@Saheedbadmos This was the reason why the ECO refused you visa according to you "I won't leave uk at the end of my proposed visit and that my travelling intention is different from what i stated in my application" did you declare ties or property? May I ask you your travelling intentions? I mean what you stated in your application,better still can you type the refusal the way it is written in the letter so I can advice you better. Do you have limited right of appeal? |
@g-rock He should stop worrying himself over nothing. His UK refusal was on time factor only. So he need not to worry. As for applying for a Canadian Student Visa yes he can apply it won't affect anything. So long as information is not withheld when filling out the Student application form. If he's been asked in the form if he's been refused a visa from any other country he should declare it and also the reason why he was refused for transparency. He should vet all his documents properly to make sure he meet all the requirements regarding the Canadian Student Visa before applying, because once beaten twice shy. If he want to go to UK for visit and he has the right documents to show for it he can apply first week in February his travelling date should be first week in April, he will be granted Visa. @g-rock Sorry about the sad news regarding your brothers refusal. The wedding was for the 29th of Dec. 2012, so its done already, you have right of appeal because its family visit visa. He can appeal if he want but my fear is the event in which he had wanted to travel has come and gone. Appeal takes a hell of time, time as in 6 to 9 months. To my own opinion if I was in his shoes I will reapply again for family visit visa to visit the couple since they only refused me on the ground of time factor. Please when reapplying allow enough time to enable them do their job cos they've got loads of pending application to deal with. When reapplying don't forget to declare you've been refused a visa before and the reason in which you was refused. Failure to disclose this piece of information will lead to 10 year ban. Make a choice and go for it. Trust me you'll be given visa if you reapply. Have a nice evening. Take care. Cheers. |
@Junnymercy Would you like to listen to the bitter truth? She shouldn't bother going thru administrative review...alright, cos its a waste of time. She can reapply if she meets the requirements and is able to provide concrete evidence of ties, personal statement of A/C, Job, and so on. The reason why she was refused was because of lack of concrete evidence and the ECO is not satisfied cos she may decide not to return to her country. This is what the ECO is guiding against. Family visit Visa would have been the best for her. This is my opinion from experience. Take care. Cheers. |
@favouredgal]@Lamosy and the house, the lawyer is very right, I also applied for settlement visa, I was refused n went for appeal. The tribunal sent me a mail that my bundle has been sent to d BDHC for review, and dt it will take up to 19 weeks which was Feb 28, 2013, and after this date if the BDHC still uphold their initial decision, then i will b sent the hearing date which is another 2 to 3 months I was so sad and thought thats a long time to wait. Fortunately for me, my case didn't get to the Feb 28 or hearing level before I was called by the embassy. I raised a question some weeks back here, Lamosy if u could remember. I was called to submit my passport after the tribunal sent my appeal bundle to the BDHC Lagos for review. The BDHC overturned their decision after going through my new evidence. I got my passport back after 2 weeks with my multiple years visa. I was called last week Monday to come for my passport, went on Thursday and travelled to the UK over the weekend. Now with my husband, dream come true. My Advice Lamosy: be patient, pray ceaselessly so you can find favour in the sight of the Entry Clearance Manager that is suppose to review your case, and go to UKBA websites, you will get your facts. Appeal takes time but it works. It will b over sooner than you thought. I am yet to believe am in the UK because everything happened so fast. The Tribunal sent a Notice of Pending Appeal letter to my lawyer who forwarded the Content to me. The letter was dated 20th Dec. 2012. Favouredgal just like they wrote to you,the review will take 19 weeks, and the Tribunal ask the Respondent(BDHC)to file 2nd of May 2013 giving reason for that decision they made. May I ask if you received another letter from the Tribunal before you was granted your visa? Common girl reply me swiftly. I'm waiting. I've been praying too. Justwise how's your family? Please may I ask how long it took BDHC to request for your passport? I mean from the time you put in your appeal. How long did it take the Tribunal to send you the mail you received? How long was your wait since the day you put in the appeal till the day you got your visa? All together was it up to 5 or 6 month? Ha ha ha ha ha ......I'm just curious. @erico2k2 Thank God for you. I have lived with my husband for over 3 years before we got married and applied for visa in June. But I haven't got a baby for him. Oh erico I pray it does not exceed 3 month. Does the 3 month include winning the appeal and issuing Visa or just winning the appeal excluding the issue of visa? @ erico2k2 As per evidence of contact you can write a letter covering that explaing means of contact and the reason you could not provide physical evidence. Just to let you know that I've printed emails month by month from January to October the emails are bulky