According to a report by PM News, a Court of Appeal sitting in Lagos has quashed the 22-count charge brought against the former Managing Director of Intercontinental Bank Plc, Dr. Erastus Akingbola by the Economic and Financial Crimes Commission (EFCC). The EFCC had alleged that Akingbola stole N47.5 billion belonging to the bank. The report below... Ruling on Akingbola’s application on jurisdiction, the court presided over by Justice Amina Augie held that the High Court of Lagos State presided over by Justice Lateef Lawal-Akapo lacked jurisdiction to entertain the suit filed against him by the commission Justice Augie said it amounted to miscarriage of justice for the lower court to have dismissed Akingbola’s application challenging its jurisdiction on the matter. “The appeal is meritorious and allowed,” she declared. “I am convinced that the lower court refused to align itself with the decision of this court in Nwosu’s case,” she further held. Akingbola and his co-defendant, Bayo Dada, had filed two separate applications challenging the jurisdiction of the court to hear the 22-count charge filed against them by the EFCC. But, the lower court, in its ruling on 2 May, 2014 dismissed their applications. Justice Lawal-Akapo had then held that the charges preferred against the defendants were within its competence and jurisdiction to determine. Dissatisfied with the ruling of the high court, Akingbola and Dada approached the Appeal Court, praying that the trial court’s decision be set aside. Delievering the judgement, Justice Augie declared that the lower court fell into serious error by not abiding by the decision on Nwosu’s case adding, “it is most unfair and is an injustice”. According to her, the lower court has no option than to follow the decision of the higher court on Nwosu’s case. “The point must be made that the decision of this court in Nwosu’s case was based on proof of evidence.” The judge noted that all the charges against the defendants arose out of capital market transactions. “Only federal high court is conferred with the exclusive jurisdiction to try cases of capital market transaction,” she stressed. The appellate court held that the lower court owes it a duty to compare and contrast the documents cited by parties. “It is its duty to examine materials brought before him. It is the role of the judge to do justice in adjudicating all the cases brought before him. “One sided justice would amount to injustice and favouring one side. “The proof of evidence was there but the trial judge at the lower court accused the defendants of not furnishing him with the documents. “He has failed in his duty.” Justice Augie further held that the appeal filed by the defendants has nothing to do with evidence, noting that the lower court failed to go through argument canvassed before it assumed jurisdiction on the matter. She emphasised that the issue of jurisdiction should not have been toyed with by the lower court. “I agree with the appellant that the lower court ought to have gone through the proof of evidence. “There is no way a charge of stealing can stand without going through the proof of evidence,” she declared. The All Progressives Congress, APC, on Monday stated that only corrupt Nigerians and persons opposed to change were against the election of its presidential flag bearer, Gen Muhammadu Buhari, as Nigeria’s president. APC National Chairman, Chief John Odigie-Oyegun, said this in Benin, while speaking on speculations that the former military Head of State would probe past political office holders if he won the 2015 presidential election. Odigie-Oyegun, who stressed that the APC was interested in the future of the country rather than digging into the past, said, “only people I can think of who will fear the Buhari Presidency are those who do not want change; those who want to continue with business as usual; those who want to continue to profit from the level of corruption in the society. We will have no apologies for people like that. “But it is clear that from the Buhari perspective and that of the APC, the future of the people of this country is too important for us to spend valuable time trying to dig into the past.” While urging public office holders to desist from corrupt practices, the APC Chairman assured Nigerians that the law would take its cause and that anybody who believed that the future of Nigeria was greater than his or her personal proclivity would have nothing to fear. He said, “The message will be clear, whatever you engage in before that is detrimental to the people of this country, please stop it; change has come. It is time for change and anybody who decides that he does not want to be part of change and wants business as usual, that is his choice. “And we are going to go into a situation, post May 2015, where the law will normally take its course. There will be a line drawn on the sand, on one part is the past the other side is the future. “If you are part of the future, part of change, part of changing society from all these deliberating ills that have brought us to our knees, you are our friend. You have nothing at all to fear. We don’t have time to go digging into the past, the future of our people is the challenge that we have not the past.” Expressing optimism that Nigerians would resist every form of rigging in next year’s elections, Odigie-Oyegun said, “One will hope the PDP don’t rig. Two, I hope they realize that there is a great movement for change and we hope they are wise enough, they should recognize it and allow the people’s vote to count. “The international community has been sensitized. You can only rig when the people largely are on your side. I expect that they won’t be foolish enough to attempt the kind of crude and blatant rigging that can upturn the results that we expect and upturn the wishes of the people. “I cannot predict; we