The government should try to make them reach a common ground. It is just like selling the same piece of land to two people. You either give one aggrieved party a different land that is equal in all aspect with the disputed land or is equally satisfying or you give both of them different lands or you refund. I think they won't want a refund since they stand a lot to gain from mining . Besides whoever is responsible should be reprimanded and this never be allowed to repeat itself. Potential investors are watching. Mynd44 Lalasticlala |

Military: report on attack on UN workers grossly misrepresented The United Nations on Monday warned that continued ambush of humanitarian workers by Boko Haram terrorists could affect UN intervention and assistance to the needy in the North-east, where there has been a resurgence of attacks and killings by the sect in the last two months. This came as the Nigerian Army denied that four UN staff had been killed and four trucks conveying food for internally displaced persons (IDPs) were carted away. Boko Haram terrorists were alleged to have attacked a convoy carrying UN humanitarian workers in Borno State. The rise in ambush of UN workers have sort of created a palpable air of unease between the Nigerian military and the UN in recent times. Speaking on the Borno State ambush, the UN Humanitarian Coordinator in Nigeria, Mr. Edward Kallon, deplored the deadly ambush on a convoy carrying humanitarian food supplies for conflict- affected persons on December 16. Kallon expressed great concern over the limitations that attacks of this nature may have on the delivery of life-saving supplies to people in need in North-east Nigeria. According to him, the by a non-state armed group took place on the road between Dikwa and Gamboru in Borno State, and resulted in the reported loss of at least four civilian lives as well as the destruction of basic aid items initially destined to alleviate the suffering of thousands of women, children and men. “Violence against convoys carrying humanitarian aid is unacceptable and can result in concerning limitations in our ability to provide life-saving relief to those who need it the most. “We must ensure the safety of aid workers and aid convoys across the North-east of Nigeria, so people in need of assistance can access it in a timely manner and in sufficient quantity. Many lives are at risk,” Kallon added. He stated that the United Nations and its partners operate in the north-east of Nigeria in order to provide life-saving assistance to 6.9 million people affected by the brutal conflict. Humanitarian operations are carried out following the four basic humanitarian principles of operational independence, humanity, impartiality and neutrality and should be respected as such. “Since January 2017, despite major challenges, humanitarian operations in north-east Nigeria have managed to assist over 5 million conflict- affected people in the states of Adamawa, Borno and Yobe, including three million with food security interventions, 936,000 with nutritional support, five million with health care assistance, and over 1.3 million with safe drinking water,” he observed. But the Deputy Director, Army Public Relations, Col Onyema Nwachukwu of the Theatre Command, Operation Lafiya Dole explained that “contrary to the information currently making the rounds in a section of the media that four United Nations staff had been killed and four trucks conveying food for internally displaced persons were carted away, the Theatre Command Operation Lafiya Dole wishes to state that the report grossly misrepresents the true situation of the incident as none of the casualties in the encounter has been identified as a staff of the UN. “In setting the record straight, it is necessary to state here that a patrol escorting a convoy of civilian vehicles to Logomani encountered an ambush staged by elements of Boko Haram insurgents at Maula village along Dikwa-Ngala trans sahara highway which resulted in a firefight between troops and the insurgents. “The troops however fought through the ambush, overpowered the insurgents and killed six of them. The troops also captured 3 AK 47 rifles, 3 locally fabricated fire arms, 4 magazines and a belt of 7.62 mm ammunition. “Sadly four persons died in the encounter. Although none of the persons killed in the ambush has so far been identified as a staff of the UN, this Headquarters considers the lives of all citizens and indeed all humans sacrosanct, which must be protected by troops even at a supreme price. “The situation has been brought under control and and further exploitation of the general area is currently being carried out by Mobile strike Team of Operation Lafiya Dole,” Nwachukwu stated. www.thisdaylive.com/index.php/2017/12/19/un-troops-give-different-account-on-borno-ambush/ Mynd44 lalasticlala |

