PoliticsOkada Riders Appeal Judgment On Restriction by dotcomnamename(op): 5:30am On Dec 31, 2012
Commercial motorcyclists (okada riders) in Lagos State have appealed against a court judgment, which on December 13, upheld the decision of the government to restrict their operations on 475 roads in the state.

The appellant, under the aegis of the Incorporated Trustees of All Nigerians Autobike Commercial Owners and Workers Association, filed seven grounds of appeal dated December 27, 2012 at the Lagos Division of the Court of Appeal.

The okada riders, through their counsel, Mr. Bamidele Aturu, are contesting the whole judgment which was delivered by Justice Aishat Opesanwo of the Lagos High Court in Ikeja.

They argued that Opesanwo erred in law by holding in her judgment that there was no any instrument by the National Assembly designating any road to be a Federal Trunk Road.

The appellant, had through their suit at the lower court, challenged some sections of the Lagos State Traffic laws.

They argued that the government and the House of Assembly lacked the powers to enforce or make any law on some roads considered as federal trunk roads in the state.

The notice of appeal read in part, “Section 28 of the Federal Highways Act, cap F13, Laws of the Federation of Nigeria, 2004 makes it clear that federal highways are federal trunk roads contrary to the decision of the learned trial judge.

“The learned trial judge ought to have held that the various Federal Highways (Declaration) Orders which designate certain roads as trunk roads are instruments or acts of the National Assembly having been made pursuant to an existing law, the Federal Highways Act, cap F13, Laws of the Federation of Nigeria, 2004 which predates the National Assembly.”

Among their other reasons for faulting the judgment was that the judge refused to agree that the Lagos Traffic Law was being used by the state government to encroach on Federal Trunk Roads or Federal Highways reserved for the federal legislature and the ministers respectively.

Aturu stated, “The learned trial judge who held clearly and unequivocally that some of the roads listed in the Schedule of the Lagos State Road Traffic Law, 2012 are Federal Highways under the Federal Highways Act ought to have found that the respondents cannot validly enact a law to control traffic on the Federal Highways.”

The respondents in the appeal are the state government, House of Assembly, and the Attorney-General and Commissioner for Justice, Mr. Ade Ipaye.

A former governorship candidate in the 2007 elections in Anambra State, Chief Stanley Okeke, has dragged President Goodluck Jonathan before a Federal High Court sitting in Abuja, asking it to compel the president to remove forthwith the subsidy being paid on fuel in the country.

The plaintiff, who filed the suit through his cousel, M.A Ebute and U.B. Eyo, is also seeking an order compelling President Jonathan to refund to the Federation Account such sum earlier appropriated and/or approved under the sub-head of fuel subsidy funds or money as, according to him, same cannot be justified in the face of the pervasive corruption, perennial fuel shortage and long queues witnessed in petrol stations.

Also joined in the suit as second and third defendants are the Minister of Petroleum, Diezani Alison-Madueke and the Minister of Finance Dr Ngozi Okonjo-Iweala.

The plaintiff is also asking the court for an order directing the third defendant to stop further payment of fuel subsidy money predicated on the corrupt, illegal and unlawful fuel subsidy regime.

Okeke is again asking the court to declare that the fuel subsidy currently being funded by the Federal Government is a waste of public funds and, therefore, unlawful and illegal.

He also prayed the court for a declaration that the pervasive corruption inherent in the fuel subsidy scheme had caused untold hardship to the masses of the country and, therefore, is an abuse of the rights of Nigerians as guaranteed by the provisions of the 1999 Constitution as amended.

He also wants the court to declare that the fuel subsidy scheme, having failed to achieve the purpose for which it was meant, should be outrightly abolished as same had violated the Nigerian people’s rights as guaranteed by the provisions of the 1999 Constitution.

The plaintiff also wants a declaration that the failure of the second and third defendants in their ministerial duties to ensure a corrupt-free subsidy regime is a breach of public trust and a violation of their oaths of office as contained in the seventh schedule to the 1999 Constitution.

Okeke also asked the court to determine whether in view of the official corruption and abuse of office inherent in the fuel subsidy regime as evidenced by the ongoing trial of certain individuals in the Federal High Court in Lagos, the President of the Federal Republic of Nigeria is competent to order the removal and/or abolition of the fuel subsidy scheme.

The plaintiff in a 27 paragraphed affidavit he deposed to in support of the originating summons averred that Nigeria under the leadership of President Jonathan now imports fuel from various oil producing nations for local consumption by Nigerians and that the importation is highly subsidised by the Federal Government.

Okeke stated that the only way to stop the high level of abuse of the fuel subsidy scheme is the removal of the policy by the Federal Government.

