The Election Petitions Tribunal hearing the petitions arising from the Osun State governorship election on Thursday granted the Peoples Democratic Party governorship candidate, Senator Iyiola Omisore, the permission to paste the notice of the tribunal on the walls of Government House, Osogbo and the Governor’s Office. However, Governor Rauf Aregbesola, has challenged the authority of the chairman of the tribunal, Justice Suleiman Ambrusa, to grant such permission and has asked him to step down. Earlier, Ambrusa had said having considered the application of the petitioner’s counsel, Mr. Afolabi Fashanu, the respondent should be served a copy of the petition by pasting same on the walls of the Government House and Governor’s Office at the state secretariat. The petitioner had prayed the tribunal for an order of substituted service following an allegation that security agents did not allow the bailiff to serve the governor. The chairman of the tribunal said that evading service would not be an excuse for not serving the respondent because the case should not be one-sided. But Aregbesola’s counsel, Mr. Kunle Adegoke, asked the tribunal chairman to disqualify himself because of a petition written against him and addressed to the National Judicial Council. Adegoke said, “There are certain fundamental issues that must be addressed in the petition against you at the NJC. If a party is expressing lack of confidence in a judge, the requirement is that such judge should step aside from handling the case.” But Ambrusa said he could not be stampeded into stepping aside from sitting on the panel because it was only the NJC that could ask him to step down. He said, “I am ready to step down. I didn’t put myself here. I have not seen the copy of the petition against me. There should be decorum. I would be served a copy of your petition since you have written to the NJC. It is only the NJC that can act on your application.” It will be recalled that Omisore had filed a petition challenging the result of about 17 local government areas at the tribunal. Omisore, while asking the tribunal to nullify Aregbesola’s victory, prayed that he should be declared the winner of the election. Former Vice-President and All Progressives Congress chieftain, Atiku Abubakar, has denied the rumour going round in Adamawa State that he intends to contest in the governorship by-election in the state. The election, which will hold on October 11, is expected to be a two-horse race between the APC and the Peoples Democratic Party. Among the people gunning for the governorship seat are the former Deputy Governor of the state, Bala Ngilari, the former military Governor of Lagos State, Col Buba Marwa (retd) and the ex-Chairman of the Economic and Financial Crime Commission, Mallam Nuhu Ribadu, who recently defected from the APC to the PDP. Concerning the rumour, Atiku on Saturday posted on his Facebook page, “I just read this rumour that I am running for governor of Adamawa State. This is not true.” According to him, contesting again as the governor of the state will mean taking a step backward. “I was elected governor of Adamawa State 15 years ago, but was elevated to the position of vice president. I believe we must always look forward, not backwards. “I will never back away from supporting the development of my home state, as I have always done, both as a businessman and a statesman,” Atiku said. Former Adamawa State Governor, Murtala Nyako, has requested the Acting Chief Judge of the state, Justice Ambrose Mammadi, to quickly assign his newly filed suit to a vacation judge. He is through his suit, marked ASY/107/2014, seeking among other things, an order to disband the Judicial Commission of Inquiry set up by the administration of the acting governor, Ahmadu Fintiri, to probe his administration. In his letter sent by his lawyer, Chief Niyi AKintola (SAN), to Justice Mammadi, he requested that his suit be heard during the ongoing vacation of state and federal judges. The letter, which was signed by a lawyer in Akintola’s law firm, Mr. Oladele Oyelami, read in part, “This suit was filed on August 8, 2014 together with an affidavit of urgency given the nature of this suit. “Consequently, I have instructions of Chief Niyi Akintola (SAN) and our client to write your lordship on the urgent need to assign this suit to the vacation judge of the state, Justice Hafsatu Abdulrahman, in order for us to be given the earliest possible date to heard, given the nature of interlocutory applications filed along with the originating processes. “We implore my lord to give urgent consideration to our request as we anticipate a quick response to our application.” The defendants in the suit are the Adamawa State Judicial Panel of Inquiry, Chairman of the panel, Justice Bobo Umar; Philemon Leha (retd DIG); Mr. Zira Maigadi, Sulaiman Naiwa and Abubakar Abdullahi. Others are Samuel Kyanson, Dedan Nyari (Secretary of the panel); the Attorney-General of the state and the Solicitor-General/Permanent Secretary of the state Ministry of Justice. In a supporting affidavit to the suit, the former governor argued that the setting of the commission was illegal as it was done without recourse to the House of Assembly. He alleged that the acting governor had set up the commission to persecute him, adding that he was also not served with the summons of the panel. The supporting affidavit read in part, “Plaintiff avers that when he learnt about the purported commission of inquiry, he directed his solicitor/counsel. Adeniyi Akintola, to institute an action against the defendants to challenge the