Osucoward:All the points you mentioned wouldn't have mattered if not for proximity. Take nothing away from Ogun state and its leaders but let's call a spade a spade. |
Osucoward:What? There are a whole lot of variables in play. That would have been considered long before the MOU. Why do you think it wasn't grown in Lagos instead? Every state has their comparative advantage and we are talking welfare of Nigeria's most populous city, you can't be sentimental about that. |

Good idea but. . . Who carries out the drug test? Will the body be independent? Will it be self funded or will the same government still fund it? This would probably explain why a certain man from the SW believes in feeding the people's stomach daily than actually investing in that sector to make the people feed themselves and be gainfully employed. |
Osucoward:Not just agriculture, sir. But Agriculture goes a longer way in alleviating the grief and easing the pangs of inflation. If the people can afford cheaper food then it would mitigate the on going tensions. Besides, not every state is as geographically blessed as Ogun state to benefit from its proximity to Lagos. Then again, some states might be agro based and it can be enough. I also believe it is relatively cheaper and it creates employment too. |
Laments use of drug addicts as body guards by leaders …Afenifere, Osuntokun back Sanusi’s call …Senate working to tackle drug abuse menace — Saraki …N4.1bn drugs burnt in Kano; problem continues — Deputy Gov The Emir of Kano, Muhammadu Sanusi, has called for a law to compel Nigerian political and religious leaders, including lawmakers, governors and traditional rulers, to undertake drug test. According to him, leaders in the country condone the use of illegal substances by their bodyguards and thugs. Sanusi, who made the call at the opening of a two-day Senate Roundtable on Drug Abuse Epidemic in Nigeria, organised by the Senate in Kano yesterday, said he would be happy to subject himself to same test. He said: “I will be happy to subject myself to drug test. We deceive ourselves if we say we are not part of the problem. 90 per cent of issues that we have, flourish due to lack of political will. “Anybody who an element of drug abuse is found in him should quickly resign his position because he is not fit to hold public position.’’ He said it was hypocritical and amounted to mere talk for a governor or senator or any big political office holder, to speak against drug abuse in the society, while having highly drugged thugs as his body guards moving around freely. “Today, it is better to be a drug baron on the payroll of a political leader, than to be a legally recognised security man, which means we must clean our acts before trying to achieve anything. Drug addicts as body guards “Political leaders employ and support drug addicts as body guards, despite their unlimited access to established security agencies, both public and private.” He said he was “very ready and happy to be subjected to drugs test. And if I am found not worthy of being emir, I will quietly resign because the matter is bigger than what we are talking about.” The emir noted that several laws are in the books to fight drug abuse but lamented that they are not being implemented. He said: “If we are not implementing these laws in the books, what assurance do we have that new ones will be implemented? “The trade in illicit drugs is a protective trade, and we must ask, who are those involved in this? How many rehabilitation centres do we have? How well equipped are they ready for the challenges; how many capacity development centres do we have? I think we must answer these questions for us to make headway. ‘’Like I always say, if you don’t want to hear the truth, don’t invite me. Our major problem is that we are not implementing the laws we have for regulating drugs. ‘’We have guidelines on who is allowed to sell drugs and who to sell the drugs to, but we are not following these guidelines.” Senate to tackle menace — Saraki In his remarks at the roundtable, Senate President, Bukola Saraki, said the Senate is pushing for laws that will tackle the menace of drug abuse in the country because of its concern for the future of younger generations of Nigerians. Saraki, who noted that the National Assembly decided to take decisive actions against drug abuse in Nigeria through the roundtable, as part of moves to finally tackle the menace, said: “If we continue to be a society that ignores laws and do as we wish, we are not far from being a failed state. “But in the Senate, we are firm in ensuring that what is right is done to protect the nation. We want to see here