SO MANY IRREGULARITIES RIGHT INSIDE INEC OFFICE AT BUGUMA

Not too long, we informed you about plans of the Asari-Toru LGA electoral officer (EO) to move election materials at midnight from INEC LGA office to another destination, to create room for his suspected paymasters to hijack and swap the materials.

Again, Soibi, the inlaw to the APC House of Assembly candidate for Asari-Toru constituency 1, Hope Barango, has succeeded in armtwisting the EO and other INEC officials to make her the SPO of ward 1. A ward which is the second largest in voting strength in the constituency and the stronghold/home ward of the PDP House of Assembly candidate, Hon. Tekenari G. Wellington.

On knowing about this bias decision by INEC, Hon. Wellington's supporters and all other party agents began protesting and resisting this ugly mood.

It may also interest you to know that the wife of the APC House of Assembly candidate, Hope Barango is also working as an assistant EO of INEC.

What I even want to know is the content of the law... who will be the judges ... will there be a course in our universities now called christianic law (very absurd) ... if a christian is convicted 'justly' in sharia court, will his/her case transfered to christian court for leniency (very laughable) ... if I meet a fellow christian on my wife (u know what I mean), how will this case be judged - please chemcrown, forgive and forget just as has Christ... or tit for tat or dead by hanging etc ... where will there contents of the law come from - the Bible (new testament - love your neighbour as yourselve and love your GOD with the whole of your heart or old testament - where laws could be given because of the hardness of people's heart) or are 'we' going to review sharia laws so that 'our' laws will stand CONTRARY to that of sharia? - if a man steal a goat and sharia law stipulates cutting of arms, will Christian law retrieve the man a set him free to counter the judgment, oh! the man will be put in jail...

Africa’s largest telecom firm, MTN, has said the activities of ‘over-the-top’ companies like WhatsApp have adverse effects on the sustainability of Nigeria’s telecommunications industry.

The company’s Chief Executive Officer, Ferdinand Moolman, said this while making a presentation at a hearing convened by Senate Committee on Communications on Tuesday.

The hearing chaired by Adeola Olamilekan, vice-chairman of the committee, was organised following the now suspended data tariff hike by the Nigerian Communications Commission.

Last week, NCC had directed the major telecommunications companies to increase data price in order to allow “new entrants” acquire market share and operate profitably. The policy was later suspended following public outcry.

The Senate also asked the regulatory agency to halt the policy.
At the Tuesday’s hearing, Mr. Moolman, highlighted factors impacting Nigeria’s telecommunications industry.

Among these factors, Mr. Moolman mentioned “the depletion of operator revenues by unlicensed providers of “over-the-top” telecoms services who do not have any physical presence; nor pay any taxes; nor make any significant contribution to employment or other socio-economic objectives of government in Nigeria.”

Mentioning WhatsApp, Viber etc., he said these companies were eroding gains of Nigeria’s telecom companies and asked Nigeria to take action like the United Arab Emirates did.


He also lamented the inability of operators to access foreign exchange.

“This is particularly debilitating given that most of our inputs are sourced off-shore. This has very significantly increased both operating and capital expenses.”
Also, speaking at the hearing, NCC’s boss, Umar Dambatta, said the move by the NCC last week was to ensure competition.

Mr. Dambatta said major telecom firms offering data at low cost would later raise the price after pushing competitors (new entrants) out of market.
Communications Minister, Adebayo Shittu, told the hearing he was not consulted by the NCC before issuing the directive.

Another major telecom firm, Globacom, however, said floor pricing should be left to market forces and not to the regulator.

1. Mr. Chukwunweike Okafor, on Monday, (january 27, 2015) approached the Federal High Court in Abuja with an application seeking the court to disqualify the candidate over issues bothering on his credentials.

The Nigerian Communications Commission (NCC) approved a new “floor plan”, or minimum pricing, for data services by mobile operators “to address market distortions, unhealthy price wars and value erosion that could threaten the going concern of the service providers”, according to an internal working document seen by TheCable.

In a letter to the big operators, the commission had directed that the floor plan for data should be 0.90k/MB effective December 1, 2016 “pending the finalisation of the study on the determination of cost-based pricing for retail broadband and data services in Nigeria”.

