NEW YORK - A man was charged with withdrawing $2 million from an account after a bank confused him with a man who has the same name. Benjamin Lovell was arraigned Tuesday on grand larceny charges. The 48-year-old salesman said he tried to tell officials at Commerce Bank in December that he did not have a $5 million account.

Lovell said he was told it was his and he could withdraw the money.

Prosecutors said the bank — which advertises itself as America's Most Convenient Bank — confused Lovell with a Benjamin Lovell who works for a property management company.

The lesser-funded Lovell gave away some of the withdrawn money and blew some of it on gifts, but lost much of it on bad investments, prosecutors said.

The district attorney's office did not immediately have information on his lawyer. Calls left with Commerce Bank on Wednesday were not immediately returned.

Soon after we published our first story on the killing of Barnabas and Amaka Blessing (Abgal) Igwe, we were given the contact number of Chuma Nzeribe, a prominent member of the House of Representative representing Ihiala Federal Constituency, whose name featured in our story. We exchanged text messages with the federal law maker and eventually spoke with him on the phone.

During our chat with Chuma Nzeribe he threatened to sue us and also promised to give us an interview. We assured Chuma Nzeribe that he was within his rights to seek a legal redress for any harm he may have suffered by virtue of our reports. After this conversation with us, Nzeribe stopped taking our calls. Elendureports.com silently continued to investigate the death of the Igwes and we have published a few reports and more are to come. In the course of our investigations we stumbled on more reports and documents concerning the dramatis personae. Part of the document cache in our possession concern Rep. Chuma Nzeribe. These include his Peoples Democratic Party (PDP) nomination form and accompanying documents. We are also in possession of resolutions passed by the Anambra State House of Assembly concerning Rep. Nzeribe.

The PDP nomination form for Fed. House of Representatives filled and signed by Nzeribe Chukwumaeze Marcellinus on the 9th of December 2002 declares that the signatory graduated from Christ the King School, Aba in 1971, Holy Ghost Juniorate, Ihiala, in 1974 and Boys High School, Ihiala, in 1976. The document also declares that Chuma Nzeribe graduated from Institute of Commerce, Civitavecchia, Italy, in 1982. According to the form, Nzeribe possesses a First School Leaving Certificate, West African School Certificate, General Certificate of Education, A Level, and Higher National Diploma, HND in accounting. Subsequently, Nzeribe served his National Youth Service Corps with the firm of Olaseni Lawal & Co., Lagos in 1984.

Curiously, Nzeribe did not attach his West African Examinations Council (WAEC) certificate to the documents that accompanied his PDP form. Rather, he attached his A Level certificate which shows that he recorded one subject: Economics. His score for this subject is: E. Our investigations show that the reason Nzeribe did not attach a School Certificate is because he does not have it. According to our investigations, the 1976 WAEC result of Boys High School, Ihiala, was seized. So, how did Chuma Nzeribe gain admission into a school in Italy? There are allegations that he may have used a forged result to gain admission into the school. Elendureports.com has tried to contact the Italian school. Our searches on google and other search engines did not pull up any information on the school. Also, our search of Nzeribe’s WAEC result is yet to bear fruits.

The certificate from the school in Italy is another curious document. According to the document in our possession, Nzeribe was enrolled at the Italian school from 1981 to 1982. In Nzeribe’s House of Representatives PDP nomination form, he swore to an oath before a Commissioner for Oaths at Federal High Court, Abuja that he was enrolled at Institute of Commerce from April 1980 to July 1982. If Chuma Nzeribe obtained admission from the school in Italy with his one paper A Level, was that enough to bypass the Ordinary National Diploma (OND) program and go straight to the Higher National Diploma (HND) program?

Other questions arising from Nzeribe’s PDP nomination papers include: What documents did Chuma Nzeribe present to the National Youth Service Corps to qualify him for service? If he presented the same documents in our possession, did somebody not question the veracity of his HND qualification given that he spent one year at the Italian school? Elendureports.com have been unable to get any response from NYSC even after one week of going to their offices daily.

It would appear, according to documents in our possession, that Chuma Nzeribe has encountered challenges with the law several times and yet curiously escaped its wrath. A document written and signed by E.I. Okafor of Public Prosecutions office in Anambra State had directed that Chuma Nzeribe be arraigned for illegal possession of arms and ammunition. The letter, which was addressed to the Commissioner of Police and dated Nov. 17th, 2003 said: “…in the course of investigation recovered inter alia the undermentioned (sic) items in the house and premises of Chief Chuma Nzeribe at Umudike Village, Uzoakwa Ihiala.” It listed the items recovered as: a) 31 rounds of live 9mm ammunitions, b) 12 rounds of AK 47 live ammunitions, c) 31 live rounds of cartridges.

