I actually thought this same argument canvassed by some lawyers and the PDP itself was just a propaganda tool and the party trying to blackmail the electoral empire.
But now that Iwu has clearly stated its antecedents and the only constitutional provisions it should apply,its clear that Adeleke should have been declared the winner.
Its a tricky situation now.
If PDP loses after participating in the re-run,it has shot itself in the foot,legally.
I feel PDP should heard to court to stop the rerun and compel INEC to declare Adeleke the winner of the election already.

A former chairman of the Independent National Electoral Commission (INEC), Prof. Maurice Iwu, has faulted the declaration of the Osun governorship election that held on September 22 as inconclusive.
Iwu, who was in office from June 2005 to April 2010, spoke on Sunday following the declaration of the guber poll as inconclusive due to vote difference by the Chief Returning Officer, Prof. Joseph Afuwape.

According to the former INEC boss, “Actually, in 2010 during the review of INEC’s Elections’ Manual, my committee and I as the chair, invented the inconclusive elections outcomes, particularly where elections did not hold for one reason or the other.

“However, we the initiators of the inconclusive elections realised that our proposal was against the provisions of the 1999 Constitution (as Amended), particularly the presidential and the governorship elections and returns.

“Our proposals could be applied only in senatorial, House of Representatives, and state assembly elections and returns, for which the Constitution did not specify how these returns should be made.

“In this, what is required by the Constitution is that the ‘first past the post’ and/or that the candidate must have the polled majority of the votes cast.

“Secondly, that the candidate in addition to it, must obtain 25 per cent of the total votes cast in two-third of the LGAs of the state in question or of the states in case of presidential election. The electoral act or INEC guidelines cannot supersede the constitutional provisions for that purpose.

“As the constitution has clearly spelt out the manner and how a return should be made in the cases of governorship or presidential election returns.

“Now that the abuse of this tool is becoming obvious, the beneficiaries of this anomaly have refused to listen or adjust accordingly.

“God will surely help us.”

Politicians and political leaders, groups and group leaders, stakeholders in the development of our state and our nation, fellow indigenes of Sokoto State and citizens of our great country, members of the press, ladies and gentlemen.
It is with gratitude to Almighty Allah, our Sustainer that I address you on a matter of great importance to our nation at this auspicious moment in our political history. I stand before you with a heavy heart, wishing I had cheery words of progress, instead of the sad report that I am constrained to give you on the situation of our dear nation.
2. The struggle for democracy is one that began with our fight for independence as a sovereign nation. To this end, the blood, freedom and other liberties of our past heroes and contemporary veterans were sacrificed. The current dispensation began in 1999, as the watershed of our toil, which granted to us a democratic system that is striving to evolve and survive.
3. Through those years the forces of genuine change gravitated and by 2015, merged to ensure a transition of power that Nigerians hoped would herald a new order of true democracy under an atmosphere of justice, peace, equity and the rule of law. The leaders of that coalition represented and symbolized the aspiration of Nigerians for progress and prosperity under one united, indivisible nation.
4. As the speaker of the House of Representatives then, I left my comfort zone to be involved in the struggle for the enthronement of purposeful leadership for the citizens of our dear country.

6. Now, almost four years into what ought to be a new order as desired and elected by Nigerians, the nation is unfortunately going through the most difficult and precarious times, since the Civil war; with ethno, religious and regional distrust at its highest ebb.

7. This development had often been blamed on political opponents. Meanwhile, there are issues of brazen inequity and capacity and questionable distribution of appointments/projects. This is in addition to lack of statesmanship in responding to national issues, among other things that are for aggravating the anomaly.

8. In line with the best traditions in any major political decision, especially by a serving elected Governor, I have painstakingly consulted far and wide, on whether the present political platform is a viable vehicle for achieving the aspiration of our people.

9. It is because I am convinced that no nation can thrive while there is inequity and bad governance; because I am saddened by the fact that lethargy, incompetence and sustained denial of obvious leadership missteps have become the major raw materials with which the Nigerian State is being run today; because I am unwilling to be part of frightful conspiracy against the cohesion of the Nigerian State, Nigerian youths and peoples; because I am unable to feel at ease in the face of a progressively divided nation and, above all, because I am totally unable to reconcile myself to a national leadership that offers no redeeming moral beacons that I am here with you today; to announce withdrawal of my membership of the All Progressives Congress and return to the People’s Democratic Party.

