For all intent and purpose our independent union captures the core of democratic theory in referring to "Governments ..deriving their just powers from the consent of the governed."
Free and fair elections are essential in assuring the "consent of the governed," the bedrock of democratic politics. They are at once both power- and legitimacy-conferring instruments, just as unfair and dishonest elections may cast doubt on one's claim to office and diminish one's ability to govern: "the dependence on the people". Which is obviously and most importantly the primary control on the government."
By determining peacefully those who shall govern and by bestowing legitimacy on the decisions they make, elections provide answers to crucial questions faced by any political system. These goals are more easily achieved when the characteristics of an electoral system encourage a widely shared perception that elections are both free and fair. Factors encouraging this perception are a franchise and an access to the ballot that are more inclusive than exclusive; an equality of votes so that no vote counts more than another; and election outcomes determined by rules established in advance, with minimal cheating and fraud in the casting and counting of votes. These standards for free and fair elections were in place yesterday unlike past elections in our political history where ballot box stufings are the top order of the day.
Few argue that electoral politics in Lautech is perfect as Some of its features from time to time don't seem to have hindered, deflected, muted, or distorted the people's consent by determining winners and losers, they simply accomplish what elections are designed to do. Defeated candidates and their supporters willingly, if not cheerfully, defer to the victors and acknowledge their right to rule with the notable example of the last year Arexzie /Dr young post election hug at Faculty of Management sciences. This is no small achievement. Such acceptance presupposes a stable political system where ultimate values and interests are rarely, if ever, at risk.
Barely 24hrs ago,Lautech witnessed one of the most free and fairest elections ever conducted in the Campus Unfortunately as fate struck the election was pronounced suspended and the electoral commission led by Oke Oluwaseun Isaac Dr Young dissolved.
As early as 6:40, Divergent contrasting irony of fate started to dawn on both the opposition and the ruling party which began striking them one after the other.
There were many‘ifs’ just 20 hours after the purported cancelation of the May 28, 2015 lautech student election–that even as transitional as it is from manua to e-voting, it is still considered freest and fairest.
If the parliamentarians, that voted the pronounced dissolved electoral chairman, had known that their decision to vote him would ultimately one day soon Put our union on the brink of extinction that the election he was saddled to orchestrate would lead to the plethora of crises that Lautech would take long to get over, they may not have acted in that manner.  Indeed if he, the electoral chairman had known that this  electoral process can in no little way be influenced or tampered with without producing events that would spiral to a fatal end for him, he may not have sought the chairmanship of the Electoral commission. 
Ethically and Legally, no one has the right to cancel an election that is less than 5 minutes from being over, But as we know, the winner takes it all mindset in Lautech is trying to make the situation on the ground so terrible as the ruling class smelled they have lost this election they wouldn't give room for the wish of the people and decided to hold the whole school to ransome by choosing not to declare a winner they fear would not be from their side of the divide.
That either Zeal or Solace,Bepo or Babalola might have won the election fairly and squarely but was not declared or that some collegians were circumstantially not allowed to exercise their civic right as ladokites both are matters that neither is as big as making the election cancelled.
As early as 8am on Thursday when voting timetable was announced student from college were zoned to cast their votes using the Lautech e-voting facility in the school library latter the electoral chairman swiftly resorted this time announcing that collegians are to now vote in the New college with about 70 laptops already on there way to the college.
Hustle followed tustle yet about 40% of collegians willing to vote could not successfully cast their votes as at 3:pm while almost every centres inside school have closed for the business of the day. Seeing the blunder they have unleashed on collegians the electoral committee then re-mandated collegians to start voting inside school using all of union buses to convey collegians to where they were originally alotted to vote and extended the elections by a further 1hour 30minutes with all this going on the commission still argued that collegians were not allowed to vote,
My million dollar question is who did not allow them? And have they being doing on those laptops since morning ?
If During the Nigeria general elections, election was not cancelled because there was no election in about 22 polling units nationwide and some prominent areas in Rivers and Akwa-ibom state why not can umpire Dr Young led commission entrusted with our Mandate pronounce the result from our student union election.
The nasty fact is that our winner-take-all election system, has the potential to leave up to 69.9% of the Ladokites feeling unrepresented whatever their department or Level is.
Ladokites interest has, however, become less relevant to political umpires such as Dr young and his crews, despite the role of our a political structure saddled with sustaining differences based on Affliation. It was largely supplanted yesterday by party agenda and selfish ideologies that has become a characteristic of Lautech politics.
Because of our peculiar electoral law, the Student Union government is divided between two parties.
I just Pray Ladokites are yet to because if a winner is not pronounced I fear for our unity as Passaites would never stop seeing Famasaites as enemies and Fabamsaites would not stop seeing Passaites as enemies.
Our Prayer is that the school would remember a part in the second stanza of our school anthem insinuating that our union is to Foster unity and would no matter what give us our election results whether Zeal or Solace whether Babalola or Bepo ladokites have decided and nobody no matter how provostial should not and we hope would not be allowed to edit the voices of Ladokites.
We hope in future the country and fellow alma-matas would emulate Lautech's e-voting arrangement as ladokites have proved it to be fairest sort of Electioneering.