are not in control of security forces. We are not in control of the police. We pray for peace; we want peace; we desire peace for the interest of the long suffering people of this country. “But they will need to do something totally crude that any blind man can see for them to succeed in February 14. On Sunday, Pres. Goodluck Jonathan worshipped at the Christs Apostolic Church in Durumi Abuja. Speaking to the congregants, he said: “We are facing a lot of challenges now as a nation. The challenges did not start today but somehow, instead of abating, the problems started increasing for one reason or the other, but I am convinced that it would have been worse than this but for your prayers. With the prayers you continue to offer to God, God will see us through.” The worrying part of the speech for the president’s media team must be his seeming admission that the problems of Nigeria has actually “increased” under his watch. The statement is one which opponents of the administration might be using in its argument against the president in the coming month of election campaigning. However, Pres. Jonathan pointed out to the worshippers that progress has been recorded by his government. He said, if the progress continues like this for another four or five years, Nigeria will be the better for it. He said that Nigeria was not yet at its rightful place and the efforts which he has been putting in for the economy may not immediately be obvious to Nigerians, but promised to continue doing his best. “For me and members of my team, in spite of the challenges, we will continue to do our best. As a nation, we have not reached where we want to be – definitely not – but we are coming up with a number of policies. “Those who are taking pains to look at what we are doing will agree with us that if we progress as a nation steadily in this manner, in the next four or five years, this country will be a better place,” he said. Speaking on the global drop in the price of oil and his government’s effort to stabilise things, Pres. Jonathan said, “We have talked about the drop in the global price of oil. Of course, if there is a drop in oil price, it will affect us in one way or the other. We tell our people to bear with us. It has happened before – in 2008, 2009. It came down to almost about $40, but we survived as a nation. “This time, by all predictions, it will not even go as low as that. We will surely survive it. The economic team is working very hard to stabilise it and we believe that although there may be temporary inconveniences, it will definitely not bring the economy down.” He urged the church to continue to pray for his administration, saying despite the fact that the country was facing challenges, Nigeria’s troubles would not be more than what God’s children faced in the Bible. Speaking on the 2015 elections, he said: “I however believe that the God who brought us to this level will see us through. President Goodluck Jonathan, yesterday, urged Nigerians to pray fervently about 2015 as it would be a turbulent year. The president, who spoke at the Christ Apostolic Church, Area I, Durumi, Abuja where he joined other worshippers for the last Sunday of the year service, urged special prayers for politicians in the country, whose utterances, he noted, was capable of setting Nigeria ablaze. “Next year is a tempting year for us. Election year in Third World countries is always a turbulent year with all kinds of predictions. I, however, believe that God who brought us to this level will see us through,” Jonathan said. “All that I will request of you is to continue to pray for us politicians, myself and other politicians from all political parties, for God to guide us in our utterances and what we do so that we will not sacrifice the lives of Nigerians because of our ambitions. “Nobody’s ambition is worth the blood of any Nigerian. Pray to God to give us that wisdom and mind to make sure we conduct ourselves in a way that will not set the country ablaze because of our personal ambitions,” he said. The Peoples Democratic Party, PDP, presidential candidate also said that people occupying public offices are just privileged, as there are several Nigerians who are also qualified. This, he believes, should make leaders conduct themselves in the right manner. “There are so many good Nigerians that can hold the offices we are occupying or aspiring to occupy, it is by privilege of God that we are here in positions to ask for the mandates of Nigerians. “None of us should begin to think that he is the best person to be anywhere from state houses of assembly to the Presidency. There are a thousand and one Nigerians that are super qualified more than those people who are even aspiring to occupy offices. “Pray for us that God should give us the wisdom to conduct ourselves in a manner that at the end of the day, this country will triumph,” he said. Jonathan, while speaking further, noted that leadership is all about service. According to him, anyone who truly wants to serve will not encourage killing of opponents, as is becoming commonplace in our country. “The development of Nigeria is what all of us want. If every aspirant has the mind to develop the people, then you do not need to kill or maim people to get there. Chairman, Organisation and mobilisation committee of the People’s Democratic Party in South West, Prince Buruji Kashamu, has presented a book to counter the autobiography written by former President Olusegun Obasanjo. Mr. Obasanjo, in his three volume autobiography titled “My watch”, came down hard on President Goodluck Jonathan and his style of leadership. In his own book entitled “no enemies to fight, Goodluck Jonathan on the marble” which contained Jonathan’s quotable quotes since 2011 till May 1, 2013 was yesterday, presented to the public at Ijebu-Igbo in Ijebu-North local government area of