before we finish the two-day roundtable in Kano that some pharmacies are closed down for violating the rules. Then we will know we are serious about it.” According to him, the main purpose of the roundtable is to send a message that there was hope in actualising a drug-free society. “There is no sense in calling agencies to fight drugs when we are not funding them. It doesn’t make sense. We must make a commitment that we are ready to do away with these problems. We should not be discouraged in the fight, as political leaders, we must have political will in the fight.” N4.1bn drugs burnt in Kano Deputy Governor of Kano State, Prof. Hafiz Abubakar, said drugs worth N4.1 billion had been confiscated and burnt in the state, while another seizure worth N1 billion had been made and the suspects arrested. Professor Abubakar said: “As you know, Kano has the largest share of all the challenges, considering our population and commercial base, but we have just one rehabilitation centre. “The government set up task force to track the drug abusers and arrests were made. Drugs worth N4.1 billion have already been destroyed, but I can tell you, this has little or no significant effect from what is on ground. So, we need federal government’s support.” It’s a good consideration — Afenifere Throwing its weight behind the Emir, the pan- Yoruba socio political organisation said it was a good consideration. Afenifere’s National Publicity Secretary, Mr Yinka Odumakin said: “It is a good consideration because most of the actions that our public office holders exhibit at times, we wonder if they are not under influence. I think it will be good for them to take such drug test and ensure that drug is not one of the things we would not be dealing with in those who are ruling us.” There’s logic to his concerns – Osuntokun On his part, Mr Akin Osuntokun , former Political Adviser to ex-President Olusegun Obasanjo said: “Well I don’t know whether the Emir has any specific reference in mind but given the ways and manners of a number of characters in public office there’s logic to his concerns. For instance it is next to impossible to fathom a reason to what is happening in Imo state. I’m almost certain that the governor is not a drug addict but there’s something unhinged about recent developments in that state. Look also at Donald Trump and his sparring partner in North Korea. The leading American psychiatric association has actually come out with a publication on the subject of the mental stability of President Trump.” Recall Vanguard report yesterday, in which the Senate had raised alarm three months ago on the floor of the Senate that the 19 Northern states of the federation are under serious threat due to drug abuse, stating that over three million bottles of codeine syrup are consumed daily in Kano and Jigawa states. It disclosed that across the 19 states, women, young girls in tertiary institutions, working class ladies, including married and unemployed women displaced by Boko Haram insurgency, among others, were involved in drug abuse, and that in 2015 alone, over 2,205 people were arrested in North-West geo- political zone by the National Drug Law Enforcement Agency, NDLEA, over drug-related abuses. Consequently, the Senate mandated its Joint Committee on Drugs and Narcotics and Health to investigate the growing misuse of cough and other prescriptive drugs abuse and report back to the Senate on the needed legislative interventions to combat the trend. The senators stressed that secondary school students consume cough syrups regularly. https://www.vanguardngr.com/2017/12/test-nigerian-leaders-drug-abuse-emir-sanusi/

A cash-call exit agreement between the Nigerian National Petroleum Corporation (NNPC) and Joint Ventures partners, the Federal Government has saved about $1.7billion. It will repay the Cash Call arrears of $5.1billion within five years. These facts are contained in a document titled “The new JV Self-Funding Model/ Cash Call Exit: Issues and implications”, which has been presented to the Federation Account Allocation Committee (FAAC) by the Nigerian National Petroleum Corporation (NNPC). A critical part of the document, which was obtained by our correspondent, borders on “Key Negotiated Terms” on the lingering JV Cash Call arrears. The terms were part of issues discussed at the November 21 session of the FAAC Post-Mortem Sub-Committee meeting. The key terms are as follows: “On JV Cash Call arrears, the full and final settlement of the arrears amount to $5.1billion which represents 75% of the reported arrears of $6.8billion. “The negotiated amount ($5.1billion) is inclusive of indigenous JV partners ($436.09m). The duration of repayment is five (5) years. “The $1.7billion reduction write-down