I would say ask for sponsorship 3/6 months into the role after gaining good understanding of the role and proving you are useful. At that point, they would rather sponsor you than hire a new person but if you say it now they may begin to weigh their options and may find alternatives. This is what I did and I got sponsored last year.

Also, if they don’t at least you have got the experience and can start shooting your application elsewhere. All the best.

giselle237:
pls ask the employer about sponsorship. This or the next. But since it is graduate visa and you have sometime till next year then you might also want to take your chances and hope for a better opportunity next year with your now band 7 experience in hand. Your graduate visa is till nov 2025 you say so I feel there is time.
Also follow all the advice above mine

Didn’t get the email .

My own opinion on the whole saga is owner trying to save face, reported all staffs with less hours to avoid HO getting to know about workers with less hours by themselves, to avoid terminating its licence
I have resent it and thanks for clarifying.

Ok thanks. Was wondering how home office found out too until I saw someone mentioned that the employer informed Home office. That’s crazy. Did the person refused to take more hours?

I have also responded to your email. Thanks again.

Schoolhike:
Minimum hours to be sponsored is 37 or 37.5hrs I guess. So, if you’ve been working less than that you ain’t meeting the HO requirements. But there are some exemptions shaa (like sickness, maternity, strike action etc)

Hi, please if you don’t mind for the sake of others to learn from what do you mean by visa was withdrawn due to less hours?

Schoolhike:
Oh sorry maybe the use of my grammar is wrong , Visa withdrawn as a result of non compliance to Home office rules (less hours).

Got letter from HO to leave Uk by June (60 days expiration) letter came in late I guess or maybe they did not receive letter early.

Happy to connect with you. DM?

I know I only come here once in a while but cheers to everyone that shares important information on this thread. You are treasured!

Any data professional in the building, would love to connect. Plus is there a thread or even forum network for Black Data professionals in the UK?

I have recently ported from project management to a core data quality role (did MSc.data science) so need to overcome my imposter syndrome and be confident in my dealings with ‘onyibo’ and colleagues.

Thank you very much. I feel more confident now and will check YouTube as advised.

Goodenoch:
Completing a self-assessment and running a business are two completely different things that'll never intersect in this specific context.

Investing in stocks is not 'running a business' so you can invest £1 Billion if you have it and make millions in dividends or price appreciation, and it won't be a violation of your visa rules.

Taxes for the dividends depend on your overall income and you pay tax on it as usual with income after you subtract your personal allowance (typically £12,570) and also subtract the £500 dividend allowance. How you will pay depends on how much it is - here's the HMRC explainer page. You can also call them. The link is in the page - https://www.gov.uk/tax-on-dividends

Youtube videos can also be helpful in breaking it down further.

Thank you very much. Unfortunately I already opened an account. Would have liked to use your referral link.

Just to confirm please, if the stock dividend exceeds £500 for a tier 2 visa holder is that deem as a business with the need to complete a tax assessment?

Also, is that a violation of the visa rule?

Lexusgs430:
Hi,

Thank you Lexusgs430.

Yes the visa holder has a national insurance number and why do you ask please?

- To open any share dealing account, your national insurance number, is one of the requirements......

I’m confused about your second point please. Does this mean a tier 2 visa holder MUST not buy and hold shares outside an ISA?

- You are permitted to buy, sell & hold.... You can hold shares outside an ISA account, but it's more tax efficient to open an ISA account.........

Speaking of ISA, can a tier 2 visa holder open a LISA and receive benefit of the £1K for every £4K saved towards buying their first home? Is that seen as receiving public funds?
- Yes, you can open a LISA account (if you're under 40 years old) + hope to buy a new build + property is not over £450K (check this figure)........

What’s GIA please?

- General Investment Account

Lastly, so opening a trading 212 invest account and buying and holding stocks outside an ISA is a form of business as you may have to complete a tax assessment once the dividend exceeds £500? Before it does, is it still safe to buy and hold?

- Very safe .......🤣

Don't forget to use my T212 referral link..... We both receive free shares.......😁

Lexusgs430:
- Does this visa holder, have a national insurance number......
- Buying stock and shares, is classified as a form of trading/investment
- You have tax efficient ways of buying stocks/shares.... Simply open an ISA account, you can invest £20,000 per tax year (free of taxation)......
- If you open a GIA, you would be expected to pay tax, over any capital gains above £500.00.........
- Trading is indeed a form of business, some investors receive over £1500 dividends payout monthly........🤣😁

Hi great people, please can a visa holder buy and hold stocks and shares? Will that be perceived as a form of trading or investment? Also, if one can and the dividend exceed £500 does it mean one has to file a tax return (will this then become a business?)?

