It is starting to look like these PVCs can easily be programmed, manipulated or simulated to meet certain parochial ends.

Why Jonathan cannot fire Jega

Amid speculations of plots by the Presidency to remove the Chairman of the Independent National Electoral Commission, Attahiru Jega, from office, it has been established that the president has no powers to do so.
According to the 1999 Constitution (amended), the president can only remove the INEC Chairman on the strength of an advice from the Senate.
Mr. Jega, a former vice chancellor of Bayero University, Kano, who was appointed in June 2009, completes his five year tenure on June 30 this year.
However, there are reports that the presidency is already shopping for a replacement for the embattled INEC chairman over allegations that he has been compromised.
The presidency and the ruling Peoples Democratic Party, PDP, are believed to be uncomfortable with the INEC chairman and have allegedly vowed to remove him before the March 28 and April 11 dates for the general elections.
Mr. Jega had last Saturday announced the shift of the polls from February 14 and 28 citing security challenges in the north east. He also said the military had told the Commission it would not be available to provide security on the Election Day.
Last week, some southern elders under the aegis of Southern Nigeria Peoples Assembly, led by a former Federal Commissioner for Information, Edwin Clark, demanded Mr. Jega’s sack and arrest.
The elders, who are rooting for the re-election of President Goodluck Jonathan, alleged that INEC was favouring the North in the distribution of Permanent Voter Cards.
However, should Mr. Jonathan succumb to pressure to remove Mr. Jega, he cannot do so unilaterally. In accordance with the Constitution, the president will have to rely on the nod of the two-third members of the Senate, the nation’s highest law-making body, which is currently on break.
Section 157 (1) states that “Subject to the provision of subsection (3) of this Removal section, a person holding any of the offices to which this section applies may only be removed from that office by the president acting on an address supported by two-thirds majority of the Senate praying that he be so removed for inability to discharge the functions of the office (whether arising from infirmity of mind or body or any other cause) or for misconduct.”
Subsection 2 states “This section applies to the office of the chairman and member of the Code of Conduct Bureau, the Federal Civil Service Commission, the Independent National Electoral Commission, the National Judicial Council, the Federal Judicial Service Commission, the Federal Character Commission, the Nigeria Police Force, the National Population Commission, the Revenue Mobilisation Allocation and Fiscal Commission and the Police Service Commission.”
Although none of the nation’s law gives the president powers to ask the INEC chairman to proceed on retirement leave, he could however want to rely on Part D Section 171, under Public Service Rules of the Federation, to move against Mr. Jega.
Section 171 (1) states, “….Power to appoint persons to hold or act in the office to which this section applies and to remove persons so appointed from any such office shall vest in the President.
Subsection 2 listed such officers to include the secretary to the government of the federation, ambassadors and high commissioners, permanent secretaries or head of any extra ministerial department of the government of the federation however designated.
Appointment
In appointing an INEC chairman, the president consults the Council of State but the appointment will be subject to the confirmation of the Senate.
Section 153 (1) of the 1999 Constitution (amended) listed 14 bodies, including the INEC to be established by the Federal Government.
According to Section 154 “Except in the case of ex officio members or where other provisions are made in the Constitution, the Chairman and members of any of the bodies to the provisions of the Constitution, be appointed by the President and the appointment shall be subject to confirmation by the Senate.”
Section 154 (3) says “In exercising the powers to appoint a person as Chairman or member of the Independent National Electoral Commission, National Judicial Council, the Federal Judicial Service Commission or the National Population Commission, the President shall consult the Council of State.”
Precedence
As he did in the case of the immediate past Governor of the Central Bank of Nigeria, Lamido Sanusi, the president might ignore the laws to oust Mr. Jega.
On February 20, 2014, the president, via a statement by his media aide, Reuben Abati, accused the former CBN Governor, who was on an assignment outside the country of “Various acts of financial recklessness and misconduct which are inconsistent with the administration’s vision of a Central Bank propelled by the core values of focused economic management, prudence, transparency and financial disciple”.
The statement also said the president was “deeply concerned about far reaching irregularities under Mallam Sanusi’s watch which have distracted the Central Bank away from the pursuit and achievement of its statutory mandate.”
Before his suspension, which was to allow the Financial Regulatory Council, FRC, to conclude investigations on the allegations, Mr. Sanusi had alleged at a Senate public hearing that the sum of $20 million was missing from the Federation Account.
But the action of the president raised questions as to whether he had the power under the nation’s laws to suspend the CBN chief.
In a media chat few days later, Mr. Jonathan said he had full powers to suspend the CBN Governor because of his oversight functions he exercises over the bank.
“Yes, I have absolute power. The CBN is not well defined in the Nigerian Constitution,” he said while responding to a question by the panel of journalists.
Though under the CBN Act, 2007, the president cannot suspend the CBN Governor, it however provides that he has powers to remove a CBN Governor subject to the approval of two-third majority of the Senate.
The Act states that the Governor, Deputy Governor or Director of CBN shall cease to hold office if he “is removed by the President Provided that the removal of the Governor shall be supported by two-third majority of the Senate praying that he be so removed.”

