What is Land Use Charge (“LUC”)?

• Land Use Charge (“LUC”) is a Lagos State property tax backed by the Land Use Charge Law of 2018.

• LUC is a consolidation of ground rent, tenement rate, and neighbourhoodimprovement levy.

Is LUC a new form of tax?

• LUC is not a new form of tax.

• The Law backing LUC was first enacted in 2001.

What is LUC based on?

LUC shall be payable in respect of all real estate property situated in Lagos State (“the State”).

What was the rationale for repealing and re-enacting the LUC Law?

• The LUC Law was repealed and re-enacted to address some identified challenges which include:

1. Lack of clarity on the LUC formula to support self-assessment;

2. Obsolete rates which had not been reviewed in over a decade;

3. Need to improve LUC administration efficiency; etc.

• The new LUC Law also provides a robust legal and regulatory framework to support ongoing LUC administration reforms aimed growing the State’s economy.

Could you please explain the concept of self-assessment and its implication?

• Self-assessment essentially means that payers can compute the amount of LUC payable on their respective property by themselves.

• What this means is that, since the formula is now easy to understand, you do not need to wait to receive a demand notice on your property before making payment; from the comfort of your home, you can calculate the LUC payable and are able to make your payments promptly.

• We expect that this will drive up compliance, improve the timeliness of collections and minimiseleakages.

What was the situation under the old Law without self-assessment?

• Before now, the formula/basis for LUC determination were not clearly defined thereby creating room for subjectivity in the computation of LUC amount payable.

• Furthermore, payers were only able to make payments of LUC based on demand notices served by the State Government.

• However, due to administrative challenges, including inadequate enumeration, LUC demand notices were not served timely/regularly in most cases.

• This meant that, if you did not receive a demand notice, you were not likely to pay LUC thereby resulting in lost revenue to the State Government.

How often is LUC payable?

• LUC is an annual tax which becomes payable from the first day of each new year (i.e. from 1 January).

How is LUC derived?

• LUC payable on a property shall be arrived at by multiplying the Market Value (“MV”)of that property by the applicable Relief Rate (“RR”)and Annual Charge Rate (“CR”), using the prescribed formula.


What is the formula for calculating LUC?

The formula that shall be used to determine the annual amount of LUC payable is:

LUC = (Land Value + Building Development Value) x Relief Rate x Charge Rate


How is the LUC formula interpreted?

• The formula can be interpreted as:

LUC = [(LA x LR) + (BA x BR x DR) x RR x CR]

•Where

?LA= area of the land parcel in square metres

?LR= average Market Value of a land parcel in the neighbourhood, on a per square metrebasis in Naira based on Market Value property as determined by professional valuersappointed the Commissioner for Finance for that purpose

?BA= the total developed floor area of building on the plot of land om square metres, or total floor area of apartment unit in a building where the apartment has a separate ownership title

?BR=average construction value of medium quality buildings and improvements in the neighbourhood, on a per square metrebasis in Naira based on the market value of the property as determined by professional valuersappointed the Commissioner for Finance for that purpose

?DR= the Depreciation Rate for the buildings and improvements of land which accounts for the building being of higher or lower value than the average buildings in the neighbourhoodand which also accounts for the degree of completion of construction of the building

?RR= rate of relief from tax (if any) applicable to the owner-occupier in the circumstances shall be determined by the Commissioner and published in the State Government Official Gazette and in one or more newspapers circulating within the State and reviewed by the Commissioner once every five years

?CR= annual charge rate expressed as a percentage of the assessed Market Value of the property and which may, at the State Government’s discretion, vary between:

a)owner occupied and other property;

b)residential property and commercial (revenue-generating property);

c)physically-challenged persons; and

d)persons who have been resident at the same location for at least 12 years, minor, retired owners and occupiers, on the one hand, and other owners and occupiers on the other.

What is the specific Annual Charge Rate applicable to eligible property?

• The Annual Charge Rateto be applied to eligible property in Lagos State shall be as follows:

1.Owner-occupied residential property–0.076% per annum of the assessed property value

2.Owner-occupied pensioner’s property–Exempted from LUC

3.Lagos State Government property–Exempted from LUC

4.Industrial premises of manufacturing concerns–0.256% per annum of the assessed property value

5.Residential property (owner and third party–0.256% per annum of the assessed property value

6.Residential property (without owner in residence)–0.76% per annum of the assessed property value

7.Commercial property (used by occupier for business purposes)–0.76% per annum of the assessed property value

8.Vacant property and open empty land–0.76% per annum of the assessed property value

Are there any form of reliefs available for LUC payers?

