The festering crisis rocking the All Progressives Congress (ÀPC) in Rivers State, took a new twist, as Chairman of the sacked Caretaker Committee, Isaac Ogbobula, claims he remains in charge of the party and not Igo Aguma. Ogbobula, who chaired the State Caretaker Committee that was declared illegal by a Port Harcourt High Court, last Tuesday, declared yesterday, that he remained in charge and asked statutory members of the party’s State Executive Committee to ignore a virtual meeting called Igo Aguma. He stated that based on the judgment order of Justice George Omereji, in Suit No. PHC/4355/2019, that sacked his committee and directed the APC and its National Chairman to constitute a fresh caretaker committee within 48 hours of the judgment, he had filed an appeal for a Stay of Execution of that order. “As a party to the said suit, I have exercised my undoubted constitutional right of appeal by filing a Notice of Appeal on June 10, 2020, along with a Motion on Notice for an injunction pending appeal/stay of execution. These court processes were duly served on the APC and its National Chairman within the 48 hours timeline given by the Court for the constitution of a fresh Caretaker Committee” he said. Ogbobula said as a responsible political party, the APC could not proceed to execute the judgment of Justice Omereji in the face of his appeal and the accompanying application for stay. According to him, the APC is an avowed rule of law tilted party has to abide by the established principles of the law by the Supreme Court of Nigeria already declared in several decisions. “The implication, therefore, is that the status quo ante Bellum before the judgment of Justice G.O. Omereji remains. This means that the Caretaker Committee set up by the National Working Committee of the Party in September 2019 headed by me remains intact,” he said. Consequently, he said had not summoned any meeting of any organ of the APC in the state, all statutory members of the State Executive Committee of the Party were asked to ignore and completely disregard the purported meeting called by Aguma. “I and the members of the Caretaker Committee shall, in due course, by a well-publicised notice, call a proper meeting of the appropriate organ of the party in furtherance of the party’s activities,” he added. The Guardian learnt that 20 out of the 27 statutory members of the State Executive Committee attended the meeting called by Aguma yesterday. Aguma was quoted to have said that reconciliation and conduct of congresses in line with the Supreme Court judges were the primary focus of the meeting. |
Describes it as a miscarriage of justice… Assured party faithful that the evil gang-up will not stand The governorship candidate of the All Progressives Congress (APC) in Rivers State during the 2015 general elections, Dr. Dakuku Peterside says today’s judgment by Rivers State High Courts were not totally unexpected. In a chat with journalists, he stressed that the court in its wisdom in both cases granted all reliefs sought by the claimants including reliefs not sought. On one hand, Dele Moses and nine others had gone to court against the APC to declare them authentic candidates for the party’s congresses in the state. On the other hand, Hon Igo Aguma had gone to court, challenging the composition of the caretaker committee for the party in the state. The former member of National Assembly noted that the ruling was not totally “unexpected given recent happenings in Rivers State but as Democrats, we have accepted it and will explore all legal means to seek redress at upstairs. According to him, “It is true that lately, we are facing a lot of challenges, some of which are caused by the interference of non-party members in government, who want to see the party in comatose to their advantage and against the interest of Rivers State but I am confident that as a party we shall overcome. “I acknowledge that there is no easy path to victory and even God did not promise us an easy path but what the Almighty assured us is the ultimate victory. I urge all true members of APC under the leadership of Rt Hon Chibuike Amaechi not to despair nor be discouraged but continue to have abiding faith in God and our democratic institutions to restore the glory of our party, which will take over the leadership of the state and restore sanity in governance. “No amount of gang-up or manipulation of institutions by enemies of APC and Rivers State will succeed because they do not have the support of God of justice and moral force of the law behind them. “I am confident that the Appeal Court will correct the miscarriage of justice witnessed today. Our lawyers upon instructions of leadership have already filed an appeal and motions for stay of execution immediately after the judgments were delivered. “I wish to personally appeal to all our people to remain calm as we seek solutions within the confines of the law and through other credible political means to resolve some of our genuine challenges.” Dakuku Peterside Media Team June 9, 2020

