PoliticsCourt Fixes Date For Contempt Suit Against Gov Makinde by Ify05(op): 3:59pm On Jun 18, 2019
An Ibadan High Court on Tuesday, fixed July 30 to hear a contempt suit filed by the Association of Local Government of Nigeria (ALGON) , Oyo State Chapter, against Gov. Seyi Makinde on the dissolution of 33 Local Governments and Local Council Development Area (LCDA) in the state.

ALGON, through its Counsel, Mr Kunle Sobaloju, also named the Oyo State House of assembly Speaker, Commissioner for Local Government and Chieftaincy Affairs and the Attorney-General and Commissioner for Justice in the suit.

The News Agency of Nigeria (NAN) reports that the court had earlier ordered Makinde not to dissolve the LG and LCDA in the state but the governor went ahead to dissolve them immediately after his inauguration on May 29.

Sobaloju informed the court that the application to set aside the governor’s order was filed on June 10.

He argued that the governor was making steps to appoint caretaker chairmen for the LGs and LCDAs.

Counsel to the state government, Mr Oluwaseun Dada, told the court that the application to set aside the order of the governor dissolving the LGs and LCDA has not been serve on him and therefore not ripe for hearing.

Dada said that the argument that the governor was taking steps to appoint caretaker chairmen was a hearsay and the court cannot act on such.

The respondents’ counsel also told the court that he has filed an application for a stay of execution of the judgment of the court.

Dada prayed for an adjournment to enable him serve the respondents in the matter.

PoliticsUsman Jubril Endorsed For Kogi Governor By APC Leaders, Elders by Ify05(op): 12:09pm On Jun 18, 2019
KOGI—ELDERS and leaders of the All Progressives Congress, APC in Kogi West senatorial district of Kogi state have endorsed the governorship aspiration of the former Chief of Naval Staff, Admiral Usman Jubril (retd).

The endorsement of the former naval chief followed the report of the screening committee set up by elders and leaders of the APC in the area, who described the former naval chief as the hope of the APC in the coming governorship election in the state.

It was recently gathered that the retired Admiral may be the choice of the National Working Committee, NWC of the APC, after party leaders in the state raised an alarm of impending doom for the APC if the incumbent governor, Yahaya Bello is given a second term.

However, the screening committee of Kogi APC leaders and community elders headed by Sule Iyaji had nineteen members while the chairman absented himself from vote, the eighteen members voted to the admiration of thousands of APC members.

The elders who spoke separately, said that though the APC is loved in the state due to the leadership of President Muhammadu Buhari and the leadership of the APC under Comrade Adams Oshiomhole, the activities and performance of the incumbent governor of the state, Yahaya Bello is giving the party a bad name.

“Therefore, for APC to still continue to remain our darling party in the state, the people of Kogi will appreciate a change during the primaries of the APC. And that is why we have all agreed after strenuous search for a new leader, to decide that we will give our support to Admiral Jubril come rain come shine. And we urged the National leadership of the APC to do the needful by ensuring they give the ticket to Admiral Jubril so that the main election will be a walk over for the APC in the state.

“As a former Chief of Naval Staff, we believe that he has the credentials, the experience that is currently lacking in the management of the affairs of Kogi state by the current administration” the communique signed by Alhaji Sule Iyaji stated.

PoliticsOsun Gov Dispute: Supreme Court Hears Adeleke’s Appeal, Monday by Ify05(op): 6:10pm On Jun 16, 2019
The Supreme Court has scheduled hearing for Monday in the appeal filed by the candidate of the Peoples Democratic Party (PDP) Senator Ademola Adeleke in the September 2018 governorship election in Osun State.

Adeleke is, by the appeal, seeking the reversal of the May 9, 2019 majority judgment of the Court of Appeal, Abuja, which upheld the election of Adegboyega Oyetola of the All Progressives Congress (APC) as the Governor of Osun State.

Information about the hearing date is contained in notices sent to parties last week by the Registry of the Supreme Court, a copy of which The Nation sighted in Abuja.

On March 22, 2019 the three-man election tribunal gave a split decision of two-to-one in favour of the petitioners – Adeleke and the PDP.

Justices Peter Obiorah and Adegboye Gbolagunte, in the majority decision, upheld the petition, voided Oyetola’s victory and declared Adeleke of the PDP. winner of the governorship election.

Justice Ibrahim Sirajo, who chaired the tribunal, gave a minority judgment, in which he dissented and struck out the petition on the grounds that the petitioners did not prove their case.

Oyetola, APC and INEC appealed the  majority judgment at the Court of Appeal,Abuja, while Adeleke and the PDP appealed the minority decision.

On May 9, 2019 the Court of Appeal gave its decisions on the appeals, with four members of the five-man panel, upholding the appeals by Oyetola, APC and INEC, and dismissing the cross-appeal by Adeleke and the PDP.

The Court of Appeal’s majority judgement set aside the majority judgment of the election tribunal, upheld the result as declared by INEC and affirmed Oyetola of the APC as winner of the election.

PoliticsAtiku Speaks On ‘plan To Lead Protest Against Buhari Govt, INEC’ by Ify05(op): 1:20pm On Jun 16, 2019
The presidential candidate of the Peoples Democratic Party, PDP, in the last election, Atiku Abubakar, on Sunday morning refuted the claim that he was planning to protest against the Muhammadu Buhari government and the Independent National Electoral Commission, INEC.

