Crime › DJ In Court For Killing Friend With Pestle by gulfer(op): 8:33am On Sep 16, 2016
An 18-year-old Disc Jockey, Ugbede Iyeh was on Thursday remanded in prison custody by the Lokoja Chief Magistrate’s Court 1 for allegedly killing his friend, Ikani Amodu, with a pestle.

Mr. Levi Animoku, the chief magistrate who gave the order in his ruling after the arraignment of the accused in Lokoja, Kogi State, said the count of culpable homicide preferred against the defendant and the manner in which the act was allegedly committed was horrifying.

The police prosecutor, Sergeant Tuesday Ganagana, told the court that the case was reported to the police by one Samson Ebenehi, the elder brother of the deceased.

It was alleged that the accused had on August 28, at about 8am, gone to the shop of the deceased, who was a barber, to download some music from the deceased’s laptop.

The prosecutor said the accused in the process deleted all music in the late barber’s laptop, which caused a misunderstanding between them.

He added that in the ensuing altercation, the accused “criminally took a pestle and hit the deceased on the head.”

“As a result, the barber fell down and became unconscious and was rushed to Peace Hospital, Anyigba, for treatment, but was confirmed dead on arrival,” Ganagana said.

The prosecutor submitted that investigation into the matter was still ongoing, pleading that the court should adjourned till another day.

He reminded the court that the offence of culpable homicide, under Section 221 of the Penal Code, was not bailable and therefore, urged the court to remand the accused in prison custody.

Animoku said the offence carried the highest penalty “in our law. Bail is not granted as a matter of course as Section 341(1) of the Criminal Procedure Code precludes the court.”

“The accused shall be remanded at the Federal Prison, Dekina. The case is hereby transferred to the Chief Magistrate Court, Dekina,” he added.

He also adjourned the case till September 27, 2016, for mention.

Politics › How Senator Elected 10 Months Before End Of Session Was Paid For 4 Years – Audit by gulfer(op): 9:06am On Sep 05, 2016
A Nigerian senator who replaced a deceased lawmaker barely 10 months to the expiration of the Seventh Assembly under David Mark, received full four-year pay for accommodation and furniture, the government’s audit report has shown.
A Nigerian senator who replaced a deceased lawmaker barely 10 months to the expiration of the Seventh Assembly under David Mark, received full four-year pay for accommodation and furniture, the government’s audit report has shown.
The 2014 audit report said the lawmaker was overpaid by nearly N8 million.
The report released this year, had earlier been submitted to the National Assembly, but its full details recently became public.
It contains shocking revelations of how state resources were squandered on bogus spending, and how officials, in many cases, arbitrarily spent billions of naira without explanations.
“A Senator who was elected to replace a deceased Senator, in the month of September 2014, 10 (ten) months to the expiration of the 7th Senate was found to have been paid full Accommodation and Furniture Allowance (of Four Years),” the report disclosed.
According to the report, N10, 132,000.00 (Ten million, one hundred and thirty-two 229 thousand naira) was paid to the Senator, “instead of N2, 533,000.00 (Two million, five hundred and thirty-three thousand naira) which represented his actual entitlement for one year.”
While there was no mention of the name of the lawmaker in the report, senate records show that Shem Zagbayi, Niger East, was the only lawmaker sworn in in September 2014 – the period referenced by the audit report.
Mr. Zagbayi, a member of the Peoples Democratic Party, was elected as replacement for Dahiru Kuta, who died in June 2014.
The audit report shows that Mr. Zagbayi was overpaid by the David Mark-led Senate by N7.6 million.
The report demanded the amount be recovered and paid back to government.
Although the audit report said the overpaid Senator had 10 months to serve, records show Mr. Zagbayi actually served for just seven months, as a court later ruled that his election was fraudulent in the first place.
On March 11, 2015, the Minna, Niger State, division of the Court of Appeal, sacked Mr. Zagbayi about three months to the end of the Seventh Senate.
The court affirmed an earlier ruling of a Tribunal which cited malpractices and non-compliance with relevant laws, and granted victory to the All Progressives Congress candidate, David Umaru.
Mr. Umaru who was sworn in April 1, 2015. He later returned to the eighth senate, and is currently the chairman of the committee on judiciary and human rights.
It was not immediately clear if Mr. Umaru, like Mr. Zagbayi, was paid for four years instead of the barely two months he had to serve in the Seventh Assembly.
Mr. Umaru did not answer calls or reply to messages from PREMIUM TIMES.
There is no evidence, also, that Mr. Zagbayi made any refunds to the government. He too could not be reached for comments.
Mr. Mark, who authorized the humongous pay for Mr. Zagbayi, could not also be reached, for comments.
His spokesperson, Paul Mumeh, did not answer calls placed to him.

