The 2023 Country Reports on Human Rights Practices says the last general election in Nigeria reflected the will of the populace despite widespread irregularities.

The report published by the bureau of democracy, human rights, and labour, US Department of State, highlights human rights practices and violations in different countries, including Nigeria.

The report stated that supporters of the All Progressives Congress (APC) suppressed votes in Igbo-dominated areas during the March 2023 governorship election in Lagos.

“National elections were widely reported to have reflected the will of voters, despite technical and logistical difficulties, and some irregularities,” the report reads.

“Many independent observers assessed the results of the presidential, legislative, and state-level elections during the year reflected the will of voters, despite reports of voter suppression and vote buying, campaigning at polling stations, lack of ballot secrecy, violence, and intimidation.

“During the March 18 state election in Lagos, All Progressives Congress (APC) supporters reportedly intimidated and suppressed voters in Igbo-dominated areas, which Labour Party presidential candidate Peter Obi won in the February 25 national election.

“Viral videos on social media showed APC supporters in Ojo (a LGA in Lagos) threatening to attack ethnic Igbo voters presumed to be pro-Obi.

“In Eti-Osa, APC supporters also attacked journalists and, in some cases, shut down voting and prevented non-Yoruba voters from accessing polls. They similarly destroyed property and physically blocked voters in Amuwo-Odofin.

“According to videos posted on social media, police officers were present but failed to respond to attacks.”

The report said there was no evidence that individuals who perpetrated violence in Lagos during the election were arrested or prosecuted.


‘CORRUPTION IN GOVERNMENT‘

The report stated that the Nigerian government has not “consistently” implemented anti-corruption laws.

It said there was “widespread” corruption across the country, including in the judiciary.

“In August, President Tinubu appointed former Governor Abubakar Bagudu, the Minister of Budget, despite Bagudu’s widely reported history of helping then-President Sani Abacha steal hundreds of millions of dollars from the government in the 1990s,” the report said.

“Police arrested former Central Bank Governor Godwin Emefiele on June 10 and charged him and a co-defendant with defrauding the government of 6.5 billion naira ($10.4 million), later reduced to 1.6 billion naira ($2.5 million).”

A former governor of Imo State, Emeka Ihedioha, has resigned his membership of the Peoples Democratic Party, PDP.

In his resignation letter addressed to the PDP chairman in Mbutu Ward, Aboh Mbaise Local Government Area of the state, Ihedioha cited a misalignment between his personal beliefs and the current trajectory of the main opposition party.

The former governor expressed his dedication to the advancement of democracy and good governance in the country despite his decision to step away from PDP.

According to Ihedioha, having been a member of the party since its inception in 1998, he has contributed immensely to the growth and evolution of the party.

The former governor, however, lamented recent developments within the PDP, stating that it has deviated from its core principles.

He voiced concerns over the party’s inability to enact internal reforms, uphold its own regulations, and effectively oppose the ruling All Progressives Congress, APC.

“Regrettably, in recent times, the party has taken on a path that is at variance with my personal beliefs. Despite my attempt to offer counsel, the party is, sadly, no longer able to carry out internal reforms, enforce its own rules or offer credible opposition to the ruling All Progressives Congress.’

“It is in the light of the foregoing, that I am compelled to offer my resignation from the People’s Democratic Party effective immediately.

“While the decision was difficult to take, I, however, believe that it is the right one. Despite this resignation, I will always be available to offer my services towards the deepening of democracy and good governance in Nigeria”, the letter added.

The Chicago State University (CSU) yesterday released the academic records of President Bola Ahmed Tinubu in compliance with the order of the District Court of Northern District of Illinois, Eastern Division.

The court had, on Saturday, ordered the CSU to release the academic records of Tinubu to the presidential candidate of the Peoples Democratic Party (PDP), Atiku Abubakar, Tinubu’s main challenger in the 2023 general elections.

The development came after a U.S Judge, Nancy Maldonado, in a memorandum of opinion and order, adopted all the ruling of Magistrate Judge Jeffrey Gilbert of the U.S. District Court.

Tinubu, the candidate of the All Progressives Congress (APC), had objected to the Magistrate Judge Jeffrey Gilbert ruling ordering the immediate release of the academic records by the CSU.