will not qualify as a tax- deductible expense by the International Oil Companies JV partners for PPT determination. “No tax payable on arrears to be repaid. Receipt by the IOC JV partners of the repayment of Cash Call arrears of $5.1billion represents refund of advances made on behalf of NNPC and is not revenue to IOCs. Therefore, it is not subject to any tax, fee or levy.” It was also agreed that the “repayment source will be NNPC’s share of incremental production from JV activities after payment of royalties. “100% of PPT from incremental Crude Oil Production is payable to the Federal Inland Revenue Service (FIRS) after deduction of related cost of production and accumulated arrears.” On the 2016 JV Cash Call funding shortfall, the terms indicated that there will be “phased payment of the shortfall to manage impact on the foreign reserves. “The parties will set up a mechanism to ensure the remaining future approved 2016 JV Cash Call funding shortfalls are settled installmentally up to April 2018. The NNPC and its Joint Venture partners had on December 15, 2016 signed a cash-call exit agreement. The JV Partners are Shell, Total, Chevron, ExxonMobil, Nigeria Agip Oil Company (NAOC) and Oando. At the ceremony, the Minister of State for Petroleum Resources, Dr. Ibe Kachikwu, said with the agreement, the Upstream petroleum sector will soon be upbeat in a flurry of activities. ”This event is significant because it has taken us to a point where we can compete with our colleagues all over world. “We have dealt with the downstream, and this is probably the most important item in the upstream and that is obvious we will begin to go into the policy measures and infrastructural development and the rest after the signing ceremony,” he said. The Group Managing Director of NNPC GMD, Dr. Maikanti Baru, said the exit cash call agreements comprised three components which are: the process of settling the pre-2016 cash call areas; the process of sustaining the cash call payment from 2017; and agreement and settlement over performance in 2016. NNPC, through its General Manager, Group Public Affairs Division, Mr. Nu Ughamadu, had said: “Under the new arrangement the entire NNPC equity Oil and gas revenues are now to be paid directly into the Federation Account. “Hitherto, competition from other appropriated items of expenditure in the Federal Government’s budget has always limited the deduction of technical cost required to fund the cash calls on monthly basis. “It is expected that execution of this agreement would end the long standing cash call challenges that have impacted the Nigerian oil and gas industry over the years. “With this arrangement, the Federal Government will continue to receive royalties, taxies and profit from its equity share of JV oil and gas production while the cost of operation is deducted upfront. “The agreement provides that the outstanding cash call arrears will be repaid within a period of five years through incremental production revenues without impacting the established based production revenue.” http//:thenationonlineng.net/fed-govt-saves-1-7b-jv-cash-call-arrears/

If only states can toe the path of Lagos (the least Allocation dependent state) by engaging in agricultural activities. Gradually, the policies from the top are spiralling down to the bottom. The sad thing is people need money in their pockets to enjoy this and our state governors are not helping by not paying salaries. Rice is cheaper here in Benue but it is a "Civil Servant dominated" state: Few monies chasing these goods. I hope Fayose can learn what stomach infrastructure truly is . |

Chairman of the Presidential Advisory Committee on Anti-Corruption, PACAC, Prof Itse Sagay, SAN, has said he never supported the extradition of former governor of Bayelsa State, late Diepreye Alamieyeseigha from the United Kingdom. In a statement he entitled, “My relationship with the late Diepreye Alamieyeseigha, former governor of Bayelsa State”, Prof. Sagay described the report as, “wicked and malicious lie, cooked up by some opportunists.” He said, “I wish to correct the false allegation made against me with regard to former Governor Alamieyeseigha, namely that I supported his being extradited to the U.K because it goes to my character, an attribute which I regard as fundamental. “I was involved in Alamieyeseigha’s matter on two related areas, namely, (i) his illegal and gangster like removal from the office of Governor and (2) whether he was entitled to immunity outside Nigeria as Governor of a State in Nigeria. “I was never involved in his trial for economic and financial crimes as alleged. So the question of defending him for corruption does not arise. That was a criminal case handled by other lawyers, which