Yes it is easy to get Ead through economic hardship if the hardship where caused by circumstances beyond your control after you arrived the United States. I was able to apply for and receive Ead based on economic hardship but you still have to pay the $380 application fee. Remember is going to be tough if you don’t have any help from home. I have to work two jobs to save up money every semester but I will be graduating next semester by God grace.

Dear Visa Officer I received an e-mail from LagosNIV@state.gov stating that my passport is available for pick up at the DHL PICKUP Facility/GSS Document Collection Center – DHL: Plot 230 Muri Okunola Street, Victoria Island Nigeria.

On receiving the e-mail I asked my cousin to go and retrieve my passport. My cousin travelled all the way from Port Harcourt to Lagos only to be told by the officers at the collection center that the US CONSULATE GENERAL LAGOS, NIGERIA has collected back my passport and has subsequently forwarded it to the GSS Document Collection Center DHL, 82 Trans Amadi – Ellah Estate, by Bewac Junction Port Harcourt, Nigeria.

Please can you verify the accuracy of the above information and if I may request if my passport is actually at the GSS Document Collection Center DHL, 82 Trans Amadi – Ellah Estate, by Bewac Junction Port Harcourt, Nigeria can they please hold my passport there until my cousin returns back to Port Harcourt from Lagos. My cousin has just departed Lagos and should be back to Port Harcourt by tomorrow.

Dear Visa Officer I have sent an e-mail to LagosNIV@state.gov requesting for my passport and I received a reply back stating

“We have forwarded your email to the appropriate unit. Your passport will be returned as requested”.

It have been almost a week and I have already sent an e-mail twice to LagosNIV@state.gov to confirm if the US CONSULATE GENERAL LAGOS, NIGERIA has returned my passport as requested to the GSS Document Collection Centers in Lagos; DHL: Plot 230 Muri Okunola Street, Victoria Island Nigeria but no response yet.

My cousin will heading to Lagos this morning from PortHarcourt to retrieve my passport and I don’t want him to be disappointed when he gets to Lagos and is unable to retrieve my passport.
Please can you be kind enough to confirm if the US CONSULATE GENERAL LAGOS, NIGERIA has forwarded my international passport to the GSS Document Collection Centers in Lagos.

Many have responded and like Ojap says, it will be best for you to consult an immigration lawyer (if you're in the U.S).

Based on your family record, you're an intended immigrant. Since you can complete your studies without visa and you still maintain your pended I-130 application (if in the U.S.), why don't you forget leaving the country for a non-immigrant visa. And if you're already in Nigeria, you got no choice than defending your case in Nigeria.

Also, it seems you don't qualify for an interview waiver for your F1 visa.
Yes I am still in the United States and I meet all the requirements for an interview waiver that was the reason I applied for an F-1 Student Visa Renewal application through the DropBox Visa Renewal Program.The reason I applied for a renewal is because I have an urgent humanitarian situation that require my presence back in Nigeria.

F-1 Visa Application: Non-Immigrant Intent.

Form I-130: Immigrant Intent.

I honestly don't know how you can claim to have both intents at the same time under the law. This may amount to immigration fraud in the face of the law. I remember you from here and I remember your case. I know you are a genuine candidate and have good intentions. However, the USCIS is somehow vague on filing a pending I-130, applying for a visa, and travelling outside of the USA. One thing I know for sure is that you can't file a I-485 and travel outside of the country without an advanced parole. That would mean that you have abandoned your case.

I know several people whose relatives have petitioned for them in the past and were able to obtain a visa and beat the POE officials. Their case is so different from yours because they didn't declare any where in their application that they have relatives or have a pending I-130 application. Some were lucky to get away with it while some didn't. I guess it boils down to the luck factor here.

Honestly, I wish I could give you a solid and concrete answer but my hands are tied. I like to say what I know for sure and won't like to mislead you. But make use of everything that I have said here and please make sure to consult an experienced immigration lawyer. It looks to me like it is much more than what we think it is. Only a good lawyer maybe able to find any loop hole(s) and use that against the USCIS especially when certain sections of the law are ambiguous.

I was planning to file for an advance parole document but however a friend of mine explained the likely scenarios to me so I was kinda confused

Scenario 1
If I file and receive an advance parole document prior to departure from the United States. During reentry I will be paroled into the United States as an applicant for adjustment of status. As a result my F-1 student status will be automatically terminated. If that happens that means I will not be able to continue attending school until my Form I-130 is approved by the United States Citizenship and Immigration Services (USCIS). But the problem here is that I still want to continue attending school since I will be graduating this year.