setting up of the purported Judicial Commission of Inquiry which has been merely set up to witch hunt and indict the plaintiff (Nyako). “The plaintiff avers that the totality of the allegations leveled against him by the defendants are false. “Plaintiff avers that since he was the principal target of the probe that he was neither served the summons nor notified of the allegation(s) warranting or leading to the setting up of the commission of inquiry. “Plaintiff avers that the essence of the setting up of the Judicial Commission of Inquiry constituted by the acting governor is to embarrass and/or ridicule his person because of the political difference between the plaintiff and acting governor in particular.” He is therefore seeking “a declaration that the defendants have no power to set up a Judicial Commission of Inquiry to investigate the plaintiff and his administration between 2007 and 2014 in contravention of the provisions of the constitution of the Federal Republic of Nigeria. “A declaration that the defendants do not have the constitutional power(s) to inaugurate and set up the Judicial Commission of Inquiry without recourse to the Adamawa State of Assembly in line with the provisions of the Constitution of the Federal Republic of Nigeria.” http://www.punchng.com/news/nyako-moves-to-block-fresh-probe/ |
Barely one month after the impeachment of Governor Murtala Nyako of Adamawa State and the controversial resignation of his deputy, Bala Ngillari, another gale of impeachment is sweeping some local government councils in the state. According to reports, two council chairmen are facing impeachment from majority of their councillors on allegations of financial fraud and abuse of oath of office. Ten of 11 councillors in Mubi North Local Government have handed a 20-point notice of impeachment to the chairman, Sahabo Jauro. The councillor representing Digil Ward, Bello Sahabi, told journalists that the State House of Assembly has been notified on Friday and that the chairman has seven days to respond. He accused the chairman of attempting to usurp some of the powers of the legislative arm and of high handedness in running the affairs of the council without recourse to the principles of separation of powers. Mr. Sahabi said the Legislative Council was committed to asserting its constitutional role of oversight function to ensure compliance with the rule, advising traditional rulers and elders to allow them carry out their responsibilities. He said lawmakers would ensure compliance with the law throughout the process. “The chairman operates more like a sole administrator, awarding contracts without council extracts because he has no respect for the law. He should know that the Legislative Council is a house established by law and that we are empowered by the law to carry out over sight functions,” the councillor stated. The offences allegedly committed by Mr. Jauro, as contained in the impeachment notice, range from diversion of funds, non-payment of workers’ salaries, inflation of contracts sum involving monies worth millions of naira. It was gathered that the embattled chairman, who had earlier shunned a meeting with the councillors just before the impeachment move, had approached the Emir of Mubi, Abubakar Ahmadu, and some community elders to persuade the councillors to withdraw the notice. PREMIUM TIMES’ attempts to speak to the chairman were, however, not successful as his phone was switched off up to the time of filing this report. In a related development, the chairman of Fufore Local Government, Sahabo Gurin, who is also the state chairman of the Association of Local Governments of Nigeria, ALGON, denied reports that his councillors were perfecting a plot to impeach him. Eight of 11councillors in Fufore are believed to be in support of Mr. Gurin’s impeachment. “I have just interacted with the leader and other councillors and there is nothing like that. We had problem before the coming of the present administration in the state but we have resolved our differences”, the chairman said. Meanwhile, the Chairman of Ganye Local Government Council, Farouk Mohammed, was recently served with an impeachment notice for alleged embezzlement of public funds. The impeachment notice, signed by 10 councillors, a copy of which was made available to journalists in Yola, said “Sequel to the resolution of the legislative council sitting No. 7 of its second session, the House hereby resolved unanimously to serve you with this notice of impeachment.” Some of the 15 allegations against the chairman include unauthorised collection of bank overdrafts totalling N132 million, an unaccounted N10 million excess crude oil revenue received in December 2013, and short changing political appointees by paying them half of their entitlements after posting full payment in the local government’s cash book. As gathered, the occupant of the seat of Emir of Kano is reported to have been placed under suicide watch. Shortly after Sanusi Lamido Sanusi’s controversial ascension to the seat of Emir on June 8, 2014, of which some believed was a politically motivated appointment by the governor of Kano State, the occupant of the seat of Emir began exhibiting symptoms of severe clinical depression. The symptoms reportedly grew worse. According to our source, the occupant of the Emir’s seat, began having thoughts of suicide. “He is suicidal. He is secretly being watched by his close aides”, said the source. However, another source from a popular political family, the Yankassi family in Kano who is considered a family friend to the Sanusi Lamido Sanusi family