•There are various forms of reliefs that are available to payers of LUC.

•The reliefs include:

a)General reliefof 40% (applicable to all property liable to pay LUC); and

b)Specific reliefsapplicable to property owners and leases of 10 years and above for:

I.Pensioners (60 years and above)–100% for owner-occupied property

II.Persons with disability–10% for owner-occupied property

III.Aged persons(70 years and above) –10% for owner-occupied property

IV.Age of property–10% for property aged 25 years and above

V.Long occupation by owners–5% for 12 years and above

VI.Federal and other State Government property–20% for non-revenue generating property

VII.Partial relief under the LUC Law–20% for non-profit-making organisations

How can payers take advantage of the available reliefs?
•To enjoy the available reliefs, payers will need to provide relevant documentary evidence to support their relief claims.

How can payers apply for the reliefs?
•All application for reliefs can be made to the Commissioner for Finance for approval and supported with relevant documents.

What do the payers stand to benefit from early payment of LUC?
•All LUC paired within 15 days of receipt of Demand Notice will enjoy a timely payment discount of 15%.

What is the minimum LUC payable?
•The minimum LUC payable on any given property shall not be less than ?5,000 irrespective of any LUC relief granted on the property.

Who is responsible for the property enumeration and valuation?
•The Commissioner for Finance is empowered to appoint such Property Identification Officers, Professional Valuersand other persons as may be considered necessary for the purpose of assessing the charge applicable to a property.

Are there any property exempted from LUC?
•The following category of property are exempted from LUC:

1.Property owned and occupied by a religious body and used exclusively as a place of worship or religious education;

2.Public cemeteries and burial grounds;

3.Property used as a registered educational institution certified by the commissioner to be non-profit making;

4.Property used as public library or as a private library certified by the commissioner to be non-profit making;

5.Any property specifically exempted by the Executive Governor by notice published in the State Official Gazette; and

6.All palaces of recognised Obas and Chiefs in the State provided that if any of the exempted property is leased out to private entities for revenue generation, it shall forfeit its exemption status as contemplated under the provisions of this Law.

What are the offences and penalties?
•Any person who:

1.Refuses or neglects to comply with any provision of this Law when required to do so by the Property Identification Officer or an Assessor;

2.Prevents, hinders, or obstructs any Property Identification Officer or an Assessor in the course of lawful duty; or

3.Removes, damages or destroys a Property Identification plaque on any Property or building,

commits an offence and shall be liable on summary conviction to a maximum fine of two hundred and fifty thousand naira only (?250,000) or to a maximum term of imprisonment for aperiodod three (3) months or both.

Is there any penalty for people who incites others to refuse to pay LUC?
•Any person who:

a)incites another person to refuse to pay LUC; or

b)Incites or assists any person to misrepresent in any way the person’s chargeable property;

commits an offence and shall on summary conviction be liable to a maximum fine of two hundred and fifty thousand naira only (?250,000) or to a maximum term of imprisonment for a period of three (3) months or both.

What dispute resolution mechanism has been put in place?
The new LUC Law establishes an Assessment Appeal Tribunal (“the Tribunal”) in each division of the State to treat all appeals and resolve any potential disputes.

Who makes up the Assessment Appeal Tribunal?
•Each Tribunal shall consist of:

1.A Chairman who shall be a legal practitioner of not less than 15 years post-call experience;

2.A representative of the Attorney-General;

3.A registered town planner;

4.A registered land surveyor;

5.A registered estate valuer;

6.A representative of the Lagos State Valuation Office;

7.A person with cognate experience in accounting and taxation; and

What is the mediation process under the new LUC Law?
•In resolving disputes arising from the provisions of this Law, the parties shall submit to a confidential mediation in an effort to resolve such disputes.

•Where the mediation does not resolve the dispute within 45 working days of the first session or when the mediator declares an impasse, the mediation shall be deemed inconclusive and parties shall be at liberty to resolve their dispute formally at the Tribunal or through any other lawful means.