I found Lola Shoneyin's piece on Buhari titled, "How My Father's Jailer Can Offer Nigeria A Fresh Start" very engaging although it dredged up some very painful memories. It took me down memory lane; indeed, it was a vivid reminder of an awful road on which l and others like Audu Ogbeh, now an ardent Buhari backer, travelled. It was my painful duty as the “Captain” of the detainees, to receive Lola's father, Engr. Tinuoye Shoneyin into the Abeokuta prison and to make him as comfortable as possible in the extremely difficult prison environment, providing him with clothes, a towel and toiletries. Engr. Shoneyin had, as a matter of courtesy, responded to the invitation of the government of Ogun State then led by Colonel Oladipo Diya, who later became the deputy to Gen. Sani Abacha, to answer some questions and had expected to be back home that evening. He was not to return home for six months!
Lola's account dwelt on the torture that she (at such a young age) and her family had to endure and the telling effect of such an experience on the family. Many detainees never recovered from the torture and the injustice that this experience represented. In many cases, mine included, there was no accusation, much less a charge. One slight misstatement in Lola's account was that the detention was at the behest of Col. Tunde Idiagbon, the erstwhile deputy to General Buhari. I doubt if that is quite true. The problem with autocracy is that once the atmosphere has been established or allowed by the leader, many tin gods at the various levels of the strata will for any number of reasons, exploit the situation for the purpose of settling personal and petty scores including disputations over girlfriends! So in the case of Lola's father, the local despot at the time was Colonel Oladipo Diya who was mean, brutal and sadistic and locked up as many people as he wanted, for good, bad or sometimes no reason at all. He flogged civil servants for lateness, taxed the people on every imaginable score, and signed for nearly 20 people who had been sentenced to death (none of whom his predecessor permitted to be killed), to be executed by hanging in one day. He reveled in making people suffer wherewith he was promptly given the name of "Kunya" meaning tormentor which was the direct opposite of what his name “Diya” means in the Yoruba language. He was, indeed, the harbinger of torment and suffering. He it was who saw a ghost in every situation. If the sun was too bright he blamed it on the dethroned politicians. He was a cruel taskmaster who tried irrationally to get water out of stone. At a stage he rounded up contractors who had done various jobs for the state government and dictated that they should either pay certain arbitrary fines or be locked up in prison.
I was in the gulag for 18 months, 16 of which l spent in the Abeokuta prison. Prior to this time, I had presided over three Ministries in four years and three months. There was never an accusation or a charge of any sort against me. His investigators were surprised at how clean my affairs were and how l could succinctly explain every transaction l was involved in including providing photocopies of cheques that even pre-dated my appointment. "Were you expecting that this type of thing would happen? Why did you leave a thriving law practice for a job like this?" they asked me repeatedly. Therein lies the dilemma of our country that needs good people to preside over its affairs, yet castigates the few who dare to get in the fray. "The punishment for the wise who refuse to take part in the government of their people," said a Greek philosopher, "is to be ruled by fools."
I came to understand that Diya's grouse with me was that l was so close to the late Chief Olabisi Onabanjo, my governor, and that there was no way of getting Onabanjo without getting Adefulu his political son and confidant! "Onabanjo did nothing Adefulu did not know of," Diya was reported to have said repeatedly. So l had to be purged! Oluokun the head of state security, himself a dastardly character, was Diya's hatchet man. When all efforts at intimidation and harassment failed, they changed tactics and tried to recruit me as an informant against Onabanjo. It soon became clear to them however, that I was not going to be party to their pursuit of crass injustice and motive hunting. I asked Oluokun pointedly to cock his gun and shoot and kill me because under no circumstances would l be part of such villainy. In any case, unless l wanted to become a liar, such incriminating evidence did not exist except in the figment of Diya's convoluted imagination. Onabanjo was the quintessential leader - open, fair minded, as straight as a spoke and a great lover of the people; a man who, to this day, several years after his demise, l still hold in the highest regard.
At the time of my incarceration, my family was at a more delicate stage than the Shoneyins, because it was younger and less endowed. My first son Adeoye, was just under 10 years and our last daughter, Dayo was three months old. I was 37 years old at the time of the coup. My family was subjected to a long and extremely humiliating deprivation. It was the unjust compensation l received for a job to which l gave the very best of my life at a very young age (try as you may, such injustice never leaves you. The wound may heal but the scar is there and sometimes stares you in the face). I tried hard to be strong and for the most part, l was. The knowledge that I had served with the very best of my ability in a job l truly enjoyed, gave me peace of mind and assurance. The open and vocal agitation of many well-meaning citizens such as Professor Wole Soyinka for my release was an act of grace for which l will forever be grateful. The only time l broke down was the day my son, Adeoye, turned 10. With a smuggled recorder, I had recorded a birthday message for him and his young siblings admonishing them to be strong in the knowledge that God was on our side. After recording the message, l wept profusely. It was terrible! My co-prisoners, including my Deputy Governor, the late Chief Sesan Soluade, and the present Emir of Suleija, Alhaji Anwal Ibrahim, the erstwhile Governor of Niger State, and the others, tried hard to console me. I had been the strong one, the encourager of the brethren, but l guess the cup had become too full and it ran over.
While time heals, the impact of such injustice endures. It leaves a telling effect which you carry for the rest of your life. Ironically, when l was finally released, l was in hospital where l had just undergone an emergency operation. Liberty had come at last but it met me totally broken and incapacitated. At my release and after, no one offered any apology for this gruesome and very unjust recompense. Nobody, without due process, should ever have the power to visit such humiliation and injustice on any human being. The irony of dictatorship is that a leader can be so conscientiouslywrong in his crusading mission. The Buhari regime was very wrong in my case as in the case of several others. I, along with many others, had come into office with the purest motive of service. It was what l had always wanted to do. I thought it was my life's mission and when the opportunity came l did the work as if my life depended on it. I left a lucrative practice to serve my people. I was totally accountable, yet l was unfairly thrown into jail for no just cause for 18 months!