His rebuttal was contained in a tweet he posted on Twitter.

He was reacting to a quote credited to a PDP Youth Group which said: “My Server Results Are Authentic and If judges frustrate the Justice we will take over the street. I will lead all Nigerians in a massive protest that mankind have never witness before.”

Responding: Atiku said: “The quote purportedly attributed to me with respect to INEC Server, an issue currently before the Presidential Election Petition Tribunal is fake and the handiwork of mischief makers.”

Atiku and the PDP had through their lawyers led by Levy Uzoukwu, SAN, asked the Tribunal to compel the electoral umpire to grant them access to the server and smart card readers.

However, INEC’s lawyer, Yunus Ustaz Usman (SAN) in a counter affidavit asked the court to dismiss the application.

“They are asking us to bring something we don’t have,” he said.

Usman further called the Tribunal’s attention to its judgment on March 6 granting PDP access to inspect only election materials without the server.

President Muhammadu Buhari’s lawyer, Wole Olanipekun, SAN, and the All Progressives Congress, APC, Lateef Fagnemi, SAN, both told the Tribunal to dismiss the application for failing to disclose the existence of the server.

PoliticsWhy Edo Assembly Was Not Inaugurated On Monday – APC by Ify05(op): 9:37pm On Jun 10, 2019
The inauguration of the Edo State House Assembly failed to hold on Monday following Governor Godwin Obaseki’s delay in transmitting a letter of proclamation to the clerk of the Assembly.

This is even as a combined team of security personnel made up of the police and Nigerian Security and Civil Defence Corp (NSCDC) laid siege to the premises of the Assembly complex.
Supporters and relations of elected lawmakers who had turned up to witness the inauguration were turned back by the security personnel who also locked up the main entrance and two exit gates of the complex, thereby preventing members of staff from gaining access to the complex with their vehicles.

According to DAILY POST the 24 lawmakers elected to the Edo Assembly are members of the All Progressives Congress (APC). However, only eight lawmakers were re-elected to the 7th Assembly while 16 new lawmakers are to be inaugurated.

The 6th Assembly ended last week with the former Speaker, Hon Kabiru Adjoto adjourning sitting sine die.

Some lawmakers-elect to the 7th Assembly had expressed reservations over the date fixed for their inauguration.

Reacting to the failure to inaugurate the Edo Assembly, the State Secretary of the APC, Mr. Lawrence Okah, told journalists, “The Edo State House of Assembly is waiting for a letter of proclamation from Governor Obaseki as instituted in the law.”

Meanwhile, a top government official said the there was no breach of the law in the governor’s action.

“Is there a law that says it must be on a particular day? They should go and read the constitution. Did it say every state must inaugurate its assembly the same day. That is not the position. It is when the governor writes and proclaim it that it is inaugurated and it is only the governor that can do it. Our own will either be Friday or Monday,” he told Nation newspaper.

CrimeNasiru Ali Kozzographa To Sue EFCC For Parading Him As ‘Yahoo Boy’ by Ify05(op): 9:18pm On Jun 09, 2019
An Abuja-based music producer, Mr Nasiru Ali, popularly known as “Kozzographa”, on Sunday threatened to sue the Economic and Financial Crimes Commission (EFCC) for wrongly calling him a fraudster (Yahoo boy).

The News Agency of Nigeria (NAN) reports that Ali was among 10 suspected internet fraudsters paraded on May 17 by EFCC operatives.

The EFCC personnel raided the suspect’s residence at Favour Land Estate, Life Camp, Abuja.

According to the EFCC, they were arrested following a tip-off by an anonymous source.

The agency said that the suspects would be charged to court as soon as investigations were concluded.

But Ali, in a petition to the EFCC Acting Chairman, Ibrahim Magu, on May 31, demanded a compensation of N100 million and an unreserved apology for arresting him wrongly and giving a libelous information to the public about him.

The musician, through his lawyer, Mr Pelumi Olajengbensi, said that he would drag the EFCC to court for refusing to retract the negative publications about him after a seven-day ultimatum.

“He lost a contract of five million naira with United Global Resolve for Peace (UNGREP), which he had been interviewed for and hitherto offered unequivocally because the contractors became disturbed and concerned by the publication thus doubtful of his reputation.

“He has been ostracised by his colleagues and associates as well as senior associates who usually refer to him for jobs in the past, thereby losing their trust and reference.

“He has been bombarded with a barrage of calls from friends and family members calling his reputation to question, while expressing their disappointment and indicating their intention to cut all connection with him forthwith.

“His relationship with his intended life partner has been irreparably strained by the negative publicity generated by the unlawful arrest, particularly the publication on your media platform on same matter.

“The publication has led to close clients taking their jobs off him and taking them to other persons thereby amounting to great level of loss and in some cases varying level of indebtedness,” Ali’s lawyer stated in the petition to EFCC.

Ali also claimed in the petition that his health and psychology had been affected following the Gestapo way he was arrested and assaulted by the commission operatives.

He said that the men that raided his home were dressed in black with no means of identifying them as officers of the EFCC