A BILL FOR

A LAW TO REPEAL THE LAND USE CHARGE LAW, 2001 AND ENACT THE LAND USE CHARGE LAW,

2017 TO PROVIDE FOR THE CONSOLIDATION OF PROPERTY AND LAND BASED RATES AND CHARGES PAYABLE UNDER THE LAND RATES LAW, THE NEIGHBOURHOOD IMPROVEMENT CHARGE LAW AND TENEMENT RATES LAW IN LAGOS STATE INTO A NEW LAND BASED CHARGE, TO BE CALLED LAND USE CHARGE, TO MAKE PROVISION FOR THE LEVYING AND COLLECTION OF THE CHARGE AND FOR CONNECTED PURPOSES.

THE LAGOS STATE HOUSE OF ASSEMBLY enacts as follow:

Interpretation. 1. In this Law –


“Annual Charge Rate” means the percentage of the assessed value of the property over a period of twelve months;

“Assessment Appeal Tribunal” or Tribunal means the Assessment Appeal Tribunal establishment under section 12 of this law;

“Building” includes anything constructed or place on, in, over or under land but does not include a highway or road or a bridge that forms part of a highway or road;

“Charge” means an assessed amount on property payable under this Law;

“Chargeable person” means a person liable to pay Land Use Charge on a chargeable property or his successors-in-title, assigns, executors and administrators;

“Chargeable Property” means any property in respect of which Land Use Charge is payable;

“Commercial Property” means any property that generates revenue;

“Commissioner” means commissioner for Finance or such other member of the State Executive Council for the time being in charge of Finance;

“Designated Bank” means a company carrying out banking activities as provided for under the law and listed as bank that may collect on behalf of the Government any Land Use Charge payable under this Law;

“Exempt Property” means any property of a class described under section 7;

“Financial year” means any period of twelve (12) months beginning from January 1 and ending on December 31;

“Governor” means the Governor of Lagos State;

“High Court” means the High Court of Lagos State;

“Improvement to property” means a building structure, fixture or fence erected on or affixed to land, or a movable structure that is designed to be occupied for residential or business purposes whether or not affixed to the land;

“Land Use Charge” includes all property and Land Based Rates and Charges payable under the Land Rate Law, the Neighbourhood Improvement Charge Law and the Tenement Rate Law as may now be computed on the basis of the Schedule of this Law;

“Market value” means the total sum of Land Value and Building Development;

“Occupier” in relation to a property, shall include not only a person whether lawfully or unlawfully in actual occupation of the whole or part of such property but also any person with a right to actual or beneficial occupation or mandated to occupy the land by a person with such right, whether solely or concurrently with other persons, although this does not mean it must be of pecuniary benefit and does not include a lodger;

“Owner” in relation to any property shall include the person for the time being receiving the property in connection with which the word is used, whether on his own account or as agent or trustee for any other person who would receive the sum if such property were let to a tenant, and the holder of a property direct from the Sate whether under lease, licence or otherwise and will include the estate of a deceased holder of a right of occupancy, whether expressly granted by the Governor or otherwise, and shall include every assignee from a holder;

“Property” includes –

(i) a building;
(ii) any improvement on land;
(iii) a parcel of land, whether or not reclaimed,
waterlogged or otherwise;
(iv) a parcel of land and any building or improvement;
(v) a wharf or pier; or
(vi) leasehold of up to ten (10) years;

“State” means Lagos State of Nigeria;
“Structure” includes a building or other thing erected or
placed in, on, over or under land whether or not it is affixed
to the land.


Land Use Charge. 2.

(1) Subject to the provisions of the Law, is imposed a land based
charge, to be called Land Use Charge which shall be payable on all
real property situate in the State;

(2) For the purpose of this Law, each Local Government Area in
the state shall be the collecting authority and it shall be the only
body empowered to levy and collect Land Use Charge for its area of
jurisdiction.

(3) Each collecting authority may delegate to the State, by
written agreement, its functions with respect to the collection of
rates and the assessment of privately-owned houses or tenement
for the purpose of levying such rate as may be prescribed under this
Law.


Property liable
to charge 3. Land Use Charge shall be payable in respect of any property that is
not exempt under section 7 of this Law.

Identification or assessment of a Property.

(1) The commissioner shall undertake or cause to be Undertaken an assessment of chargeable properties in such areas of the State as the Commissioner may designate.

