Properties › 5 Facts You Must Know About Statutory Fees In Lagos Real Estate by Folayat(op): 8:57am On Dec 07, 2023
It is so worrisome to have interest in a particular property thinking that is certain price and at the end of the day, you were told there are other payment aside the actual cost of the land.

Before, statutory fees is always separated from the cost of the land but now most real estate companies add the cost of the land with the statutory fees to make it total cost and give the price of the land as all inclusive. (Total package)

While some developers still prefer to break the cost down and make the statutory fees on a separate plan.

Do you want to buy a property but you don't really know much about statutory fees?

Statutory fees are customary fee being paid when a land is purchased and they are used to settle many bills in Lagos real estate.

Check out my official website on the link below to read more about Statutory fee

Properties › Is Freehold Land Safe To Buy In Nigeria by Folayat(op): 8:58am On Nov 18, 2023
Is Land with Freehold safe to buy in Nigeria?

This is the question you will hear from anyone who want to invest in Epe, Lagos state.

One of my prospective clients call me to make enquiry about Epe, he said all what he has been hearing about Epe is freehold and he was asking me to elaborate what Freehold really means and how safe is the land with such land title is safe to buy.

Do you want to buy land in Lagos but you don’t really understand what freehold is and wondering whether it is safe to buy?

Do you also want to know the meaning of freehold?

Well!

Buying of property without getting a valid document can make one lost the property and there are different types of land titles documents in Nigeria such as:

Global acquisition

Excision

Gazette

Certificate of Occupany

Governor’s consent

Freehold.

Then the question is.

Is Freehold land safe to buy and how genuine is it?

Freehold is a new land title for most land in Epe, presently most real estate developers obtain freehold in order to assure intending buyers that the land is free from government acquisition.

Freehold property is not under a committed land

Do you know what a committed land is?

A committed land is a parcel of land under government acquisition which the government has intention of using in the future for specific purposes such as construction road network, infrastructural facilities, housing project etc.

So, freehold as the name implied it is free from being hold by the government.

It is like other land titles I mentioned earlier, it is genuine and very safe to buy and processing of certificate of occupancy on such land is very easy in the future.

Properties › Do I Need A Lawyer For A Property Transaction? by Folayat(op):
Do I need a lawyer for a property transaction?

Buying a property either land or house is a powerful transaction because of huge amount of money involved.

Most potential buyers don't really know whether to get a lawyer when buying or not.

Do I need to get a property lawyer?

Yes and No.

Yes, you need a lawyer when you are buying from Omo onile. As we all know the mischievous behaviour of most Omo onile, the best thing to do when dealing with them is to get a lawyer.

The work of the lawyer is to investigate if the property is genuine, check whether there is any record about the property at land ministry and also draw the deed of assignment between you and the seller.

But when it comes to buying property from a real estate company.
The answer is NO.

Buying a property from real estate developer is always very safe and stress free.

Especially, when you buying through a realtor, the realtor can help you to monitor all the necessary procedures involved if you are busy or not available.

Getting a lawyer when buying from a real estate company is not mandatory, because real estate company also use lawyer in their properties dealing and their land is always genuine and void of dispute.

They give registered survey, deed of assignment and other land titles after payment.

So the work need to be done by your lawyer has been done by theirs to relieve your stress and save you money.

But if you insist on getting your own lawyer no problem with that but not necessary.

All what you need to do is to know the company's name and make sure you are paying into the company's bank account.

So you need not to worry when buying a property from a real estate company

Properties › Why C Of O Is Not The Most Important Land Document by Folayat(op):
Is not a new thing that the dream of most property buyers is to have a property with Certificate of Occupancy, because they believe that it is the only valid document that they could have to give them peace of mind.

Certificate of occupancy simply means a document that is issued by a state government to own a property for 99yrs.

What make C of O powerful among other land documents is because of the power it has to obtain loan from the bank using it as a collateral.
Buying a property with other types of land titles documents such as Approved excision, Governor's consent, Gazette is also safe.

Likewise a property with only deed of assignment and registered survey protect you as the rightful owner. The issue with deed of assignment and registered survey is just that if anything happens in future where government needs that kind of land, you might not be compensated. But having deed of assignment and registered survey can prevent loosing your property to another person.

Have seen a scenario where a land was sold to two people by a family member. The initial buyer processed deed of assignment and registered survey on the land while the later buyer processed C of O on the same land.

