Nigeria’s Attorney General Files Affidavits To Scuttle Use Of PVCs For Elections BY SAHARAREPORTERS, NEW YORKFEB 24, 2015 Affidavits filed by Nigeria’s Attorney General Mohammed Bello Adoke and just leaked to SaharaReporters reveal a stealth and controversial attempt by President Goodluck Jonathan’s government to undermine the use of permanent voter cards (PVCs) in the country’s forthcoming elections. Judicial sources, who leaked the affidavits to SaharaReporters, said the documents show that Mr. Adoke is opposed to efforts by the Independent National Electoral Commission (INEC) to conduct free and fair elections using an updated electronic voters register and permanent voter cards. At campaign stumps and interviews, President Jonathan has touted the adoption of PVCs as part of his legacy to ensure the empowerment of Nigerian voters, stating that the initiative would eliminate lapses in past elections. But affidavits filed by Mr. Adoke, a longtime confidante of Mr. Jonathan’s, reveal a surreptitious scheme to undermine the use of PVCs. In one of the affidavits, Mr. Adoke, who is also Nigeria’s Minister of Justice, argued, “if the election is conducted majorly with the use of Permanent Voters’ Card, the constitutional right of the many eligible voters would be taken away from them.” The affidavit also argued that the election “is likely to be unsuccessful if rigid use of the Permanent Voters’ Card is carried out.” A second affidavit, also leaked to SaharaReporters, stated, “the use of card readers and/ or any other machine at the general elections must encourage eligible voters to vote without being deprived in any way.” INEC chairman Attahiru Jega recently stated that the use of PVCs would not be to cast votes but to validate and authenticate the votes cast. The distinction, he said, was that the PVCs and card readers would prevent electoral manipulation by acting as a checking mechanism. An INEC source told SaharaReporters that, without these electronic verification mechanisms, the presidential and other elections could be severely compromised. Mr. Adoke’s affidavits, which are dated February 23, 2015, expose yet another attempt by President Jonathan’s associates to use incessant lawsuits to disrupt electoral processes decided on and announced by INEC several years ago. SaharaReporters had revealed that cronies of Mr. Jonathan had filed some 15 lawsuits aimed at once again scuttling the presidential election now scheduled for March 28, 2015. The affidavits by Mr. Adoke represent a new twist in the familiar plot, one legal source in Abuja told SaharaReporters. “The office of the Attorney General of the Federation has aligned itself with many litigants who are determined to use the courts to either scuttle the elections or stop INEC from using the best tools to prevent or drastically reduce rigging in this year’s elections. The use of rigging-proof electronic voter cards, which the AGF is now challenging, is an ominous sign,” said the source, a senior advocate of Nigeria. Why I directed PDP Ward Leader to tear my membership card – Obasanjo As criticisms and commendations continue to trail his dramatic exit from the Peoples Democratic Party, former President Olusegun Obasanjo has explained how he arrived at the decision to dump the party to which he belonged for 16 years. The former president had Monday announced his resignation as a member of the party on whose platform he ruled the country between 1999 and 2007. Mr. Obasanjo renounced his membership of the PDP when some leaders of the party led by Surajudeen Oladunjoye, the chairman of the ward around his former residence in Ita Eko, visited him at his Presidential Hilltop mansion in Abeokuta home. The former president directed Mr. Oladunjoye to tear his membership card at a press conference organised during the visit. About two hours later, the PDP leadership in Ogun State announced the expulsion of the former president from the party. However, in a telephone interview with PREMIUM TIMES Tuesday, Mr. Obasanjo explained that the PDP members visited him to express their genuine concern about his refusal to be active in the party. “They were concerned that I had only one leg in the party, and worried that since I’m their leader in the ward, they need to hear from me,” the former President said. According to him, when the party members arrived his residence, they were singing a song in Yoruba language – “Nigeria yi ti gbobgo wa ni, Ko ma gbodo ba je. Eje ka sowopo kajo gbega (Meaning – Nigeria belongs to all of us, we must not allow it to be destroyed and we must join hands to make it great). Mr. Obasanjo said when they settled down he sought to know why they came and that it was at that point that Mr. Oladunjoye told him that since he (Obasanjo) as their leader became angry with the PDP and remained inactive in the party, they had not only lost sense of direction but also worried about their political future. He also said the party members informed him that the leadership in the state was planning to expel him and that they wondered what would happen to them if he was expelled because they would become rudderless. “You are our leader and it is you we are following. You have remained a card-carrying member of the the party. But since you became angry with the party we have lost sense of direction and now we are hearing that they want to expel you. If they expel you, where do we go? What do we