Politics › N1.9b Contract: Court Shifts Orubebe’s Trial Due To Domestic Accident Read More by gulfer(op): 10:43am On Aug 31, 2016
…says he’s being unjustly persecuted
The case instituted by the Independent Corrupt Practices Commission against former Minister of Niger Delta, Godsday Orubebe, has been rescheduled following a domestic accident involving the former minister. Orubebe Orubebe is reported to have been injured on the leg in his Ministers Quarters apartment, thereby forcing the trial judge to move the case to next week, according documents sighted last night by our correspondent. The government, through the Independent Corrupt Practices and other related offences Commission (ICPC), filed the charges against the former minister at a federal capital territory (FCT) high court, Abuja. Orubebe is to be arraigned alongside Oludare Lawrence Alaba, Ephraim Towelde Zaki and Gitto Construction Limited on a five-count charge of corruption, perjury, and diversion of about N2bn meant for the dualisation of Section IV of the East-West Road. Count one of the charge reads: “That you, Elder Godsday Peter Orubebe, sometime in September 2015 or thereabout at the Independent Corrupt Practices and Other Related Offences Commission (ICPC), Abuja, within the Jurisdiction of this Honourable Court, did make false statement to officers of the Independent Corrupt Practices and Other Related Offences Commission (ICIP), Messrs Eric Anona, Isiona Okolo and Bukar Galadima in the course of their official duty, when you informed them in writing respecting the contract for the dualisation of Eket Urban Road that the decision to rehabilitate instead of dualisation was taken when you had left office as Minister of the Federal Republic of Nigeria which information you knew was false and thereby committed an offence contrary to Section 25 (1)(a) and punishable under Section 25 (1) (b) of the Corrupt Practices and Other Related Offences Act 2000.” Count two reads: “That you, Elder Godsday Peter Orubebe, sometime between 2010 and 2014 or thereabout, while being a Hon. Minister of the Federal Republic of Nigeria, deployed to the Federal Ministry of Niger Delta Affairs, Abuja, within the jurisdiction of this Court, used your position as minister to confer an unfair advantage upon Gitto Costruzioni Generali (Nig.) Ltd by circumventing the approval of the Federal Executive Council respecting the contract for the dualization of the Eket-Oron Road when you took a decision to rehabilitate the road contrary to the award letter reference No. WR14522/Vol. 1/55 dated 28/09/2006 as approved by the Federal Executive Council and you thereby committed an offence contrary to and punishable under the section 19 of the Corrupt Practices and other related offences Act, 2000.” But Orubebe told our correspondent last night that he was unduly being persecuted since he knew nothing about the said payment, which the ICPC investigated and found nothing incriminating against him about a year ago. “My hands are clean and I did not do anything wrong throughout my tenure as Minister of Niger Delta. I want Nigerians to know that I am being unjustly persecuted and that what they are doing to me is unfair,” Orubebe said.

An analysis of the 2014 Budget Proposal of Nigeria

Budget 2014: Beyond heads and figures
By Obo Effanga.

As the National Assembly resumes for 2014, one of the key functions it is expected to dwell on is the consideration and passage of the budget proposal as prepared by the Executive. As citizens, we owe our country a duty to interrogate the contents of the proposed budget and offer our views. This, it is hoped, would help our parliamentarians, as our representatives, to make informed decisions when considering the proposal for passage.

One way to look at the budget proposal however is to consider what each of the heads and figures allocated means for our country and its development. Here are a few of those queries.

The first observation to make is that the budget proposal allocates 76.3 per cent to recurrent expenditure and just 23.7 per cent to capital expenditure. One interpretation of this is that the budget is meant to just keep the country and its institutions running with nothing spectacular to show for. A budget focused on massive development of infrastructure would assign more to capital rather than to recurrent which covers personnel and overhead costs.

There are however a few noticeable exceptions which are to be commended. These include agriculture and rural development that allocate N35.1bn to capital and N31.4bn to recurrent respectively; water resources, N30.6bn and N7.7bn; power N59bn and N3.3bn; transport, N29.3bn and N8.1bn; works, N100.1bn and N28.5bn; lands and housing, N12.8bn and N5.6 and aviation N26.1bn and N6.1bn.

The rest of the 42 Ministries, Departments and Agencies will spend more on their recurrent than on capital and in some instances the difference is so huge. Here are a few cases: The Ministry of Interior, which is expected to spend N144.7bn in recurrent and just N6.29bn on capital; Police formation and commands, N285.5bn and N6.79bn; Education including UBEC, N443.9bn and N49.5bn and Health, N216.4bn and N46.3bn.

Zeroing in on the Interior Ministry’s budget shows that the Prisons Service would spend N45.2bn on recurrent and a mere N2.3bn on capital. With such lopsided allocation, it is doubtful if our prisons infrastructure would be revamped from their current state of dilapidation and dehumanisation this year. Equally difficult to carry out would be construction of new prisons to decongest the present number, even as the country has just signed a deal with the United Kingdom that might see the repatriation of more than 600 Nigerians serving jail terms in the UK to come home to complete their sentences.

