I don't like the way you called the lawyer illiterate.

Buhari's entire military career is fraudulent because he never had WASC. Secondly, he committed perjury by lying that his certificate was with the military board when he didn't have any.

He hired 13 SANs to argue why the court notice should be served him in APC secretariat and not in Kaduna. That is simply the same kind of delay tactics Saraki used and APC supporters were accusing him.

Thank u my brother, if person talk dem go say corruption is fighting back. The biggest fraudulent corrupt act is happening right in front of us and everybody they act on assumption. When I heard about this case few months ago, I laffed it off. But when I saw the delay tactics been used by Buhari lawyers I have to think again. .......SMH for the country

What is a transcript and what is a certificate. Pls kindly expantiate for those of us who are ignorant. What I posted for u clearly states that documents required are CERTIFICATE OR TRANSCRIPT...so explain to us what a certificate stands for and what a transcript stands for.

Transcript An inventory of the courses taken and grades earned of a student alleged throughout a course. Note the key word there "throughout "

Certificate A document serving as evidence as a person has completed an educational course. Also note the key word here "completed".

I believe you can correlate these two key words on your own. And believe me there is no school you are applying for abroad that won't ask for both you transcript and your certificate. Unless you are starting afresh in there secondary school equivalent.

I believe you are trying to say is that, he may not have the certificate, but he may have something equivalent or even higher, I may be getting u wrong.

Somebody said this above "There is no foundation upon which other certificate will rest" meaning for Nigeria, without waec every other certificate is null and illegal. Is like entryin the university with awaiting result ,then the result finally comes, you didn't pass the core subject. Then you say since u are already in, no need. Pls tell me what happens when it's time for final verification?

Must someone be guilty of all 13 counts? Does even failing to get a conviction imply that the EFCC failed in their case? Did the fact that EFCC proved it's case against Ibori prevent the Naija Judge from acquitting him while the UK Judge sent him to the gaol.

All freeze001 is saying is that FG and EFCC should take their time in carrying out proper investigation instead of going to embarrass themselves in court. Let me tell u something, no matter how guilty a person is, if u can't convince the Judge, that guilty person will definitely walk free. They are bundling this cases and doing a poor job at handling dem all. Y not handlee one at a time and do a good job at it. I hope now u understand? The way they are rushing these cases one wld think they have a hiding agenda.

You see, in a democracy imperfect as ours is, justice must be done and seen to be done. The provisions of the law are clear.

For stopping the trial:
1. The issue he raised was jurisdiction of the tribunal as to constitution of the panel. The CCB Act says 3 judges constitute a panel. The intention of the law for providing an odd number even in the appellate courts is so that in the event of dissenting judgements, there will always be a majority which becomes the binding judgment. However, the law also says 2 judges can form a quorum and on the basis of this, his appeal was quashed at the Supreme Court. He had the right of appeal which he rightly exercised.

2. Another issue raised was the condition precedent set by the tribunal with Tinubu which is also a set down precedent in the Act that the declarant must be informed and his statement or clarification to issues raised by the CCB must be received in writing by the CCB. Where the CCB is satisfied by the clarification of any issues raised, there will be no need to proceed to the tribunal but where it is not satisfied, it can approach the tribunal and that written statement by the declarant is one of the mandatory documents with which to institute an action at the tribunal and which vests it with the jurisdiction to entertain the matter.

This was not complied with in Tinubu's case on the basis of which the tribunal chairman dismissed the charges against Tinubu. The same situation played out in Saraki's case as he wasn't informed nor given the opportunity to respond as statutorily required before he was served with notice to appear before the tribunal.

Again he had the right to rely on the precedent set by the tribunal and the extant provisions of the law. The same chairman that ruled on Tinubu's case chose to overrule himself rather than comply with the law and its own precedent. Legally the tribunal has no power to act as an appellate court unto itself and can no longer rule on a previous judgment because it is functus officio. Still that has been done and the matter continues.

3. Asking the chairman to recuse himself on grounds of bias: In law, even the slightest whiff of bias established by a defendant against a judge allows issues to be resolved in his favor upon appeal. The possibility of and actual bias is frowned upon very strongly. Saraki rightly pointed out the possible bias of the tribunal due to his pending issues with EFCC, the same EFCC which is testifying against Saraki.

My point with the above is that with an independent judiciary, all these issues raised on appeal can overturn the decision of the tribunal upon appeal. It would then be on apparently technical grounds to those who don't understand these things because jurisdiction is fundamental. If that happens, u all will still say the judiciary is the problem!