When the initial buyer discovered that her land has been sold, she consulted a lawyer and the matter was charged to court.
The judgement of the judge was that The C of O of the later buyer would be revoked, because the deed of assignment had shown that the first buyer is the rightful owner of the land.

However,if you have the power you may get a property with C of O, but if you don't. It is not something that should be delaying you from buying a property or that won't give you peace of mind, because other land titles too can also protect you as the rightful owner of a land which make certificate of Occupancy as not the most important land document.

If you have any question related to real estate matters or need a land in Ogun and Lagos state.

Properties › All You Need To Know About Conveyance Deed And Deed Of Assignment by Folayat(op):
What you need to know about Conveyance Deed and Deed of Assignment.

The document you need to get when buying a property for yourself is different from the one you need to get when you want to buy the property for someone else.

At times people get confused when it comes to obtaining certain documents for property acquisition.

If you don’t really know the difference between Deed of assignment and Conveyance deed.

I’m here to make you understand!

You know if you buy an item, you would be given receipt as an evidence of legally purchasing the item. the receipt is enough for you to claim ownership of the item purchased if the seller want to play to outsmart you.

But reverse is the case, when you are buying a property. Receipt is never enough to claim your property back if the seller sells the property to someone else.

I have seen several cases where a land is sold to more than one person. It is the buyer who has the perfect document that will eventually win the dispute. That is why it is very important to get the right document when buying your property.

Conveyance Deed and Deed of Assignment.

When it comes to conveyance deed and deed of assignment, there is a slight difference between the two.

Deed of Assignment

Deed of assignment is one of the most important land documents to acquire which shows the authentic owner of a property.

It’s a legal document which serves as a proof that the property purchased has been transferred from the seller to the buyer. It is always drawn by a property lawyer.

When ownership is transferred, the deed shows the new legal owner of the property with pertinent information such as;

The names of the buyer and the seller.
The address of both parties.
The agreed cost and the size of the land to be sold.
The signature of the both parties etc.
The deed of assignment for land has.

The deed of assignment for land has to be recorded in the land registry to show legal proof and publicity.

While the Conveyance Deed on the other hand is

Properties › Land Documents And Their Validity In Nigeria by Folayat(op):
Land Title is a legal document that guarantee the rightful owner of a pieces of land.
When considering buying a property especially land, it is very important to know the title the land is possessing in order to avoid story that touches.

Generally, all lands are owned by Government. It is after is classified under global or general acquisition that citizens have the right to sell or buy such lands.
Even after the general or global acquisition, one still needs to get legal title before one could claim the rightful owner.

The importance of land title cannot be overemphasized. Investors who have taken it for granted have either lost their hard earned money or in litigation.
Here are some of the land titles and their validity in Nigeria.
*Excision
Excision is a title that shows or proves that government has released an expanse of land to the general public which means such land is free to sell or buy.
Pls note: A land with Govt. Approved Excision is very safe buy than excision in process.

*Gazette
When the excised expanse of land is published in government official book of record called gazette such land is said to have Gazette as title.
Note: Approved Excision and Gazette are very good documents for a parcel of land, such lands are safe to buy and develop.

*Certificate of Occupancy
A C of O is usually issued by the state government and it connotes that the state government has officially leased the piece of land to the applicant for 99years.

https://naijatrustedrealtor.com/

There can only be one rightful owner of C of O on a particular land, other subsequent buyers of such land will be given Governor's Consent.
So many people think a land with C of O is the only genuine document because of it popularity. The importance C of O has over other land documents is that it can be used as collateral in the bank to obtain loan.

*Governor's Consent
A governor’s consent can only be processed on a land that have either Gazette or have an existing Certificate of Occupancy (C of O).

If a person with C of O decides to sell his land, the only document that can be given to the new buyer or every other subsequent buyers is the right of occupancy or ownership is a governor’s consent.

*Deed of Assignment
A Deed of Assignment is one of the transactional document drawn up by a real estate attorney between the current title.
In real property transactions, a deed of assignment is a legal document that transfers the interest of the owner of that interest to the person to whom it is assigned, "the assignee".
When ownership is transferred, the deed of assignment shows the new legal owner of the property.

The deed contains very pertinent information for a real estate transaction. It contains the date the ownership of the property is transferred from one owner to the other.
The deed also states the specific description of the property that is included in the transfer of ownership.

However, most genuine real estate companies always give deed of assignment and survey plan to support any land document the land is possessing, because it is the deed of assignment that shows that the property has been sold to you.
