Twin suicide attacks believed to have been carried out by Boko Haram bombers in two Borno communities have killed no fewer than five people. A security source said a male suicide bomber in Kimba village, south of Borno attempted to enter the market and suddenly his bomb exploded prematurely, killing two people. A woman and her baby were also injured in the process. “Today is Kimba market day and some suicide bombers attempted to invade the crowded market on Friday morning but were prevented by some vigilante members. However, the bomb-laden vest of the suicide bomber exploded prematurely and two people died at the scene,” the security said. The blast occurred at about 9am yesterday in Kimba some 55 kilometres to Biu, headquarters of Biu Local Government. Also in Sabon Gari, few Kilometres to Kimba, another female suicide bomber detonated explosive devices at a security checkpoint and killed three other persons. “She was on queue at the checkpoint, unknown to them she was carrying IEDs She is a Boko Haram suicide bomber. LAWYERS to the Independent National Electoral Commission (INEC) have, in a legal opinion forwarded to the commission, asked it to cancel the inconclusive November 21 election in Kogi State. The law firm of Awomolo and Associates, in the legal opinion submitted to the commission on November 24, 2015, said with the death of Abubakar Audu as the governorship candidate of All Progressives Congress (APC), the electoral commission should have cancelled the election and started a fresh process. The legal opinion, signed by five Senior Advocates of Nigeria (SAN), Adegboyega Awomolo, A.B. Mahmoud, Dr Onyechi Ikpeazu, Hassan M. Liman and Ahmed Raji, indicated that the crisis over the inconclusive election could have been averted if INEC had countermanded the election and kicked off a fresh process. The lawyers said in the 10-page letter that since the constitution did not envisage the death of a candidate during an election and since no candidate had been duly elected, the commission should have simply cancelled the entire process. According to the lawyers, the Kogi scenario had failed to meet the conditions under Section 179 of the 1999 Constitution and also failed to meet the circumstances contained in Section 36 of the Electoral Act 2010, which indicated what was to be done if a candidate dies before the commencement of polls. “The foregoing frontally deals with a situation where poll had not been commenced. This section did not anticipate a situation where poll had commenced but was not concluded. “Though it may be argued that the section is not on all fours with the present case, it could, however, be contended that for the reason that ‘poll’ is yet to take place with respect to the polling units over which supplementary election is scheduled (which is yet to commence), the principle within that section could still be applicable. “If the latter scenario is adopted, then, clearly, there will be a need to countermind the poll and indeed the entire process cancelled. “The foregoing is supported by a combined effect of sections 178(1)(1),186,187(1) of the Constitution, which stipulate that there must be a candidate for the office of a governor as well as a candidate for the office of a deputy governor before a nomination can be valid,” the letter read. The counsel concluded that the way out for INEC was to cancel the inconclusive poll. “We are of the opinion that the best option in the circumstances is to countermand the election to the office of the governor of Kogi State, call for a nomination of another governorship candidate of the All Progressives Congress and schedule another date for election in all the 21 local government areas of the state,” they added. Meanwhile, all is now set for Justice Gabriel Kolawole of the Federal High Court in Abuja, to deliver judgment on the contentious issues that emanated from the November 21, 2015 governorship election in Kogi State, which was declared inconclusive by the INEC. At the resumed hearing of the matter on Thursday, counsel for all parties adopted and argued their various briefs for and against the decision of INEC to proceed with the December 5, 2015 supplementary election. The court also heard arguments from counsel on the burning issues with respect to declaratory reliefs sought by the contending politicians and their political parties. Specifically, while Governor Idris Wada is urging the court to compel INEC to issue him a certificate of return as the only surviving candidate with the highest number of votes in the election, James Faleke, on the other hand is also, asking the court to order INEC to declare him winner of the election. Other plaintiffs in consolidated suits, Emmanuel Idakwo, John Jacob Usman and Honourable Emmanuel Igbokwe had, in their various suits, asked the court to compel the electoral body to contact fresh election in the state following the death of Alhaji Abubakar Audu, the governorship candidate of the APC in the election. In canvassing their various arguments, counsel for INEC, Yahaya Bello and the APC submitted that the court has no jurisdiction to adjudicate on the issues raised by the plaintiff, saying that the appropriate court is the election petition tribunal. On the other hand, Falake’s counsel, Chief Wole Olanipekun, Pius Akubo for PDP and Chris Uche for Captain Wadadisagreed on the ground that since no candidate had been declared winner, the matter could not be heard by the election petition tribunal. Eyinnaya Abaribe, a Peoples Democratic Party (PDP) senator from Abia state, on Tuesday urged the senate to summon President Muhammadu Buhari over the scarcity of