I do not even remember. “Given my firm view that the former Governor was entitled to immunity outside Nigeria and that he was illegally removed from office, I could not, in anyone’s wildest imagination, have supported his being extradited to London for trial. “In any case, he had already been tried and sentenced to imprisonment in Nigeria, and was entitled to plead “autrefoi convict” (previously convicted) as provided in Section 36(9) of the Constitution, which prohibits double conviction for the same offence. Until his sad passing away, I remained loyal as his former lawyer, to the former Governor. “Indeed, a few days to his passing away, I got a text message from him that he was coming to see me in Lagos. Sadly, that was never to be. The false and vindictive accusation that I called for his extradition to the U.K. is a wicked and malicious lie, cooked up by some opportunists, who just wanted to tarnish my image.” http://dailypost.ng/2017/10/12/prof-sagay-reveals-relationship-former-gov-bayelsa-late-alamieyeseigha/

MYNATION NEWS – T his is really coming from the Igbo for Nigeria Movement, INM, the group has faulted the reports in some quarters that the suspected cases of MonkeyPox recorded in some states were caused by the Medical Outreach of Operation Python Dance II by the Nigerian Army. According to report, rumour had it that the soldiers were in Anambra to inject children with vaccines as had allegedly been done in Bayelsa State with the hope of infecting them with the disease. The reports created panic in the entire Igboland as parents and guardians besieged schools to forcefully evacuate their children and wards. Reacting to the development, INM, said the circulation of the rumour had portrayed Ndigbo as unthinking and shallow-minded people. Addressing newsmen on Tuesday on the report, national president of INM, Mazi Ifeanyi Igwe, observed that the fact on ground showed that the larger population of the southeast are law abiding and have very cordial relationship with the military and all security agencies in Nigeria, including the Nigerian Army, adding that only those with criminal intent need to fear for their illicit activities, which the Army has thwarted. He said, “We want to appeal to Ndigbo to decisively deal with the IPOB problem as it has been established that this criminal lies emanated from the terror group. Even as the damage is unfolding, Emma Powerful, the supposed spokesperson of IPOB continues to make inflammatory remarks, which were sadly reported by some mainstream media that ignored the fact that his group is a designated terror organization. “Unfortunately, IPOB is laying the ground works to kill and destroy more Igbo people than any security agency could have ever done even if they had mounted a coordinated genocidal campaign against the southeast geo-political zone. This is a concern that is backed up by logic: “The IPOB lies has practically shut down schools. Emma Powerful asked teachers and pupils to stay at home until Operation Python Dance II leaves the southeast. This is going to disrupt education calendar in Igbo areas and this will leave our students at disadvantage since the other parts of the country would not pause their calendar for the southeast. Since Operation Python Dance is now poised to be an annual event are we going to be shutting down our school every year while other regions make progress? “Should Monkey Pox evolve into an epidemic that requires mass vaccination the lies and rumours that have spread like wildfire will prevent people from accepting life saving inoculations and treatment. This could cause casualty on a catastrophic scale. Let us be reminded that some parts of the country only a few weeks ago have to get vaccinated for cholera. The vaccines were shipped and conveyed by people in the South that included Igbo yet persons of northern ethnicities that received the vaccines did not wrongly accuse or fear the Igbo even at a time IPOB’s hate speech was at its vilest. The lies have set up our people to die needlessly should there be a national health emergency. “While IPOB’s lies may serve its immediate propaganda goal, it will create a new generation of vaccine deniers in the long term. We only need to take a cue from the impact of the anti-vaccines movements in the United States; they rely on the kind of rumours being spread in Nigeria now to push their agenda but the impact of the follies is being felt by way of resurfacing of diseases that the US had once eradicate while children are dying needlessly. Unless something is urgently done we are at risk of babies dying while those that survive would do so with the ravages of diseases like polio that vaccines could have easily dealt with. We will also bear the burden