That was many years ago and since l have focused on re-building my life and raising my family. I have prayed and tried hard to forgive my unjust tormentors but l know that the scar is there and people like Lola Shoneyin stroke that weak point now and again, albeit unwittingly. Obviously this is not an experience that can be wished away because it evidently affected my being and changed my life fundamentally. It makes me appreciate people like Mandela so much - 26 years on Robben Island (have you been there?) and he came out with no bitterness and no guile! Such men are rare!
Understandably then, it has taken some effort for me to embrace Buhari's candidacy. I have never voted for him. I did not even like him. But as my friend, Audu Ogbeh said to me once, "so much has gone wrong with our polity, that our emphasis now must not be on ourselves but on the survival of the nation." I have no doubt he is right. This is a time when the overriding interest must be that of the country. As a student of history, l know that while constitutions can be copied and adopted, in the end every nation will only learn by its national experience. The history of many of the democracies we admire today is replete with unimaginable and odious occurrences that characterized their development. It is obvious to me that the trust we reposed in President Jonathan in 2011 has been wantonly squandered.
The sobering state of our nation and realpolitik has made me take another look at Buhari. How viable is he for our polity given the available options? Is the General, the devil he is portrayed to be, or a victim of circumstances or a misunderstood individual? To me President Jonathan has been such a disappointment in many critical areas of our national life. There has been unprecedented violence and blood letting under this administration,which, naively in my view, treated the Boko Haram insurgency with kid gloves and a total lack of resolve. Today, Boko Haram has established a formidable force and has succeeded, before our very eyes, in changing the map of Nigeria. The President appears to have turned deaf ears to the voices of wisdom and surrounded himself with cronies whose main pre-occupation is to exploit him. Some of his spokesmen have made a virtue of rascality and turned public relations upside down. Miscreants who should be in jail for their past deeds are the ones now threatening that our collective vote must go a particular way or there will be insurrection. We never heard of "democracy" at gunpoint till now.
To the discerning, it is clear that the Boko Haram insurgency has been employed as a source of inscrutable abuse, or how else do we explain a Nigerian private plane filled with raw US dollars being impounded abroad? How many such planeloads escaped without being caught is anybody's guess, yet our troops are said to be so ill equipped that the insurgents have better arms. All this despite the huge sums that have been voted for defence under this administration;one wonders where all that money went. Then the massive corruption in every sphere of public office - pension funds stuffed into pillows and mattresses, etc. The disgusting state pardon for a man who, before an incredulous world, broke the terms to a court order and left Britain dressed as a woman! This is not how a leader should exercise such hallowed prerogative power. The President's conduct sent a chilling message down the spine of the polity that corruption and stealing are the way to go. You can add to that the company of shady men wanted abroad for all manner of crimes, including drug offences, who have been installed in positions of leadership in the PDP or have been fielded as Senatorial candidates. The management or lack of it of our foreign reserves (which have become totally depleted) and reports of billions of missing dollars dominate the air. Everybody who is working hard is in trouble. Joblessness has risen to record levels. The youths are, justifiably restless because they have no future in the present dispensation. The tales of woe are just endless. Billions of dollars have disappeared into petroleum subsidy yet even the cost of kerosene, the poor man's fuel, is at an all-time high. It is the oil sheiks that are being subsidized not the ordinary people. To say the ship of state is clearly adrift in Nigeria is an understatement.A land that should be flowing with milk and honey has become the laughing stock of the international community. We simply can no longer tolerate this grotesque level of gluttony and of corruption. There is an urgent need for a change otherwise, we face a huge problem and social dis-location ahead beyond what we already have.
These are the reasons why l have embraced Buhari. If you look at his past, and some of the statements credited to him, he is not an easy man for a person like me to embrace. But 30 years is a long time and l honestly believe he has had enough time to reflect and to change. He is no more a military officer. He has retained a sharp, social conscience for the people. I am impressed with the hunger with which he has fought for elections. I want to believe that it is out of an earnest desire to work for the people and to do some things right that General Buhari has struggled so hard to win the nation's leadership through the electoral process. While he may not be a saint, he is certainly not a villain. His choice of a very good man in Professor Yemi Osinbajo, for a Vice President gave me the assurance that Buhari was listening to the comments on his areas of weakness. There are enough checks and balances in a democratic set up to make fears of a return to dictatorship a joke. I am also impressed by his modest lifestyle, unlike many of his ilk who live in opulence and indulgence. This says something about the man. I can trust this man with my wallet in a way l cannot do with Jonathan who appears to have forgotten where he came from. Jonathan has lost the golden opportunity to fundamentally affect the lives of the ordinary folks. I am persuaded that it will be a tragedy for us to continue in this drift for another four years. While Buhari is far from being my ideal candidate and l worry about some of his deficiencies, my perception is that although he may be short on the skills required for the modern management of a state - technology, economic management etc. - his record shows that he has the ability to enlist support. I hope this time he will choose the right people and avoid those who will use his name to do iniquity. While Buhari may not be the ideal candidate we need, he is, certainly the best we have. There is a time in the history of a nation when an individual is needed to rescue it or perform a historic role. As it was with Winston Churchill who provided Britain with the much needed war-time leadership, General Charles de Gaulle who restored the confidence of France, Madiba, Nelson Mandela of South Africa who championed the cause of majority rule and showed the way to national reconciliation and our own Gen. Olusegun Obasanjo who provided leadership to a country on the brink after the Abacha years, my belief is that this is the hour for Muhammadu Buhari to stop the torment of a hemorrhaging nation and restore its confidence.
Lastly, the General owes me one. I will still like Buhari to vocalize an apology and offer some succour to people like me whom his government brutalized in the past. It is the least he can do. To do so is not weakness. Indeed, it is strength to admit the mistakes of the past and to promote national reconciliation.For now, even ahead of the apology, and in the national interest, l have thrown in my hat with Buhari. So has Lola Shoneyin's father. Now 87 but still spritely and alert, my big brother and comrade, Engr. Tinuoye Shoneyin, always a big heart, is enthusiastically by my side at political rallies and party support meetings. Our jailer has become our hope. Life is indeed nothing if not an agglomeration of ironies.