and all the money transfer documents though my husband put the money in my mums name to collect it and give to me. I made a copy of my mums passport and visa page and sent along with my appeal. Its the time I'm worried about. How long did it take you to win your appeal before they issue you visa? According to what you said in your mail in the first thread if I'm not miss quoting you "you said you've been refused thrice and appeal thrice" I'm I correct? If yes, how long did the first appeal took before the refused you? Do you think all the documents enclosed with the appeal is enough to overtone their decision? Say hello to your wife and baby. @ Hacklilc Sorry to hear that. Well if you had known you would have asked your company to always credit your account with your income, by so doing the monthly income will reflect in your statement of account, also get a coloured bio-data of your sponsor and a letter from your sponsor to explain that the bio-metric page is his. Then wait after 5 months to re apply, that's all dear. Your case is not very difficult. Now you're appealing I hope all relevant documents were submitted, God will help you definitely. Cheers. |
@erico2k2 I was refused on the ground of evidence of contact. My lawyer is Nigeria. It was stated in my Right of appeal that my case can be treated with all the relevant documents and may not go for appeal hearing. I don't know why they made this statement. Does that mean they can review the case without the case going for appeal hearing. I'm restless erico |
@justwise I've asked my husband he said "no he didn't give me a copy, email the lawyer & ask him these questions. I don't want you to start pestering him over this things please he's done his job, you've got to be patient darling and stop panicking you're doing my head in." Don't know what to say to him. He believes whatever he's been told and act on it. Since the lawyer said "there's no chasing up" that when the Tribunal is done I will be contacted that's what he's going to do. God help me. @justwise Thank you for your time dear. I really do appreciate your advice. I worried when Hacklilc said his acknowledgement letter came after 5 month oh my God, that's way too long justwise, woooooow. Oh justwise I'm crying for not re applying. I will ask the lawyer if he has received an acknowledgement letter from the Tribunal if he says no I will ask my husband to make the call. I'm sure the lawyer did not give him a copy of the appeal form. I will ask my husband if a copy was given to him. I will ask the lawyer second week in December the letter. I actually sent the appeal form and relevent documents to the lawyer so I do not know my Reference No. And the phone number to contact the Tribunal on. I can email customer service to find out if they've received it isn't it? Should I ask the lawyer for my reference no.? This lawyer can be strict he's Nigeria and I pray he oblige me my request. |
@ Hacklilc Thanks for contributing. Was it settlement Visa you applied for? I'm asking because you They acknowledge your appeal after 5 month, does that mean you won the appeal and you're waiting for the Embassy to ask you to bring your passport to append the Visa on it? @ justwise You're right, I believe the Embassy handle Administrative review, but the lawyer said he sent the appeal to the Tribunal that the Tribunal will send the paperwork to the Embassy for review, after reading a lot from this thread I disagree with him mail to me because I learnt the Tribunal will send the appellant acknowledgement letter, secondly they will send another letter regarding the hearing date, if I win the case then the Tribunal will contact UKBA, if the UKBA didn't challenge it then the Embassy will be contacted regarding the issue of my Visa. I've not received any letter yet, my husband signed the appeal form before the lawyer sent it off. I don't know if it is oral or paper hearing. What do I do now? Because the lawyer said there's no chasing up. Please help, will the Tribunal send me my own acknowledgement letter or to my husbands address in UK? Because I'm in Nigeria O. |
@ erico2k2 This was the mail my lawyer sent after putting in the appeal: Appeal has been sent with all the documents provided (emails and western union receipts). All the documents were posted to the Tribunal in the UK. The Tribunal will then send them to the Embassy. Once the Embassy receives the documents they will review everything sent including our grounds for disagreeing with their decision. If they are convinced and satisfied with the documents then, they may withdraw their refusal and invite you to produce your passport in order to issue the visa. This can take up to about 3months from now, although it may take slightly longer or shorter. There is usually no chasing up. In some cases they may agree with our reasons. If this happens they may withdraw the refusal and reissue another refusal with other reasons. However, if they are not convinced with the documents sent to them, then they will maintain their decision which means that the matter will proceed to Court hearing in about 6months. If the matter is successful al at the hearing then it takes another 6 to 8 weeks after the hearing to have the visa issued. I wanted to re apply the lawyer said the Embassy can be tricky that they may find another fault who knows the best bet is to appeal because the refusal is just evidence of contact which I have provided all emails and western Union, in which they can review. This is my predicament O. I sometimes can't sleep. |