The president had said releasing the documents with deposition would cause him severe harm because they were private to him and would not be admissible in the ongoing petition against him in Nigeria.

But Atiku had filed another appeal, leading to the judge ordering that the documents be released within 48 hours.


“The Court overrules President Tinubu’s objections to Magistrate Judge Gilbert’s recommended ruling, and therefore adopts the ruling in full. Mr Abubakar’s application is therefore granted,” the judge had ruled.

CSU, in a certificate of service signed by its counsel, Michael D. Hayes, stated that: “I hereby certify that on this 2nd day of October, 2023 the forgoing response to the Applicant’s Revised Subpoena to Produce Documents was served on all counsel of record by electronic mail.”

Details of the released documents sought by Atiku showed that CSU complied with his request for a true correct copy of diploma for Bachelor of Science degree issued in 1979 and Bates labelled as CSU 0001 through 0007 with an obscured student’s name which the university said was for privacy reasons.

The university, however, said it could not locate a true and correct copy relating to the diploma it issued in 1979 to Tinubu.

The university said, “CSU does not in the ordinary course keep copies of student diplomas, and after diligent search cannot locate a copy of the original diploma it prepared for Mr Tinubu in 1979, hence has no documents responsive to this request.

On Atiku’s request for any of the university’s diploma other than that issued to President Tinubu that “contains the same font, seal, signatures, and wording which purports to be a CSU diploma issued to the president on or about June 22, 1979, the university said after diligent search it located and Bates labelled them CSU 0008 through CSU 0010 and obscured the student’s identity for privacy reasons.

“The students’ names on these diplomas have been redacted for privacy reasons. CSU is also producing Bates labeled as CSU 0011 and CSU 0012 diplomas prepared for other CSU students (with their names redacted for privacy) which match the format of the Tinubu replacement diploma dated June 27, 1997,” the university said.

The university also released documents demanded by Atiku on the correct copies of the documents earlier certified by Jamar Orr in Exhibit D to Uwais Declaration and Bates labelled same CSU 0013 through 0032. But the institution said the communication to CSU between August 1, 2022 and August 1, 2023, was not produced because the objection to them was sustained by the court.


The releases followed an order on Saturday by Judge Nancy Maldonado, in overruling Tinubu’s objection to Judge Gilbert’s earlier approval to Atiku’s application.

She ruled that Atiku’a requests met the threshold and requirements under 28 U.S.C S 1782 as Tinubu’s submission of his CSU diploma to the Independent National Electoral Commission (INEC) and its relevancy outweighs his privacy interests.

She further noted that Atiku made the request for the documents as a candidate in the February 25 presidential election to enable him tender them in his appeal at the Supreme Court in Nigeria in support of his claim that Tinubu was as of the time of the election not qualified to contest.

When contacted on the telephone last night for a reaction to the release of Tinubu’s academic records, a spokesperson to Atiku, Phrank Shaibu, said he would get back to Daily Trust, but as of the time of filing the report around midnight, he did not do so. Neither did he reply a text message sent to him.

Controversy had trailed the details of credentials submitted by Tinubu to the Independent National Electoral Commission (INEC).

As a legal practitioner, I interpreted the provision of the EA 2022 like the learned Lordship.

There would be double nomination if Shettima went into the elections against Atiku and Obi as a prospective vice President and at the same time stood elections to represent his senatorial district at the red chamber.

Shettima did not contest for two constituencies in the February 25th election and neither did he contest the primaries that produced Tinubu as the flag bearer of the APC. When he was selected as Tinubu's running mate, in good faith, he relinquished the senatorial ticket he had already clinched.

The claim of double nomination is frivolous, malicious and libelous as it never existed ab initio.

“Multiple nominations with the electoral act does not occur simply because he accepted a second nomination, the fact that the acceptance was immediately relinquished so as to pave way for another person to replace him as senatorial candidate cannot be overlooked or disregarded.

“We have to be very careful the way we read provisions of facts particularly when they are public interest issues and for presidential requirements where it is broad knowledge where it is very clear that the purpose of the statutory provision is to avoid a situation where the person holds two nominations to have an election as a candidate either in two constituencies or political parties.

“The purpose of that provision is to avoid the situation but where a person has clearly said ‘no I don’t want’, and relinquishes one, I do not think it will be acting in good faith to jump on him and infer something else.