Osun Tribunal Update.

Aregbesola declared winner of the August 9, 2014 Gominatorial Electionsmiley


The tribunal ruled that the Petitioners failed to prove allegations of improper accreditation. On the allegation of non stamping of result by the Petitioners, the Tribunal ruled that the result sheets were properly signed and stamped.

On the allegations of intimidation and prevention of people from voting, the tribunal ruled that no evidence was led. On allegations of over-voting, the Tribunal ruled that no single evidence of over-voting was proved by the petitioners.

On allegation of using O'Yes as INEC officials, there is no such evidence on record as what they have are two O'Yes member who testified as agent and not INEC official.

The Tribunal ruled that there is nothing expert in the so called expert witness report.

On the complaints that INEC did not call witness, the Tribunal ruled that the petitioners is duty bound to discharge the onus to prove the allegations.

In this case the petitioners failed to prove their allegations to warrant INEC calling evidence.

Atakunmosa East, apart from abandonment of pleadings, the testimony of the witness here is unreliable and cannot be relied upon.

We do not know how testimony of a single witness can aggregate all the contested polling units in the Local Government.

Fenerbahce star, Emmanuel Emenike has told
AfricanFootball he is prepared to stay out of
the Super Eagles if coach Stephen Keshi
believed he is the problem of the team.
Keshi has been quoted as saying he is unhappy
with the AFCON 2013 top scorer, who he
sensationally benched in last month’s AFCON
qualifier against Congo in Calabar.
However, Emenike says he has utmost respect for
Keshi.
“I have always treated Keshi like a father, and he
has always lived in my heart to be a goodfather.
Before now, we have been enjoying a smooth
relationship and I see no reason why he should
be holding grudges against me.”
“Keshi is a good coach, a coach with high
pedigree. I give him all the respect I can give my
father whenever I come for a national
assignment.
“Everything changed after the Nations Cup,
everything about him towards me changed and I
decided to stay on my own,” he further revealed.
“But I am very surprised by what he said that he
and some players in the Eagles are not happy
with me. Over what?
“I don’t want Nigerians to see me as being proud
or arrogant, but if the coach thought inviting me
to his team will not bring result or peace to the
team, he can let me be.
“I have maintained a solid relationship to avoid
quarreling with him, but if my invitation to play
for Nigeria does not stand for peace, I will like to
stay focused with my club,” Emenike said.
He added: “I have always loved to give my best for
Nigeria and I always make it known that I can
always fight to score goals for my country and I
will not like coach Keshi to let Nigerians see me as
an indisciplined player who is not ready to give
them my best again.
“My Super Eagles career is as important as my
club career. Coming to play for Nigeria was the
biggest decision I have ever made in my life. And I appreciate the way the fans have been striving
hard to cheer me up whenever I push for goal.”
He stated that: “I have never seen the Super
Eagles camp as my father’s house, it’s a temporary place for everybody, and why should we be making problems for ourselves? he asked.
“If Keshi thought inviting me is a problem to his
selection or the team, I will prefer to stay back
and maintain my big respect for him”.