Okafor’s letter also stated: “The said Chuma Nzeribe was not duly authorized to posses the ammunitions. Sequel to that you are directed to arraign the said Chief Chuma Nzeribe for unlawful possession of the above stated ammunition before Chief Magistrate Court, Ihiala. The charge is punishable under s.3(1) of the Robbery and Firearms (special provision) Act, Cap.358, vol.22, Laws of the Federation of Nigeria 1990 as amended by Act No.62 of 1999.” To the best of our knowledge, these charges were never pursued by the police.

Three years earlier, the Anambra State House of Assembly had through Resolution No. 95 directed Gov. Chinwoke Mbadinuju to exclude Chuma Nzeribe and one Fort Dike from his cabinet. That same year, a petition written by one Ifeanyi Ibegbu of the Anambra State House of Assembly accused Chuma Nzeribe of shooting somebody to death. “In that incident, Mr. Nzeribe had led a squad of brigands employed by the Onitsha Traders Association (OTA), invaded the Inland Town Section of the town and murdered these youth (sic). During that operation, Mr. Nzeribe himself was personally responsible for killing one person with a pistol, the license for which is doubtful to say the lest (sic).”

The general feeling of politicians in Anambra State and Abuja is that Chuma Nzeribe has been shielded from the law by politicians and law enforcement agents who may have benefited from his activities. They point to his relationship with the Uba brothers. One politician in Awka wondered how Nzeribe could have escaped the wrath of the law after the abduction of Gov. Chris Ngige. “Everybody knows the role Chuma played in the abduction of Gov. Ngige, yet because of Christian and Andy Uba he was walking the streets freely and throwing his weight about.” There are indications too that Nzeribe may have benefited with a very top female police officer.

Rep. Chuma Nzeribe declined to be interviewed on the phone for this story and would not give us a date for a face to face interview. He did not respond to our text message.

THE International Monetary Fund (IMF) has declared that poverty remains high in Nigeria despite several years of solid growth. The executive board of the International Monetary Fund (IMF) revealed this in an analysis of the Nigerian economy in the Article IV consultation.

According to the board, despite the fact that authorities in the country were making efforts to achieve the Millennium Development Goals (MDGs) and have established targeted prog-rammes financed, poverty was estimated at about 55 per cent based on the 2004 household survey, empha-sising that development indicators were low.

The board further said that Nigeria was increasingly integrating into global financial markets, improving macro-economic conditions, reducing external vulnerabilities, especially since the recapitalisation of the banking industry.

The board also said that the financial sector was expanding rapidly, supporting private sector activities, strengthening treasury capacity to offer new products found in other emerging markets, and expanding into cross-border and cross-sector activities.

According to the board, inflation has been brought down to single digits while the changes in macro-economic conditions and the financial market brought new challenges for monetary management.

The executive directors of the fund advised the Federal Government to secure agreement with states on a fiscal framework that would continue to delink spending from oil revenue flows and thus protect macroeconomic stability and positive outlook for faster growth, reducing poverty and attaining the MDGs.

Who was Murtala Muhammed?

Who was Murtala Ramat Muhammed? To his friends, he was the greatest pan-Nigeria hero that ever lived. But to his foes, he was no hero, even if his six-month tenure as military head of state was dramatic, if not outright heroic. The truth probably lies between these two extremes.

Gen. Muhammed was head of state from July 29, 1975 (when Gen. Yakubu Gowon was ousted) and February 13, 1976 (when he was killed in the foiled Bukar Sukar Dimka coup). But that brief period of explosive drama quaked with contrasting passions: the good and the ugly; the reasonable and the irrational, the ordered and the chaotic, the noble and the ignoble.

Gen. Muhammed symbolised the best and the worst for the polity. As head of state, his personal probity was legendary. So was his simplicity. And so was his ability to rouse others.

But his sense of judgment was simply ruinous. As an institution, the federal civil service is yet to recover from Hurricane Ramat, which rocked it to its very basis, in the Murtala purges. Nigerian Civil War (1967-1970) accounts also spoke of avoidable routs, if the young officer-in-charge would only act less on passion, but more after deep thinking.

