The Legal Practitioners’ Privileges Committee has withdrawn the Senior Advocate of Nigeria rank from a lawyer, Mr. Beluolisa Nwofor, who represented the Ali Modu Sheriff faction of the Peoples Democratic Party in the legal battle for the party’s ticket ahead of last year’s governorship election in Ondo State. The Sheriff faction had recorded a temporary victory by obtaining a judgment of the Federal High Court in Abuja, which recognised the faction’s preferred aspirant, Mr. Jimoh Ibrahim, as the PDP’s governorship candidate for the said governorship poll. The victory was truncated few days to the election when the Court of Appeal in Abuja in its judgment delivered on November 23, 2016, retrieved the ticket from Ibrahim and returned it to Eyitayo Jegede, who was the candidate of the rival Ahmed Makarfi-led faction of the party. The LPPC, in a statement dated Thursday but released late on Friday, described the conduct of Nwofor during the hearing of the case as “unbecoming of the holder of the esteemed rank of Senior Advocate of Nigeria.” The statement signed by the Chief Registrar of the Supreme Court and Secretary of the LPPC, Mr. Ahmed Saleh, stated that the decision to strip Nwofor of his SAN rank was based on a petition filed against the lawyer by the Court of Appeal. The decision, according to the statement, took immediate effect. The statement read, “The Legal Practitioners’ Privileges Committee at its 126th General Meeting held on 22nd of June, 2017 considered extensively the complaint filed by the Court of Appeal of Nigeria against B.E.I Nwofor Esq., a Senior Advocate of Nigeria, with his response to same and all material facts and have decided that B.E.I Nwofor Esq., a Senior Advocate of Nigeria, conducted himself in a manner unbecoming of the holder of the esteemed rank of Senior Advocate of Nigeria. “By reason of the foregoing, the rank of Senior Advocate of Nigeria (including its privileges) has been withdrawn from B.E.I Nwofor Esq., forthwith.” It will be recalled that Nwofor had a rancorous encounter with the Justice Ibrahim Saulawa-led three-man panel during the hearing of the case by the Court of Appeal. Specifically, the November 16, 2016 proceedings went on for over five hours in a tense courtroom charged by the confrontation between members of the Justice Saulawa-led panel and Nwofor. Also before the conclusion of the case, Nwofor also on behalf of his client filed before the Supreme Court, two motions, one of which asked for a stay of the appeal court’s proceedings. The second motion also sought an order disbanding the Justice Saulawa panel. The Supreme Court on November 22, 2016, dismissed the two motions, paving the way for the Justice Saulawa panel to go ahead to deliver its judgment in the Ondo State PDP case earlier reserved to await the decision of the apex court. Incensed by the motions which Nwofor filed on behalf of his clients, the Supreme Court after dismissing them, awarded cumulative fines of over N10m against the applicants and Nwofor, their lawyer, for filing the applications adjudged to have constituted an abuse of court process. The Justice Saulawa-led panel of the Court of Appeal eventually on November 23, 2016, delivered its judgment in which it sacked Jimoh Ibrahim as the PDP’s candidate in the governorship election. The National Chairman of the Peoples Democratic Party, Senator Ali Modu Sheriff, has said that it will be near impossible to stop members of the party from defecting to other political paries. He said even the expected outcome of the party’s case might not be acceptable to some people, adding that it would be wrong for him to stick his neck for members of the party that they would not move to other political parties. Sheriff, who spoke through the acting National Publicity Secretary of the party, Mr. Bernard Mikko, told our correspondent in Abuja on Tuesday that every member of the party was eagerly waiting for the Supreme Court to adjudicate on the leadership crisis. But he said he and other members of the party were expecting justice to be done in the case. The National Caretaker Committee of the party led by Senator Ahmed Makarfi had lodged an appeal before the Supreme Court to challenge the ruling of the Court of Appeal, Port Harcourt Division, which pronounced Sheriff as the national chairman. Before the Court of Appeal ruling, a Federal High Court also sitting in Port Harcourt, Rivers State, had upheld the selection of the caretaker committee at the party’s failed national convention. Since the beginning of the crisis, many prominent members of the party had defected to other political parties, especially the ruling All Progressives Congress. Mikko also spoke on the statement by five governors of the party who met in Abuja on Friday where they resolved that they would stand by the outcome of the judgement of the Supreme Court. He said, “Well, we have heard what the governors said, and we are all waiting for the judgment of the Supreme Court. We know that the court will toe the line of justice. “While we are expecting justice, it will be wrong to assume that we can stop people from defecting or leaving the party.” He also said that the party was aware that the registration of five new political parties by the Independent