fuel across the country. Abaribe said since Buhari is the “senior minister of petroleum”, he should be asked to explain the cause of the scarcity. He said the federal government under his party was criticised for spending billions of naira on fuel subsidy and wondered why the current administration was taking the same approach. Earlier, Barau Jibrin (Kano north), and 28 senators co-sponsored a motion on the current situation. The lawmakers observed that fuel scarcity had remained a recurring problem in the country, adding that it was time to put a stop to the trend. Debating the motion, Gbenga Ashafa, an All Progressives Congress (APC) senator from Lagos state, urged his colleagues to give their approval to the N465bn supplementary budget of President Muhammadu Buhari so that subsidy claims could be settled, and Nigerians eased from hardship. In as much as I would want APC to win, I won't support setting bad precedent. First of all AGF mentioned the power of substitution for a candidate dies but didn't add " before the election" as the law states. I believe that election is to allow the majority to select whom they want to rule them. Therefore there should be a specified candidate throughout the election. What sense does it make that in a single election some people will vote for a particular candidate and others vote for another candidate all for the same party? I criticized the case of Amaechi vs INEC because it sets bad precedent. If you say it is the party that has the vote, why should a Governor decamp from his party and still retain his position? That is incongruent logic. Electorates are voting based on the: 1) the Party ( Manifesto) 2) the credibility of the candidate. If the too are not complete throughout the election, the election should be reconducted. |

HOW Did THIS AGITATION COME THIS FAR? Well, it’s been a very long journey and for people like us, it is not surprising. The agitation for Biafra is not news to us because it has been there over time especially since 1966 with what gave birth to the overthrow of the Aguiyi Ironsi government after the killing of some top leaders. The agitation has been there and that was what led to civil war in 1967 when Odimegwu Ojukwu came on board against the state and the reconciliation in the 1970s. Ever since, there had always been one agitation of the other. But the truth of the matter is that nobody is happy about the situation and all of us felt that it would not augur and it is not even in the best interest of this country for any part to secede now. This is a critical and very challenging time. And it is high time we began looking at the issue critically. We are only pretending that Nigeria is a nation, it has never been a nation. We just pray that it would become a nation. There are very fundamental issues that need to be addressed by any government in place and, to do that we must apply the principles of equity, justice and fairness to all. The moment we begin to say this group of people must be dealt with decisively because of their mindset or thinking that they are being marginalised, then there is a problem. In resolving this problem now, do you suggest that the report of the last National Conference should be looked into? The report of the National Conference cannot be a reason to start looking at a new Nigeria because even some of us have issues with the Confab and its composition and how it went. This government must be open because if we cannot sit down and discuss it, then there is a problem. This government must be create an atmosphere and engage everyone. I believe a Sovereign National Conference is the answer to this whole thing and there must be no no-go area. People must be allowed to discuss issues. Often, when the issues of national discourse emerge, these mischief makers, these crooks who are 80 percent criminally-minded people at the National Assembly would tell you that they are the ones to discuss them. President Buhari asked Governors to cut down bogus pensions for Governors and their deputies. According to a reliable source, “He was very blunt about it and said that it was something that was going to be done immediately, especially because it is not something that can be suspended. “The feeling was that not only was it wrong and morally unconscionable, but that it was not something that should be encouraged, and he was appealing to them that it should be changed,” the newspaper quoted a source. The pension law in Lagos, Kwara, Rivers, Edo states are 100 % basic salary while that of Oyo state is put at 300%. The Lagos State Governor and Deputy Governor Pensions Law of 2007 provides that “a former governor and family (spouse and children both married and unmarried) are entitled to free medical treatment which is not capped. Another highlight is that the ex-governor is entitled to a cook, steward, gardener and other domestic staff who are pensionable. The benefits: Annual Basic Salary: 100% of annual basic salaries of the incumbent governor and deputy. Accommodation: One residential house in Lagos and another in FCT for the former governor; one residential house in Lagos for the deputy. Transport:Three cars, two backup cars and one pilot car for the ex-governor every three years; two cars, two backup cars and one pilot car for the deputy governor every three years. Furniture:300 per cent of annual basic salary every two years. House maintenance: 10 per cent of annual basic salary. Domestic staff: Cook, steward, gardener and other domestic staff (no limit) who shall be pensionable. Medical: Free medical treatment for ex-governor and deputy and members of their families (not just spouses). Security: Two DSS operatives, one female officer, eight policemen (four each for house and personal security) for the ex-governor; one SSS operative and two policemen (one each for house and personal security) for the deputy. PA: 25% of annual basic salary. Car maintenance: 30% of annual basic salary. Entertainment: 10% of annual basic salary. Utility: 20% of annual basic salary. Drivers: Pensionable (no limit to number of drivers). Severance gratuity: Not specified. 