This question of whether Mr Ayo Fayose is qualified to contest for Governorship election in Ekiti where he had earlier been Governor under controversial circumstances has been raised by analysts in several fora . The Nigerian constitution states the Qualification for Governorship in Sec.182.
The PDP took a great risk albeit an unpardonable one to present a candidate with so much moral and legal baggages in such a critical election when there were other competent and credible alternatives available. Fayose was impeached as Governor of Ekiti state in 2006 after a panel constituted by the Chief Judge had found him indicted on fraud related offences as reported to the House by EFCC. A careful reading of S 182 e and i of the Nigerian Constitution will
give a proper ' caveat emptor' or constructive notice of the risks involved in presenting a character like Fayose for an election apart from several moral debilities which are still fresh in the memories of Ekiti people!
"S 182. (1) No person shall be qualified for election to the office of Governor of a State if -
(a) subject to the provisions of section 28 of this Constitution, he has voluntarily acquired the citizenship of a country other than Nigeria or, except in such cases as may be prescribed by the National Assembly, he has made a declaration of allegiance to such other country; or
(b) he has been elected to such office at any two previous elections; or
(c) under the law in any part of Nigeria, he is adjudged to be a lunatic or otherwise declared to be of unsound mind; or
(d) he is under a sentence of death imposed by any competent court of law or tribunal in Nigeria or a sentence of
imprisonment for any offence involving dishonesty or fraud (by whatever name called) or any other offence imposed on him by any court or tribunal or constituted by a competent authority for any other sentence imposed on him by such a court or tribunal; or
(e) within a period of less than ten years before the date of election to the office of Governor of a State he has been convicted and sentenced for an offence involving dishonesty or he has been found guilty of the contravention of the code of Conduct; or
(f) he is an undischarged bankrupt, having been adjudged or otherwise declared bankrupt under any law in force in Nigeria; or
(g) being a person employed in the public service of the Federation or of any State, he has not resigned, withdrawn or retired from the employment at least thirty days to the date of the election; or
(h) he is a member of any secret society; or
(i) he has been indicted for
embezzlement or fraud by a Judicial Commission of Inquiry or an Administrative Panel of Inquiry or a Tribunal set up under the Tribunals of Inquiry Act, a Tribunals of Inquiry Law or any other law by the Federal or State Government which indictment has been accepted by the Federal or State Government; or
(j) he has presented a forged certificate to the independent National Electoral Commission........."
Curiously in his present contest, Fayose is no longer ebullient about his HND qualification from the Polytechnic Ibadan which was hotly challenged by some alumni and media organizations. It should be recalled that a lot of drama ensued as the authorities of the Polytechnic somersaulted in first denying and later accepting he was their graduate. This time Fayose has allegedly played safe by claiming only his School Certificate in his INEC form.Afterall this is the minimum educational qualification in the Constitution. Is this an indication of forgery of
earlier qualification or a denial of it?
There are some analysts who believe that Fayose hoodwinked the leadership of his party to take the slot believing that he would thereafter upon winning the election be clothed with immunity. That would effectively frustrate his on going trial for humongous fraud during his first tenure and others like the Murder trial for killing of one Omojola in Ifaki which was suspended for Fayose"s being at "large"
It would be seen in no distant future whether a state of intellectuals such that has been described as land of knowledge and honour could harbor yet again such personality at its highest level of governance. Some have argued that anything can happen in politics particularly in the state of poverty that many of the electorates are. A large percentage of the voters are unemployed young graduates, pauperised adults,artisans and peasants who could be energized even against their collective future by few wads of naira currency. Also in this clime,memories are short as Nigerians are known to forget so soon even monumental events in their recent history.Agreeably this is the tragedy of African democracy.This doesn't make PDP- and it's leadership -a party of such huge prime position in the politics of Nigeria shine in the sun. The party ought to be at the fore front of enhancing integrity and sanity in our politics. Sadly it has not.
No doubt the lack luster performance of the current Government in Ekiti has opened a window for the PDP which during the tenure of former Governor Segun Oni raised the bar of Performance and good governance and thus a formidable structure to climb upon.Sadly this opportunity seemed already frittered.
It is worrisome however that the intellectual and integrity gate keepers of Ekiti are either asleep or their voices have become muffled by personal considerations or economic realities.This is a sad commentary on a state that has produced world class giants like chief Afe Babalola SAN,Chief Ayo Ogunlade,professors Ade
Ajayi,Sam Aluko,Osuntokun, Banji Akintoye,Lola Borisade, Tunde Adeniran etc Or is this not the state of Prince Adelusi Adeluyi, Ayo Ajayi former MD UAC,Gbenga Oyebode Chairman Access Bank,Wole Olanipekun SAN ?to mention but a few.Ekiti state presents a paradox .Indeed a potent lesson of how not to leave politics in the hands of the dregs of the society.Our collective value is depreciated in the process.