of staring afresh to roll back any eradicated disease that resurfaces as a result. “If our Hausa-Fulani brothers or any other ethnic group for that matter are resolute on decimating the Igbo as Emma Powerful is lying they will easily achieve that by tampering with our food sources since Nigeria’s food chain is heavily interconnected. The southeast does not produce all the meat, fish, grains and tubers it consumes and these are items that can be tampered with or bio engineered to deliver pestilence. It is therefore unkind to accuse others of what we are incapable of,” he added. Igwe called on state and federal governments to take immediate steps to stop further propagation of the lies by getting legal interpretation on IPoB’s continuing capacity to issue statements as an already- labeled terror group. He added, “The court order that designated IPoB as a terror group also outlawed its activities which leaves us at a loss of why a terrorist under the name of Emma Powerful continues to freely operate with the group’s name without being arrested. He should be immediately arrested.” http://mynationnews.com/2017/10/12/monkeypox-igbo-group-cry-out-says-monkeypox-another-wicked-plot-to-set-our-people-against-nigerian-army/

Activist-lawyer Femi Falana (SAN) has said that the defence of the Group Managing Director (GMD), Dr. Maikanti Baru, that he has powers to award contracts to the exclusion of the Minister of State in the Ministry of Petroleum Resources and the board of the Nigerian National Petroleum Corporation (NNPC) is illegal and violates the NNPC Act. Falana contended that the defence of Dr. Baru failed to recognise of the provision of Section 6 (c) of the NNPC Act, which has vested the Board of the NNPC with the exclusive power to”enter into contracts or partnerships with any company, firm or person which in the opinion of the Corporation will facilitate the discharge of the said duties under this Act.” Falana stated this in a statement issued in Lagos yesterday titled, “NNPC operates outside the law” in reaction to the on-going face-off between the minister and the GMD of the corporation, Dr. Maikanti Baru over the unilateral award of $25 billion contracts by the latter. The lawyer also noted that Dr. Baru failed to respond to the unilateral appointments of key staff in the NNPC without the approval of the Board of Directors, pointing out that since this particular allegation was not denied, it is reasonable to conclude that it is admitted by the NNPC management, even though the appointments in question were made in utter violation of the Federal Character Commission Act. Notwithstanding the report that the Presidency has thrown its weight behind the NNPC GMD in the face-off with the Minster, Falana stressed the need to review the matter within the ambit of the law. On the management of the NNPC and contract awards, Falana said: “For the avoidance of doubt, Section 1 (2) of the NNPC Act states that the affairs of the Corporation shall be conducted by the Board of Directors of the Corporation. Since it is conceded by Dr. Baru that some contracts are subject to the approval of either the Board or the Federal Executive Council, he is yet to inform the Nigerian people who approved the $25 billion contracts. “It is pertinent to state, without any fear of contradiction, that by virtue of Section 3 of the NNPC Act, the GMD as the chief executive of the Corporation, shall be responsible for the execution of the policy of the Corporation and the day to day running of the Corporation’s activities and its associated services. But, contrary to the erroneous impression conveyed by the management of the NNPC, there is no conflict whatsoever between the provisions of the NNPC Act and the Public Procurement Act, 2007 to justify the usurpation of the powers of the NNPC Board by the Tenders Board of the NNPC headed by the GMD. Therefore, the unilateral award of multi-billion dollar contracts in the NNPC by Dr. Baru or the Tenders Board is illegal, null and void in every material particular. “With respect, the totality of Dr. Baru’s defence was anchored on the mistaken belief that the NNPC Act does not require him to report to the Minister of State but to President Buhari in his capacity as the Minister of Petroleum Resources. “Dr. Baru must have forgotten that upon the removal of Dr. Kachikwu as the NNPC GMD in 2016, the President appointed him as the Chairman of the reconstituted Board of the NNPC in line with Section 3 of the NNPC Act. Therefore, the decision of Dr. Baru to by-pass the Chairman of the Board in the award of the contracts and appointment of NNPC staff cannot be justified either under the NNPC Act.” Falana contended that “since Dr. Kachukwu was not removed as the Chairman of the