10. I speak to you today with a mixture of sadness and relief because I did not expect that the APC, which promised so much when the People’s Democratic party (PDP) stood under the sway of impunity, could not maintain or manage whatever good it inherited. It has also not broken new grounds in any positive sense, but has instead reached historically unprecedented heights of impunity in all manner of vices far above and beyond the challenges which made some of us to leave the PDP about four years ago to join others to form the APC. The party has brazenly turned itself into a sanctuary for the corrupt and a machine for rigging and for the rape of democracy.

11. Let me also put it on record that all attempts to discuss the electoral promises of the APC-led government, including the restructuring of the country as promised Nigerians and as contained in the APC manifesto, have proved abortive.

12. Beyond that, I cannot look those who elected me as their Governor here in Sokoto State in the face and boldly point to any meaningful Federal Projects initiated in the state under the APC government. Even the bulk of uncompleted Federal Projects here that were inherited from the previous administration have largely remained in their state of neglect. Sokoto State is also not being meaningfully carried along in political appointments and in other matters of national importance.

13. Like most states of the North, and indeed the entire federation, elders and traditional institutions have come under measured disrespect. The recent attack in Tabinnii in Rabah LGA of Sokoto State, the routine invasion of Zamfara State by armed bandits, the now-regular killing of policemen by unknown gun men all over the country, the regular massacre of innocent people in the North East axis and many similar daily incidents, do not attract much attention any more.

14. Good governance, viz-a-viz economic wellbeing of our people, remains the major reason for my action of today. Information from National Bureau of Statistics (NBS) shows that over nine million jobs have been lost in the last 3 years, since the APC Government came into office. While youth unemployment rate was 11.70 per cent during the fourth quarter of 2014, it rose to 33.10 per cent in third quarter of 2017 under the APC Government. The economy is not showing any real signs of improvement. Our educational and health institutions are in retreat. Poverty is on rampage and still ravages the land. It is unacceptable that majority of those who voted for APC in 2015 should have nothing good to show for it.

15. As in the past, it is only my interest in equity, the wellbeing of Nigerians and a befitting future for our teeming youths, national unity and economic prosperity that has led to my new locus in Nigerian politics today. We all have a duty to do our best, while nudging our political parties to progressively align political contests in Nigeria along clear ideological lines; such that sooner rather than later the aspirations and the will of our people will be the only determinant of election outcomes.

16. Let me at this juncture state emphatically that I return to the PDP with a clear conscience today, because the party has learnt some bitter lessons and noted what mistakes it must avoid in the future. It is now a repositioned and forward looking political party to which I now pledge loyalty, in my resolve to contribute towards improving the lives of Nigerians and expanding opportunities for the youths. It is only by working together as agents of development that we can promote excellence, competence, good governance and enthronement of genuine democracy to save Nigeria.

17. I thank you for your understanding, support, prayers and your continued faith in the Nigerian Project. May Almighty Allah guide and protect us.

I had a girl working for me years ago in Kaduna. H had a lot of male friends who were always gathering at my kiosk. The girl's numerous friends always came to patronize me. The friends of her friends also came to patronize me. My kiosk was more than a business hub; a Mecca of some sort.

I was happy because my business was doing great. If I bought rolls of recharge cards, they would be exhausted before nightfall.
.
One day, a woman who had a shop in the neighborhood surreptitiously summoned me.
.
"Put an eye on that your girl. I think she is stealing from you." The woman said.
.
I thanked her and left.
.
That evening, I took all our books home and went through them but I found nothing incriminating.
.
We were okay profit-wise. If there was fraud as the woman had alleged, my girl deserved to be applauded because there was no trace of it in the books.
.
However, two things occupied my mind; the thought of making more money if I had a more trusted person on the saddle and the curiosity of a feline kitten. I wanted to catch her red handed.
.
A week later, a young man came to see me. "Bros, sack that your girl." He fired emphatically. "She too dey follow boys."
.
I told him the girl's personal life had got nothing to do with my business.
.
"But na your name dey girl dey spoil na. People will be talking that na ashawo dey work for you."
.
I thought about it but I refused to fire H.
.
Then came the red handed day! A man came to buy glo recharge card of five hundred naira. She sold the card in my presence but when I looked in the books later, it was not captured in it.
.
I was flabbergasted. So it was true! Judgement day had come finally.
.
I confronted her the next day and discovered that she indeed faulted. However, she actually did not steal from me. She sold her own card.
.
"You mean you bring your own recharge cards here to sell?" I thundered truculently. Then, I uttered the dreaded words; "You are fired!"
.
Quietly, she left without putting a word of scorn against me.
.
Someone introduced T to me; a humble girl whom everyone trusted. "She will not steal from you." I was told.
.
Dry, cold and snaky; T was. All my customers left one by one. She was hostile. She was never going to cross the road like H and get change for customers. Better she didn't sell than for her to go about looking for change. All that she cared about was her salary. Some customers said she was rude.
.
Soon, this disposition began to tell on the business negatively. My money was never missing but business became terrible for me. I was now borrowing to pay her.
.
One day I rode past a street around my area and found H in a kiosk. She was now with another. There were lots of people around her and there was good life there.
Deep inside me, I wished I hadn't fired her but I could not say it for fear of being labeled a bad business man.
.
Miserably, I hid my face and went back to my kiosk where I found T as usual dozing on the chair. I didn't need anyone to tell me that I'd failed. A week later, I sold everything and closed shop.
.
These things happen all the time to us. A good business man will never fire a productive staff but the Adamic nature of man which makes him insatiable will always make him think lime was better than orange. And until he had tasted lime which he does not have, he would forever think orange was the worst among all the fruits.
.
If this scenario plays out in my next life, who would you advise I hire; H or T?
.

