Even in US, he will need to prove the fact that he said he has always had his suspicion and he secretly sneaked in is not a premeditation to murder. What was he thinking he will do if he caught his wife? The cutlass used, was it already sharpened and kept with the purpose of committing murder? My dear, premeditation nails a murder case even in US.