The lawyer didn't listen to me when I told him I was going to include these evidence he said its not necessary and not in their rules. When I was about to submit my application then in June the guy vetting my documents said have I got emails I said no he said but they normally would like to see emails between me and my husband, stupid me I told him not to worry because I paid the stupid lawyer to do his job and the job was not well done. In my right of appeal it was stated that after filling my appeal form I should send it to them that it may not go thru appeal hearing. My lawyer in UK said he sent the appeal to the Tribunal the Tribunal will send all the evidence to the Embassy to review the case and issue me Visa if they are satisfied. I will send you what my lawyer said after putting in the appeal. I've been in Nigeria since Jan. 27th its very frustrating my husband only visited me once and he's always busy working. I've cried but its not going to help, I pray everyday for God to help put it in the past. I'm alone Erico, its boring, constant interruption of power supply, Generator noise is the worst. @ erico2k2 and everybody in the house please help. Sorry to bother you, just want to find out after winning your appeal how long did it take the Embassy to issue you a visa? Because mine is settlement Visa, refused on the ground of No evidence of Contact. Was refused mid October, put in an appeal 1st of November, this is why I ask you this question, just to know the time frame. Also were you ask to come along with a new statement of account or any other documents. Please when you've got time kindly furnish me with the answers just to get prepared in case I am called. @justwise Thank you for you candid response. My husband said he can not afford to waste £1000 re applying again, that I have to wait on their response. I don't know how to convince he. Moreover he doesn't really know a fadding about visa processing, he's always telling me to allow them to do their job and there's no way he can hurry them up. I get upset when he talk like this, we've not seen each other for 8 months now, I am the one feeling the pinch big time, no job and husband is not here with me, no children. @justwise Thank you very much for you swift response. The mistake was the Attorneys because I told him I'll include all the western unions and emails he said I shouldn't worry because he felt since we live together in UK and both of our names appeared on our bills and council tax. I told him about sponsors undertaking still he argued that its not in their rules. When I scanned the form to him he believed me. My Job is on the line because of my papers, I didn't re apply because our account we use to have £35,000 when I submitted my application, later we bought a house in Malta with a little deposit from this account and loan granted by the bank. Now we have £12,800 this was why I was afraid to re apply and also that they don't find any other fault again that was why I opt for an appeal. I've been in Nigeria february till now, submitted application mid june got refused mid October. Its so sad Justwise that I didn't do my paperwork properly and the delay has cost me over £10,000 for staying in Nigeria, the money is for expenses, my husband is so sad that we from commonwealth country must pass thru this rigorous process, he's white british but love Nigerian Culture when he visited. I have a good job but my job is on the line trust me. I've been with my parents waiting patiently That means I have another 3 months wait again? Mennn I miss my husband. @Morjid Any fake document carries a 10 years ban its non negotiable. But since you said the document is not fake get immigration Attorney to advice you properly on what to do. Or wait for the big boyz in the house to advice you more. Cheers |
@favouredgal My Immigration consultant in London said 4 to 6 weeks, for what I've read on this thread it sometimes take up to 8 weeks. Yours will never get to that extent in Jesus name. Thank God you're waiting for your visa. As for your husband you'll meet in good condition by the special grace of God. My case is same as yours. I miss my husband badly I've got no choice but to wait for Gods intervention. I was refused mid October on the ground of not providing evidence of contact since my husband left for the UK. Put in my appeal 1st of November with relevant documents e.g emails and western union. As you can see I'm on the waiting list. My right of appeal states that my case can be reviewed without going for hearing. My Lawyer sent the appeal to the Tribunal who will then send it to the Embassy for review and see how it goes. I pray fervently for God to see me through. Please gentlemen and ladies kindly furnish me with good advice on how long it will take them to review it and to call me to pick up my visa. Vicjustise, justwise, omo_tier1 you guys are fab I must confess including some ladies who render good advice. Please I want you all to advice me on the time frame and if you believe I'll be granted. @favouredgal What type of visa did you apply for? Thank God they upturned their decision. You're right I've heard about people submitting their passport in BHC Abuja for visa and they are granted that same day. BDHC rang you on the 12th of Nov. To submit your passport for visa, you should have asked if it was possible for you to submit in Abuja and their answer would be yes because that was what someone said she did on thread and she was given that same day she submitted at Abuja. Please you have to exercise patience because they have a lot of cases on ground always. You will be issued Visa eventually. Good luck |
