to freeze Fayose’s account, the governor, through Ozekhome, went before Justice Taiwo Taiwo of the Ado Ekiti Division of the Federal High Court to obtain an order to unfreeze the account.

The EFCC prosecutor said despite the fact that Fayose was aware that it had immediately appealed Justice Taiwo’s ruling, the governor still went ahead to dissipate part of the contentious funds, paying a sum of N75m to Ozekhome who helped him to secure Justice Taiwo’s unfreezing order.

The EFCC said Ozekhome ought to have “reasonably known that the N75m was transferred to him” from Fayose’s account, which the EFCC claimed was used to retain proceeds of crime and alleged kickbacks from some contractors in Ekiti State.

The EFCC urged Justice Anka not to unfreeze Ozekhome’s account.

Justice Anka adjourned till 7, 2017 for hearing in the case.

The Federal High Court in Abuja and the Central Bank of Nigeria (CBN) have been asked to wind up and revoke the operational licence of the Heritage Bank over an alleged state of financial insolvency of the financial institution.

The court and CBN were asked to invoke the provisions of section 408, 409 and 410 of the Companies and Allied Matters Act 1990 to liquidate the bank because of its alleged inability to meet up with demands of its customers due to its distressed status.

An Abuja based company, Geonel Integrated Services Limited in a petition filed against the bank at the Federal High Court alleged that Heritage bank has been showing signs of distress and insolvency in the recent times and may cause colossal economic damages to Nigerians unless it is shut down on court order.

In the petition filed by the security outfit, it claimed that it maintains four separate accounts with Nos. 1300083902, 6200100931, 6000105125 and 3200121515 as well as a fixed deposit account at the Abuja branch of the bank.


Petitioner owned by a foreign investor, Mr. Wolfgang Reinl, an Australian Security Experts claimed it has N1,811,555,258 and another $85,859 in the accounts and that the huge sums have been trapped in the bank due to its inability to meet up with its expected obligations.

In the petition filed by Mr. Mazi Afam Osigwe, an Abuja based lawyer, the company alleged that it had made several applications through cheques to transact withdrawal business but that the bank had failed and neglected to honour the cheques.

Petitioner alleged that in January last year, a Judge of the court, Binta Murtala Nyako granted the Economic and Financial Crimes Commission (EFCC) an order to freeze the accounts for a period of six months to carry out some investigations.

It claimed that the order granted EFCC expired on July 24, 2016 and that the same Justice Binta Murtala Nyako confirmed expiration of the order in her ruling delivered on November 16, 2016.

As a result of the inability of the bank to honour its obligations, the petitioner claimed that it has been actively instigating the EFCC to secure a fresh order to stop it from accessing or operating the accounts so as to cover up its distressed status.

The petitioner presented several newspaper reports that the bank is financially distressed and the denial of its management to the contrary.

It, however, said that in spite of the public denial of the distress, the bank has been unable to honour several financial obligations to customers rushing to withdraw their money to escape unpleasant economic effects.

It, therefore, urged the court to declare the bank distressed, insolvent and to hold that the bank is indebted to it to the tune of N1.8b and another $85,859.


Petitioner also applied for an order of the court to wind up the bank and another order compelling the CBN to withdraw or revoke the banking licence of the bank.

Meanwhile, no date has yet been fixed for hearing of the petition.

Members of the House of Representatives exchanged words on Tuesday over the health status of President Muhammadu Buhari.

Lawmakers quarrelled over the use of the word “sickness” in referring to Buhari or explaining his reason for being away from the country to the United Kingdom since January 19.

The disagreement was more pronounced among members of the ruling All Progressives Congress, the President’s party.

While some members said Buhari was sick and was away to treat himself, others claimed that he was on “medical vacation.”

It was the House Majority Leader, Mr. Femi Gbajabiamila, who started the argument when he tried to stop the Chief Whip, Mr. Alhassan Ado-Doguwa, from describing the President as a sick man.

Both Gbajabiamila, who is from Lagos State, and Ado-Doguwa, who is from Kano State, are members of the APC.

Ado-Doguwa was contributing and opposing a motion seeking to investigate the alleged harassment of members of ‘Kwankwasia’ followers, a political group loyal to former Kano State Governor, Senator Rabiu Kwankwaso.

He had stated that the motion, which was moved by a fellow Kano lawmaker, Mr. Aliyu Madaki, was “basesless” because the Kwankwasia group was known for moving around the state and inciting people against the political leadership.

Ado-Doguwa observed that the country was already under tension owing to the absence of Buhari and could not afford any “partisan” activities that could lead to insecurity.

He added that the group was already campaigning for the 2019 presidential elections in a volatile place like Kano.
“Our beloved President is sick abroad.

“These partisan activities are completely unnecessary and baseless. The police must do their work of protecting lives and property anywhere in the country.”

The Movement for the Actualization of the Sovereign State of Biafra, MASSOB, on Tuesday explained why it is impossible for someone from the South-East to become Nigeria’s President.

In a statement by its leader, Uchenna Madu, the group said the structure of Nigerian system which had reduced Igbos to “minorities” had made it impossible for the race to emerge as Nigerian President.

Claiming that “Igbo leaders are political slaves in Nigeria,” Madu said, “The way Nigeria is structured politically, it will be very hard for Igbo man to be president of Nigeria. The structure almost reduced Ndigbo to a minority tribe in Nigeria but history has always proved that Ndigbo is the largest ethnic nationality in Nigeria.

“Even though five states were accorded to Ndigbo in Nigeria but we are the largest ethnic group in every state after the indigenes of that state, in all the Nations of the world.

“Ndigbo are also the largest Nigerian ethnic nationality; even during the yuletide, all the states in Nigeria become temporal deserts and inhabitable because Ndigbo that make every state thick returned to their native hometowns.

“Even with our population and handshake with some geopolitical zones, it will be hard for the Igbo to be Nigerian president because there is a grand plot against Ndigbo in Nigeria. It will still be difficult for Igbo man to be president in Nigeria.”

He, however, noted that the only reason that will force Igbos to agree to Presidency was for Nigerians to support the actualisation struggle “because that’s the only working panacea that attract regional interest to the presidency.”

Recall that former President, Olusegun Obasanjo had recently advocated for an Igbo Presidency in 2019.