He further averred that recently in December 2012 the President 1st defendant submitted a supplementary budget of over N161,000,000,000 to the National Assembly for the payment of additional fuel subsidy money to the fuel importers and marketers.

Former Commissioner for Sport in Ondo State, Mr John Ola Mafo, believes coach Stephen Keshi is at fault for dropping West Bromwich Albion forward, Osaze Odemwingie from the list of players invited for the final phase of camping ahead of the 2013 Africa Cup Nations.

The former Bendel Insurance striker made an outburst on twitter after his exclusion from the Eagles’ provisional list.

“I think on the issue of Osaze, Keshi has allowed his personal feelings to overide national issue. He based his decision to exclude Osaze on what he did in December 2011, which shows that he lacks tolerance and forgiving spirit.’’

Speaking further, Mafo said Keshi should have taken a cue from previous Nigerian coaches who managed to tame controversial players like Tarila Okorowanta and Etim Esin as well as Manchester City manager, Roberto Mancini who has been able to handle players like Mario Balotelli and Carlos Tevez.

‘’Even as he (Keshi) was tough during his playing days, he still featured for Nigeria for many years and was even the captain despite being the leader of the mafia group,’’ added Mafo.

He argued that a coach must have a large heart to accommodate players, saying, ‘’some players could be tough off the pitch but they are stars on the pitch.’’

Mafo also expressed fears that the exclusion of left back, Taye Taiwo could be counter-productive, stressing that the Eagles should boast of at least two players in each department.

I don't understand the different between this administrative review and appeal anymore.

This is exactly what you need to prove to the visa officer.You can prove your ties to your country of origin by presenting supporting documents that can establish either your strong economic ties or strong social ties to your country.

Documents you can use to prove your economic ties include bank statement,employment letter,landed property etc while documents you can use to prove your social ties include; marriage certificate,certificate of birth of your children,letter from your university (if you are in a university in Nigeria),etc.

If not that he insisted to spend his holiday in France, I've told him to apply to Irish Embassy and come spend his holiday here in Dublin.
I don't know French Embassy's problem... All they just want is your money, and nothing more..

Now, lets be realistic !

You stated up here that ''one need to prove to the Visa officer ties to his/her country by presenting supporting documents that can establish either strong economic ties or social ties to his/her country.

Now, let me break it down for you to be satisfied that the FRENCH EMBASSY in Lagos Nigeria is nothing but korokoro 419 fraudster. All they want is your visa fees.
Example:

My friend applied for a Tourist Visa recently, he submitted all the required documents to the French Embassy on 17th December 2012.
Bellow are exactly the documents he submitted along with his application form.

1.1 Colour ID photograph, size, 3,5x4,5,

2.Passport with a validity of at least 3-6

3.Two copies of passport data pages--

4.Letter of Undertaking in English Language, and French- original and signed

5.Statement of Purpose Letter in English language and French- original and signed

6.Letter from company as proof of employment and Leave Letter- Original

7.Photocopy of the Certificate of Incorporation of the company he work- original was returned, but accepted only photocopy

8.Company’s Tax Clearance- original was returned, but accepted only photocopy

9.ID.Card- original was returned, but accepted only photocopy

10.Bank Account (Micro Finance) with balance of 1.3 Million Naira- original submitted

11.Letter from Bank (Micro Finance) confirming the account holder- original submitted

12.Birth certificate- original was returned, but accepted only photocopy

13.Original Child Birth certificate- original was returned, but accepted only photocopy

14.Marriage Certificate- original was returned, but accepted only photocopy

15.Family pictures snap with wife and son, but the pictures was returned at the VFS as they said they don't need it.

16.Landed Property Documents with C of O- original was returned, but accepted only photocopy

17.Medical Insurance for Schengen covering 7 days holiday

18.Flight Reservation Confirmation print out- confirmed

19.Hotel Reservation Confirmation print out- confirmed paid hotel

Could you believe that upon all these documents, he was refused visa on 24th December 2012 for just two unnecessary reasons.

REASONS:

(8.) The Information submitted regarding the justification for the purpose and conditions of the intended stay was not reliable.

(9.) Your intention to leave the territory of the Member State before the expiry of the visa could not be ascertained.

At of 9 permanent reason they always give applicant they refused, they only gave him just the above two reason, and i believe those two reasons are unnecessary.
Although he has prepared his appeal and he will lodge his appeal this coming Monday and the appeal points out each fact that '' EVIDENCE of the justification for the purpose and conditions of his intended stay was actually provided when he applied, and photocopies of the same set documentary evidence is now attached with the appeal.
Documentary evidence eg. Letter of Undertaking'' was provided including other required documents, same set is now attached with the appeal yesterday anyway, but
my point is: from all your contribution on about ties in Nigeria etc, i disagree with your point as likely reason they refused this type of applicant because of ties in Nigeria.