Case closed. I've been wondering why nobody thought along this lines since this argument started. The guy didn't go into the election standing in 2 constituencies. He relinquished one and INEC only published his name in the VP slot so why all the cacophony of conspiracies?

I'm not surprised the judges choose this common sense path.

The supreme court on Friday, described the Peoples Democratic Party (PDP) as a “meddlesome interloper” over the suit seeking the disqualification of Bola Tinubu and Kashim Shettima.

The PDP had alleged that Shettima was still the Borno central senatorial candidate of the All Progressives Congress (APC) on July 14 when he accepted the nomination for vice-presidential candidate.

The party claimed that the nomination of Shettima as the vice-presidential candidate of the APC was in breach of the provisions of sections 29(1), 33, 35, and 84(1)(2) of the Electoral Act.

Responding to PDP’s argument, the respondents said the suit was statute-barred, having been filed 15 days after the cause of action instead of 14 days as required by law.

They also averred that the issue being contested is an internal party affair and that the appellants lacked the locus standi to institute the suit.

Delivering judgement on Friday, a five-member panel of the apex court agreed that the PDP lacked the locus standi to institute the suit.

The supreme court said the PDP is like a “nosy busybody” that is peeping into the affairs of its neighbours.

The apex court added that the PDP failed to show the potential harm it suffered or stands to suffer from the action of the respondents.

Adamu Jauro, a member of the panel who delivered the lead judgment, said: “It is therefore abundantly clear that a political party that files a suit challenging the nomination of a candidate of another political party would be a nosy busybody, a meddlesome interloper, peeping into the affairs of his neighbour without any backing.

“The appellants by its originating summons and affidavits in support failed to disclose any nexus between the actions of the respondents and the suit.

“And it has failed to show which harm it suffered or that it stands to potentially suffer from the action of the respondents.

“In fact, no dispute has been shown to exist between the appellants and the respondents.

“I’m in complete agreement with the lower court that the appellant lacked locus standi to institute and maintain this action at the trial court.”

Jauro added that the case has been a waste of precious time.

“It is frivolous and bound to fail and is fraught with manifest malady. It has been a waste of precious time and judicial energy.

“Counsel should do better to advise their clients to desist from such frivolous matters.

“The appeal is grossly lacking in merit and it is hereby dismissed.”

The supreme court also awarded the sum of N2 million against PDP and in favour of the respondents–Tinubu, Shettima and APC.

The Spokesman of the Coalition of United Political Parties (CUPP) and member-elect for Ideato North/South federal constituency of Imo State, Ikenga Ugochinyere, and 62 other members-elect from the opposition parties, have endorsed the All Progressives Congress (APC) consensus candidates, Hon. Tajudeen Abbas and Hon. Benjamin Kalu, for Speaker, Deputy Speaker of the incoming 10th National Assembly.

Ugochinyere made this known at a press conference addressed in Abuja on Wednesday.

He called on other candidates in the race who were banking on opposition votes to stage a rebellion against the Abbas/Kalu ticket to withdraw from the race as the opposition votes they were banking on would no longer be available for them.

While describing Abass and Kalu as men of integrity, and competence to preside over the affairs of the 10th House of Representatives, Ugochinyere said it was time for national development, growth and stability and not the time for party politics.

He called on the APC not to do anything that will tarnish the character of Hon. Abbas and Kalu or the independence of the House if the duo emerged victorious.

The CUPP spokesman also stated that allegations that the House Rules were tampered with were not true, stating that the House Rules were last printed in December 2020 and not after the 2023 elections, hence by the extant Rules, the election of the presiding officers of the House will be by open ballot system.

Ugochinyere said, “It is on this note that I call on my fellow colleague members-elect who are still in the race to stop and join the prefect of the class, Hon Tajudeen Abbas, to steer the ship of the 10th Assembly to beat the records of the other Houses in performance and achievement for Nigeria. Our common goal now should be beyond party and partisan politics and totally focused on Nigeria and her greater good. We want the best and we have selected the best and importantly, the selection is by merit.