100% of basic salary in Kwara The law stipulated that qualified former governors and their deputies be paid pension for life, without other perks like accommodation, cars, etc. The law was reviewed in 2010 by Bukola Saraki, a former governor of the state and a serving senator, who with the support of the state House of Assembly imposed outrageous raises on all the benefits. The 2010 law gives a former governor two cars and a security car, replaceable every three years. The governor is also entitled to a “well-furnished 5-bedroom duplex,” furniture allowance of 300 per cent of his salary (which totals over N6 million). The law also gives the governor five personal staff paid for by the state, eight policemen, three DSS operatives (of which one must be a female), free medicals for the governor and the deputy. Other entitlements are 30 per cent of salary for car maintenance, 20 per cent for utility, 10 per cent for entertainment, 10 per cent for house maintenance. 100% of basic salary in Rivers The Rivers pension law was first approved in 2003 by former governor, Peter Odili, having been passed by a state assembly headed by the present governor, Chibuike Amaechi as speaker. The 2003 pension law provides pension for life for governors and deputies, defining “pension” as embodying annual terminal basic salary, annual transport allowance, annual rent subsidy, annual utility allowance, entertainment allowance, domestic staff of not more than four. The new law gives the former governor a house in Rivers State and anywhere in Nigeria. The former governor is also entitled to pension for life at the rate of the governor’s basic salary, 300 per cent of salary for furniture paid every four years, three cars every four years, free medical and 10 per cent for house maintenance. The law gives the former governor a security detail comprising two DSS operatives, four police officers, 30 per cent for car maintenance, 10 per cent entertainment, 20 per cent utility and several domestic staff. 100% of basic salary in Edo The Edo State House of Assembly on May 16, 2007 passed a law entitled ‘Provision for the Pension of Rights of the Governor and Deputy Governor of the state. It provides for 100 per cent pension for the governor at a rate similar to the salary of the incumbent office holder and for domestic staff among others for the former governor. 300% of annual salary in Oyo The Oyo State Pension Law 2004 provides that the Governor and Deputy Governor after leaving office shall be entitled to Pension for life at a rate equivalent to the annual salary of the incumbent Governor or Deputy Governor. Among all the small, medium and large companies/industries across the federation, the people from the SE own 45 -50% and they all pay corporate taxes to FG Check out the obvious Marginalization. 1) The SE has the least number of states per GP zone. 5 while you have 6 in some and 7 in another zone. Automatically their numerical strength in the federal legislature is reduced. Again the number of LGAs in a Northern State is 44 even far more than double of a state as populous as Lagos and almost triple of some SE States. 2) 80% of the importation in the country is done by the people of SE yet they do not have a single sea port. And dredging of R. Niger has been turned to project for political manoeuvring whereas we all read here the amount FG spends always to create irrigation and other agricultural facilities in other zones. Yet duties for imported goods keep increasing and a wide range of goods tagged contraband without adequate facilities made available by the government for the growth of Local industries for such goods. 3)Check by yourself the FG appointment and parastatals manned by the S Easterners and compare it with other GP zones. 4) The SE people are most enterprising and the zone with highest travel rate both locally and internationally but just got an international airport yet some international airlines bidding for licence to travel to Enugu were denied. On the road creation and maintenance the strategic Onitsha-Enugu Express way, Oba-Okigwe Express way ( to mention a few) are no longer plied by the motorists. I think it's high time NUC started looking into this blatant exploitation of teeming Nigerians struggling to get education by the private varsity owners. This is one of the banes of capitalism. It is true that the school owners are into business but they shouldn't be allowed to frustrate the efforts and ambitions of their helpless students. I am sure if some students had known of this spate of increments in school fees, they wouldn't have registered and now only God knows the number that will quit their studies. I'm not against increment in the school fees but that should be done reasonably based on certain standards. The NUC should monitor to see that there is commensurate improvement in the standard of education offered and the general wellbeing of the students. The school should be mandated to give at least 2yrs notice of such impending outrageous increase in the school fees and at what rate. By so doing the students and their guardians can way their capacity to avoid going on school halfway. |