On February 13, it was 32 years since the mercurial Murtala was assassinated. But the jury is still out on which side of his tempestuous coin history should endorse as his true essence. That debate is not about to end – even with his posthumous 70
th birthday coming up on November 8.

But for an intimate impression, Aishat Oyebode, the general’s daughter and first-born, who was only 12 when the coup plotters struck, offers a clue. Mrs Oyebode told The Nation (February 13) that her father was an epitome of calm, love, passion and patriotism.

He was also a simple family man who skipped no opportunity to be with his children; and who shared his dinner with his friends under the almond tree in their vast, Ikoyi, Lagos home.

That account might be a study in filial love. It could also have been coloured by the impressionable eyes of childhood. Still, it is evocative of the total devotion to his family of an otherwise fiery general.

Besides, Mrs Oyebode’s candid concession that the Nigerian state has done more than enough for her father bespeaks a lack of presumption, so lacking among the high and the mighty. Now, if Muhammed’s daughter speaks with so much grace, so much humility and so much calm – surely, she must have inherited such traits from her father?

But the public perception of Gen. Muhammed is much less placid – particularly in his relations with superior officers. The general impression was that of a presumptuous officer, contemptuous of his superiors. And accounts to support this view come from both friends and foe.

First, friends. After the first transition to democratic order in 1979 under Olusegun Obasanjo’s tutelage, came a slew of self-laudatory accounts that branded the Murtala-Obasanjo regime as a band of new super-patriots, for handing over power to President Shehu Shagari: Obasanjo (Not My Will), David Jemibewon (Combatant in Government) and Joe Garba (Diplomatic Soldiering), just to mention a few.

In one of those accounts (Combatant in Government, I think), the author lauded Gen. Muhammed as a reincarnation of the charismatic Brig Zakariya Maimalari (felled in the first coup of January 15, 1966), who was very popular among junior officers.

But as Maimalari was contemptuous of Gen. Thomas Aguiyi-Ironsi (who the army grapevine back then claimed could hardly command a funeral detail), the book proudly announced, so was Murtala Muhammed contemptuous of Gen. Gowon!

That Murtala fired the imagination of junior officers but held some of his seniors in contempt came clear in his pledge, in Garba’s Diplomatic Soldiering, to the "junta" that plotted Gowon’s ouster. He would not support the action, he told them. But he would do whatever in his power to save their necks, should things go wrong!

So, whatever gave Murtala the impression that he could save the coup plotters should their action fail against Gowon, the sitting head of state? If Gen. Muhammed had indeed displayed such devil-may-care contempt for constituted authority, could he in all good conscience, take power (from that same action) and still decry the galloping indiscipline all over the place?

Sowaribi Tolofari, a former army major who was part of the abortive Gideon Orkar coup, introduced a not-so-noble motive to the Murtala take-over.

Quoting extensively from a January 20, 1986 issue of Newswatch magazine, in his book, Exploitation and Instability in Nigeria: the Orkar Coup in Perspective, he alleged that Murtala supported the coup plotters because Gen. Gowon would not succumb to his blackmail to install less qualified candidates as general manager of the then Nigerian National Oil Corporation (now NNPC), instead of IGT Ordor, head of Nigeria’s only refinery then in Port Harcourt.

Gen. Gowon, according to Tolofari, put his foot down. Mr. Ordor got his appointment on July 4, 1975. On July 29, 1975 – 25 days later – Gowon was ousted and Murtala took over. Eight days after the coup, Obasanjo, as chief of staff, Supreme Headquarters, signed a letter dismissing Ordor as NNOC general manager.

Even if this chain of events were true, would it be enough to void Gen. Muhammed’s perceived claim to patriotism and the highest of ideals during his brief tenure as head of state? Maybe not; even if many may disagree. But maybe, the received wisdom concerning Murtala’s tenure has been hasty. That is only to be expected in a country desperately in search of genuine heroes.

So, what is Murtala’s place in history? In personal probity and integrity, a model the present leaders can learn a lot from. But as a builder of institutions? Well neigh nothing to teach on that score – for the collapse of the civil service and the stifling centralisation that is the bane of Nigerian underdevelopment started during his regime.

Even then, Gen. Muhammed, good or bad, gave his all. That much cannot be said of many that have come after him.

Annual salaries and allowances of the 469 members of the National Assembly have been increased from about N41bn to N60bn.

Details of the new pay and allowances are contained in a document by the Revenue Mobilisation Allocation and Fiscal Commission which was obtained by our correspondent in Abuja on Friday.