National Electoral Commission could trigger some members of the party to defect. He said, “We know some members might want to leave (because of the registration of the new parties), it is possible. However, the registration of these parties is good for our democracy. “Members (of the PDP) that may want to move to other political are the same as proliferation of political parties don’t change people. “Majority of the people in the All Progressives Congress are from the PDP. The National Chairman of the All Progressives Congress, Chief John Odigie-Oyegun, yesterday stated that the party can be fired if it did not meet the aspirations of Nigerians. He said that the party was conscious that Nigerians reserved the power to vote it out in 2019 if it failed to meet their expectations. He, however, reaffirmed that the APC-led Federal Government would not disappoint Nigerians. Oyegun stated this yesterday at the national secretariat of the party when a book titled: “APC: The making of a change agents, written by the Special Assistant to the President on Prosecution, Mr. Okoi Obono-Obla, was presented to him. According to him, Nigerians applied the right to fire a government for the first time when they voted out the Peoples Democratic Party (PDP). He defined democracy as hiring and firing of political office holders by those that elected them. He said: “What is democracy? The ability to hire and fire. This is the first time Nigerians had the ability of firing and it has become internalised in our political culture. We too now know that we can be fired and that is the democracy.” Speaking on the book, the APC national chairman described the book as an insider account of the merger process that culminated in the formation of the APC, as he encouraged other stakeholders who “participated intimately” in the formation of the APC to document their record of events for posterity He hailed the contributions and sacrifices of chairmen of the legacy parties that merged to form the APC; former vice president, Atiku Abubakar; former governor of Lagos State, Asiwaju Bola Tinubu; new PDP entrants, amongst other stakeholders, in the formation of the APC. Governor Kashim Shettima of Borno state has said that the voice of the leaked telephone conversation between himself and an impersonator of Governor Ibikunle Amosun is not his. According to his spokesperson, Isa Gusau, the governor’s voice is totally different from the voice of a telephone caller who admitted being a PDP member, in a 20 minutes conversation between him and the impersonator of Governor Amosun which have been circulated online since Sunday night. “In the clarification, a video of Governor Shettima speaking to the Nigerian Television Authority was attached alongside audio of the 20 minutes and 38 seconds telephone conversation for the purpose of comparisons by listeners. The two voices were clearly different.” he stated. “The caller who is being presented as Governor Shettima speaks very fast as against the relatively slower tone of Shettima. “The caller’s didn’t have any Kanuri accent whereas Governor Shettima has some Kanuri accent. The caller had at the opening of his 20 minutes conversation with a so-called Governor Amosun, first introduced himself as a PDP member whereas Governor Shettima is known to be in the APC. “Also in the conversation, the caller addresses his recipient as ‘Kunle’ with no respectful prefix of ‘Your Excellency’ as Shettima is known to be using in most of his conversations with fellow Governors. “The caller went ahead to contradict himself as he promotes and at the same time castigate Buhari while also insulting National Leaders that include the Sultan of Sokoto, Sa’ad Abubakar, Minister of Transport Rotimi Amaechi, Governor Rochas Okorocha of Imo State and also insulting people of the entire southeast. The entire aim is to cast set up the leaders against Governor Shettima and also incite Nigerians from the southern part of Nigeria against him” Gusau explained. Appeal Court to Deliver Judgment on Edo Guber Poll Friday Appeal Court in Benin City, will today deliver judgment on the appeal filed by the governorship candidate of the Peoples Democratic Party (PDP), Pastor Osagie Ize-Iyamu against the ruling of the Edo state governorship election petition tribunal, which upheld the election of governor Godwin Obaseki of the All Progressives Congress (APC). The Justice Ahmed Badamasi, led Election Petition Tribunal had on Friday, April 14, 2017, upheld the election of Governor Obaseki of the APC, who was declared winner of the September 28, 2016 governorship election in Edo state by the Independent National Electoral Commission (INEC). THISDAY gathered that the five man appeal panel led by Justice M.B Dongban-Mensem, had communicated to counsels to the parties that judgment on the matter will be delivered today. Ize-Iyamu had through his Counsels led by Yusuf Ali (SAN), appealed the judgment, asking the appellate court to rely and use the evidence of the first appellant as recorded by Justice Gilbert Ngele (Member 1) of the lower Tribunal instead of that of the Tribunal’s chairman, Justice Ahmed Badamasi. He also sought an order deeming the record of his evidence by Justice Ngele, made onJanuary 30, as the correct record of