It’s a petition let the tribunal gives the case hearing first… Tinubu will defend this case…. Tribalism will break this country… it’s trending in the south west that OBi is fighting the Yorubas just like what happened to MKO… the only mistake obi made was for him to ask the court for a fresh election instead he should have as for them to declare him winner….if it happens to do a fresh election the south west and north will not vote obi and e will lose again… obi should just sued inec and the process alone
Everything you are seeing is the consequence of thorough legal evaluation...

If you are dealing with Supreme Court in Nigeria you have to be sure that you cover every loophole or else they will manufacture a technicality to rubbish your case.
The prayer for the cancellation of the exercise is not a frivolous fantasy...there is a reason for that...

Tinubu had an out of court settlement in a civil case. He was never indicted and the case was DISMISSED WITH PREJUDICE. It is a closed case that can never be reopened.

INEC can decide to transmit result anyhow they like. INEC guidelines recognize both manual and online transmission of results. The court will not nullify the election because some results were not immediately transmitted to IREV as a result of network problem. The non-transmission did not affect the outcome of the election in any way and the manual transmission is enough to complete the process.

Tinubu is not on any rope and Wole Olanipekun is actually drinking beer because this will be his easiest case so far.
You are obviously a legal illiterate else you cannot be saying what you are saying...

The prayers are weighty and damaging...Tinubu lawyers know this and are sweating to build a defense...

That FCT 25% NONSENSE sounds absurd to me. FCT is often separated from the 36 states because it's a territory, not a state. As far as the election is concerned, FCT is like every other state in the country.

BTW, if Peter Obi is hoping to use that as basis to upturn Tinubu's sham victory, then I am afraid he has no case against the Druggie because it won't work.
Legally speaking, no candidate would be seen as having met the requirements to be declared a winner if they fail to satisfy the FCT threshold...

The law doesn't operate on supposition and emotion but its spirit and letters.

That's the particular of prayer 1- That Tinubu was not eligible to contest. It falls under ground 1.

The drug case is Obi's evidence while the prayer / relief sought is that Tinubu has a drug case and no certificate.

The petition is what it is- a total blackmail. Obi has no fictitious mandate to reclaim.

The court will strike it out.

Another one spotted. May be you should go and check the Tribunal petition of Oyetola vs Adeleke and compare it with this joke. Probably then you can tell who is a backward thinker.

Courts are not based on emotions but facts, yes they may have the exhibits somewhere but you need to highlight on the ground of your prayers to the court. The petition only stated they are not qualified and nothing more. But like I said it would be nice to see how the court cases would go.

I just hope some SANs won't end up sounding foolish in the end.

On what ground would you say INEC should disqualify a candidate and not eligible to contest.

That INEC should disregard the vote of the 1st and 2nd respondent, and hence declare the 1st petitioner as the winner. Then what should Atiku that came 2nd with over 6.8m votes do?

I think some SANs need to think deeply before filing a petition because these are pre-election matters than is the responsibility of the party not the opposition.

Well, it would be interesting to see the outcome of the Tribunal but honestly I expected something solid from the Obi's legal team and not this joke.

A prayer for disqualification cannot be based on mere oral statement...

Don't give up at all. The PO legal team know exactly what they are doing.

You have to realise that INEC only gave the LP lawyers access to the election materials just a few days ago, and the legal team had to file something before their deadline for filing cases run out.

I'm sure that as I write, the LP machinery is sieving through the mountains of evidence, and may yet attach evidence of electoral fraud, once they identify enough. At the moment, I am pretty sure LP can prove massive electoral fraud in both Rivers and Lagos state presidential election exercise, but they have to bring in more fraud cases from more states, and that will not be difficult.

Remember that this is not the first time Obi is facing such an obstacle. These people know the process. Tinubu's team is worried now. Trust me.
One obvious fact is that the level intellectual depth and critical thinking in this forum is very low...

The only thing most participants do here is fight defeatist ethnic supremacy battles with very little attention for objectivity...

It is trite that what is going to unfold will be a long, arduous legal skirmish...

You don't have the likes of Livi Uzukwu, Onyechi Ikoeazu, Jubril Okutepa, J Hong etc in your team and then begin to second guess and flinch...

Go first with overarching constitutional breaches before amending your prayers to include the low hanging fruits...

A marathon is not a sprint event....
