She took the result to the Embassy personally they refused to accept it, then she DHL it and they receive it because she was afraid of not loosing the original document. Cheers.

Well your lawyer can advise you better on this. The Turkish girl I said had similar case like yours sent her original English test result to the Embassy personally, but it took time for the Embassy to confirm they received the parcel from DHL. She was issued visa but took a while because of the original English test document she did not include when putting in her appeal. Ask your lawyer about this issue, I am very sure they will need the original English test result. Take care sweetie. Don't panic, be calm. Cheers.

Very good. Thank God you put your house in order already, God is your help he alone can make the ECM upturn their decision, and by the grace of God the ECM will overturn their decision in Jesus name...Amen. Just believe that God has done it for you and you will receive a good result from the Embassy. I know you're worried, apply little more patient and you'll hear a good result soon....ok. You'll be fine soon. Victory is yours. Take care. Cheers.

Change in your field is non of their business it is your choice and a decision you've made that will boost up your career and broaden your scope. Then the gap of a thing since you said you did your house job which is mandatory in the medical field then you should have given the Embassy relevant documents regarding the house job, and this gap issue wouldn't have cropped up. I can't tell your chance of wining but I can tell the waiting time in accordance with UKBA Guidance note.

--Administrative review request notice guidance notes

You must not send any additional documents such as your passport, travel document or supporting documents. If they overturn their refusal decision, they will ask you to send in your passport or travel document.

The administrative review will be completed within 28 days. You will be notified of the result in writing. To ensure that the review is independent, the review result may not be sent from the post that made the original decision.

I hope this help. God is able in all situations he will judge in your favour. Take care. Cheers.

You have to give them more time. Sometimes it takes 2 month. You will be contacted as soon as they are done. In the next 2 to 3 weeks the Embassy will contact you because issuing of visa after appeal is won is between 6 to 8 weeks, little patient....ok. Take care. Cheer.

That's fine. But you have to give them 19 weeks to work on your papers. I have not contacted the Embassy since I received my letter that I should give them 19 weeks, so I'm waiting for the 19 weeks to lapse. I am more than tired. Generator is a problem to me cos of the noise, constant interruption of power supply. So much heat to bear. I'm always in door cos of dust and heat. I'm use to it now bubblygirl there's no cause for alarm. Our endurance will soon come to an end in Jesus name....Amen. Take care. Cheers.

You said "is al most 4 month now that have sent my Appeal stuff to the Appeal peps in Uk..." May I ask when you submit your appeal did you not receive acknowledgement letter from the Tribunal in UK regarding your case and the amount of time you need to comply with? If you did received a letter then you have to adhere to it. If you applied for visiting visa your wait is 16 weeks which is the 4 months you've waited, give them more time you'll be contacted if its successful or not, and if its not you'll receive a letter regarding your hearing date. I hope you're sending the emails to the right place because you said they've not replied you? You can email customer service once again and see how it goes. Take care. Cheers.

You remember I said a thread mate submitted appeal 12th of July 2012 was called to bring her passport 12th of Nov 2012, and was called to pick up her visa 26th of Nov 2012, her acknowledgement letter stated 23rd of February 2013 and she got her visa in Nov.2012. BHDC used 19 weeks and 4 days to finally issue her visa. Put your house in order and you'll smile like this lady. Today complete 16 weeks I've been waiting for mine. I was given 2nd of May. I am waiting patiently, I count days like I'm counting money. God is our help. Take care. Cheers.

@bubblygirl

Your lawyer is wrong. I was refused because of evidence of communication only, my lawyer is based in UK, my lawyer sent all the email I printed from January to October last year and western union money papers together with the appeal to the Tribunal. The Embassy will not ring you to bring extra document because they are not in a position to do so in this kind of case. You have to speak to your lawyer to send all documents that can address the issues to them at once. If you don't send concrete evidence to BHC how will they review your case for crying out loud? Please don't make any mistake or give them the chance to prolong your days of wait. My friend in Aberdeen last year was refused because she did not write the English test, she sat for the test, passed, and reapplied, was granted visa with 3 month, this was last year September BHC granted her visa. If you're refused visa because of communication and English test its not a problem, so long as you have your test result ready and emails or printed phone calls that's fine you can reapply if you can afford it which is quicker or wait for the appeal to come thru which is longer. Please make sure you address all the points of the ECO in your appeal, they will need the original of the English Test Result will be required by BHC, (TRUST ME). You lawyer is right when he said you should reapply. Your appeal is just a month plus right so you can reapply if you can afford it once again. I applied for mine Nov. Bye
TravelRe: UK Spouse Visa/Appeal Process-part2 by lamosy(f): 7:54am On Feb 26, 2013
@bubblygirl78