ABUJA — With the successful postponement of the elections by the Independent National Electoral Commission, INEC, the Presidency has launched a two-pronged war to ensure that President Goodluck Jonathan wins the election convincingly.

The two strategies are to stop Muhammadu Buhari, the All Progressives Congress candidate from contesting the election with Jonathan and the replacement of the INEC Chairman, Prof Attahiru Jega, with a less independent-minded person. Jega, it was gathered, had been described by hawks around the president of being too independent-minded and ‘uncooperative’ despite being given the job on a platter of gold by the president’s men.

Vanguard learnt that Jega might have unwittingly played into the hands of the forces arrayed against him by agreeing to shift the elections.


Legal war to disqualify Buhari

Competent sources said last night that the move to remove Jega and the legal fireworks against Buhari, would be taken up simultaneously with effect from this week given the timeframe made possible by the shift.

The retired general is to be prosecuted by a team of legal luminaries for ‘lying on oath’ that he had a school certificate with the Nigerian Army when he knew that it was untrue. The plaintiffs are said to have settled for trying Buhari for alleged ‘perjury’ instead of outright non-possession of certificate following legal advice that the latter would be more difficult to prove within the time at their disposal.

Vanguard learnt that although Jega reluctantly succumbed to pressure from the Presidency and its security chiefs to shift the polls, he might still not be allowed by the forces to conduct the rescheduled elections between March 28 and April 11. Vanguard gathered from competent sources that the Presidency was no longer comfortable with Jega and was, therefore, working tirelessly to get him out of the commission to pave the way for a more ‘trusted hand’ to conduct the rescheduled elections.

It was learnt that the forces arrayed against the INEC boss had convinced the President not to renew Jega’s tenure, which is expected to lapse on June 13 this year. The forces, it was learnt, felt that Jega was rather too ‘difficult’ to deal with, having not allowed himself to be dictated to by anyone since assuming office like other appointees of the government.

It was learnt that in a bid to sweep off Jega from his seat without raising any dust, he would be asked to comply with the civil service procedure by proceeding on his three months terminal leave with effect from March 1, this year since he is expected to retire on June 13.

S-West gov’s brother may replace Jega

Vanguard gathered that in his place, the Presidency was considering bringing in another academic from the South-West, who is currently heading a tertiary institution in the country. The professor of Political Science and International Relations is said to be a sibling of a serving governor in the South-West, who is a close ally of President Goodluck Jonathan and his party.

Competent sources also told Vanguard last night that although the name of the academic had been made known in security circles, it was not clear whether the man had been cleared by the forces with a view to sending his name to the National Assembly for possible confirmation, as required by law.


Working against Jonathan’s interest

As a prelude to removing Jega from office, some close allies of the President had started accusing him of taking side with the opposition to undermine the success of Jonathan and his party in the next election. Earlier last week, Jonathan’s godfather, Chief Edwin Clark and other prominent politicians from the Southern part of the country had accused Jega of working against the interest of the president and the PDP and asked him to resign from the commission.

Although no evidence was adduced by Clark and his group to support their allegation, they nonetheless called for the arrest of Jega. Similarly, Senior Special Assistant to the President on Public Affairs, Dr. Doyin Okupe, on Saturday, said Jega had lied about the state of the commission’s preparedness for the conduct of the election.

In the same vein, the National Publicity Secretary of the PDP, Mr. Olisa Metuh, accused INEC of working with the opposition to deny its members of permanent voter cards in some states. He called on the security agents to probe the commission over the development.