REPORT OF THE INVESTIGATION PANEL OF SEVEN PERSONS APPOINTED BY HONOURABLE JUSTICE JUBRILL B.K. ALADEJANA ON THE ALLEGATIONS OF ACTS OF GROSS MISCOUNDUCT LEVELED AGAINST THE EXECUTIVE GOVERNOR OF EKITI STATE. DR. AYODELE FAYOSE DATED 16TH DAY OF OCTOBER 2006
Report of the Report of the investigation panel of seven persons appointed by Honourable Justice Jubrill B.K. Aladejana on the allegations of acts of gross misconduct leveled against the Executive Governor of Ekiti State - Dr. Ayodele Fayose.
Introduction: Pursuant to section 188 (5) of the 1999 Constitution of the Federal Republic of Nigeria, this panel of seven persons was set up by Honourable Justice Jubril B.K. Aladejana on Friday, 13th October 2006.
The seven persons are:
1. Mr. Emmanuel Bamidele Omotoso Chairman
2. Deacon Olajubu Solomon Owoeye Member
3. Eng. Ismail Olowolafe Dayisi Member
4. Mr. Kayode Failani Member
5. Pastor (Mrs) Funmi Adeniyi Member
6. Rev. Father Anthony Oluwole Ijasan Member
7. Major J. O. Odusina (Rtd) Member
Venue: Ekiti State House of Assembly Complex Ado-Ekiti
Rules of procedure: Pursuant to section 188, subsection 7(a) of the constitution of the Federal Republic of Nigeria, 1999 the Ekiti State House of Assembly prescribed the Rules of procedure which are 23 in number, hereinafter referred to as "the Rules".
This panel in compliance with section 188 (7) (a) of the 1999 constitution of the Federal Republic of Nigeria 1999 exercised its powers and functions in accordance with the Rules.
Notices: Notices of sittings duly signed by the Chairman of the Panel were dispatched to all the parties concerned viz:-
(i) The Speaker of the House,
(ii) The Executive Governor of Ekiti State - Dr. Peter Ayodele Fayose and
(iii) The Deputy Governor of Ekiti State - Chief (Mrs.) Abiodun Olujimi.
Commencement of sittings: Relying on rule 4 of the Rules, the Panel commenced its sitting on 13th October, 2006 at 10.30a.m.
Attendance: The legal Representatives of the House of Assembly and Deputy of Governor of Ekiti State Rowland Otaru, SAN, with Gboyega Oyewole, Tayo Aluko, Akintude Esan, and Joseph Omodele Adewumi Esquire respectively.
Absent: The Executive Governor of Ekiti State, Dr. Peter Ayodele Fayose and his legal representative were absent.
Witnesses: Ekiti State House of Assembly called three witnesses and closed its case. The witnesses were viz:-
(a) M.P. Ogele, Esquire, a private legal practitioner and National Coordinator of Ekiti State Equity, Justice and Peace Movement.
(b) Abubakar Aliyu Madaki, Deputy Superintendent of Police attached to Economic and Financial Crimes commission. (EFCC).
(c) Mr. Gbenga James, Managing Director, Biological Concepts Limited, Afao-Ekiti, Ekiti State and Avian Specialties Nigeria Limited, a close friend of Dr. Ayodele Fayose.
These witnesses were cross-examined by the legal representative of Her Excellency, Chief (Mrs.) Abiodun Olujimi.
The Executive Governor - Dr. Peter Ayodele Fayose and his witnesses failed to appear before the panel but forwarded his response to the 7 allegations of gross misconduct against him. The Deputy Gov., Chief (Mrs) Abiodun Olujimi called no witness. Her legal representative rested her case on the House of Assembly.
Addresses: Learned counsel to the Deputy Governor Joseph Omodele Adewumi Esquire addressed the panel followed by learned counsel to the House of Assembly, Rowland Otaru, SAN, with Gboyega Oyewole, Tayo Aluko and Akintunde Esan.
Close of proceedings: After the addresses of the aforesaid learned counsel, the proceedings of the panel was declared closed on 14th day of October, 2006, when it became obvious that the Governor of Ekiti State - Dr. Peter Ayodele Fayose would not attend the panel sittings.
Report:
Dr. Peter Ayodele Fayose, The Executive Governor of Ekiti State.
After careful consideration of the evidence of the witnesses for the Ekiti State House of Assembly which was unchallenged by the Executive Governor, the panel hereby reports thus:-
Allegation One:
Illegal Operation of Foreign Accounts contrary to paragraph 3 of the Code of Conduct for public officers to wit.
Operation of foreign account with the Bank of Africa, United State of America with VISA CREDIT NO 45397806 and 28083056 valid until August, 2007, contrary to the provisions of paragraph 3 of the Code of conduct for Public Officers.
Evidence: Olatunji Adegoke, Personal Assistant to the Executive Governor, Dr. Peter Ayodele Fayose in whose custody the credit card No. 45397806 was found made confessional written statement to the Economic and Financial Crime Commission on 24th day of July 2006 to the effect that the aforesaid credit card belonged to Dr. Peter Ayodele Fayose. The statement was tendered in evidence by EFCC representative. A copy of the Visa credit of the Bank of America U.S.A. valid until August 28 with the signature of the Executive Governor, Dr. Peter Ayodele Fayose, was also received in evidence. The evidence was unchallenged.
Verdict: Guilty
Allegation Two:
Illegal Operation of Foreign Account Contrary to paragraph 3 of the Code of Conduct for Public Officers to wit:
Operation of Foreign accounts Nos: 50633925, 60642924 and 808909594 kept with Barclays Bank Plc. 38, Hans Crescent Knightsbridge, London, SWL XOLZ contrary to paragraph 3 of the Code of Conduct for public officers.
Evidence: The EFCC tendered a copy of the Premier Bank Account of Barclays Bank Plc, 38 Hans Crescent Knightsbridge, London with account No 50633925 and Account Name Mr. Ayodele Fayose and same was received in evidence. This evidence was unchallenged.
Verdict: Guilty
Allegation Three:
Illegal diversion of Local Government Funds contrary to Section 162 of the Constitution of the Federal Republic of Nigeria 1999.
Diversion from the Ekiti State Joint Local Government Account the sum of N11.7 Billion received from the Federation Account from January 2004 to June 2006.
Evidence:
There are overwhelming evidence to the effect that various sums of money from the Ekiti State Joint Local Government Account were diverted to illegal quarters. The evidence were uncontroverted.
Verdict: Guilty
Allegation Four
Receipt of illegal gifts contrary to paragraph 6 of the Code of Conduct to wit:
Receipt of the sum of ₤37,000.00 (Thirty Seven Thousand Pounds sterling only) from the Biological Concepts Ltd. Knowing it to be the proceeds of the Poultry Project embarked upon by the State Government.
Evidence:
Mr. Gbenga James, The Managing Director of Biological Concepts Ltd. Gave evidence before the Panel that out of the money for the Integrated Poultry Project he gave ₤37,000 (Thirty Seven Thousand Pounds sterling) to Adegoke Olatunji the Personal Assistant to the Executive Governor, Dr. Peter Ayodele Fayose on the instruction of the Executive Governor.
Verdict: Guilty
Allegation Five:
Receipt of the illegal gift contrary to paragraph 6 of the Code of Conduct to wit:-
Receipt of a house lying and being at 10 Kobiowu Crescent, Iyaganku, GRA, Ibadan Oyo State valued at over N40 million built from the proceeds of the poultry project.
Evidence:
Evidence was led by the prosecution to show that there was an agreement between Mr. Gbenga James, the Managing Director of both Biological Concepts Ltd. and Avian Specialties Ltd. And the Governor to build a building worth 40 million at Ibadan from the proceeds earmarked by the State Government for the poultry project.
Mr. Gbenga James gave evidence that the building drawn by Grid Associates was actually built at 10 Kobiowu Crescent, Iyaganku G.R.A. Ibadan, Oyo State valued N40 million being part of the money earmarked by the State Government for the poultry project.
The building plan of the said building was tendered through Mr. Gbenga James by the prosecution.
Various documents to corroborate this evidence were tendered and received in evidence.
Verdict: Guilty
Allegation Six
Receipt of illegal gifts of two houses contrary to paragraph 6 of the Code of Conduct to wit:-
i. Property lying and being at 23, Ring Road Restaurant Street, Behind Total Petrol Station, Iyaganku, GRA, Ibadan, Oyo State valued at about N20 million built from the proceeds of the contracts of Ekiti State Governor's Office awarded to Grid Associates headed by Abiodun Fari-Arole.
ii. Property lying and being at Are Road, Afao-Ekiti State valued at about N25 million built from the proceeds of the contracts for Fountain Hotel awarded to Grid Associates headed by Abiodun Fari-Arole.
iii.The sum of N42 Million collected from Mr. Abiodun Fari-Arole of Grid Associates through Mr. Ayobola Abiola, then of the Standard Trust Bank Plc, now with FCMB Plc, Dugbe Branch being proceeds of the contract for Fountain Hotel and Governor's Office.
Evidence:
This allegation was substantiated with unchallenged oral documentary evidence tendered by the EFCC and Mr. Gbenga James, the Managing Director of Biologicawl Concept Ltd. and Avian specialties Ltd.
Verdict: Guilty
Allegation Seven:
Illegal transfer of the sum of $100,000 to the United State of American contrary to the money laundering act 2004.
Transfer of the sum of $100,000 to the United State of America on 20th August, 2004 through Account No 45703770 of City Bank, 244, Mani Street, White Palms NY 10601 belonging to Mr. Toney Orubuloye contrary to the money laundering Act, 2004.
Evidence:
The EFCC representative gave evidence that Abiola Ayobola of Zonal Head-West First City Merchant Bank Ibadan transferred a sum of $100,000 dollars to the United States of America on 20th August 2004 through account No 45703770 of City Bank, 244, Mani Street, White Palms NY 10601 belonging to Mr. Toney Orubuloye for the benefit of His Excellency Governor Ayo Fayose and personal staff who reportedly ran out of cash in United State of America.
This evidence was unchallenged.
Verdict: Guilty.
Conclusion:
In view of the available evidence before the Panel, the Panel came to the conclusion that all the aforementioned allegations of acts of gross misconduct against the Executive Governor of Ekiti State. Dr. Peter Ayodele Fayose have been proved.