I don't know why you're refused, the letter you received after putting in appeal is normal procedure. The content in the letter states you have to give BHC 19 weeks to review your case with the relevant documents provided, that was why the Tribunal gave BHC 6 months to deal with the review for now, if BHC overturn their decision they will contact you to bring you passport and append visa in it for you, but if they maintain their decision they will inform the Tribunal and you will receive a letter regarding your hearing date and BHC will send in their bundle regarding you case to the Tribunal who will look into your case independently. I know when sending appeal you are told not to send original document, I am saying this because you mentioned sending your English test result online to Tribunal or BHC I don't know which, trust what I'm telling you now if you do not send the original English test result to BHC they will delay you unnecessarily. This happened to a lady in Turkey and the appeal took ages. She sent copy of her result but when the appeal was taking too long she rang the Embassy luckily ECM spoke to her and told her they can not process her papers without the Original English Test Result, she had to DHL it to the Embassy but she saw hell before they confirmed they receive the original document. If you're refused because of the English test you don't have to worry they will grant you visa at the end of the 19 weeks, but if there are other clause in which you're been refused I can not assure you but only God can be your help. Even if you're been refused on other grounds so long as you've addressed those issues with concrete evidence you don't need to worry. Appeal is time consuming 6-9 months, be patient. A thread mate submitted appeal 12th of July 2012 was called to bring her passport 12th of Nov 2012 was called to pick up her visa 26th of Nov 2012, she's with her husband since last year. Have a nice day. I know your mail was addressed to Justwise I am sorry if I intrude into your privacy please pardon me, but felt I could throw a little light on it to relief you off some stress. Take care. Cheers.

Actually any fake or forged documents attract 10 years ban in accordance with their law. I am not saying you submitted fake documents but just to let you know the penalty. The only way you can win the case is if you are able to proof beyond reasonable doubt that those documents provide are all genuine and not forged. In this kind of case you need Immigration Consultant who can help you put your house in order before submitting your appeal. This kind of case need a concrete evidence to challenge the ECO's decision, because the Embassy has a way of verifying Bank Statements in various Banks in Nigeria. ECO can make mistake too, maybe the ECO did who knows? So the only way to handle this case is thru appeal which you've done, very good, brilliant. The only way you can win the appeal is if you've got a satisfactory evidence against ECO's decision, then don't be afraid just pray there's nothing too big for God to handle, pray that your evidence should be satisfactory to whoever is reviewing your case, and you'll see how good God is. Make sure your evidence are intact. Well the Lord is your helper in times like this. Appeal is time consuming, so be patient, it takes 6 to 9 months. Some are lucky they get thru by 4 month, some 5 month. I know its frustrating please be patient. If you want to send more evidence you can. Take care. Cheers.

Simple option regarding your friends case is to re apply and address all the issues raised by the ECO. Also take the advice of Justwise. If you go for legal you'll waste your money and the case will remain the same. So let your friend address those issue the ECO raise first and then re apply, this is faster. I know you're worried, easy does it. Take care. Cheers.

You stated categorically that "my mum applied for a visit visa for me and in my application i applied as a student" this sound complicated to me. You also stated your mum provided marriage certificate, why? Was the marriage certificate your mum's or yours? May I ask with all due respect Which of the country you intend to visit? If its UK fine I can be of assistance but if its Italy I may be giving you the wrong information because I'm not use to their system and process. If its UK and you're sure there's an error on the ECO's part according to your statement you said you provided all the documents needed and you're sure you met the requirement you can request for Administrative review.

The administrative review is free of charge.

You must ask for an administrative review no more than 28 days after the date when you receive the refusal notice (GV51). When they send you the refusal notice, they will also send you:

--An administrative review. request notice

You may request only one administrative review per refusal decision. If you make any further review requests for the same refusal decision, they will not be accepted and will be returned to you.

Take care. Cheers

What happens next after your documents is sent to British Embassy in Cairo for review?

An entry clearance manager (ECM) at the visa office in Cairo will review their decision to refuse your application, in light of your appeal form and any supporting documents that you have sent. If the ECM is satisfied that your application meets the Immigration Rules, they may overturn our original decision and issue you with a visa or entry clearance.

If the ECM does not overturn the decision, an entry clearance officer (ECO) will write a statement explaining why the ECM has upheld the decision to refuse your application. They will send this and all your papers (known as 'the appeal bundle') to the FTTIAC. They will prepare and send your appeal bundle within:

20 working days for non-settlement and family visitor cases; or

90 working days for settlement cases.