While speaking yesterday during a meeting with some defectors he received from the PDP, at the weekend in Benin, Edo State governor, Adams Oshiomhole spoke against the postponement of the general elections from the 14th of February to the 28th of March.
The governor praised the courage of the defectors for dumping the Peoples Democratic Party to pitch tent with the party that is set to bring the much desired change and development to the country and assured them of level playing ground in the All Progressive Congress.
“I am really grateful to all of you that have joined. You can fool some of the people some of the time but you cannot fool all of the people all of the time. I want to promise you that together, we will continue to build a new digital political soft structure on top of which we can build all the other things.”
Over 300 PDP members defected to the APC.
He further insisted that the May 29 handover date of the Peoples Democratic Party (PDP) administration to the All Progressives Congress (APC) cannot be postponed.
1. “You heard what happened. They said they have postponed the elections. Few days back, they called us to a meeting at the Council of State and we said they should go ahead and do the elections. In any event, we are not the only country with security challenges. Even elections are held in Afghanistan and Iraq.
2. “So, whether they postpone the election or not, we won’t fight. They can’t postpone Christmas.
3. I want to appeal to all of you, nobody should be angry because I know you were ready for Saturday’s election. Only a debtor thinks tomorrow is far. Everybody has seen they don’t want elections.
4. They sponsored discussions on television, Jega said INEC was not the issue. So, they came up with security. If they like, let them keep coming up with issues; elections will hold.
5. “So, I ask you: just take it easy. These six weeks will cost us more resources and time because we thought we will do the election, get through with it and get on with our lives, but they decided to postpone the election, to prolong it but let me ask you, a child that is due to arrive after nine months, how long can you prevent it from birthing?
6. “APC is already in power, by the grace of God. They can postpone the election but they cannot postpone May 29 handover date. Two wrongs don’t make a right. Don’t fight; make peace
7. “We will use the remaining six weeks to mobilize more, pull out more people from the PDP so that Edo State will be 100 per cent for APC.”
They were led by Chief Sunny Erhengbo; a former PDP House of Representatives aspirant for Ikpoba Okha/Egor, Dr. Friday Omokaro and Edo State Head of Security, Goodluck to Goodluck Campaign Organisation, Mr. Fred Ikhuebor.

The Presidential candidate of the All Progressives Congress (APC), Muhammadu Buhari bared his mind on the matter during a recent interview.The Independent National Electoral Commission (INEC) on Saturday, February 7, announced the postponement of the 2015 General Elections for six weeks.

The Presidential candidate of the All Progressives Congress (APC), Muhammadu Buhari had earlier said that it would be too bad if INEC allowed itself to be pushed into shifting the polls.
Buhari bared his mind on the matter during an interview with Reuters on Friday, February 6.
"There will be no delay. But if INEC is compromised then it will be too bad,” Buhari said.
The APC candidate also expressed optimism at his chances of winning the election.
“I’m optimistic that I won’t lose. But we signed an undertaking that it will be violence – free. We are attempting to stabilize a multi – party democratic system,” he said.
The former Head of State was also, on Wednesday, February 4, present at a Council of State meeting which rejected plans to shift the polls.
Buhari is however yet to issue an official reaction to the postponement of the elections.

By causing the postponement of the general elections, the National Security Adviser, Sambo Dasuki, and the military chiefs have plotted a coup against the Nigerian constitution, radical lawyer, Femi Falana, has said.

Mr. Falana, a Senior Advocate of Nigeria, stated this in his response to the postponement of the general elections as announced by the electoral agency, INEC, through its chairman, Attahiru Jega.

Mr. Jega on Saturday night said the elections, initially scheduled for February 14 and 28 will now hold on March 28 and April 11. He explained that the postponement was necessitated by the statements of the NSA and military chiefs that they could not provide security in February as the military would be busy with tackling the Boko Haram insurgency.

Mr. Falana, citing constitutional provisions, however, argued that both the military chiefs acted wrongly by making such assertions.

“In a desperate bid to blackmail the INEC to postpone the election the NSA wrote a letter to the INEC to the effect that the armed forces could not provide security for the election because of the operations in the north east region.

“By writing directly to the INEC on the security situation in the north east region the NSA usurped the functions of the National Security Council.”

Mr. Falana added that “by causing the election to be postponed, the NSA and the security chiefs have staged a coup against the Constitution. They are liable to be prosecuted for the grave offence of treason at the appropriate time.”

At a public lecture delivered at the Chartham House in London last month, the National Security Adviser, Colonel Sambo Dasuki disclosed that he had “advised” the Independent National Electoral Commission to postpone the election. The reason adduced then for the unsolicited advice was that the INEC needed time to distribute permanent voters’ cards to all registered voters. As an adviser to the President on national security the NSA has no powers whatsoever to give directives or advice to the INEC. Indeed, there is no statutory nexus between the INEC and the NSA to warrant the purported demand for the postponement of the General Election. To that extent, the NSA acted illegally. The INEC rightly rejected the unwarranted interference from the NSA.

