The supreme Court didn't say it had to be rounded off to 13. Supreme Court supported 12 not 13. And it was Awolowo that insisted 13 was the appropriate number of states to be won.
And after that particular judgement, supreme Court stated specifically that the judgement can't be sited as precedence.
I think that was necessary because they knew they were wrong to have supported 12 over 13. And it's reason Awolowo felt cheated.