The Confederation Africaine De Football has appointed the embattled NFF President, Amaju Pinnick, the 1st Vice President of CAF.
According to the letter available to TheCapitalng,
“Following the resignation of the 1st Vice President Mr. Kwesi NYANTAKYI, CAF President, after consulting the members of the Emergency Committee, appointed Mr. Amaju Melvin Pinnick as 1st Vice President.
The decision is immediately applicable, in accordance with article 27 para. 2 of the statutes, which will be ratified by the Executive Committee in its session scheduled on the 27 and 28 of September 2018.

A Nigerian Twitter user identified as Chris Nnatu (@chrisnnatu), has taken to the social networking platform to reveal how his friend was given a slap by a woman at an ATM queue.
According to Chris’ friend, a light argument had started after the woman came to the queue and insisted that she was there before him, and a few minutes later, she landed him a slap.
And to test her, he dared her to slap him again, and she did just that. But being a good guy that he is, he just stood for minutes, flashed back at his mom, sister, cousin, girlfriend and just walk away.

The failed recall of Senator Dino Melaye on Saturday provides an opportunity for lessons to be drawn from the implementation of the recall constitutional provisions. Out of 189,870 signatories to the petition for Melaye’s recall, only 18,742 were verified by the Independent National Electoral Commission. This is a paltry 5.34 per cent of the total number of registered voters in the senatorial district and therefore did not satisfy the requirement of the law demanding a simple majority of the signatures of voters registered to vote in the constituency.
The Constitution of the Federal Republic of Nigeria 1999 in Section 69 provides for the recall of senators and members of the House of Representatives. It requires that a petition signed by more than one half of the persons registered to vote in the member’s constituency alleging that they have lost confidence in that member be presented to the chairman of the Independent National Electoral Commission. Thereafter, the petition is subjected to a referendum conducted by INEC and if it is approved by a simple majority of voters registered in that member’s constituency, the member stands recalled. In between the presentation of the petition and referendum, a verification of the signatures of the petitioners is conducted by INEC. For the verification to succeed, 50 per cent plus one of the registered voters in the constituency need to be verified.
The provision for recall of legislators is based on the sovereignty of the people affirmed in Section 14 (2) (a) of the Constitution to wit; that sovereignty belongs to the people of Nigeria from whom government through the constitution derives all its powers and authority. It is about the right of the people to change their mind on the mandate they gave to a representative, midway into a legislative term. It is democratic and tallies with the right of the people to choose their representatives. The Constitution is the supreme law of the land. In the secular world, it is the equivalent of the holy book in the great religions. Every other law derives its validity through compliance with the foundational principles and philosophy of the constitution and any law in conflict or inconsistent with it is void to the extent of its inconsistency. Provisions of such a foundational law are not to be invoked for mere atavism or just to prove an empty political point to a political opponent.
Media reports monitored last Saturday indicated that there was a very low turnout and the constituents were not in any mood to recall their senator. They were also unaware of the sins of Melaye that would have led to the commencement of the recall process. They constituents simply stayed away and went about their normal routine business. Again, the media reported “fictitious and forged signatures and names of dead persons affixed to the recall petition by its promoters”. The constitution does not anticipate or provide that signatures would be forged or the names of dead persons be inserted in a petition to recall a serving senator. It is imperative to state that forgery is a criminal offence for which the offenders should face stiff penalties and sanction. It is the expectation that the police and INEC should proceed with the same rigour and vigour with which they moved to recall the senator and go after the culprits and bring them to book.