has called the claim of Sanusi Lamido Sanusi being clinically depressed false. In fact I just came out from a meeting with him and he looks very stable with sound mind”.It remains uncertain the health status of the occupant of the Emir’s seat in Kano. Osogbo – The PDP candidate in Saturday’s governorship election in Osun, Sen. Iyiola Omisore, says he is still consulting with relevant stakeholders before reacting to the outcome of the election. The INEC had declared the APC flagbearer, Gov. Rauf Aregbesola, winner after polling 394,684 votes to defeat Omisore who polled 292,747 votes to emerge second. Omisore, however, said on Sunday that he had to engage in widespread consultation as a committed party man. The PDP flag bearer, who spoke on phone through his spokesman, Mr Diran Odeyemi, said:“ Omisore is not a tin god. “ He is a committed party man and 24 hours is too short to engage in widespread consultation. “ Consultation is on with our men on the field, meetings are already on and as soon as all these are concluded, we would issue a formal statement on the development.’’ He, however, expressed gratitude to God for the sustained peace before, during and after the election. He also commended the people of the state for coming out to exercise their franchise. Meanwhile, Gov. Rauf Aregbesola has said his victory in the election was a call to more improved service delivery to the people. The Presidency on Sunday said it was painful that the ruling Peoples Democratic Party lost the Saturday’s governorship election in Osun State to the All Progressives Congress. Special Adviser to President Jonathan on Political Affairs, Prof. Rufa’i Alkali, said this while conducting a facility tour on Goodluck 2 Goodluck () 2015 Project national headquarters in Abuja. He said. “Today we would have celebrated Osun victory. It is however, a very painful day for us because the PDP candidate and the party had completed their home work and we know the people of Osun are tired of what is happening in the state, but here we are. “I hope the APC, which is in the habit of complaining of having security agencies in ensuring enabling environment for election and is consistent in controversy and rejecting election results, will reject this Osun state gubernatorial election result.” He however commended Independent National Electoral Commission and the security agencies for the roles they played in delivering a credible election in Osun. Speaking on the groups canvassing for the reelection of President Jonathan in 2015, the Special Adviser said “Since assumption of office, we inherited 3,000 Goodluck Support groups, some have been existing and some are new, and we felt it is only those that are serious, and that we know each and every one of them, in faces, not only on papers, know what they can do and how we can collaborate with them. The national coordinator of and former governorship candidate of PDP in Edo state, Gen. Occurstaem: Yes they are working for PDP. Yesterday,after DSS arrested two INEC officials trying to smuggle already casted ballot boxes of about 100 of which all were PDP. The DSS director at Osogbo first admitted that they did arrest two INEC officials and later said it was a lie even when reporters have already broadcasted it on radios and televisions.That's bad.....may be he got order 4rm above ![]() |

The Minority Leader, Nasarawa State House of Assembly, Mr. Tanko Maikatako, has said President Goodluck Jonathan’s efforts to amicably settle the dispute between the lawmakers and Governor Umaru Al-Makura were rejected. “The President’s efforts toward peace were not successful due to selfishness among the lawmakers,” Maikatako, a member of the All Progressives Congress, who represents Lafia Central Constituency, told the News Agency of Nigeria, on Wednesday in Lafia. According to him, Jonathan had appealed to the lawmakers to opt for dialogue rather than impeaching Al-Makura, but that the legislators insisted on removing the governor. “The President met with us and appealed to us to go back and meet with the governor to iron out the issues, but the members refused,” he said. Maikatako said he was very surprised at that development. “We don’t know why it happened that way. If the President himself, the PDP leader in the country, appeals to his colleagues to return to Nasarawa, meet the governor to iron out issues, they should have come back,” he opined. Maikatako frowned on the attitude of his 20 colleagues, declaring that their insistence on ignoring Jonathan’s peace offer snowballed into the political crisis. “Their resolve to go ahead with the impeachment of Gov. Umaru Al-Makura was selfishly motivated,” said Maikatako, who claimed that the lawmakers did not have an iota of evidence to substantiate their claims against Al-Makura. “They abandoned all the allegations they levelled against the governor; that means that the allegations were baseless. One can therefore conclude that the panel did its job. “As it is, the lawmakers must come back. That was what Mr President advised them to do; they must meet the governor and iron out the issues.” He appealed to his colleagues to return back to the state to tackle issues that were beneficial and had direct bearing on the lives of the electorate “instead of looking for ‘every trick’ to oust the governor”. “It is not too late for us to achieve much for our people. Let the law makers come back so that we can continue our work. “There are lots of executive bills that are of immense benefit to the electorate. We resumed yesterday (Tuesday), but they are nowhere to be found,” he said.