By Davies Iheamnachor – Port Harcourt A Rivers State High Court sitting in Port Harcourt has declared Hon. Igo Aguma, the Acting Chairman of the All Progressives Congress in the state. The court also compelled the party to allow all members of the party loyal to Sen. Magnus Abe, who purchased from for the congresses of the party in 2018 to take part in the process. Justice George Omereji gave these rulings in two separate suits brought before him by Dele Moses and 9 others and Igo Aguma, a chieftain of the party, on different matters in the crises rocking the party in the state. Aguma had sought the court to declare the Caretaker Committee brought by the National Working Committee of the party as void, and declare him to head the affairs of the state by virtue of his position as the National Delegate and Statutory member .Omereji in his judgment after the submissions of the claimant’s counsel, Echezona Etiaba, a Senior Advocate of Nigeria, declared that Aguma had the locus standi to approach the court, adding that there was the issue of injustice and violation of the civil right of the applicant. On issues of jurisdiction as raised by the defendants, Omereji held that the court has the right to entertain the matter to see whether the rights of the claimants have been violated, adding that defendants have not established that the claimant has no locus standi and had provided no evidence to show that he (Aguma) did not exhaust all the avenues in the party before approaching the court. He also ruled that the suit was not an abuse of the court process, because he only requested that the APC rules should be followed, noting that the claimant being a former member of House of Representatives meets the requirements of a statutory member. He ruled that no section of the APC constitution prohibits the statutory members of the party not to carry out the duties of the State Executive Committee in their absence, noting that in the case such lacuna that will warrant the setting up of the Committee by the national body of the party has not arisen because there was still the State Executive Committee of the party in the state. He held: “It is my view that the appointment of the caretaker of the Committee without the inclusion of the national delegate and SEC is a violation of the party’s constitution. All the National Convention Delegates and State Executive Committee members should be part of the caretaker Committee.” He noted that the tenure of the caretaker committee of the party elapsed in September, noting that the continuous stay of the caretaker Committee is null and void, even he described it as fatal. Omereji, who granted all the prayers of the claimant, Aguma, held that the decision of the court should be given immediate effect to enable the second party to rebuild itself. On the matter brought by Dele Moses and nine others, Omereji held that only those who purchased the form to participate in the annulled Congresses of the party in the state should participate in the Congresses to be rescheduled by the party. The judge granted all six prayers of the applicants, ruling that the court can interfere in the internal affairs of the party when the party constitution is not followed. Omereji held that democracy would be effective in the country when the parties have internal democracy, noting that the suit by Moses and others is justiceable. He ruled that all the candidates and those excluded in the cancelled Congresses are automatic to be allowed to participate in the process. Reacting to the court judgment, Aguma, noted that the ruling has given the party opportunity to make peace, noting that the party is bigger than any individual. Aguma promised not to compromise the confidence reposed on him in piloting the affairs of the party, adding that peace would be restored in the party. However, counsel for the defendants, Mr. Emenike Ebete, said the decisions of the court on the two matters would be challenged at the Court of Appeal. He noted that there were a lot of grounds where the court erred in its decisions, adding that the judgment would not survive tested at the appelate court

The youth leader who is said to have criminal records before he defected to the PDP from APC. The LGA taskforce gave Prudent and Etemeteh Hotels the go ahead order to operate even with the lockdown. The state taskforce got the info and moved to enforce the lockdown order only for the manager of one of the hotels to put call across to the LGA taskforce led by the wanted PDP youth leader, they responded and descended on the state taskforce members. Governor Okezie Ikpeazu of Abia State has relaxed the COVID-19 induced lockdown of the state with effect from today. Addressing journalists at Government House, Umuahia after a meeting with some critical stakeholders in the state, Ikpeazu said as from today, vehicular movements would be allowed in the state. He however said that commercial vehicle and Keke operators in the state must observe strictly guidelines specified by the state committee on COVID-19 and that anybody who violated the guidelines would be arrested and prosecuted The Committee’s guidelines are that keke operators must carry only two passengers in a given trip, while commercial buses must not carry more than five persons. Residents of the state according to the guidelines should wear nose mask before coming out in public, while churches will operate with fewer members and must observe social distancing. It also stated that burials shall be in a football field with not more than 30 person, while if it is taking place in a compound, there will not be more than 10 persons in attendance. Before the burial, churches are to obtain permission from the Secretary to the State Government while traditional worshippers should go through their traditional rulers, social distancing must be observed. Ikpeazu directed market union leaders to meet and plan on how to operate.

THE All Progressives Congress has said some of its members were conniving with its enemies to destroy the party in Rivers State through judicial manipulations and betrayal. The Publicity Secretary of one of the factions of the APC in Rivers State, Mr Chris Finebone, said such members claimed to be the APC members in the media by day and in another political party at night. Finebone spoke through a voice message sent to our correspondent on Sunday while reacting to the defection of a former commissioner for education in the state, Allwell Onyesoh from the APC to the Peoples Democratic Party. The state APC spokesman said Onyesoh was only exercising his right to free association, adding, “My reaction to Chief Allwell Onyesoh leaving the APC to the PDP is that he simply exercised his right to free association and none can fault that. “Some are in the APC on television and in the newspapers by day and in another party by night. They are the ones, who connived with the adversaries to destroy the party through judicial manipulation and outright betrayal. Placed side-by-side, Chief Onyesoh towers above them in principle,” Finebone added. The ex-commissioner for education described his defection to the PDP as homecoming.
