As per the mother, will my cousin standing as sponsor for future application be sufficient, then? By the way, isn't my cousin allowed to sponsor her mother for this sole purpose of her attending her graduation? Yes she is a final year student but the funds in her account is sufficient to maintain her mother for three weeks at least. Can they reapply with the graduating student as sponsor? |
justwise: Getting a visa to the UK as a matured student is always difficult especially if you are not from a rich family or attending one of those expensive schools in Nigeria.Okay, so going the appeal route will be futile. I have advised my cousin to wait till she gains full time employment to re-invite them at which time she will be their sole sponsor and her sister in Nigeria would have marked on Youth service. How feasible do you think this is? What are the foreseeable obstacles in your opinion? How will this refusal impact on subsequent application for visit for both mother and sister? What does she need to do now to prepare for a re-application say in December? |
justwise: She can't afford the trip and does not have any strong tie-to-Nigeria. Even if she sister in the UK has all the money to sponsor her she still need to show that strong tie-to-Nigeria as an adult.Thanks for your reply. That part about her sister proving ties to Nigeria confuses me though. What other ways can a student show ties to Nigeria? |

Did she submit her tax certificate as a business owner?No she didn't submit her tax certificate as I doubt that her' sis a registered business. Her balance as I understand it was 60k and she is a pensioner who owns her own house and subscribed to shares in a number of companies. More so shouldn't regard have bee given to the account of the UK child? She claims that her invitation letter detailed her responsibility for their welfare and accommodation during their stay. |

I am aware that the letter was produced at your request and solely for the purpose of this visa application. You have elected not to submit any satisfactory evidence to support your claim to study in Nigeria. Without sufficient documents supporting your studies, I am not satisfied that you are settled and established as a student to ensure your departure from the UK. I am not satisfied that you are genuinely seeking entry to the UK as a visitor for a period not exceeding six months. .you state that your mother will fund your travel and stay and I recognise that you have submitted two bank statements I. Her name. However I note that the balance of the funds across the two accts total 60,000.42. I am not satisfied that these funds are sufficient to support both yourself and your sponsor for a two week period. I note that you have submitted no other evidence that your mother will have access to further funds. Given the concerns raised, I am not satisfied that you are genuinely seeking entry as a visitor or that you intend to leave the UK at the end of the period of visit. I am therefore not satisfied that you meet the requirements of para 41(I) and (II) of the uk immi rules hc395. Or that you will be maintained and accommodated in the UK without working or having recourse to public funds or able to meet the cost of return or onward journey as required by para 41... Therefore I am not satisfied that you are seeking a genuine visit or that you intend to leave the UK at the end of your visit. |

If possible remove all personal details and paste the refusal letter here You state that you are self employed and that you earn £120,000 using an exchange rate of 272 naira to the £1 per month. I am not satisfied you have provided adequate evidence to substantiate this claim. I recognise that you have provided two bank statements. However you have provided no official document that link you to a business in Nigeria and I note that the deposit seen in your account are not commensurate with the income you have declared. In addition, I note that the initial balance across both accounts is 60,000 naira. Whilst I acknowledge that you are self employed and may not have a fixed monthly income deposited into your account, it is reasonable to expect your acct transactions to be commensurate to your stated circumstances. However as detailed above I am not satisfied that your statement of acct does accurately reflect your income as detailed on your application. You have not provided satisfactory evidence to show the origin of these funds or evidence that they are under your exclusive account. I further note that the balance of these account fluctuates considerably over the period of the statement. I am therefore not satisfied that the documents provided are the accurate reflection of your personal or financial circumstances.Mind you my cousin claims she had sent six months bank statements and tenancy agreement to support their application. |

Hello Justwise, I trust you are well. Please assist me with this query. My cousin' smother and sister's visa application to attend her graduation ceremony has just been refused and she is beside herself with sadness. The refusal was based on the financial status of the mother and that the ECO was not satisfied of the sister's educational status(she had submitted her school I'd card and letter from school verifying her registration at that said university. In addition, she(the sister in Nigeria) recently graduated). My question, I supposeis: how would you advise them? The graduating sister in the UK is unemployed for now and has about £5k in her account. Is she allowed to be a sponsor? She also has adequate accommodation. How should they proceed now? Appeal? Mind you, she graduates at the end of July. Thanking you in advance for your response. |
