I write in reference to your recent editorial on the fine imposed on MTN. Beyond the issues so eloquently articulated in the piece, I believe that the fine in the sum of N1.04 trillion(Later reduced to N780Billion) is ultra vires for the simple reason that the commission lacked the legal power, under section 12(1)(c)(ii) of the interpretation act, to exceed the sum of N100 per contravention of the Nigerian Communication Commission(Registration of Phone Subscribers) regulation 2012. To the extent that the commission purported to empower itself, vide regulation 19, 20 & 21 of its said regulations, to impose fines on telecom service providers at the rate of N200,000 per contravention, the NCC simply exceeded its power under the provision of the interpretation act. Hence, my belief that the said fine is invalid, null and void. In my opinion, the size of the fine ought not to have exceeded the sum of N520Million based on the total number of allegedly unregistered subscribers(5.2Million) on MTN's network multiplied by the sum of N100 as stipulated under the said provision of the interpretation act. MTN Group President and Chief Executive Officer, Sifiso Dabengwa, resigned on Monday morning over the N1.04tn fine imposed on MTN Nigeria by the country’s regulatory body – the Nigerian Communications Commission. A credible source at the MTN Group office told our correspondent that the company subsequently appointed Phuthuma Nhleko as Executive Chairman in a temporary capacity. He said Nhleko, the current Non-executive Chairman, has agreed to act as Executive Chairman for a maximum period of six months while the company identifies a successor for Dabengwa. A copy of Dabengwa’s resignation letter was made available to our correspondent. It read in parts, “Due to the most unfortunate prevailing circumstances occurring at MTN Nigeria, I, in the interest of the company and its shareholders, have tendered my resignation with immediate effect.” Officials at MTN said Nhleko was no stranger to the business as he served as non-executive director and chairman of MTN from July 2001 until June 2002 and thereafter as an executive director, Group president and CEO until March 2011. He has subsequently chaired the Group in a non-executive capacity for the past two and a half years (since May 29, 2013). “I will assume responsibility as Executive Chairman for the next six months as I proactively deal with the Nigerian regulator and will continue to work with them in addressing the issues around unregistered subscribers as a matter of urgency,” Nhleko said in his acceptance letter. The PUNCH gathered that Mr. Alan van Biljon would continue to serve as the Lead Independent Director on the MTN board of directors (MTN Board), while Nhleko takes over executive responsibility. “Together with the MTN Board, my second priority will be to find an appropriate Chief Executive Officer to take MTN forward. On the anniversary of the abduction of over 200 secondary school girls from Chibok secondary school in Borno State, the National Security Adviser (NSA) Col. Sambo Dasuki (rtd) has given assurance that the Federal Government would make every effort to ensure that the over 200 abducted Chibok girls along with other Nigerian abducted by terrorists are rescued. Dasuki, who gave the assurance in an interview he granted PRNigeria, a media agency that distributes press releases on behalf of security agencies, also declared that Sambisa Forest, which is the fortress of Boko Haram terrorists and one of their last remaining camps will be stormed and liberated before the May 29, 2015 presidential hand-over date. He said: “Right now, all Boko Haram camps, except Sambisa Forest have been destroyed. The forest would have since been liberated but for the unfavourable weather condition prevailing in the area as all needed reconnaissance activity and necessary deployment of troops have been made for the operation. “Every movement of the terrorists is being monitored and every necessary detail is being taken care of to rid the country of the last bastion of terrorists’ infestation,” the NSA said. He explained that government is concerned about the welfare of every single Nigerian including the girls saying; “aside the Chibok girls, other Nigerian girls, boys, men and women were abducted by the terrorists and all efforts are being made to rescue them all.” While appealing for a little more time to complete the routing of terrorists, Dasuki noted that before elections were postponed in February, over 20 local governments were occupied by the Boko Haram sect, adding that most Nigerians were pleasantly surprised that so much has been achieved against insurgency within six weeks. He commended President Goodluck Jonathan for the successful conduct of the 2015 elections, even as he stressed that contrary to insinuation in certain quarters, nobody pressured the President into conceding defeat in the presidential election. According to him; “President Jonathan had already given his words to all the security and Service Chiefs before the election that he would abide by the decision of Nigerians.