“I do not speak for myself alone. I speak for the 63 likeminded Honourable members-elect of the opposition family who have agreed on a common vision for the 10th Assembly. We will transform to the TBK Group. Our 63 votes without any dissent or abstention will go for Hon. Tajudeen Abbas. In the coming days, Nigerians will come to know the identity of the TBK Group and will also feel our impact.”

In his closing remarks, another member-elect to represent Isuikwuato/Umunneochi federal constituency under the platform of Labour Party, Hon. Amobi Ogah, said, “For the first time, we are trying to make history. I’m supporting Abass and Kalu not because APC picked them. Abass and Kalu have the capacity and competence. The tenth Assembly will be a unique one if the duo emerge as Speaker, Deputy. I beg my colleagues to support the duo in the interest of National unity.”

Based on this Judgment Order, this case was filed on the 11th day of May, 2023.

Alex Otti emerged as the gubernatorial candidate of LP during primaries held in June 2022.

Section 285 of the Constitution states that all pre-election matters must be filed within 14 days of event.

A case relating to election is either a pre-election matter or a post election matter (election petition).

If the case filed by Ibrahim Haruna Ibrahim at the Federal High Court in Kano was/is a pre-election matter, it should have been filed within 14 days of the primaries.
How can a court assume jurisdiction in a matter that is indisputably statute barred?

This is shocking.

Also, no candidate was joined as a party in this suit. I have noted that Abia is specifically mentioned in the judgment. A court in Kano cannot nullify primaries outside Kano.

The jurisdiction of the Federal High Court cannot be invoked this way.

Nullifying primaries of candidates, and even declaring votes scored as wasted votes in this circumstance, goes against all established principles of law and fair hearing.

The court lacked jurisdiction.

This type of judgment has the potential of exposing the judiciary to avoidable public ridicule.

A former Attorney General of Abia State and Commissioner for Justice, Chief Umeh Kalu (SAN), has dismissed a High Court judgement sacking candidates elected under the platform of the Labour Party (LP), describing it as “inconsequential”.

Justice M N Yunusa of Kano High Court, on Friday said the Labour Party failed to comply with the provisions of the 2022 Electoral Act in nominating its candidates.

The Court in Suit No FHC/KN/CS/107/2023 filed by Mr Ibrahim Haruna Ibrahim against the Labour Party and the Independent National Electoral Commission ruled that the failure of the Labour Party to submit its membership register to the Independent National electoral commission within 30days before their primaries renders the process invalid.

“The party that has not complied with the provisions of the electoral act cannot be said to have a candidate in an election and cannot be declared winner of an election this being so, the votes credited to the 1st defendant is a wasted Vote as the decision of the Supreme court,” the Judge ruled.

Reacting to the judgement, Chief Umeh Kalu, the Abia State Coordinator of the Obi/Datti Presidential Campaign Organization, in a telephone interview with THE WHISPERER described the judgement as inconsequential and dead on arrival.

He said: “The judgement is Inconsequential and dead on arrival. It is dead on arrival because Alex Otti is not a party to the suit. I have seen the judgement. You cannot make an order to anybody that is not a party before you. The issues they raised there are the same thing they raised at the tribunal. They said that the membership register of the Labour Party (LP) was not submitted 30 days before— and— all these issues were raised at the tribunal. Elections have come and gone; candidates accepted by INEC, elections conducted, results declared. Any issue that has to do with that election, the only arena for it is the election tribunal. The issue they raised is pre- election matter.

“But, even on the merit, the Kano case is dead on arrival. You cannot shave anybody’s head in his absence. Alex Otti’s name was not mentioned in that judgement even though I think he is the target.”

The Independent National Electoral Commission has declared Ibrahim Lamido of the All Progressives Congress as the winner of the Sokoto East Senate seat at the National Assembly.

INEC Returning Officer, Prof. Muhammad Bayawa, declared the result in Sokoto on Sunday.

Bayawa said that Lamido scored 112,764 votes to defeat Gwanda Shuaibu of the Peoples Democratic Party who polled 107,834 votes.

He said that Abdullahi Dahiru of the New Nigeria Peoples Party polled 410 votes to place as distant third.

Meanwhile, the APC has also won eight out of the 10 House of Representatives seats covered by supplementary election.

In Gudu/ Tangaza Federal Constituency Prof Muazu Shamaki, the returning officer declared Alhaji Sani Yakubu of the APC as the winner with 23,473 votes.