Will appreciate your responses. Thanks

Thanks. I believe they should be aware that I will need to update my visa as they asked during the hiring process the type of visa that I am currently on. I will check with them as you have advised if they can increase the salary which I doubt (they can be stingy is my fear and not agree to increase) and understand what their initial plan is.

Zahra29:
Lol I think HR/the employer is trying to pull a fast one here? (There's actually a Secondment Worker Visa but it doesn't apply in this case).

Even if the move was temporary, how would they explain/prove that to the Home Office if they paid them a visit? Unless they plan to conceal the facts?

Note the following:

If you are an employer of a sponsored migrant whose employment details have changed, or if you are working in the UK on a skilled worker visa and there have been changes to your personal details or circumstances, these changes will need to be reported within a specific timeframe. Failure to comply will mean the sponsor and/or the visa holder will be in breach and could face Home Office penalties.

Reporting a skilled worker change of circumstances
When sponsored under the skilled worker route, an individual is permitted only to be employed in the specific capacity stated on the Certificate of Sponsorship (CoS) with the company who has sponsored their employment in the UK.

The Certificate of Sponsorship outlines the following information:

Personal details of the migrant
Place of work
Role to be undertaken
Salary, hours of work
Duties and responsibilities

If any of the above details change, this must be reported to the Home Office within 10 working days. Here, the reporting duties lie with the sponsor and with the migrant worker

So even if it was a temporary move, it would still need to be reported within the stipulated time period. The exception here is if the other job was supplementary, I.e. 20 hrs max a week - but his main role would still be his current one.
TravelRe: Living In The Uk-life Of An Immigrant (part 3) by Ibro99: 4:52pm On Apr 11, 2024
Ok thanks. There was also the option on accepting the offer on a secondment or permanent basis. Is it necessary to update such if on a secondment which is liable to be temporary?

Zahra29:
I don't think the individual meets the new entrant requirements due to his current permission being a Tier 2 visa.

I would advise the options in bold as HR should really be looking to increase his salary in line with the going rate for the new occupation. Speak to them and see what they say.

I wouldn't advise accepting the offer and not updating the visa. If Home Office does an audit, both the individual and the company would be in trouble as he would in effect be doing a different job to what has been declared to the Home Office.
TravelRe: Living In The Uk-life Of An Immigrant (part 3) by Ibro99:
Hi Zahra,

Thank you for this. Honestly, I’m surprised the new salary threshold is not being discussed here as I for one have been worrisome since the hike in salary thresholds for Tier 2 visa.

Please I want to get advice on if one already on Tier 2 visa (for 3 years) intends to change role with the same employer but the new job salary does not meet the new lower going rate. The person salary is £34k, current occupation code is 3131 and new job occupation code (junior data engineer) is 2133 (according to the CASCOT). The person is now 27 years and completed MSc in 2021 and spent less than 4 years in the UK including graduate visa (not sure if person meets entrant requirement). What should one do before accepting the offer:

- inform HR that the new job salary does not meet the threshold for the occupation code in order to update visa.
- Not mention it and accept offer as the need to update visa has not been mentioned (whose responsibility is it and is there any implication if one does not update or how will they know)
- Reject offer as current salary is well enough for current occupation code and wait to renew visa even though salary thresholds were mentioned to be liable to change regularly.
- Request salary increase to meet new occupation code before accepting offer.

Please I would appreciate any advice that you have. Thank you.

Zahra29:
Do you think major immigration policies are implemented and reversed just like that?

The ban is still in force. Scroll down to the eligibility requirements section:

SW 29.1A. In SW 29.1(a) and (b), P must not have (or be applying for) entry clearance or permission as a Skilled Worker sponsored for a job in:
(a) the SOC 2020 occupation code “6135 Care workers and home carers” or “6136 Senior care workers”, or
(b) the SOC 2010 occupation code “6145 Care workers and home carers” or “6146 Senior care workers”,

Good afternoon all, Congrats to all those that secured admission, funding and visa.

I’m currently preparing applications for a Masters in Electrical Engineering (non-thesis), I recently took the Gre which really hit me but I’ve decided to proceed using it. Please I will greatly appreciate any help

My profile
GPA (free wes evaluation): 3.8/4
GRE: 153Q, 155V
IELTS: 8.0
Work experience: Industrial training for 6 months (and NYSC posting to a school)

I have tried to pick out a few schools that I think would fit my profile (mostly as a result of the Gre)
Texas tech
Texas state
University of texas Dallas
University of texas Elpaso
Texa A&M kingsville

However I can only afford to apply to 3 schools, please I would appreciate your suggestions and advice, I’m also open to other school suggestions (preferably in Texas. Thank you
Hello, i have been a tacit member here. Also, preparing to write my GRE soon. Please how did you go about your free WES evaluation for GPA.