As virtually all the big operators were already charging below the new floor rate, the directive meant an automatic increase in charges for data services.

However, small operators and new entrants in the data market, such as Spectranet, Ntel and Smile, are still allowed to charge below 0.90k/MB.

NCC defines “small operator” as one that has less than 7.5% market share and “new entrant” as one that has operated for less than three years.

The regulator is of the opinion that without a price floor, the dominant operators can engage in predatory pricing to drive down other operators, meaning the industry could be moving towards a monopoly.

A senior NCC official told TheCable that CDMA operators – such as Multilinks and Starcomms – were muscled out of the by the Big Four because of their market power.

“At the rate they are crashing data tariffs, there is every chance that they will soon kill all the small operators and new entrants. Part of the functions and duties of NCC is to check monopolistic and oligopolistic behaviours in the telecom market,” the official said.

Globacom currently charges 21k/MB apparently because of the economies of scale advantage, compared to Smile which charges 84k/MB, or four times Glo’s rate, in order to break even.

Under the new tariff regime, Smile can continue to charge 84k but Glo will have to move up to 90k/MB – a 328% increase.

MARKET PRICES

The document seen by TheCable says in line with its mandate of promoting fair competition in the industry, the commission monitored activities in the data market segment “and observed that a significant reduction in current market prices for data services; in addition to complaints by subscribers to re-introduce the price floor for data services”.

It gave five reasons for re-introducing the price floor, which was first introduced in 2014 and suspended in October 2015.

The reasons are:

Some service providers were actually pricing their services below cost, a situation which could spell doom for the industry.
Dominant Operators in the wholesale leased line market, who also operate in the retail market embarked on massive predatory pricing, a conduct capable of substantially lessening competition.
The removal of floor price for data resulted in eroding value in the market.
The need to safeguard investment and ensure growth, development and sustainability of the telecoms industry.
It is important to maintain the integrity of the network as operators lack capacity to accommodate the volume of transaction on their network.
It said: “When markets work efficiently, companies provide customers with more choice, lower prices better quality products and services. However, due to market imperfections, market forces alone cannot be entirely relied upon to discipline the operators to ensure efficient market conducts and promote market efficiency.

“It is in recognition of the above that regulatory intervention is required and has become a veritable tool to facilitate competition and create a level playing field between competitors.”

STAKEHOLDERS’ INPUTS

TheCable understands that the big operators made inputs into the decision-making process.

A stakeholders’ meeting with service providers was held in October to discuss “anti-competitive practices” in the data market and to get their comments and inputs on what the price floor should be.

At the meeting, NCC, according to sources in the know, informed the operators on the need to create a balance by ensuring that the interim price floor “is not too low in order to provide a cushion for small operators and new entrant to offer competitive products”.

It also said the price floor “should not be too high to ensure affordability by consumers” and that the rate should be fixed at a level that “will encourage growth, roll-out services and ultimately attract investments into the telecom sector”.

Mimiko in a statement signed by his Chief Press Secretary, Eni Akinsola, said “it behoves of him as the Governor of Ondo State to congratulate the Governor-elect, Mr. Rotimi Akeredolu, SAN, and wish him success in the challenging task of governing our dear State.”

THERE are palpable signs that Nigeria’s bid to qualify for the next World Cup in Russia may be aborted as embattled Chairman of Giwa FC, Chris Giwa, has concluded plans to drag the Nigeria Football Federation, NFF, to the Supreme Court, seeking a termination of the Amaju Pinnick-led Executive Committee.

According to our usually authoritative sources, who spoke on grounds of anonymity, Giwa has directed his legal team to file a prayer at the Supreme Court, next week, seeking a dissolution of the NFF board forthwith. If granted by the apex court, the prayer may spell doom for the Super Eagles’ quest to qualify for the 2018 FIFA World Cup.

We gathered, last night, that Giwa will ask the Supreme Court to restrain Pinnick from parading himself as President of the NFF pending the determination of the case.

If the court grants Giwa’s prayer, FIFA will react and this time, the reaction will be to suspend Nigeria from participating in all football-related activities, which in turn means that the Super Eagles will be stopped from further participation in the on-going qualifying campaign for the 2018 World Cup in Russia.
