Hi Mayowa94, I can see you desperately need a response to this query as you've posted it several times.

Firstly, the following are the SOC's related to data analysis - 2135, 2136 and 3539.
Secondly, all the above SOC's are eligible for the SWV however, only the first two are on the SW Shortage Occupations list.
Lastly, I wouldn't know what exactly your job/role entails, because that's what determines your SOC, but, if you deal in IT and would like to apply under the shortage occupations list, then you may want to use 2135 (as a "Data Communications Analyst" only). But if your role entails finance, or you write just Data Analyst, this may be regarded as 3539 instead, and is NOT on the shortage occupations list.

However, you may want to confirm from your prospective employer which SOC your job falls under. Cheers.😉

For Question 1 and 3, the answers are clear on the UKVI Health care visa webpage. Regarding basic visa rules, you'd not get any information online that'd rival what you have there.

Extra work has to be in thesame occupation code as your mainjob or a shortage occupation. Extra work done with your sponsor is not counted towards your 20hrs.

That’s a long shot!, I really can’t answer that, there are lots of factors to consider. Are you applying from within the US or outside?
If you’re within the US, was your application concurrently filed (I-140 and I-485 together)?

Generally, people say adjustment of status (for those applying for greencard within the US) is faster than consular processing (applying from outside the US).

Hi, I would guess that what you mean is that your labor certification was filed in September 2022. Hence, your priority date is September 2022.

You need to provide a better context when asking questions, cos lots of folks here probably skipped the labor certification process because we filed our I-140’s under the National Interest Waiver (NIW) category.

Back to your question. If I understand you correctly, your I-140 application was received by USCIS on Aug. 24, 2023 and it was filed with premium processing. All things being equal, you should receive a response soon.

Per USCIS, premium processing usually takes within 15 calendar days, but in some cases, could take up to 45 calendar days.

Are you sure that you paid for premium service (extra $2500), because even normal processing should have a decision by now. A year has passed already. I stand to be corrected though.

Premium processing takes 15 days.

You can earn up to $2000 per week working as a registry CNA in California. You'll need to undergo training though.

What she is intending to do is visa fraud. She is just a member of deeper life but the life of Christ is not in her. If she have her migrate Visa i can even be of help to her both assigning a total free accommodation for her for three months to enable her and kids settle down and also help her with job contacts but with tourists Visa no way. Advise her to vist and go back and be of good behaviour .

@Mayowa94 What you need to see in the final action date chart EB3 ROW for your PD to be considered current is a PD further than your PD i.e if your Priority date is August 1st 2021. The priority dat on final chart has to be at least July 22 (The movement is usually between the 1st, 7-8th, 15th or 22nd day of a given month). If "C" is seen that means all priority date under consideration for visa is current .I'm Not sure we will see that anytime soon (Except DHS follows recent congressmen notification to the present to make all employment based categories current in October. This is pretty much a convo for another time). It might happen if other conditions ease up but that is pretty much retrogression waiting to happen again.

I presume you are going through consular route, then Final action Date chart is what you monitor to know if your Priority date is current or not for your case to be forwarded by nvc to your local consulate/ embassy. If yor PD is current, your Documentarily complete/qualified date is your number in line for interview letter to be sent whenever the embassy is ready to dish out Interview letter .

August and september bulletin shows that EB3 ROW candidates with Priority dates earlier than May 1st 2020 with Documentarily complete/qualified status is/are fair game for interview Letter consideration (interview letter is at the sole discretion of the consul- general at the embassy.Lagos embassy is a case unto itself, not sure which is worse Lagos or Montreal ).

Date of filing chart is usually applicable to applicants adjusting their status while in the US. This is not always the case// The visa bulletin usually indicate what chart NVC /USCIS will accept as current priority date for adjustment of status candidate.

Priority date = This is the date that U.S. Citizenship and Immigration Services (USCIS) received your I-130 (Family base petition) / 1-140 petition (Employment based petition i.e EB3 nurses , NIW ) / PERM (For employment based petition via an employer)

Current /not Current PD status = Check your visa category and nationality (ROW= rest of the world. This applies to nationals of all countries excluding india, china, phillipine, mexico.) to see if you are current or not visa bulletin every month usually between 7th - 16th of every month a new bulletin is issued for upcoming month i.e september bulletin was released this month, october bulletin will be released in september,etc
