I write in reference to your recent editorial on the fine imposed on MTN. Beyond the issues so eloquently articulated in the piece, I believe that the fine in the sum of N1.04 trillion(Later reduced to N780Billion) is ultra vires for the simple reason that the commission lacked the legal power, under section 12(1)(c)(ii) of the interpretation act, to exceed the sum of N100 per contravention of the Nigerian Communication Commission(Registration of Phone Subscribers) regulation 2012. To the extent that the commission purported to empower itself, vide regulation 19, 20 & 21 of its said regulations, to impose fines on telecom service providers at the rate of N200,000 per contravention, the NCC simply exceeded its power under the provision of the interpretation act. Hence, my belief that the said fine is invalid, null and void. In my opinion, the size of the fine ought not to have exceeded the sum of N520Million based on the total number of allegedly unregistered subscribers(5.2Million) on MTN's network multiplied by the sum of N100 as stipulated under the said provision of the interpretation act.

Politics‎MTN Group CEO Resigns Over N1.04tn Fine by funshybam(op): 8:21am On Nov 09, 2015
MTN Group President and Chief Executive Officer, Sifiso Dabengwa, resigned on Monday morning over the N1.04tn fine imposed on MTN Nigeria by the country’s regulatory body – the Nigerian Communications Commission.

A credible source at the MTN Group office told our correspondent that the company subsequently appointed ‎Phuthuma Nhleko as Executive Chairman in a temporary capacity.



He said Nhleko, the current Non-executive Chairman, has agreed to act as Executive Chairman for a maximum period of six months while the company identifies a successor for Dabengwa.

A copy of Dabengwa’s resignation letter was made available to our correspondent.

‎It read in parts, “Due to the most unfortunate prevailing circumstances occurring at MTN Nigeria, I, in the interest of the company and its shareholders, have tendered my resignation with immediate effect.”

Officials at MTN said Nhleko was no stranger to the business as he served as non-executive director and chairman of MTN from July 2001 until June 2002 and thereafter as an executive director, Group president and CEO until March 2011. He has subsequently chaired the Group in a non-executive capacity for the past two and a half years (since May 29, 2013).

“I will assume responsibility as Executive Chairman for the next six months as I proactively deal with the Nigerian regulator and will continue to work with them in addressing the issues around unregistered subscribers as a matter of urgency,” Nhleko said in his acceptance letter.

The PUNCH gathered that Mr. Alan van Biljon would continue to serve as the Lead Independent Director on the MTN board of directors (MTN Board), while Nhleko takes over executive responsibility.

“Together with the MTN Board, my second priority will be to find an appropriate Chief Executive Officer to take MTN forward. I will then revert to my Non-executive Chairman role,” Nhleko added.

‎”Stakeholders are reminded that MTN will continue to inform them of any material engagements with the Nigerian authorities via the Stock Exchange News Service of the JSE Limited.

“Shareholders are advised to continue to exercise caution when dealing in the company’s securities until a further announcement is made,” the source added.‎

Valdecir came to abuse some elderly, and defends himself by saying that ‘he had an encounter with Jesus in a brothel and gave him the mission of spreading the sacred semen throughout the state, beginning with the faithful Apore Assembly, of which he is responsible’.
Denise Pinheiro, delegate of the region, said, “Valdecir was caught red-handed while rubbing his penis in the face of a local merchant, which promised to make more sales in her business due to the divine liquid.

On the anniversary of the abduction of over 200 secondary school girls from Chibok secondary school in Borno State, the National Security Adviser (NSA) Col. Sambo Dasuki (rtd) has given assurance that the Federal Government would make every effort to ensure that the over 200 abducted Chibok girls along with other Nigerian abducted by terrorists are rescued.



Dasuki, who gave the assurance in an interview he granted PRNigeria, a media agency that distributes press releases on behalf of security agencies, also declared that Sambisa Forest, which is the fortress of Boko Haram terrorists and one of their last remaining camps will be stormed and liberated before the May 29, 2015 presidential hand-over date.

He said: “Right now, all Boko Haram camps, except Sambisa Forest have been destroyed. The forest would have since been liberated but for the unfavourable weather condition prevailing in the area as all needed reconnaissance activity and necessary deployment of troops have been made for the operation.

“Every movement of the terrorists is being monitored and every necessary detail is being taken care of to rid the country of the last bastion of terrorists’ infestation,” the NSA said.

He explained that government is concerned about the welfare of every single Nigerian including the girls saying; “aside the Chibok girls, other Nigerian girls, boys, men and women were abducted by the terrorists and all efforts are being made to rescue them all.”

While appealing for a little more time to complete the routing of terrorists, Dasuki noted that before elections were postponed in February, over 20 local governments were occupied by the Boko Haram sect, adding that most Nigerians were pleasantly surprised that so much has been achieved against insurgency within six weeks.

He commended President Goodluck Jonathan for the successful conduct of the 2015 elections, even as he stressed that contrary to insinuation in certain quarters, nobody pressured the President into conceding defeat in the presidential election.

According to him; “President Jonathan had already given his words to all the security and Service Chiefs before the election that he would abide by the decision of Nigerians. At the meeting, he also told them to perform their duties professionally during the polls.

“While we anticipated that he would congratulate his opponent if the result is announced in favour of opposition candidate, he gratuitously without prompting of anyone conceded defeat to the surprise of all.

“By that singular gesture he had saved the security agencies and the nation of unnecessary tension and stress in maintaining law and order and curtailing excesses of likely protesters.”

I found this very funny. I drove to Oja-Oba in Akure this evening to buy some stuffs only to find out that the expansive Democracy Park that usually serve as Car Park to the Large market when no political activity is taking place there, is under lock and key. The place has hosted all political rallies in the state since it was built few years ago.
The giant gates leading to the park has been rolled up and padlocked with giant keys.
Confused about where to park my vehicle or make a u-turn in the ever crowded narrow road leading to the park, I came down from my Toyota 4 Runner truck to ask from people around why the gates were locked. To my amazement, I was informed that the state government locked the park to prevent GMB/APC from using it whenever their campaign train gets to Akure the Ondo State capital.
Isn't this funny? Is this democracy? The question in the mouth of the traders and users of the park is "will the closure of the park prevent them from voting GMB"? Someone even said GMB should come and hold his rally in the street of Akure if all the official places for such programmes are not released for his use. Recall that the Ondo State command of the Nigeria Police Force teargassed a tumultuous crowd participating in a pro-APC rally in Akure last week on the instruction of the governor, Is this how Dr Mimiko will get the one million votes he promised to give to GEJ in Ondo State? my comment on the attitude of the governor is that this time shall pass and when we remember this time, we shall think about the role of Dr Mimiko in stifling democracy in Nigeria. It took the assistance of a more experienced driver to help move my vehicle out of the artificial logjam created by the governor of Ondo State for political reasons. Well my PVC is kept in a very secured place where no one will dispossess me of it, it is going to give GEJ minus one vote from me, cheers!
if you are not as daft as your handlers, you should know that you don't just barge into a "democracy park" in any state without prior application/expression of interest. ... you don't just drum and dance into a venue without first reserving the place if you are law abiding and from all your rants here, u didnt say they applied and were denied use of the place....
..... in case you don't read/listen to news, PDP despite being in control of Federal Government applied for the stadium in Porthacourt but was denied by Amechi. ... pls stop peddling lies