A House of Assembly Member in his first year receivesN100Million for constituency project. In the second year, he receives another N100Million. In his third year, he receives another N100Million. In the fourth year, another N100Million.
He has officially received N400Million on your behalf! This is outside the numerous kickbacks and loots he has received from projects he had influenced into the state budget for this period.
Five months to the end of his tenure, he calls for an 'empowerment' programme. He buys 50 okadas, 20 keke Napeps, 5 Sienna cars, 30 sewing machines, 30 I- pass-my-neighbour generators, and gives 10k to over 20 persons. All these things are shared to only his party faithfuls despite the fact that the money belongs to all irrespective of party affiliation.
Also, he mentions a number of schools he has renovated, a number of desk he has donated to numerous primary schools and other 'petty' constructions which is not more than N20Million. All these he has done within his four year tenure. Also, he distributes half a million Naira to party excos who automatically endorse him for a second term!
The following week, the jobless youths and miserable village women who have benefited from the empowerment are sponsored to come out with placards to beg the legislator to run for a second term. He considers their demand, and accepts it as a sign of his excellent previous performance. He gives them money for transportation through a proxy and the next week he declares for his second term ambition.
Now if you calculate all that he has done, you will see that out of the N400Million he has collected on your behalf for four years, he has barely spent 15% of it on you. You should even be thankful that he has intention of running for a second term, or else, you wouldn’t even have seen a bicycle. Why should he empower you when he does not need you again.
Whatever happens to the rest 85% or even more of the money this legislator has received on your behalf is not your business. After all, you did not buy his party nomination form for him while he was contesting, neither did you contribute to his campaign in anyway. So why do you think you can reap from where you did not sow?
Many Nigerian electorates are stupid people. How can a lawmaker or Governor buy an okada for you and you accept it as empowerment in this modern age. Tell me, are you not stupid? Can you feed your family with an okada? Can’t you see he is giving you death? Funny enough, this practice is going on in the 774 Local Governments in Nigeria, annually.