do?” Mr. Obasanjo quoted the ward chairman as saying. The former president explained that it was at that point that he gave them his PDP membership card and told them that they could do whatever they want with it. He said, “In my response, I said when you people came you were singing a song and I agreed that Nigeria is our own. If the issue is the party, I will not choose the party at the detriment of Nigeria and I will fight for Nigeria even at the detriment of the party. I will rather surrender my membership of the party so you people can move on politically,” Mr. Obasanjo explained to PREMIUM TIMES. “If you people’s worry is that I’m a card-carrying member of the party and I’m not showing you people direction and you are worried that I’m neither here nor there, this is the card; you can keep it, you can burn it or you can tear it, do whatever you want to do with it.” The former president said he then handed over his membership card to Mr. Oladunjoye, who immediately decided on his own to shred it. Mr. Obasanjo said he had no regrets for his action despite the criticisms that have greeted it. |

Lawyer sues Mbu, wants him dismissed February 17, 2015Ben Ezeamalu A Lagos-based lawyer, Tope Alabi, has urged a Federal High Court in Lagos to strip Joseph Mbu, the controversial Assistant Inspector-General of Police, AIG, of his police rank and declare his office vacant. In a suit FHC/L/CS/149/15, Mr. Alabi is seeking a declaration that Mr. Mbu, the first defendant, has abused his office and is unfit to be a police officer. “It is in the interest of justice to declare the first defendant unfit to be and to remain a police officer in Nigeria, considering his public conduct all the time and to declare his position and seat vacant and a replacement made without delay,” Mr. Alabi said in his court papers. A date is yet to be fixed for hearing. Mr. Mbu, the newly posted AIG in charge of Zone 2, rose to infamy for his unguarded utterances as well as his recent clashes with politicians, civil society activists, and journalists. Last week, while addressing police officers of the Ogun State Command, Mr. Mbu instructed them to be battle-ready to return “fire for fire” against politicians during the elections. “If one of my men is killed, I shall kill 20 of them but don’t shoot first. If they shoot you, shoot back in self-defence. Anybody who fires you, fire him back in self-defence,” Mr. Mbu said. In 2014, the #BringBackOurGirls protesters in Abuja slammed a N200 million damage suit against the Nigeria Police after Mr. Mbu banned their daily sit-ins to demand the release of the kidnapped Chibok girls. The police hierarchy promptly reversed the ban and the suit was dropped. Also, in 2014, Mr. Mbu detained and arraigned a journalist before a Magistrate for branding him ‘controversial’ during a TV programme. The magistrate struck out the charges. In 2013, while the Commissioner of Police in Rivers State, Mr. Mbu engaged in frequent verbal clashes with Rotimi Amaechi, the state governor, with the latter accusing him of an assassination plot. Mr. Alabi said these acts by a serving police officer are enough to declare his office vacant and replaced “without further delay.” Joined in the suit before the Lagos court are the Inspector-General of Police, Suleiman Abba, the Police Service Commission and the Attorney-General of the Federation, Mohammed Adoke, as the second to fourth defendants. As a senior police officer, according to Mr. Alabi, Mr. Mbu swore to uphold to the rule of law and abide by the Constitution, but has allegedly been behaving as if he is above the law. “A prayer urging the court to determine whether Mbu is fit and proper to remain in office considering his controversial utterances and ‘his public misconduct,’ and whether the lives of Nigerians are not in danger as long as Mbu remains in office,” Mr. Alabi stated in his court filings. The lawyer also wants the court to hold that Mr. Mbu’s threat, last week, is beyond his powers and therefore in breach of Section 308 (1) (b) of the 1999 Constitution. Mr. Alabi also wants a declaration that his life and those of other Nigerians are in danger as long as Mr. Mbu remains in office, and that their rights cannot be guaranteed unless Mr. Mbu is removed. Mr. Mbu had also told his men to arrest any erring governor before, during, or after the election. The lawyer urged the court to stop Mr. Mbu from giving that order in line with Section 308 (1) (b) of the 1999 Constitution. He also prayed for an order of perpetual injunction restraining Mr. Mbu from giving any orders during the March 28 and April 11 general elections. Mr. Alabi said Mr. Mbu has no powers under the law to personally kill or direct officers under his control to kill innocent Nigerians in retaliation should any officer be attacked. According to him, by Mr. Mbu’s utterance, he has chosen to flout the laws he swore to uphold as his statement is “capable of inciting mass killings, violence and anarchy”. Mr. Alabi recalled that Mr. Mbu served in Rivers State and in the Federal Capital Territory where he continued to violate the Constitution by exhibiting “intolerant and unlawful” behaviour. The lawyer also noted that the Inspector-General of Police’s distancing of himself from Mr. Mbu’s latest utterance by reiterating that the mandate of the police is to “save and protect lives and not to kill” is a testament of his over-reaching of his powers. |