Scenario 2
If I Depart the United States without an advance parole to attend my nonimmigrant visa interview if my F-1 student visa is approved during reentry I may be denied entry into the United States by the POE officials on the basis of a pending I-130 immigrant petition filed on my behalf. He stated that since an F-1 visa was not a “dual intent” visa as a result under the dual intent status, the USCIS Officer at the border might deny me entry into the United States based on my pending Form 1-130 (intent to immigrate)

Please can you shed more light on the above scenarios and verify if the information outlined above is accurate.

I don't understand, are you currently a student in USA and you in nig on holiday? you have a valid visa, you don't need to submit your visa through drop box, as long as you are still on status and you still have classes to take at your current school, the school will issue you an extension.

Dear forumites I applied for a renewal of my F-1 Student Visa through the Drop Box Visa Renewal Program at the U.S. Consulate General Lagos, Nigeria on December 2014 but on Wednesday January 7th 2015 I received an e-mail from the Correspondence Unit (TMI) US CONSULATE GENERAL LAGOS, NIGERIA stating that the they needed to see me in person inorder to proceed with my case. But the problem I am having right now is that my school resumes on Monday January 12th, 2015 for the spring semester. It is advisable to depart the United States while school is so close to resumption. It is worthy of note to point out that when I was filling the DS-160 nonimmigrant Visa Petition I also mentioned the following information listed below
(1) That I have a pending immigrant petition filed on my behalf by my sibling
(2) That I have a valid work authorization card issued by the United States Citizenship and Immigration Services (USCIS)
(3) That I have four siblings currently residing in the United States three of whom are United States citizens and one a permanent resident

Public service announcement: It's actually okay for student visa applicants to also have pending immigrant petitions, as long as they intend to use their student visas appropriately, and to avoid unlawful presence in the U.S. Even the student visas that clearly require their holders to return to their home countries for a time -- that's fine. You can go to school in the U.S., return home as required, and then immigrate through a petition filed years before.

Many student visa holders are misinformed about this, and therefore feel that they can't be honest with us. Unfortunately it's their lack of candor which ultimately creates problems for them.

This is true of many non-immigrant visa categories. You can overcome 214(b), the presumption that you're an intending immigrant, by convincing us that you intend to use this particular visa appropriately before your immigrant interview is ever even scheduled.
Let me make this clear I am always and will always be honest with anyone I deal with including the U.S. Consulate General in Lagos Nigeria.If I was a dishonest person as being perpetuated by some people I wouldn't have even mention that I have an immigrant petition pending. Besides what do I stand to gain by lying to the U.S. Consulate General in Lagos Nigeria. Dear Visa Officer if you want to verify my honesty you can go ahead and pull up my DS-160 application information. I clearly mentioned that I have a pending immigrant petition together with Valid work permit issued by the United States Immigration and Citizen services.I also mentioned that I had three four siblings three of whom are United States citizens and one a permanent resident.I feel that it is an insult to my personality for someone like Jchi9876 whom I only know online to explicitly state that I have clear immigrant intention without knowledge about my background. If the U.S. Consulate General in Lagos had informed me back in December that they need to see me in person to proceed with my case I would have most likely made the trip back home to attend the interview since my siblings went back to Nigeria this Christmas period.I cannot make the trip back home right now because leaving the United while classes are in session will automatically lead to termination of F-1 Student status.

It is unlikely if not impossible for me to make travel arrangement to travel back and forth between Nigeria and United States within a space of 3 days and still return to the states to resume classes on Friday January 9, 2015.Departure from the United States while classes is in session is a direct violation of F-1 Student status and will lead to being dropped from the classes that I have already registered and paid for and subsequently termination of F-1 Student status.

People can drop things off on other people's behalf, but applicants have to be physically present in the country in which they're applying for a visa. If you had mentioned that you didn't plan to be in Nigeria at all, you would have received a much different reply.

You're not in Nigeria? Where are you? Our website does say "Please note that participation in this program does not guarantee visa issuance. Additionally, the consular section may request applicants to attend a visa interview in certain cases, despite having submitted their application through the Drop Box program." It's a very bad idea to have someone submit your passport to us on your behalf when you're not even in the same country!

I tried tracking my application online and got this message 'There is no status update available for the passport number submitted’. I am worried because school resumes next week Monday January 12, 2015 and I am expected to report to school not later than Friday January 9, 2015.