The FG has not done it's job well because it doesn't seek justice but political vendetta and equity will not be used as a cloak for fraud. A defendant has every right to explore every legal avenue for justice, it must not be interpreted as an admission of guilt or an attempt to evade justice.

The law simply requires that he who comes to equity must come with clean hands and the Prosecution must always be mindful so its actions do not amount to a nullity.

You are wasting your time on a group of block heads.... Nothing you will say to them wld make dem see the reality of things. I don't know how the comprehensive capacity of an average Nigeria youth sink this low.

Please bear with me, am not much of a writer.

It pains me to see our youths tear themselves down over politicians who dont really care about you. We keep recycling past leader who have failed us over and over again, when are we going to learn?

We can't have a reasonable argument without including political affiliation, religionalism and tribalism, how do u expect such country to grow?

The laziness in the youth is so much that it's nauseating. I came across a thread where somebody said Ex president Jonathan was not an option and that left Gen Buhari as our only choice. I was like WTF! Apart from PDP and APC, we had more than 10 other parties involved in last election presidential election. Here :

If we had taken the time we used in coming online to tearing ourselves down over past failure to make research on each of the individual candidates from other parties and not just rely on what the media house feeds us, we would hv known that apart from Buhari and Jonathan, there where other fresh and better off candidate that has not failed us before, with fresh ideas suitable to rule this country. And I believe we would have been better off.

Am in for a better Nigeria, I don't care which tribe u are from or which religious group you be long to, u are a Nigerian before anything else. We should learn to criticize constructively and speak up when we see something that is not right. One year is enough for any reasonable government to atleast give us a glimpse of what to expect in the future, it doesn't have to be something magnanimous, just a glimpse.
For example this present administration criticized the last administration over the number of presidential private jet and promised to sell off majority and keep just what is needed. My fellow countrymen, how long will it take to sell off atleast one of those presidential jet which will add to nation revenue and reduce cost of maintainance?
Little things like this would go along way to show how sincere your intentions are towards the country.

We keep getting excuses upon excuses about how the government is been sabotaged, from what I know there is hardly a government in power that doesn't get sabotaged in one way or the other. Please find away around your current saboteur and we youth should hold the government responsible in making life easy for Nigerians without sentiments and pity.

Regarding the fight against corruption, nobody is against it. It should be done quietly so that those that would be indicted in the future won't cover their tracks before it gets to them and necessary information should only be released when a person is convicted. Recently our amiable president in an interview on CNN said a lot of people are in jail for corruption and from my knowledge no court of law in Nigeria has convicted anybody for corruption, so I was wondering when was anybody jailed. Till a person is successful convicted by a court, there is no recovered loot from such person. I believe we all know this, but we pretend to be blind or too dumb to understand how the law work. Just as fighting corruption is important, so is the economy, power sector,etc are important to the growth of the country, they should be done simultaneously.

What am trying to say my fellow Youth is that we should stop making the same mistake over and over again. Just like Jonathan was never an option during the last election due to the level of corruption in his regime, so was Buhari, a past failed leader. In a sane cline, General Buhari, a past coupist has no claim to be a democratic president in this country, not to talk of his number of treasonable statement he has made. And they where never our only choices,we where just too lazy to find out more.

No past leaders has done enough to warrant been giving a second chance in this country, but Nigerians would never learn. Next election maybe Jonathan or atiku or one of the past or current political would want a shot at presidency again after is past failure and we would start killing and tearing ourselves apart over people that has brought the country to its knees.

From the last election we can see no matter the rigging, is who ever we want there would be there. So Pls in the next election, we should take our time and go through the various candidates on our own and not depend on what the media houses feeds us and give a fresh person with fresh idea a chance.

An animal as low as the dogs does not go back to its vomit, why do we human being keep going back to ours, what does that make of us? The future of Nigeria is for us to determine, not these past failure. Be wise.

These politicians,both apc and pdp has caused so much suffering to this country with their looting. Comprehension is indeed an issue here. Sambo Dasuki's office as NSA(ONSA) was given $2.2billion to purchase arms. The money was "diverted" to purpose other than arms purchase. The whole money didn't end up in Dasuki account alone, some other people participated. How can you then charge Dasuki for the whole $2.2billion? This is a straightforward thing. You can only charge Sambo for stealing whatever is traced to him, and perhaps as conspirator and accestory in what went to others.