These timings exclude postage times to and from the visa office.

The FTTIAC will:

list your appeal for hearing;

send copies of all the relevant papers (including the ECO's written statement) and supporting documents to them and to your representative or sponsor; and

advise you of the date and time of your hearing. They have no control over when your appeal will be heard

An immigration judge will hear your appeal in the UK. When considering your appeal, the judge will look at all the evidence provided by your representative and by the ECO. He or she will determine your appeal on the individual details of your case in line with the Immigration Rules.

The judge will inform the FTTIAC of his or her decision no more than 10 days after the hearing. The FTTIAC will then send that decision (known as a 'determination') to everyone involved.

If your appeal is successful:

If the judge allows your appeal, his or her determination will be sent to the relevant visa section, which will in turn contact you.

It can take up to 4 weeks for determinations to reach the relevant visa section, and a further 8 weeks for them to be processed. The visa section will write to you using the contact details provided on your appeal form.

Please do not contact the visa section until 12 weeks after the date when you or your representative received the judge's decision. This date will be stated on your written determination.

Do not contact the FTTIAC or our immigration enquiry bureau about your appeal after you have received your allowed determination. They will not be able to issue you with a visa or deal with your enquiry.

Appeal in UK in person is better and faster. You said you've put in an appeal already please don't forget to address the ECO's points, such as:

1. That You have not provided documents in support of the history of your relationship.

2. The documents you have provided only begin after your departure from the UK.

3. Given the lack of evidence of personal contact and regular correspondence between you.

If you can address this issues with supporting documents and if you can provide documents before your departure from UK that'll great. Submit all this evidence along with your appeal, you'll be fine. Except you haven't got all the supporting evidence in place that's when you'll panic, if your house is in other ......trust me .....no qualms.

A fellow thread mate who was successful in her settlement visa told me the embassy rang her the day it completed two weeks to come and pick up her visa. Some people collected theirs before a month some after a month. But my lawyer told me it takes between 4 to 6 weeks to issue visa at the Embassy. I've read on this thread when an appellant complained bitterly about her visa not been issued on time that she has waited for two months. Just to let you know how clumsy and time consuming, but I pray God intervene in your case to make less or exactly two weeks for you in Jesus name ...Amen. God has favoured you already he will make it perfect. Take care. Cheers.

Very Sorry about your predicament. I know it hurt so badly. If the entry clearance officer says he or she does not believe your relationship is subsisting or not genuine, there must be reasons why the relationship is not genuine. Please can you state all the reasons exactly the way the ECO stated them on your refusal letter. Without all these reasons I can not help you. The reasons would make it easier to help you. Take care. I'm not perfect in advice, I gave advice from my own understanding and from what I've read from this thread that worked for others and by the grace of God. Dismissal can be in two ways: either the case was dismissed and determination letter was issued or the appeal was dismissed and the case was closed. Since you're told you've been sent a determination letter I would strongly advice you to receive the letter first, then read the content, if you do not understand the content please ask questions, rather than concluding negatively. Don't be afraid, be strong, God is your helper. Pray ceaselessly that the determination letter carries good new, and you will hear good news in Jesus name. A guy on this thread has similar case as yours though his was settlement, yet God judge in his favour and did it swiftly for him. he was granted Visa. Don't lose hope...ok. Don't be afraid, the God that favoured that fellow will favour you too and put a song in your mouth to glorify him. Have a good day. Take care. Cheers.

You said "My brother is point based system immigrant with resident permit. does he has legal status to invite me? I think he can if he has all the necessary documents in place. For you to be sure about this you have to visit the UKBA website for more clarification. Documents required before you can apply are as follows:
--Biometric page
--Statements of A/C
--Utility bills
--P60
--Pay slips
--Mortgage or tenancy agreement
--invitation letter to you

Documents required from you are as follows:
--Letter of employment
--tax
--A written letter from your employer stating that you're been paid cash(Salary), please use letter head paper, stamped and signed. Make sure your letter of Employment also state that your salary will be paid to you in cash. Make sure you state a reasonable salary because if what you have in your account is too much and what they pay you is a token they might suspect your source of income.
--Annual leave letter
--Ties or property if you have(this is just to convince the ECO of your coming back to Nigeria)
--Photos(pictures you've snapped with the invitee)
Warning: please make sure all your documents are authentic, do not forge any document please because it will lead to 10 years ban.
After confirming that the invitee can actually invite you, make sure all your documents are sorted before applying. Good luck in all your endeavours. Take care. Cheers.