Are there ties other than those he has already provided as ties to Nigeria? I doubt it...
I believe they are just after the visa fees.
Now, be sincere , is this applicant not a fit and proper applicant to be issued a Tourist Visa?
Are you telling me this applicant do not met the requirements of the French Tourist visa?

As my own believe, the decision was actually based on ''personal opinion and bias, and discrimination.
If not, this applicant should be granted a Tourist visa. He did qualified, even if visa is not a right, but privilege, and to get it, he must meet the requirements offwhich he did met.

I drafted the appeal myself, and i quoted to let them realize the fact that the decision was an ERROR OF LAW because the decision was actually based on ''personal opinion and bias, and discrimination, and that it is not compulsory that an applicant must have traveling experience before he can be granted visa, if not, does that mean an applicant cannot choose France as his/her first traveling experience?
A copy of this appeal and the same documents will be sent to the main officer that treated the application at the French Embassy, and a copy will be sent to France itself.

Now, let me tell you something, if it was the UK Embassy he submitted those documents to, i'm very sure, he will be granted visa.. GUARANTEE....

My MAIN POINT is: FRENCH EMBASSY in Nigeria only wants your money ''Visa Fees'', and they do not refused this type of applicant because of their stated reason.

Another friend got his France Schengen today, they gave him a month, and he's first timer, never travel before and his passport is new.
So i don't think they refused u and my friend because you guys are first timer..
I think they're not just convinced enough... but i believe appeal would be allowed if you guys appeal and carefully explain the intention...

Naija_lastborn: My guy things don spoil for we Nigerians about Visa stuff, especially those intending to travel to developed Countries, they have negatives minds against us, in which its very true, many of us we are given the opporutninty to make a difference but few make it. Fine your GF is sending you invitation but that won't secure you Schegen Visa, please believe me, I am talking from personal experience, your best bet is get your GF down to Nigeria and get Married legally, take your docs with her docs and submit it german embassy for legalization then use it to apply for Long stay Visa in which it will be surely be given if your case is genunie. Though it takes a long process but it worth it. It better you don't go for tourist because I am very sure you are a first timer and that's surely denial even though you have all the merit

Who told you they are old laws? Where do you live in Germany? Why should one hold a permit and be deported? Do we talk about holding a permit and deportation here?

Naija_lastborn: I just don't want to say anything bad about your friend visa, France doesn't give out Visa to First timer Traveller, if that your Friend submit previous UK or other country visa surely with all his docs, he will be granted the visa. Don't be surprised, well I have a format of how the appeal is gonna look like, but the letter must be in french, anything you have to write about the appeal must be in french and forward to NANTE, FRANCE. The appeal can take months before they get it done, No guarantee that he will given ooo. O boy I will advise your friend to build his Travel history okay and re-apply again. Best of Luck, I will b appealing Soon too. The above reason is an automatically reply for every First timer, that's exactly what I was told. Please don't be surprise.

I disagree with that your point of first timer been automatically denied because the applicant is traveling for the first time.
The fact is: Why should I have travel experience before I can be granted a visa to visit Paris as a Tourist?
Has the French Embassy not granted a visa to a first time traveler to France ever before?
Is it a criminal offence for my decision to make France as my first traveling experience?
The decision is an error of law, base on bias and discrimination, and that's the grounds my friend is going to appeal on because he has scanned the refusal letter to me this afternoon.. I'm still going through his appeal... and he would get a lawyer too...
That decision was unnecessary reason and it was actually base on personal opinion.

They French Embassy refused my friend's Tourist Visa Application O!
They told him to Appeal.
They gave him only 2 reason

(1) The Information submitted regarding the justification for the purpose and conditions of the intended stay was not reliable.

(2) Your intention to leave the territory of the member State before the expiry of the visa could not be ascertained

Now, he has met a lawyer and the appeal will be lodged tomorrow. But we never know how long the appeal normally takes to get the result of the appeal..
Still like a dream O!
If my friend submit all those documents to UK, UK will give him visa for real! grin

Markenny: am not trying to ague either , i just want to kwn from which year those laws was made.afar as i kwn,the german laws as for 2011 states that you are not allowed to be deported if you have have a child in german.with or with out resident permit.(ofcause on of the perent must have permit or eu citzen.)

It all went down at the afterparty of the Dynamix awards which took place at Voodoo lounge, Elegushi beach.
A reliable eye witness stated that B-Red was heavily Drunk and was arguing with the King when Davido move forward to touch the king,In a flash the monarch delivered a hot #Defjam on davido's Face and they were mercilessly beaten including Davido’s Bouncer by the Elegushi guards.

Davido & B-Red amidst Others later Prostrated & Apologized to King Saheed when they were Corrected by a member of the Crew.
