By Okafor Ofiebor/Port Harcourt The Appeal Court, Abuja has set aside the June 2020 judgment of Justice George Omereji of the State High Court, Port Harcourt and sacked Igochukwu Aguma as Acting/Caretaker Committee Chairman of APC in Rivers. In a press Statement, by Livingstone Wechie, the faction has appointed Golden Ben Chioma as Acting/CTC Chairman of Rivers APC after Court of Appeal sitting in Abuja set aside the June 2020 judgment of Justice George Omereji and sacks Igochukwu Aguma. The appellate court also affirmed the appointment of Barr. Isaac Abbot Ogbobula as Caretaker Committee Chairman of the Rivers State APC and held that it is the exclusive right of the National Working Committee of the All Progressives Congress under the party’s Constitution to appoint a Caretaker Committee for any organ of the party. Ogbobula faction is loyal to the Transportation Minister, Rotimi Chibuike Amaechi. Meanwhile,the faction which is loyal to Magnus Abe has headed to the Supreme Court to challenge the judgement. The full details of the Appeal Court judgement today has not been obtained by our Correspondent at the time of filing this report. However, press statement signed by Livingstone Wechie, Media Adviser to the of Igo Aguma faction stated that their lawyers had been contacted to go on an appeal to the Supreme Court. “We shall not give saboteurs the space to destroy our party because of the unwholesome and selfish interest of one man-styled and christened the godfather of APC Rivers State. “The Appeal Court judgement today is unacceptable and shall be appealed against at the Supreme Court in its entirety in keeping with our allegiance to the rule of Law. The crisis in the Rivers State chapter of the All Progressives Congress, APC, deepened on Monday after the faction of the party led by factional chairman, Igo Aguma suspended the minister of transportation, Rt. Hon. Chibuike Amaechi and the chairman of the faction loyal to the minister, Isaac Abbot-Ogbobula. The decision was conveyed in a statement issued by the media adviser to Aguma, Mr. Livingstone Wechie. GWG recalls that Abbot-Ogbobula had in a statement last week suspended Senator Magnus Abe, and Aguma. Besides the suspension of Amaechi, the Aguma faction also expelled erstwhile acting national chairman of the party, Victor Giadom and also suspended Senator Andrew Uchendu who are known associates of Amaechi. Even more, the faction vowed to partake in the forthcoming local government elections in the state. Wechie in the statement said: “The All Progressives Congress APC held its State Executive Caretaker Committee meeting in Port Harcourt today December 21, 2020. “The extraordinary Executive meeting was presided by Rt. Hon. Igo Aguma, the State Acting/Caretaker Committee Chairman of the Party. The meeting was well attended by Statutory/Executive members of the Party both physically and virtually and major issues were deliberated upon with the following decisions:” “The State Executive Caretaker Committee ratified the recommendation of the State Disciplinary Committee of the Party which looked into the decision of the Ward and LGA chapters to suspend His Excellency Rt. Hon. Rotimi Amaechi of Ward 8, Ikwerre Local Government Area of Rivers State for Anti-Party activities. “The State Executive Committee also accepted and ratified the decision of the State Disciplinary Committee to uphold the indefinite suspension of Barr Isaac Ogbobula by the Ward 10 and LGA Executive of Ahoada-East Local Government Area of Rivers State. Barr Isaac Ogbobula is hereby suspended indefinitely from APC Rivers.” On Giadom and Uchendu, the statement deposed: “The State Chairman briefed the Executive Committee meeting that he received communication from the APC Executive of Gokana LGA to the effect that both Ward 16, Bera and the Gokana LGA chapters of the Party have expelled Chief Victor Giadom from the APC as well as a report from Emohua LGA chapter that both Ward 4 and Emohua Local Government Chapter of the party in Rivers State have suspended Senator Chief Andrew Uchendu from the APC. “The Executive Committee referred both reports from Emohua and Gokana Local Government Areas on Chief Victor Giadom and Senator Andrew Uchendu to the State Disciplinary Committee for further action in line with Article 21 of APC Constitution.” While declaring the faction’s readiness for the Rivers State local government election, Aguma said: “The State Executive Committee mandated the Caretaker Chairman, Rt Hon Igo Aguma to write a letter to the Rivers State Independent