The prosecution will not succeed in the case because there was never an intention (mensrea) to commit the crime which is an important element to be proved in a criminal case.

Perhaps but that may not be the primary reason why she is sued. The aim may just be to frustrate the queen and deplete her of her time and resources for at least several years.

Another reason may be to watch her beg her way out of this saga while belittling her in the process and 'putting her in her place'.