Dr. Chris Nwabueze Ngige
Ngige was born on 8 August 1952. A medical doctor by profession, Ngige graduated from the University of Nigeria-Nsukka in 1979.He immediately went into the civil service, serving at the National Assembly and State House clinics at different times. He retired in 1998 as a Deputy Director in the Federal Ministry of Health.
Thereafter,Ngige turned to politics,becoming a founding member of the People's Democratic Party(PDP).By 1999, he was Assistant National Secretary and Zonal Secretary of PDP in the South East region of the country.
In 2003, he was elected governor of Anambra State in controversial circumstances.He quickly broke ranks with his political godfather, Chris Uba brother of Andy Uba, after an unsuccessful attempt on 10 July 2003 to have him removed from office,through a fabricated letter of resignation which the state assembly accepted.However,in August 2005, an election Tribunal led by Justice Nabaruma nullified Ngige's 2003 victory.He appealed to the Nigerian Federal Court of Appeal, but the annulment was confirmed on 15 March 2006,in a judgment awarding victory to Peter Obi of the All Progressives Grand Alliance(APGA). No further appeals were possible, and Ngige accepted the judgment in good grace, calling on the people of Anambra to give their total support to his successor.
Ngige's 33 months in office were characterised by populist programmes, especially road construction, leaving him in good standing with the electorate.
Following Peter Obi's subsequent impeachment,Ngige attempted to participatein state governorship elections in April 2007,but was frustrated by a dubious Independent National Electoral Commissionand federal 'disqualification', even after a Federal High Court had voided the disqualification.In the final event, Obi's impeachment was overturned anyway,and Obi served out his four years.
He was elected Senator for Anambra Central Constituency in April 2011.
In April 2011, Ngige ran for election for Senator of Anambra Central under the then Action Congress of Nigeria Now All Progressive Congress,After voting problems in some areas of the constituency on 9 April, the election in these areas was held on 25 April and Ngige was declared the winner over former Minister of Information and Communications Professor Dora Akunyili of the APGA, with 69,765 votes to Akunyili's 69,292.

can somebody please help me define suffering to this dumbass... Chelsea is suffering yet it has won more Trophies than Arsenal and United both Combined in the last 5 years,the only team in the u.e.f.a history to have won the champions league and the Europa cup back to back...
If chelsea is suffering then football in the world is suffering.

A Twitter account, believed to be
that of the ball-boy, suggested
that he had planned to use time-
wasting tactics if the ball reached

Yohan Cabaye was forced to
apologise after clashing with a
ball-boy in Newcastle's loss at
Everton last season, although he
was not reprimanded during the
game.
Should Hazard only face a similar
punishment?
The Belgian was dismissed
during the game, presumably for
violent conduct which carries an
automatic three-match ban.
A famous case that comes to
mind is that of Eric Cantona,who
was banned for an initial eight
months after his kung-fu kick on
a Crystal Palace fan. It could be
argued that hazard's case is not