In Dange-Shuni/Tureta/Bodinga Federal Constituency Prof. Chika Muhammad, the INEC Returning Officer, declared Shehu Nasiru of the APC as the winner with 40,994 votes.

Wurno/Rabah Federal Constituency the incumbent Ibrahim Al-Mustapha of APC won with 23,497 votes, while Bello Ambarura of the APC won the Gwadabawa/Illela Federal Constituency seat with 31,374 votes.

In Kware/Wamakko Constituency the incumbent Abdullahi Kalambaina of APC won with 43,344 votes.

Others were Bala Abubakar, Sokoto North/Sokoto South Constituency, Sa’adu Nabunkari, Binji/ Silame Constituency, and Jelani Danbuga, Isa/Sabon Birni federal Constituency.

However, Abdussamad Dasuki of the PDP won the Tambuwal/Kebbe federal constituency seat, while Bashir Gorau of PDP also won the Gada/Goronyo federal constituency seat.

The News Agency of Nigeria reports that Aliyu Wamakko of the APC was earlier declared as the winner of the Sokoto North Senate seat, while Gov. Aminu Tambuwal of PDP won the Sokoto South Senate seat.

NAN also reports that with the results, the APC currently has two Senate and eight House of Representatives seats, while the PDP has one Senate and three House of Representatives seats in the state. (NAN)

The Federal University of Technology Owerri, FUTO, has claimed that some political actors in Abia State attempted to bribe the Vice Chancellor, Professor Nnenna Otti, to compromise the outcome of the March 18 governorship poll in Abia State where she officiated as the Returning Officer.

The university wrote this on its website on Wednesday when it updated Otti’s profile as the eighth Vice Chancellor of the university.

According to the post, Oti’s insistence on the rule of the game saved the situation in Abia as she resisted pressures to compromise.

The post read:”Oti was the returning officer in the Abia state governorship election and was hailed for the key role she played in ensuring that the election outcome was not compromised, despite attempts and pressure from political actors in the state to bribe her”.

Professor Oti during the collation of results at the INEC headquarters in Umuahia, intermittently said that the” pastor and mother” in her would not allow her to compromise the poll result.

” I will do right by God and man”, she thundered, declaring that nobody would compel her to do the wrong.

But for her insistence on the actual number of accredited voters as captured by the Bi-modal Voter Accreditation System, BVAS machines, the alleged ” 108,000 magical votes” from Obingwa Local Government Area, which eventually came down to 27,664 votes when subjected to BVAS, would have decided the poll in favour of the ruling PDP.

Former Imo State Governor, Emeka Ihedioha has withdrawn from the Peoples Democratic Party (PDP)’s governorship primary in the South-East state.

The former governor was screened and cleared a few days ago by the PDP to contest the party’s primary ahead of the November 11 governorship election in Imo State.

However, in a letter dated March 27, 2023, Ihedioha informed the PDP leadership of his “personal sacrifice” for a “consensus candidate” by the party.

In January 2020, the Supreme Court sacked Ihedioha as the governor of Imo State after barely seven months in office.

The seven-man panel led by Chief Justice Tanko Muhammad unanimously declared Hope Uzodimma of the All Progressive Congress (APC) as the winner of the March 19, 2019 governorship election in the state.

The appellant, Uzodimma had contended that he scored the highest number of votes in the election but the Independent National Electoral Commission (INEC) returned Ihedioha as the governor of the state.

Justice Kudirat Kekere-Ekun who delivered the judgment declared that the votes due to Uzodimma were unlawfully excluded from the 318 polling units and should be added to his votes.

The apex court considered the submissions of a principal witness who was on a subpoena to present results and held that the lower court was wrong in its ruling.

Justice Kekere-Ekun subsequently declared Uzodimma as the validly elected governor and the certificate of return issued to Ihedioha was withdrawn by INEC and given to Uzodimma.

Hyacinth Alia, candidate of the All Progressives Congress (APC), has won the Benue state governorship election.

Ali, a reverend father, garnered 473,933 votes to defeat Titus Uba, the candidate of the Peoples Democracy Party (PDP), who polled 223,913 votes, to be declared the winner on Monday.

Herman Hembe of the Labour Party (LP) scored 41,881 votes.