Electoral Commission (RISIEC) communicating the readiness of the All Progressives Congress Rivers State to fully participate in the April 17th 2021 Local Government Election in the state. “The State Caretaker Committee also expressed commitment to work assiduously to bring the party to reckoning in Rivers state. …Calls on Party Members to remain calm Former representative of Rivers South-East Senatorial District at the National Assembly, Senator Magnus Ngei Abe, has condemned the purported inauguration of Local Government and Ward Executives of the All Progressives Congress (APC) in Rivers State by the Minister of Transportation, Rt. Hon Rotimi Amaechi. Abe, in a statement by his spokesperson, Parry Saroh Benson, described the inauguration as an act of impunity, pointing out that it was the same attitude of insensibility that has kept the party comatose in Rivers State. The senator posited that any inauguration of caretaker committees without consultation of other stakeholders will only put the party in more chaotic situation. He said: “It is this imperial approach to the challenges facing the party without the input and consultation of other stakeholders, that is responsible for the crisis in the party. It is clear that those who believe in the power of man are once again on the move. “It is indeed unfortunate at this critical time in the political game, that the APC in Rivers State has learnt nothing and forgotten nothing, it appears that the minister and his supporters are still hell-bent on “their way or the highway”. The end result of this kind of behaviour is not difficult to predict. As usual, it will end in failure. When it fails, Nigerians should note that the choice of impunity, disrespect for party members, exclusion of critical stakeholders, contempt for judicial pronouncements and petty arrogance, over humility and inclusiveness is the foundation of our serial failure as a party”. Abe had in an earlier letter to the APC National Caretaker Committee Chairman, His Excellency Alhaji Mai Mala Buni dated the 5th day of December, 2020, advised the party on the need to review it modus operandi in Rivers state. The letter titled: ‘The National Membership Revalidation Exercise: The Rivers State Situation’, reads in part: “I write as a concerned stakeholder to draw your attention in particular to the state of the APC in Rivers State where the party has largely been comatose, with no legal local government or ward structures, due to the inability/refusal of the party to obey the existing Judgement of the Supreme Court of Nigeria. This position of the party taken and sustained at the behest of certain individuals, has made it impossible for the party to make progress in Rivers State, all sorts of frivolous lawsuits which cannot in any way overturn the pronouncement of the Supreme Court are sustained to massage political egos, and create the illusion that there is a possible legal solution to the challenges of the APC in Rivers State that can sidestep the Supreme Court judgement. This is not true. The judgement of the Supreme Court remains final. As the party embarks on the forth coming Registration of members across the country, it is important that I draw your attention to this peculiar situation in Rivers State, any exercise that is carried out in Rivers in continued defiance of the judgement of the Supreme Court without resolving this issue will result in another round of motion without movement. The pressure being mounted on the caretaker committee to establish local government and ward caretaker committees for the party in Rivers without consultation with other stakeholders is nothing but a move to get the party to continue on the path of impunity in defiance of both law and reality. The party must either find a political solution to its challenges in Rivers State or obey the judgement of the Supreme Court of Nigeria which the APC had refused to do under previous administrations. Your Excellency, with all respect, it is the hope and expectation of members of our great party in Rivers State that your committee will break with this tradition of impunity and disregard for the law that subjugates the interest of the party to other interests, it is time to uphold the law, in other to breathe new life into the party.” Senator Abe maintained that he will remain committed to the All Progressives Congress (APC) in Rivers State and continue with a broad-based consultation and reach out process aimed at finding workable solutions to the current challenges facing the party in the State.