his evidence-in-chief at the lower court, therefore raised five grounds for the application including that the Tribunal’s record compiled and transmitted to the appellate court contained an incorrect rendition of Ize-Iyamu’s evidence by Justice Badamasi, the appellant prayed for a leave of court to correct the said record of appeal and use the supplementary record of appeal they transmitted to the court. Ondo State Governor, Rotimi Akeredolu, on Thursday said his government will try to ensure it does not owe workers their salaries. Akeredolu expressed hope that the workers would waive the outstanding salary arrears as part of their contributions to development. “If they (workers) meet and say they waived two months, we will be glad but if they insist on having the full arrears, we thank them and will look for ways of paying. “The government will continue to try and make sure we don’t owe them salaries”, he said. Akeredolu made this promise while receiving report of Committee on Arrears of Salaries of Public Servants in Akure. The governor also said the Internally Generated Revenue (IGR), needed to be increased very soon to tackle the salary arrears. “Before we present our budget and after presentation, I will have to address the workers to let them know that it’s not possible to use all our money to pay salaries. “We have said this many times, we must be prepared to make sacrifices because we don’t borrow money to pay salaries, something must be done. “I thank the people for their efforts and resilience. I know it’s not easy, but it’s also getting increasingly difficult for the government too; but whatever we do, we will try not to owe salaries”, he said. BREAKING: Court discharges, acquits Jonathan’s HoS Stephen Oronsaye over alleged N190m fraud. An FCT High Court, Maitama, on Tuesday discharged Steve Oronsaye, former Head of the Civil Service of the Federation, of the N190 million corruption charges levelled against him. Oronsaye was also the chairman, Presidential Committee on Financial Action Task Force, set up by former President Goodluck Jonathan. He was docked on a seven-count charge, bordering on breach of trust and diversion of N190 million meant for the committee he chaired. The judge, Justice Olasumbo Goodluck, in her ruling on the no-case submission filed by Oronsaye, held that the prosecution failed to establish a prima facie case against Oronsaye. “There was contradictory evidence by the prosecution witnesses on whether the defendant was still the head of service as at the time he chaired the committee. “The court seems to discredit the evidence, suffice it to say that there is no evidence linking the accused with the statutory element and ingredients of the offence with which he is charged. “The court of trial must as a matter of law discharge him because it has no business scanting for evidence that is nowhere to be found. “I have looked through the case and I am unable to see any justifications for this case. “The defendant is hereby discharged“ she held. The News Agency of Nigeria (NAN) recalled that the prosecution closed its case on Nov.15 after calling six witnesses to testify. On Dec. 9, the defence filed no-case submission, on the ground that the prosecution had no case against the defendant. In his submission, the defence counsel Chief Kanu Agabi (SAN), argued that there were omissions of essential elements in the charges against his client. He said on that account the charges were imperfect. Agabi said that the charge was initially 2- count, later amended to 7-count. He said that, that was a sign that something was wrong with the charge from the beginning. He said that the prosecution did not specify the amount that was entrusted to the defendant, nor the mandate of the committee the defendant chaired. Agabi also said there were no evidence of personal use of the fund that the defendant was accused of misusing. In his reaction, the prosecuting counsel, Mr Offem Uket, told the court that the EFCC had proved its case, adding that the defendant should enter his defence. Uket said that it was not right to bring up the issue of imperfection of charges now as it was against the provisions of the Administration of Criminal Justice Act, (ACJA) 2015. BREAKING: APC Headquarters Shut Down, As Obasanjo, IBB, Abdulsalami, Endorse Buhari’s Immediate Resignation Within 72-Hours. The National Headquarters of the ruling All Progressives Congress, APC, was on fire, on Tuesday, as some members of the party and Senators, raised an alarm over an alleged report, that three former Nigerian Heads of State, that is, Olusegun Obasanjo, Ibrahim Badamasi Babangida, and Abdulsalami Abubakar, had endorsed President Muhamamdu Buhari’s immediate resignation. The credible sources at the APC Secretariat, condemned the former Presidents, for taking such a shocking step. When Post-Nigeria’s Correspondent visited the Headquarters, the offices were in lock and keys, as staff were in groups, discussing in hushed tones. Making reference to the long press release issued by a Chieftain of the APC, Bisi Akande, on the health status of Buhari, the source said: “The life of everyone is in the hands of our Creator; nobody is saying Buhari is dying, but there’s the need for fresh approach to how his health