Although the document is awaiting the assent of President Umaru Yar’Adua, a source in RMAFC office said the lawmakers have started earning the new pay.

The source said that the new package was okayed by the commission three weeks ago.

Under the reviewed salary structure, the President of the Senate earns N2.48m yearly as basic pay while his deputy is entitled to N2.31m.

Each member of the Senate earns a basic salary of N2m annually.

The Speaker of the House of Representatives and his deputy receive almost the same package as the President of the Senate and the Deputy President of the Senate respectively.

Each member of the House of Representatives receives slightly less than a senator with about N1.99m as annual basic salary.

Before now, the President of the Senate and his deputy were entitled to N993,697 and N923,667 as annual basic salaries respectively.

The Speaker and the deputy were earning N990,844 and N877,987 per annum respectively.

A senator was entitled to N810,560 while a member of the House was was receiving N794,085 as annual basic salaries.

The Chairman, Senate Committee on Media, Senator Ayogu Eze, confirmed that the proposal had been passed by the Senate.

“We passed it. But I don’t think the President has signed it to law,” Eze said in a telephone interview.

The new pay structure has translated to skyrocketing allowances for the lawmakers.

For instance, a Senator with an annual basic salary of N2m, now receives N4m as accommodation allowance or 200 per cent of his basic salary.

He also has a furniture allowance of N6m or 300 per cent of his basic salary.

Besides, he is entitled to a vehicle loan of N8m or 400 per cent of his annual basic salary.

A member of the House is entitled to N3.98m or 200 per cent of his or her annual basic salary as accommodation allowance. He or she also receives N5.97m or 300 per cent of the basic salary for furniture.

Each lawmaker gets N7.96m or 400 per cent of his or her annaul basic salary as vehicle loan and N1.49m as maintenance allowance for the vehicle.

The reviewed salary structure also provides that a member of the House gets N497,500 or 25 per cent of the basic salary as wardrobe allowance and another N497,500 for personal assistant.

Each member is also to receive 75 per cent (N1.49m) of his basic salary as domestic allowance.

According to the document, the domestic allowance covers the cost of maintaining four domestic staff – a steward, cook, housekeeper and a gardener - employed by the member.

Besides, he or she is entitled to entertainment and utilities allowances of N597, 000 or 30 per cent of the basic salary.

The utilities allowance is to enable the member to settle electricity, water, gas, telephone and refuse collection bills.

The documents also provide that when the House proceeds on recess, each lawmaker should be paid N199, 000 or 10 per cent of his or her basic salary.

He or she is also entitled to 15 per cent of the annual basic salary as newspapers allowance.

Except when the government provides an official car or accommodation for a particular officer, the fringe benefits — in percentages — are applicable to all the members of the legislature.

The RMAFC said that in reviewing the new package, it considered the changes in the basic fundamentals of the Nigerian economy, external reserves, Gross Domestic Product growth rate, inflation and the need to correctly place some categories of public office holders that were wrongly placed in the old package.

The commission also said it recognised the need to modify old salaries and allowances and introduce new allowances that were not included in the old package.

“The commission also considered the need for a living wage to ensure honesty and dignity of the office holders,” the document said.

CENTRAL Bank governor, Prof. Charles Soludo, may have incurred the wrath of the elders in the music industry with his on-going campaign against spraying of money at parties. The campaign which claims violation could land people in jail has become a source of worry, especially to musicians who depend on such spaying for survival. At the head of the protest against the new order is Otunba Sunday Adegeye a.k.a. King Sunny Ade, KSA, who stated that spraying is our way of life and part of our culture.

Addressing journalists in Lagos, the Ondo State-born musician said: “Spraying is part of our tradition and culture and it didn’t start today. In the early days, our kings sprayed with cowries in a manner that depicted their status in the society. Although they didn’t come out to do the spraying, the practice was to string the cowries and the messenger would then tie it round the head of the musician. And when cowries were no longer in use and coins came into being, spraying continued. Spraying is not bad but I’m against those who abuse the currency by either squeezing or trampling on it.”

Adegeye, who called on government to review the new law, pointed out that the excuse given by CBN that musicians trample on money while spraying goes on was not acceptable. His words: “Money sprayed at parties are usually done on the forehead as no musician would allow such money to fall to the ground for fear of people stealing them. We depend on this money for survival and if government is sincere about enforcing the new law, then they should look elsewhere as musicians are the best keepers of the currency. We like our money to look clean and crisp.”

