We are only saying grave allegations like this require clear, credible and compelling evidence/proof. Think about the Ronaldo and Neymar's rape allegations. INEC HAS THE POWER TO DECLARE AN ELECTION INCONCLUSIVE. Will make this as brief as I can while ensuring facts are not traded in exchange. What's the actual position of the law? Pursuant to pages 22 – 23, Paragraph 4, Section N 2015 INEC Guidelines issued pursuant to Section 153 of the Electoral Act, 2010 (as amended), INEC is empowered to declare election inconclusive where the margin of victory is less than the number of registered voters in cancelled Polling Units. This power of INEC to declare an election inconclusive under the above provision has been upheld by the Supreme court in the case of Hon James Abiodun Faleke v Independent National Electoral Commission & Anor with the appeal no: SC. 648/2016 delivered in September 2016. One of the issues for determination was whether the court below was right when it held that the 1st respondent acted correctly in applying the guidelines in the Manual for Electoral Officers (updated version) to resolve the conundrum that had arisen on the 21st of November 2015 and in holding that the announcement of the election as inconclusive is not contrary to Sections 179(2) and 181(1) of the 1999 Constitution. The supreme held to wit: “The Constitution in Section 153(1)(f) & (i) provides for the establishment of the Independent National Electoral Commission (INEC), which, pursuant to paragraph 15 of Part 1 of the Third Schedule thereto, has power inter alia to “(a) organize, undertake and supervise all elections to the offices of the President and Vice President, the Governor and Deputy Governor of a State and the membership of the Senate, the House of Representatives and the House- of Assembly of each State of the Federation; and(i) to carry out such other functions as be conferred upon it by an Act of the National Assembly.” Pursuant to Section 160(1) of the Constitution, INEC has the power, by rules or otherwise to regulate its own procedure or confer powers and impose duties on any officer or authority for the purpose of discharging its function.” PER K. M.O.KEKERE-EKUN, J.S.C Flowing from the above decision of the supreme court, it is very crystal clear INEC is empowered to declare an election inconclusive pursuant to the relevant provisions of the INEC guidelines. The exercise of this power was seen in both Kogi Gubernatorial election and that of Imo State gubernatorial election where INEC declared the elections inconclusive. Note that APC in both states were winning and had infact won before INEC declared it inconclusive for the same margin reasons. Imo election was conducted during the administration of PDP(Good luck Jonathan) while Kogi was conducted after APC won the presidential election and had taken over lower. For Saraki, a seasoned law maker, Senate president and presidential aspirant to have said INEC had no such power leaves much to be desired and it tells a lot about the dubious and ignorant nature of Saraki. DerrickzB:Your sense of reasoning is quite poor. I just gave you an example of Kogi election that was conducted under the watch of Buhari after APC took over Aso rock. APC won but yet INEC under the same Buhari(APC) declared it inconclusive because of the same margin reasons. In April 2015, INEC under PDP (Jonathan was the President then) declared imo gubernatorial election inconclusive after APC won it for the same reasons. If this is not an evidence that APC had not done anything wrong, then you need deliverance from gullibility. |

Kingosytex:Not all politicians are bunch of bastards and thieves. Some have got good intentions but have had their efforts stifled by the very many selfish ones and discouraged by some of us who keep painting politics dirty. So, when you think or say all politicians are criminals, you would expect nothing from them but criminality. In the end, you might just get what you want to see. The very notion that all politicians are thieves and dishonest is highly misconceived even though there are many of them who fall within that category. There are well and a good number of good ones in it. We should raise our expectations, expect better from our leaders and we would see the good that would come out of it. |

Kogi Gubernatorial election in 2015. The 2015 Kogi Gubernatorial election was held on 21 November 2015 to determine the Governor for Kogi State. The gubernatorial election is to elect the governor of Kogi state; the official at the head of the executive branch of a state. The last Kogi state gubernatorial election was held in 2011. The incumbent Governor, Captain Idris Wada, ran for re-election against the former Governor, Prince Audu, the candidate of the All Progressives Congress. Inconclusiveness Of The Election The Independent National Electoral Commission (INEC) declared governorship election in Kogi stateinconclusive. According to results declared by the Returning Officer, Emmanuel Kucha, Abubakar Audu of the All Progressives Congress scored 240,867 while Idris Wada of the Peoples Democratic Party scored 199,514 votes. Mr. Kucha said the margin of votes between Abubakar Audu and Idris Wada is 41,353. And thereby making the election inconclusive because the total number of registered voters in 91 polling units, in 18 local government areas, where election was cancelled is 49,953. Supplementary Election The Supplementary Election was conducted on 5 December 2015 in 91 polling units across 18 local government areas in Kogi state. According to the results declared by Mr. Kucha, the APC had 6,885 votes in the supplementary election, bringing the total votes it received to 247,752, having polled 240,857 in the November 21 election. The second runner up, the Peoples Democratic Party and its candidate, Captain Idris Wada, the incumbent governor, scored 5,363 in the supplementary election. Thus, PDP polled a total of 204, 877 votes, having had 199,514 at the November 21 election.