issue is being handled, and what Nigerians are being fed with; I strongly believe that the issue formed the fulcrum of the meeting”, he said. However, a high ranking Senator said IBB and Abdulsalami, do not have the “moral grounds” to say anything in respect of Buhari’s style of leadership. “IBB recently said they are the Military wing of the PDP, and he did not support Buhari’s Presidency ab initio. Abdulsalami on the other hand, is sitting on the fence, he is neither here nor there, and cannot therefore say Buhari should handover and go anywhere, because he is sick”, he said. A coalition of over 22 democratic elements under the auspices of National Coalition of Democrats have expressed dismay over the activities of Tinubu. Addressing a press conference in Jos, the Plateau state capital, on Tuesday, May 2, the group described Tinubu as a leader of a cabal seeking to use issues around President Muhammadu Buhari's health as an opportunity to achieve a clandestine motive . The conference was addresed by Ambassador Melvin Ejeh, the Executive Director of Global Peace and Life Rescue Initiative (GOPRI) and Dr Charles Okoroji of the Action Against Oppression Initiative (AAOI). The groups accused Tinubu of heading a cabal trying to profit from Buhari's illness They stated that Nigerians have followed the recent turn of event around the President’s health and how some self acclaimed political gladiators are making a storm out of a tea cup in pursuit of reinventing their fledgling political stature . They however used the occasion to warn the cabal in the strongest terms to desist from such illicit act forthwith as it is prepared to do all that is permissible within the law to resist their attempt at power grab while hiding under the pretext of Mr President's health challenges. Part of the statement read: “In recent days, we have seen a cabal go to work. Members of this cabal had been secretive hitherto but they have developed a measure of boldness since Mr President took out time to rest in the last couple of weeks. In a curious but saddening case of deception, they are hiding their agenda behind the façade of national interest.'' They alerted the general public that, in the near future more reports aimed at causing maximum damages would be published by an online medium. In furtherance of the agenda, the coalition also noted that some unconscionable Civil Society Organisations (CSOs) have similarly been recruited to mobilize unwary Nigerians for an evil plot. The coalition also strongly believe that the comments credited to former APC Chairman, Chief Bisi Akande, while presented as the intervention of an elder statesman are in reality the position jointly adopted by a meeting of the cabal that is trying to unseat the president for their clansman. Apartment 7B, the Osborne Towers expensive home where $43.4m was found, may be sold, it was learnt yesterday. A Presidential Investigative Committee is probing the suspended Director-General of the National Intelligence Agency (NIA), Amb. Ayo Oke, over the cash and the Secretary to the Government of the Federation (SGF), Babachir Lawal, for a N200million contract awarded to a company, Global Vision Limited, linked with him. There were indications yesterday that: •the committee may have concluded the SGF’s case, which a source described as “straightforward”; •the Presidency is of the opinion that the National Security Adviser (NSA), Gen. Babagana Monguno, has no case to answer on the $43.4m; and that •the committee may not ask Monguno, who is one of its members, to step aside. It was learnt that a directive had been given to the agency to put the apartment in the property market. The apartment may fetch the agency about N200 million, a source said. The outcome of the Osinbajo Committee’s report will determine whether or not the EFCC has any further role to play on the seized $43.4 million and the N200 million alleged contract scandal. A source in the anti-graft agency said: “Once the report is submitted to President Muhammadu Buhari, whatever we should do will be communicated by the Presidency through the committee. “If any public officer will further be investigated or prosecuted, it is the committee which will determine the next step. “So far, it is becoming clearer that more public officers might have cases to answer.” The EFCC has filed an application before Justice Muslim Hassan of the Federal High Court, Lagos for the permanent forfeiture of the $43,449,947, £27,800 and N23,218,000, which it recovered at the Osborne Towers apartment to the Federal Government. Any person or agency claiming ownership of the cash is expected to appear before the judge on May 5, with proof, to show cause why the money should not be permanently forfeited to the government. There were speculations that the SGF had been recommended for trial but no committee member or presidency official could confirm this last night. “I think Lawal has got wind of the decision of the committee but he is unruffled,” a source added. There were indications that Gen. Monguno may not be asked to step aside from the committee. Oke had claimed that the NSA was in the picture of the seized $43.4 million, which he said was part of a $289 million Special Intervention Funds. He told the