KSA also shared his experience at the Glo sponsored CAF Awards where he performed alongside some prominent Franco-phone musicians. “Being a Glo ambassador, I was told I had been chosen as one of the musicians to perform the new anthem for CAF at the Togo held event. Naturally I was happy to have been chosen to fly my country’s flag at such a glamorous event. On arrival in Lome, I met other musicians from South Africa and Togo and we were given copies of the new lyrics for the anthem. And that was when it dawned on me that I would have to rehearse part of the song which was written in French.

“I spent sleepless nights doing that. First, I had to work on my diction and pronunciation, then I spent an average of seven hours a day rehearsing with my band. And rehearsals as a matter of fact lasted till the eve of the awards night. “Although I didn’t know the meaning of all the words I was stuffing into my head, I managed to do it right.” And on the night of the awards, KSA recounted how the audience reacted when he was called out to take his place on stage. “The audience gave me a standing ovation when I was called out and this really made me proud to be a Nigerian.”

Could he recite part of the lyrics to gentlemen of the press? “Ha, it’s not possible. I have forgotten every word of the lyrics. Don’t worry, next time we meet I promise to do just that”, he said. The top musician explained why he released simultaneously into the market his new album and video, pointing out that the activities of pirates prompted that.

“Four years ago when I released the cassette of my new work, I was still preparing to shoot a befitting video and compact disc when pirates decided to do that for me. I was shocked. And it was there and then that I decided that whenever I’m ready to release another album into the market, it must come complete with the CD and video.”
He also spoke on his venture into main stream gospel music, saying, “I wanted to do something new. At over 62 years of age, I needed to praise God and thank him for his mercies”.

Kosovo declares independence from Serbia

PRISTINA, Kosovo - Kosovo declared itself a nation on Sunday, mounting a historic bid to become an "independent and democratic state" backed by the U.S. and key European allies but bitterly contested by Serbia and Russia.

"Kosovo is a republic — an independent, democratic and sovereign state," parliament speaker Jakup Krasniqi said as the chamber burst into applause. Krasniqi, Prime Minister Hashim Thaci and President Fatmir Sejdiu signed the declaration, which was scripted on parchment.

Across the capital, Pristina, revelers danced in the streets, fired guns into the air and waved red and black Albanian flags in jubilation at the birth of the world's newest country.

Serbian President Boris Tadic immediately rejected the independence bid, saying his country will never accept Kosovo's "unilateral and illegal" declaration.

Sunday's declaration was carefully orchestrated with the U.S. and key European powers, and Kosovo was counting on swift international recognition that could come as early as Monday, when EU foreign ministers meet in Brussels, Belgium.

"From today onwards, Kosovo is proud, independent and free," said Thaci, a former leader of the Kosovo Liberation Army, which battled Serbian troops in a 1998-99 separatist war that claimed 10,000 lives. "We never lost faith in the dream that one day we would stand among the free nations of the world, and today we do."

"Our hopes have never been higher," he told the assembly. "Dreams are infinite, our challenges loom large, but nothing can deter us from moving forward to the greatness that history has reserved for us."

Thaci pledged that the new nation would be "a democratic, multiethnic state" — an attempt to reach out to Serbs who consider Kosovo the cradle of their medieval culture and religion.

But he also had stern words for the Serbian government, which last week declared secession illegal and invalid, saying in the Serbian language: "Kosovo will never be ruled by Belgrade again."

Reacting to the declaration, Serbian President Tadic urged international organizations "to immediately annul this act, which violates the basic principles of international law."

I would not regard it as a waste, I believe it gives the opportunity to learn about other people. It's like a means of training young mind that the world does not evolve round just you,making them see the need to serve and create impart in others which i believe that's why You and I are Created.

I'm a 'Lagos boy' serving in a Cross River State, a place where in my widest dream never exist but I'm beginning to enjoy both the hardship and the adventure.Guys NYSC is good, The question should be what happens after it all?
There is an adage in yoruba that says when you face some people you will sure back others, this means to some the Experience might be interesting and to some a hell on a Earth,

Am going to serve this year batch "A" my only interest is to see the outside world, if it is work i have 10 years of experience and for me to Serve as a Physics or Maths Teacher might be a waste of time coz i read Engineering and i work as an Engineer even before i entered into the higher institution,

And who knows one might find a lasting solutions to his/or her suffering, when serving as a teacher, the initiative is not bad, but the structure on ground is not labour friendly,
