Imagine if Dangote agree, then the judge has nothing to rule again left. Now the proof of otherwise will be brought by Dangote as i am sure you are not his son , and ofcourse he has a proof against you which will be weightier than what you have stated in affidavit.
Here, in Fubara and Amewhule case, Fubara has no opposition against Amewhule claim as it is actually what he alleged in the first place. If anything, he will add more items to substantiate Fubara's oath.
If Fubara were to be the person who swore the affidavit, then Amewhule will present the Evidences against his claim which will likely be weightier and will cause him to win and penalty could be given to Fubara for trying to mislead the court.
Accuser has nothing to prove if the defendant agree to the accusations. Tell me, would you as a Judge tell, Fubara to prove that Amewhule defected if Amewhule himself accepted under an oath that he defected? I mean, are you gonna turn logic on its head?