panel that he wrote a memo to the NSA on January 26, 2016 on the $289 million released to NIA and attached a list of nine projects being executed. He also said the NIA raised a committee in February 2016 to assess the projects. The suspended director-general said on May 17, 2016, the NSA informed him via a memo that the “detailed report of the NIA’s projects and exercises had been presented to the president and the president was pleased with their work”. A source told The Nation: “When Oke appeared before the committee, he repeated all these official procedures in the presence of the NSA who did not make any comments. “It is on this basis that Oke told the committee that the NSA knew about the $43.4m cash. “And there has been pressure on the committee to ask NSA to step aside.” But a source in the Presidency last night said the panel saw no reason for Monguno to step aside. The source said: “Some forces are just eager to drag the NSA into this crisis without taking note of the fact that he had nothing to do with it. “The NSA can even be described as the whistle-blower. He was mandated by President Buhari to raise a committee to probe arms procurement. It was the committee which actually detected that $289 million extra-.budgetary cash was allocated to NIA. “The NIA DG wrote the NSA after the arms probe panel made the discovery. It was not as if it was a willing thing. “The President put the NSA on Osinbajo panel because he has a comprehensive report and deep knowledge of the funds disbursed through the Central Bank of Nigeria, NNPC accounts and other agencies. “When the government read the report of the NSA/NIA DG ‘clash’, it was strange because NSA was never a party to the cash haul at Osborne Towers. “And what is being investigated is not the $289 million per se but $43.4 million found in the apartment in Osborne Towers. “The Presidency has made up its mind that the NSA will serve on the Osinbajo panel to the end.” A source in NIA explained why it was important for the NSA to step aside. “We expect the panel to invite and interrogate him on some issues tabled by the DG. “You cannot approbate and reprobate at the same time. He cannot sit in judgment over a matter he knew about. “We hope the President will drop the NSA from the panel.” A former spokesman for the Goodluck Campaign Organisation, Chief Femi Fani-Kayode, said the suspended NIA director-general did not spend any money on the former President’s campaign organisation. Femi-Kayode made this statement in a tweet on Monday. He said: “The attempt to rubbish the D-G of NIA and destroy him by certain elements in govt. will fail. CERTIFICATE SCANDAL: NSE EKPENYONG VINDICATED AS POLY REGISTRAR TESTIFIES IN COURT The Registrar of the Abia State Polytechnic, Dr (Mrs) Constance Evuline, today appeared before the Federal High Court sitting in UYO. She confirmed that Nse Ekpenyong was given a National Diploma certificate in Public Administration by the Abia State Polytechnic and not Business Administration as claimed in the petition against him. The registrar further maintain that Nse Ekpenyong was at no point in time a student in the department of Business Administration to earn him a Diploma as it is claimed in the petition by EFCC. Dr. Constance Evuline told the court that the certificate with the name Ekpenyong, Nse Bassey, Department of Public Administration was duly signed and approved by the Abia State Polytechnic. She concluded that a letter was written to EFCC on demand. The original certificates of Rt. Hon. Nse Ekpenyong were tendered before the court as evidence. Now the truth of the matter is that the much circulated Business Administration certificate was forged to blackmail the personality of Rt. Hon Nse Ekpenyong, Honourable Member Representing Oro Federal Constituency. The Chinese police authority has confirmed that a top member of Governor Samuel Ortom’s delegation at the just-concluded Nigerian-China Governors Forum was arrested for theft early this week. Mr.. Andrew R. Deal, chief of police of the China Groove Police Department, disclosed the name of the culprit as Mr. Tersoo Kpelai. Tersoo Kpelai is the Benue state Honourable commissioner for Trade and Investment under the administration of Governor Samuel Ortom. The police chief disclosed this during a telephone conversation between him and a reporter of Nigerian Concord Newspapers this evening. Speaking via his office telephone number 704.857.2466 ext. 201, Mr.. Deal however didn’t confirm if the case was what led to Governor Ortom’s further stay in China, having concluded the event he went to attend about four days ago. Mr.. Deal confirmed to this newspaper that the commissioner truly stole a mummified body of a king, and he was arrested but had to be released on bail immediately the police got a signal that he was on a governor’s entourage. He however noted that his international passport was seized from him at the time the bail was granted. Saying that Honourable Kpelai’s passport had been released to him since yesterday, the police chief added that investigations are still ongoing in order to ascertain What the suspect was going to do with the stolen item. He also refuted media reports which earlier said that the commissioner was tortured by the Chinese police.