(2) For the purpose of subsection (1), the commissioner may appoint such property identification officers, professional valuers or their authorized assistants may, on any day between the hours of 7:00 am and 5:00 pm;

(a) enter, inspect, survey and asses the property;

(b) request for documents or other information to be produce to the identification officer or
professional valuers;

(c) take photographs; and

(d) make copies of necessary documents

Critics on Local Rapper and Nigerian Hip Hop Sound

The Nigerian music industry has been somewhat boring all this years and there’s been nothing worth talking about which involves the quality of music we do until recently. There’s a debate growing among music fans in Nigeria now, following the release of Reminisce “Local Rapper”. A track where he featured other indigenous rappers in Olamide and Phyno. And they all but declared themselves dominant in the rap scene in Nigeria. Totally rubbishing the need for three fundamental elements which makes up a good rap song, which are ‘Wordplay’s, ‘Punchlines’ and ‘Talking Ill’.

Where did rap or good music go to?

If it’s all about the money, maybe we can argue that they are probably right. ever since the emergence of Olamide and Phyno, it’s almost been a roller coaster ride for them, getting all sorts of endorsements and performing in shows home and abroad. Every time the argument of merging Success with Hip Hop comes up, people are quick to mention Mode 9, Labeling him as the guy who can spit all the rhymes in the world but have nothing to show for it financially.

This sometimes affects the mind of a young rapper or an upcoming musician contemplating whether to stick to a style which will make him/her world-famous like Asa, Tu Face, a style which presents a better and bigger opportunity to roll with Legends like Jay-z, The Marley’s as we saw with Ice Prince and Tu Face respectively or to limit yourself to a style where you are easily accepted by your locality and it all but ends there except going abroad to perform to Nigerians there.

Some rappers have spoken against such ideology about local rap or local music taking over and the best reply so far is that of fast rising rapper Rage Millz who dropped a single titled Vocal Rapper in response to Reminisce Local Rapper.

He highlighted the need for good music saying, it’s better to do a song people listen to a thousand times than to do a thousand songs people listen to just once.

From Mode 9’s “Cry” to Tuface “African Queen” to Style Plus “Run Away”, to Dare’s “Not the girl” and many other good songs over the years. Nigerians have shown that if they hear good music, they will embrace it. Rappers like M.I and Ice Prince have also shown that you don’t have to go all indigenous to be successful as rapper in this part of the world.



While many people will agree with Reminisce, Olamide and Phyno. There’s still a fraction who disagrees. But there must be a reason why Reminisce will feel local rap has taken over. His bank account since he switched to local rap is probably what drove him to stake such claims.



Who is to blame? The Fans?

What is Local Rap or Local Music? I suppose this is the everyday song we hear with very little or no message, no constructive lyrics needed, just a bunch of weak freestyles and a repetition of same thing over and over again. A good producer does the majority of the job and all an artist have to do is hide behind beat, get a melodious chorus and just say anything that comes to your head, regardless of what sense it makes. just like Skales second verse in “Shake Body”.



What is Vocal Rap or Vocal Music? This is what we consider as good music, those kind of songs we hear from ASA, TUFACE and some very intelligent rappers. Even DA-GRIN was intelligent and had crazy word-play. you can listen to his freestyle on jimmy jump off to understand that. Hip Hop In Nigeria Is Dead Or Alive?
The Nigerian music industry has been somewhat boring all this years and there’s been nothing worth talking about which involves the quality of music we do until recently. There’s a debate growing among music fans in Nigeria now, following the release of Reminisce “Local Rapper”. A track where he featured other indigenous rappers in Olamide and Phyno. And they all but declared themselves dominant in the rap scene in Nigeria. Totally rubbishing the need for three fundamental elements which makes up a good rap song, which are ‘Wordplay’s, ‘Punchlines’ and ‘Talking Ill’.

Where did rap or good music go to?

If it’s all about the money, maybe we can argue that they are probably right. ever since the emergence of Olamide and Phyno, it’s almost been a roller coaster ride for them, getting all sorts of endorsements and performing in shows home and abroad. Every time the argument of merging Success with Hip Hop comes up, people are quick to mention Mode 9, Labeling him as the guy who can spit all the rhymes in the world but have nothing to show for it financially.

Alex Iwobi is in a privileged position. The nephew of the two-time African Footballer of the Year has always been able to turn to the man ‘so good they named him twice’ for help in his nascent career. Okocha was renowned for his lightning-fast stepovers and immaculate technique, and he has passed on all he knows to the 17-year-old.

He is relishing the prospect of playing on a bigger stage - and that starts on Thursday night as the under-21s take on West Brom at Emirates Stadium. It is a chance that Iwobi is determined not to pass up, having seen close friend Chuba Akpom make a name for himself on tour with the first team during the summer.