But why is the recurrent expenditure so huge? Perhaps, we should look at what typically appears under the recurrent expenditure, particularly under the overhead costs. Here are a few of such expenditure heads which need more explanation to the Nigerian public. What do we mean by “Welfare packages”, which will gulp as much as N40.4m in the headquarters of the Ministry of Water Resources? Please note that the said figure is not for the entire ministry and agencies under it, rather for the headquarters. Welfare package typically appears in the budget of every MDA and one wonders who audits this spending. How is the money disbursed, to whom and under what circumstances? Who determines the quantum to be disbursed in every office? Under what rules of engagement or laws did we turn our government offices to welfare package disbursers? This budget head is one that needs to be checked or discouraged as it is susceptible to abuse and corruption.

Other heads of interest demanding explanation include “Cleaning and fumigation services” (for which the Headquarters of the Ministry of Foreign Affairs would spend N201.7m and the Ministry of Niger Delta Affairs will spend N25m on) and “Anniversaries and celebrations (for which the Ministry of Women Affairs will spend N71.6m)”. There are also budgetary heads for “Printing of security documents”; “Printing of non-security documents”; “Field and camping materials supplies” (N4.39m in the Ministry of Women Affairs); “Uniforms and other clothing”; “Refreshments and meals” (N16.7m in the Ministry of Women Affairs); “Honorarium and sitting allowance” and “consultancy services for budget preparation” (N8.36m in the Ministry of Women Affairs). This last bit suggests that the Ministry of Women Affairs has no internal personnel to prepare its budget for the year and for that reason it would procure consultant(s) to help it do so and it would then part with N8.36m.

There are even more interesting, or intriguing budgetary provisions elsewhere, including the State House. For instance, the State House Headquarters plans to purchase an embalming machine at the cost of N1.65m and a hydraulic post-mortem table at N4m. What morbid humour! Of course, we know what embalmment and post-mortem are about, but in the State House Headquarters? No doubt, there is a clinic in the State House, but I am not sure that the clinic caters for a very large number of clients requiring it to have every kind of specialised units including a mortuary. I am sure any such requirement for embalmment and post-mortem would not be routine and frequently required in a clinic in the State House and thus the said equipment cannot be seen as necessities. If and when such needs arise, referral could be made to larger state hospitals like the National Hospital. But apparently, our State House functions as an integrated town that must have every facility within. After all, it has its own church (chapel) and mosque and even a zoo where N8m would be spent to upgrade and maintain it and an additional sum of N14.5m would be spent to purchase two beasts, all for the pleasure of its privileged patrons. And this is after we budgeted N7.5m for wildlife conservation in the State House last year.

Still in the State House, there is a plan to spend N76.3m to purchase “crested cutlery, flatware and glassware”. Now, isn’t that too much to spend on those items, for a State House that has existed for years and been playing host to several dinners? We don’t dispose of dinnerware on a yearly basis, do we?

General maintenance in the State House will cost N1.19bn of which N138.9 will go for motor vehicle and transport equipment maintenance; N907m for office and residential building maintenance; N17.4m for office furniture maintenance and N40m to maintain office and IT equipment (that comes to spending more than N3m each month to maintain office and IT equipment in the office of the President). Recalling that only last year, we budgeted N90.9m for this same item, it is bewildering why we plan to spend so much this year. Yet, this is aside N188.3m to be spent on office stationery and computer consumables (for which we budgeted N507.9m last year).

A peep into the budget for the Ministry of Foreign Affairs brings its own excitement or outrage. For instance, we plan to spend money for the maintenance of plants and generators in several of our foreign missions, including the one in London. It’s with the same incredulity that we notice the plan to spend money in fuelling boats and aircraft in virtually all of our foreign missions. As an example, we plan to spend N2.38m and N1.78m respectively for the above services in our Foreign Mission in Abidjan. As earlier mentioned, the foreign ministry’s headquarters would part with N201.7m for fumigation and cleaning services during the year.

There is this entry of N100m for the maintenance of Nigeria’s seat in the UN Security Council. Pray, what does that come to? One would think that since we have a permanent representative to the UN, that office would be responsible for attending Security Council meetings, which cost would be borne by the UN anyway. So, what would the N100m be used for?

Other interesting budgetary provisions proposed in this ministry include N40m for “global power on women’s empowerment, HIV and SRHR’ and N9m to be spent by one of its agencies, the Institute for Peace and Conflict Resolution for “building democracy as an instrument of peace”. And although every MDA budgets for health insurance subscription as well as medicals, there is still this curious budgetary head in the foreign affairs ministry known as “cost of medical treatment for Mrs. XYZ (I have withheld the real names) at St. Andrews Burns Service at Broomfield Hospital” for the sum of N49.76m. I am just curious why an individual’s name is listed in a federal budget as a spending. Who is the person? Why is this cost not subsumed in other medical costs or covered by insurance?

Next, the Ministry of Foreign Affairs plans to spend N834.4m to purchase and freight 40 “representational cars” to 40 of our foreign missions. This translates to N20.86m as average cost for the cars. Wouldn’t this cost be reduced if these cars are bought in the locations they are to be used?

No doubt, the above are just some of the numerous line items in the budget proposal that one could query, not necessarily because they are fake, but sometimes because they don’t appear to show prudence in the management of our resources.

As the National Assembly considers the budget, it is hoped that the lawmakers would be detailed enough to query these and more bogus and phoney entries in the Appropriation Bill.
