Obanikoro Backs Down, Sends Warning Letter To SaharaReporters Instead

After failing for more than a week to carry out his threat of filing a lawsuit against SaharaReporters in New York, and against The Punch and Premium Times in Nigeria, Nigeria’s former Minister of State for Defense, Musiliu Obanikoro, seemed to have chickened out by having a New York-based law firm send a mere warning letter to SaharaReporters.

A former senator, Mr. Obanikoro had been threatening legal action against SaharaReporters since the website first released, on February 5th, an audio recording in which he and other PDP officials are heard plotting to illegally manipulate the 2014 Ekiti State governorship election. The ex-Defense minister and his co-conspirators, including now Governor Ayo Fayose, are heard in turns berating Brigadier General A.A. Momoh and promising him promotions and other inducements for helping the PDP in its scheme to handicap APC members during the elections.

In the recording released by SaharaReporters, Mr. Obanikoro is heard stating that he was on “special assignment” from President Goodluck Jonathan to make sure the election was carried by the governorship candidate of the Peoples Democratic Party (PDP).

In a statement he gave to The Breaking Times, a Nigeria news site linked to Mr. Obanikoro, Mr. Obanikoro falsely claimed that his lawyers had served SaharaReporters with court papers last week, and that SaharaReporters had 42 days to prepare its defense.

Instead, a New York law firm emailed a warning letter to SaharaReporters on February 19th asking SaharaReporters to “cease and desist from making false and disparaging statements about Sen. Obanikoro on the Internet.” Under US rules of legal proceedings, such a letter does not amount to a lawsuit itself.

Since SaharaReporters first released the audio recording, a third party consultancy firm, Guardian Consulting, has authenticated Mr. Obanikoro as the voice offering a bribe to Brigadier General A.A. Momoh. In addition to the secret recording, a sworn affidavit was signed by a whistleblower present during the meeting where Mr. Obanikoro illegally bribed the army officer and plotted to rig the Ekiti State elections in 2014.

The warning letter sent to SaharaReporters also substantiates that Mr. Obanikoro was present during the meeting where plans were made to illegally manipulate the Ekiti State elections even though claims the conversations were vague and only relates to how the conspirators would ensure security .

Mr. Obanikoro’s warning letter comes just as he awaits Senate confirmation of his nomination by President Jonathan to a ministerial post. Analysts and observers, however, argue that Senator Obanikoro is trying to give a false impression of legal action against SaharaReporters in order to ease through his confirmation hearings.

The law offices of Tacopina and Seigel sent the warning letter on behalf of Mr. Musiliu Obanikoro. For days, Mr. Obanikoro and websites/social media outlets associated with him had made bones about Mr. Tacopina’s law firm as a firm that famously represented American baseball sensation Alex “A-Rod” Rodriguez in a case which he lost.

100% correct. We can all look at the almost complete decimation of the PDP at the polls in the SW, during the 2011 election, to appreciate this. I think these desperate PDP effort comes too late for many SW folks. My brother, believe me when I say the international community is appalled at the thought of having to work with GEJ for another 4 years. He is seen as a very dangerous 'weak link' who is compromising the system horribly. Buhari's working trip to the UK comes as a result of overtures to a President-in-waiting the west understand the highly "ineffective" (according to Obama) and terrorist-friendly PDP is trying to frustrate.

Remember Obama despatched Kerry to Nigeria to warn GEJ against election postponement because the world already knows the impotent, corrupt and incompetent GEJ wants to 'sit tight'? Even Ban Ki-Moon, UN secretary-general, has warned Nigeria not to postpone elections beyond the set date of 28th of March and 11th of April. I think the bottom line is that GEJ and his crew messed up horrendously and they appreciate they are in danger of not having a 'friendly hand' to take over and ignore their atrocities as has always been the case since the PDP began leading Nigeria in 1999. GEJ and co know the game is up but they don't want to end up like Laurent Gbagbo.

To be honest, not many are currently behind Jonathan. The election postponement only serves to accentuate the clamour for the dismissal of the ultra-awful Presidency of GEJ. I think it is all over for GEJ when Obama can try, close to the Nigerian general election, to prejudice opinion by announcing that "President Jonathan runs an ineffective government". This is a 'death sentence' announcement which means GEJ, already 'dead' in Nigeria, has virtually no allies abroad. He is a monumental failure whose position has now become untenable because his continuation in power represents huge danger for so many people and nations.

If APC published a "fake" picture of Buhari with a 'brand' like Blair then we would already know by now with multiple lawsuits initiated by the fattest law firms and lawyers in the universe. Tony Blair, if the images were doctored, would be the first to deny the picture vehemently because that development would compromise his brand image massively. Imagine that the very best electricity supply Nigerians can count on is about 8 hours a day on average? When you consider that many rural areas are not even connected to the national power grid and are yet to experience electricity since we became a sovereign nation then you begin to appreciate the wickedness of man towards his fellow man.

Nigerians know how GEJ has let them down because they wear the shoes of pain 24/7. The praise-singers of GEJ , because they are enemies of progress, are only deluding themselves about the inevitable outcome of things which is that Nigerians are ready to reject he grossly misruling GEJ any time elections are held.

We are to suddenly believe, given GEJ's deplorable nd self-serving antcedent, that this 'new drive' is anything other than an attempt at 'sit-tight' politics and an attempt for GEJ and his crew to ensure a soft landing for themselves? When has GEJ ever shown he values Nigerian lives? When? It is just sad that some choose to be dishonest and revisionist over what we have all had the displeasure to witness over the past five years GEJ has been President.

Indeed. It is then very difficult to accept this impending rejection, especially because Buhari is the incoming President , since this will mean an uncompromising probe of all their activities. Since the beginning of our fourth republic in 1999 this is the first time there is a risk, for a PDP President, that power may fall into 'unfriendly hands'.

PDP Presidents since 1999 (OBJ, Yar Adua and now Jonathan) do what they want in power because of the belief they will never be held accountable for their actions since they assume their Party, by hook or by crook, will always retain power and offer the 'customary protection' one outgoing PDP President can automatically expect from an incoming PDP colleague. Now, and for the first time, this 'arrangement' is seriously threatened by the emergence of Buhari and the belief majority of Nigerians have in him. The fear of the PDP establishment is palpable. They will therefore do anything to ensure it is "anyone but Buhari".