Board, the President ought not to have encouraged Dr. Baru to treat him with such pompous disdain and arrogance”. He argued that the impression given by Dr Baru that once the President was briefed with respect to the award of the contracts, that due process had been observed in the award of the $25 billion contracts in line with the PPA was misleading. He maintained that such a position was neither backed by the NNPC Act nor the PPA. He said the competent authorities that have the final say in the award of contracts and disposal of public assets under the current political dispensation are the Bureau of Public Procurement (BPP) and the National Council of Public Procurement (NCPP). “The NCPP is not chaired by the President, but by the Minister of Finance. The other members of the NCPP include some officials of the Federal Government and representatives of relevant professional bodies and civil society organisations. “Apart from constituting the NCPP and the BPP the President has not been empowered to approve any contract whatsoever. In fact, there is no reference whatsoever to the Federal Executive Council in the entirety of 61 sections of the PPA. To that extent, the FEC presided over by the President cannot approve the award of contracts which is the exclusive duty of the NCPP and BPP. “Although the PPA was enacted in 2007, the President or the Federal Executive Council (FEC) has been approving multi-billion dollar or naira contracts, albeit illegally. The activist lamented that the Buhari administration, which has loudly undertaken to fight corruption, has ignored calls from many civil society organisations to set up the NCPP. He said since neither the President nor the Federal Executive Council was competent to approve the award of contracts under the PPA the claim of the NNPC GMD that the controversial contracts were approved by the President could not be justified under the PPA. To avoid a situation whereby the $25 billion contracts and others being awarded by the Buhari administration are annulled and set aside on the grounds that they were awarded by either the President or the FEC without any legal authority, Falana counseled President Buhari to constitute the NCPP without any further delay. “If this call is ignored, once again, the civil society anti-corruption bodies ought to approach the Federal High Court for a writ of mandamus to compel the President to inaugurate the NCPP,” he said. He also noted that apart from breaching the NNPC Act and PPA, the NNPC had conveniently ignored the National Extractive Industries Transparency Initiative Act and had refused to comply with the directive of the NEITI to remit $21.7 billion and N376 billion illegally withheld from the Federation Account. Though Dr. Kachukwu recently disclosed that the nation had lost $60 billion due, he noted that the NNPC has refused to recover same by implementing the provisions of the Deep Offshore and Inland Basin Production Sharing Contracts Act and instead of directing the NNPC to recover and remit the huge fund to the Federation Account, the Federal Government was busy piling up external loans. He also noted that the NNPC does not subject its budgets to the National Assembly for appropriation as stipulated by the Constitution and the Fiscal Responsibility Act. H recalled that shortly before proceeding on its annual vacation, the Senate disclosed that the NNPC and 33 other agencies of the Federal Government had failed to submit their 2017 budget to the National Assembly but that the NNPC management ignored the disclosure knowing that the Senate would not pursue the matter. Falana contended that Dr.Ibe Kachukwu owed it a duty to the country to react to the allegation of the management of the Nigerian National Petroleum Corporation (NNPC) that he engaged in the unilateral award of multibillion dollar contracts during his tenure as Group Managing Director (GMD). He remarked that even if the allegation of the NNPC GMD against the minister is true, it cannot justify what he described as the reckless impunity that has characterized the management of the affairs of the NNPC since 1999. He contended however that the allegations and counter-allegations of Dr. Kachukwu and Dr. Baru over contract awards had reinforced his earlier call on President Muhammadu Buhari to relinquish the post of the Minister of Petroleum Resources and appoint a full-fledged minister to run and coordinate the affairs on the oil and gas industry in strict compliance with the law. He said the board of the NNPC should be reconstituted by reducing its present membership from nine to six persons as provided for by Section 1(2) of the NNPC Act. http//:thenationonlineng.net/award-25-billion-contracts-baru-violated-nnpc-act-says-falana/