The constitution anticipates a good faith process based on honesty of purpose. For constituents to lose confidence in a legislator, there must have been some misdeeds or offences committed by the legislator. Maybe, they mismanaged constituency project money and converted the same to their personal use. Or they have committed a grievous offence known to the law. Alternatively, they sleep in the chambers of the Senate and fail to bring up issues of importance to the constituency in the Senate. Also, the member has been docile without sponsoring appropriate bills and motions. None of these could be attributed to Dino Melaye in his representation of his people. I do not want to believe that people can make up their mind to recall a legislator for the fun of it to justify the number of petitioners who started the process. Alternatively, could it be argued that about 95 per cent of the persons who signed up for Melaye’s recall changed their mind? That would be magical and so drastic and would not have been the case in the logical and natural sequence of human action. It is a very remote probability.
The fact that those who perpetrated the forgery made the federal treasury to spend hundreds of millions of naira which should have otherwise been used to solve life and death challenges facing the nation makes the case for their prosecution more compelling. Our hospitals and schools are run down and need so much in resources to rehabilitate and our government states that the money is not available. Yet, some little minds on an ego trip decided to make Nigeria go through this punishing fiscal schedule. Yes, money must have been spent to defend the litigation from the Federal High Court to the Court of Appeal, pay the personnel that went to the field, and the logistics for the exercise, etc.
There must be a limit to the misuse of executive and state power to prove a point which has nothing to do with the interest of the people. Recalling a senator is not a tea party.
Due to the way the Melaye recall had gone initially, it encouraged some level of rascality leading to some persons in Senator Ennyinna Abaribe’s constituency in Abia to allegedly start the noise of his recall process. According to media reports, part of his sin is that he “insults” President Muhammadu Buhari in his contributions in the Senate. This is so trivial and if we do not learn lessons, it could start the process of a journey to nowhere that would waste public funds.
Let it be known that this discourse is not against the provisions of the constitution or the idea of recalling legislators. But the message is that recalls should be based on empirical evidence, good reasons and honesty of purpose. It should not be an opportunity to settle political scores or to flex muscles to show an opponent that you can lord it over them.
Let this serve as a deterrent to those who want to rig the system through forgery, so as to ensure that in future, no one will try to game the system in future.

Dr. Sid might not be supremely active in the entertainment scene but he is still one of the more recognizable faces of Nigerian music, so you can imagine how surprising it was when he was reportedly stopped by officials of SARS and harassed.
According to eyewitness reports, the singer was driving in Lekki when he was stopped by SARS officers who asked him to park and then proceeded to search his phone.
He was presumed to be a Yahoo boy and when his phone produced no evidence, they decided to seize it. The basis for their suspicion? He was on dreads.
It took the intervention of fellow label mate, Reekado Banks and comedian Basketmouth who happened to be driving by at the time before he was released by the law enforcement agents.
According to Ogunleye Olaide, an eyewitness, he said the following;
In *Lasisi Elena’s voice * something just happened now . Sars operatives stopped a random vehicle on freedom way ,Lekki Phase 1,thinking the driver was a yahoo boy, after routine check , they found nothing implicating , and resorted to seizing the phone of the driver.

When the news of the hack first broke out and was eventually confirmed by Philip via tweet, I was of the opinion that APC as a party should not only doll out millions of naira monthly to a faceless Buhari Media centre but should be bold enough to create new social media handles, got them verified and work on establishing a good social media frontier that will not just promote their program and propaganda but will also connect them with the digital realities of our World.

It is very important to point out that this is commendable but it is only the beginning.
I am worried about our tomorrow, while, we at least pray and expect that the APC will use their new handles to promote social goods, i feel that Philip Obin and the @APCnigeria issue was not well handled by the leadership of the party.
So the problem of APC is actually the APC. I pray the APC and indeed other corporate organization will learn one lesson or two from the controversy, creativity must be rewarded and we should note that loyalty is not a person but a process, it can change depending on so many factors.
Hacking is very possible, but these five ways will help you to overcome it.
1. Beware of public WiFi, It’s so dangerous.
2. Turn off your WiFi when you are not using it
3. Change your passwords frequently
4. Always check permissions on apps before installing and make sure they aren’t accessing unnecessary information. if you don’t trust an app, don’t install it.
5. After using a public WiFi, make sure you click forget the network after you finish using it.