But as soon as the INEC announced that all arrangements had been put in place for the distribution of the remaining permanent voters cards in readiness for the February 14 election the NSA began to sing a different tune. At that juncture, President Goodluck Jonathan convened a meeting of the Council of State. The NSA and the security chiefs were curiously invited to the meeting with a view to convincing the Council members to endorse the postponement of the election. To their utter dismay, they failed to achieve the illegal objective as the Council declined to support the postponement of the election. The Presidency had wanted the advisory body to usurp the constitutional duty of INEC by taking a “decision” on the postponement of the election.

In a desperate bid to blackmail the INEC to postpone the election the NSA wrote a letter to the INEC to the effect that the armed forces could not provide security for the election because of the operations in the north east region. By writing directly to the INEC on the security situation in the north east region the NSA usurped the functions of the National Security Council. That is the only body that has the constitutional duty to “advise the President on matters relating to public security including matters relating to any organization or agency established by law for ensuring the security of the Federation.” The Council which is established under section 153 of the Constitution is comprised of the President, Vice-President, the a Defence Minister, Chief of defence staff, minister of interior, minister of foreign affairs, inspector-General of police and national security adviser.

It is pertinent to point out that the security chiefs are not members of the National Security Council. Neither are they members of the Nigeria Police Council. Therefore, they lack the constitutional power to make any authoritative pronouncement on the security of the nation. Even though the NSA is a member of the National Security Council he cannot usurp the constitutional responsibilities of the body with the connivance of the service chiefs. Since the NSA and the service chiefs acted illegally and mala fide the INEC ought to have rejected their politically motivated request for the postponement of the Election. The reliance on section 25 of the Electoral Act by Professor Attahiru Jega, the INEC chairman is totally misleading. The provision does not support the postponement of a general election in the entire country but “in the area or areas” where there is violence or actual threat of a breakdown of law and order.

Since the reason for the postponement of any election must be “cogent and verifiable” it is crystal clear from the press conference addressed by Professor Jega last night that the INEC did not verify the bogus claim of the NSA and the security chiefs as required by the law. By saying that they would not provide security in aid of civil authorities pursuant to section 217 of the Constitution the security chiefs have committed the offence of mutiny contrary to section 52 of the armed Forces Act. Contrary to the mistaken belief of the INEC leadership the armed forces have no role to play in the electoral process.

Since it is the exclusive constitutional responsibility of the Nigeria Police Force to maintain law and order during elections the INEC should have called off the bluff of the security chiefs. More so, that the Inspector-General of Police had confirmed the readiness of the Police to provide security for the election. Just last week, the federal high court sitting in Sokoto declared illegal and unconstitutional the involvement of soldiers in election duties. That judgment is binding on all authorities and persons in Nigeria.

It is pertinent to point out that the postponement of a General Election throughout the country is provided for under section 135(3) of the Constitution where it is stated that “If the Federation is at war in which the territory of Nigeria is physically involved and the President considers that it is not practicable to hold elections, the National Assembly may by resolution extend the period of four years mentioned in subsection (2) of this section from time to time, but no such extension shall exceed a period of six months at any one time.” Since the President could not persuade the National Assembly to pass a resolution for tenure elongation on spurious grounds the service chiefs allowed themselves to be manipulated to subvert the democratic process. Thus, by causing the election to be postponed, the NSA and the security chiefs have staged a coup against the Constitution. They are liable to be prosecuted for the grave offence of treason at the appropriate time.

If the satanic Boko Haram sect is not defeated by the armed forces of the republics of Chad, Cameroon and Niger in the next six weeks, the security chiefs are likely to ask for another postponement of the General Election on the ground that the operations in the north east region have not been successfully concluded. As such extension cannot be accommodated under the Electoral Act and the Constitution, the democratic process may be terminated by the security chiefs to pave way for the much touted INTERIM NATIONAL GOVERNMENT. Since some of the Colonels who played a dominant role in the criminal annulment of the June 12, 1993 presidential election have taken over the security of the country, the democratic forces in Nigeria should be prepared for a long drawn out battle for the restoration of civil rule. In the circumstance, I am compelled to urge Nigerians to beware of the “Ides of March”.
