I don't think they are highly debatable as you say. Whatever is not traceable to the Prophet salallahu alayhi wa salam and his companions is out of Islam.

None of this five points were traceable to them at all.

And when scholars give fatwa they give them based on evidences available to them. They can be correct or otherwise.