As Big Brother Naija 2018 nears its conclusion, Cee-C, the most controversial contestant on the show this season, is starting to feel an emotional vacuum.
After the eviction of Khloe, Anto and Lolu on Sunday, there are five housemates left on the show; Miracle, Nina, Cee-C, Tobi and Alex.
Miracle and Nina are an item while Tobi and Alex are close friends.
Together, the four of them are chatting buddies, leaving Cee-C alone, without a friend, companion or confidante for the home stretch of the show.
The reality show star whose real name is Cynthia Nwadiora is starting to feel the effect of being ‘left alone’.
On Monday, while the other housemates were cozying up in pairs, she was on her own — doing laundry and fighting back tears.
For a few seconds, Cee-C pressed a cloth to her face to muffle her tears.
Earlier, she had prayed for strength to get through the “tough week”.
She had said: “It’s going to be a very tough week. Staying strong, trying to complete what I started. I need all the strength that I can get for this week. See who’s playing a victim. What a life?
Meanwhile, Nina has been chosen as the final head of the house. The selection was done through a vote by the housemates.
Nina was chosen by Tobi and Alex, while Miracle and Nina picked Cee-C.
However, Tobi and Alex objected Cee-C’s selection, saying she was impatient and troublesome.
The five remaining housemates are on course to win the N45m grand prize on Sunday.

Doyin Okupe, a former aide to ex-President Goodluck Jonathan has made what he called 15 revelations about the Second Niger Bridge.

In a message he entitled “GEJ, Buhari & The People,” Okupe wrote:

[1] The Bridge is NOT Being Constructed by the FGN.

[2] It’s a PPP Project which the FGN contributes a tiny fraction.

[3] The 2nd Niger Bridge Will Cost about N117 billion.

[4] Started in 2013 and should have been completed in 2017, but worked stopped for 31 months. Completion date Not certain now.

[5] FGN share of the Cost is N30billion. Jonathan through the Sure-P paid N21.2billion (71%) including N7billion for the completion of preparatory work (Phase 1).

[6] 38% of the work has been done as at Jan 2015.

[7] The N140b Oshiomhole said was wasted on Admin cost on the bridge was a lie, as admin cost will not be higher the to cost of the whole project.

[8] Buhari’s Govt Paid N2billion NOT $2billion as Osinbajo said during the Anambra state election. They will be paying another N3.05 when 2018 budget is approved.

[9] Work has restarted in earnest at the site and about 5%-7% has been completed bring the total completed work to about 43% to 45% according to an engineer I spoke to.

[10] All the pictures flying all over the internet are pictures of work-in-progress made during the 1st quarter of 2015.

[11] In summary Jonathan Govt have paid 71% of FGN share of the cost, While Buhari’s govt has paid 6.1%.

[12] Julius Berger, the Major Contractor and Construction company will put Toll Gate on Completion of the Bridge to cover their cost.

[13] The Construction Company is Funding the Project and the People using the Bridge will bear the cost via Toll Charges.

[14] The real People building the Bride are Nigerians that will use the Bridge, as they will REPAY the cost to Julius Berger.

APC senator has taken a swipe at President Muhammadu Buhari for failing to protect Dapchi schoolgirls from terrorists’ abduction after criticizing ex-President Goodluck Jonathan over Chibok schoolgirls kidnapping.
Sani, who represents Kaduna Central senatorial district, said this after President Buhari bragged about responding better than Jonathan in the schoolgirls’ abductions by Boko Haram insurgents.

Buhari had said, “The federal government’s response to the unfortunate abduction of the schoolgirls is a clear departure from the insensitivity of the past administration which looked the other way while the Chibok girls were taken away in 2014 and held in captivity for over three years,” he said.
“Due to our commitment, over 100 Chibok girls have been rescued and reunited with their families, sent back to school and empowered with requisite skills,” the president said during a townhall meeting in Damaturu, Yobe state, on Wednesday.
Reacting via his official twitter handle on Thursday, however, Senator Sani described President Buhari as a “superman” who failed to meet the expectations of the people after criticizing the past administration when the insurgents first kidnapped the Chibok girls from their hostels.
“The SpiderMan who couldn’t protect Chibok is blasted by the SuperMan who couldn’t protect Dapchi from alien invasion,” tweeted the lawmaker.
