ADC SUPREME COURT JUDGEMENT: LAWYER GIVES LEGAL EXPLANATION Nigeria’s Supreme Court on Thursday delivered a major political judgment that has temporarily strengthened the authority of the Senator David Mark-led leadership of the African Democratic Congress, ruling that the Court of Appeal exceeded its powers when it ordered parties in the ADC leadership crisis to maintain the “status quo ante bellum.” In a unanimous decision by a five-member panel led by Justice Mohammed Garba, the apex court held that the appellate court acted improperly by issuing a preservative order after it had already dismissed the appeal before it. The Supreme Court described the order as “unnecessary, unwarranted and improper,” thereby setting it aside and restoring the legal standing of the David Mark-led faction pending full determination of the substantive suit at the Federal High Court. WHAT THE JUDGMENT MEANS The practical implication of the ruling is that the David Mark-led national leadership of the ADC can continue to function for now, while the substantive dispute over who lawfully controls the party returns to the trial court for final adjudication. Before the judgment, the Independent National Electoral Commission (INEC) had relied on the Court of Appeal’s status quo order to suspend recognition of the Mark-led executives on its records. Thursday’s decision now weakens the legal basis of that earlier suspension. LEGAL BASIS OF THE DECISION The Supreme Court’s reasoning appears consistent with long-standing Nigerian judicial authorities that courts must not interfere excessively in the internal affairs of political parties except where statutory or constitutional rights are violated. The court’s position reflects earlier authorities such as: 1. Onuoha v. Okafor (1983) 2 SCNLR 244 The Supreme Court held that the selection of party officials and candidates is primarily an internal affair of a political party, beyond judicial interference unless a law has been breached. 2. PDP v. Sylva (2012) 13 NWLR (Pt. 1316) 85 The apex court reaffirmed that political parties have autonomy in managing internal disputes, except where the Electoral Act or Constitution expressly gives the court jurisdiction. 3. Lado v. CPC (2011) 18 NWLR (Pt. 1279) 689 The court emphasized that judicial intervention in party disputes must remain within clearly defined legal limits. These authorities support the principle that once an appellate court dismisses an appeal, it cannot continue making consequential orders that effectively alter party leadership structures without a live issue before it. WHY THE CASE IS IMPORTANT Legal analysts say the judgment could have wider consequences for political party disputes ahead of the 2027 general elections because it reinforces the doctrine that: courts cannot create leadership structures for political parties; interim judicial orders must not replace party constitutional procedures; appellate courts must act strictly within jurisdiction. The decision may also influence how INEC treats leadership disputes in other parties where rival factions seek judicial recognition. THE BATTLE IS NOT YET OVER Despite the victory for David Mark, the Supreme Court did not finally determine who lawfully controls the ADC. Instead, it directed the parties back to the Federal High Court, where the substantive claims over the party’s leadership will still be decided.