Ogun State. The 171 page book was jointly edited by a Special adviser to the President on Research, Documentation and strategy, Mr. Oronto Douglas and Akpodigha Filatei, with twelve chapters and was published in 2013. It would be recalled that Kashamu had obtained an injunction from the Federal High Court sitting in Abuja on December 7, restraining Obasanjo from launching his book, but the former President on December 9 went ahead to launch the book. The judge, who again ruled that the book “My Watch” be confiscated, also gave Mr. Obasanjo 21 days to provide sufficient reason why he should not be ‘punished’ for contempt of court. The former president has since appealed the decision. Mr. Kashamu did not want the book circulated because of certain revelations contained in it, which he considered damaging to his reputation. Excerpts from the highly controversial autobiography showed that Obasanjo insisted on his claim that the PDP chieftain is an indicted drug-baron and a fugitive from the law in the United States of America. The presentation of the book was done in the presence of some leaders of the party in the South West which include, South West Secretary of the party, Pegba Otemolu, Ogun State Chairman, Bayo Dayo and members of Omo-Ilu foundation from Ogun, Oyo, Ekiti, Osun, Ondo and Lagos state. Kashamu while peaking at the presentation of his book, which attracted PDP big wigs in the South-West including Secretary of the party in the zone, Pegba Otemolu; Ogun State PDP Chairman, Bayo Dayo and members of Omo-Ilu foundation from Ogun, Oyo, Ekiti, Osun, Ondo and Lagos states, said the motive and timing of “My Watch” are suspicious, pointing out that Obasanjo aimed at rubbishing the achievements of President Jonathan. According to him, Nigerians and the sophisticated people of the south west are not deceived. They can see through the smokescreen of the ex-president’s book and take informed decisions. “On a personal note, Chief Olusegun Obasanjo said he wrote in his book that it leaves much to be desired for the PDP and the President to associate with somebody that has been indicted in the United States. “I say it again that it is not in his place to say such. It is deceitful and hypocritical for him to be blowing hot and cold at the same time. “It was under his administration in 2000/2001 that the National Drug Law Enforcement Agency represented the federal government and testified in the name case in London that I do not have any association with drug trafficking. “I was tried in the United Kingdom on the basis of the same allegation by the United States, discharged and acquitted when the British court found that it was a case of mistaken identity. “Contrary to their evil wish, I will not forfeit my right under the law and play to the gallery in order to please my political opponents. If the Nigerian and Beninoise governments were adequately represented in the case, what then is the hullabaloo about? “When I was working with Chief Obasanjo and using me to further his political interest, I was a good person. He did not see anything wrong with a former president, self-acclaimed leader of the party and the then chairman of the Board of Trustees hobnobbing with an ‘indicted person’. He calls me anytime he wants. Vice President Namadi Sambo was in Lagos on Wednesday to reconcile the warring members of his party, the PDP, who have been aggrieved over the outcome of the governorship primary of the party that saw Jimi Agbaje emerge as flag bearer. At the reconciliation meeting, the vice president spent considerable time telling his party members why they need to unite to defeat the APC in the state. One of his chief reasons was the claim that many residents of Lagos State have been fleeing the state because of the high taxation being imposed by the state government. Sambo also expressed displeasure that the Lagos government was “laying claims” to some Federal Government projects, such as the deep blue sea port. The VP said he was surprised that with the large revenue the state was generating, it was unfortunate that the All Progressives Congress-led government had failed to deliver the dividends of democracy to the people. He said that if the PDP candidate, Mr. Jimi Agbaje, was elected governor next year, he (Agbaje) would bring an end to the suffering of the people. He said, “Lagos has for years been yearning for change from the burden of excessive taxation and squandering, you all know about. Today, people are leaving Lagos. The huge resources accruing to the state are used to the detriment of the good people of Lagos State. We are poised more than ever before to rescue Lagosians from the bondage and sufferings of taking back with the left hand and then, taking it away by the right hand. “I will like to mention part of the tricks of the opposition where some governors put their pictures on projects in newspapers. In one of them, I saw the Lekki Deep Sea port. This is a PPP (Private-Public Partnership) programme where the Federal Government has large shareholdings with the Nigeria Ports Authority. “The site of that Lekki Deep Sea port was the site where the Federal Government was to build a methanol plant. That methanol plant could not continue because we had spent over $200m on which has been converted to our share. “Apart from that, the NPA is a 20 per cent shareholder in that port and then the private sector has the largest share. Some states are claiming that it is their projects. Our own pictures are there and we are confident that anything that we print and show you can be verified. I believe that with the coming of our new governor, we will have realistic development in Lagos State.” The vice president said that he was happy that all aggrieved aspirants in the state have agreed to work together for the PDP candidate, Jimi Agbaje. “I am delighted to know that we are more than ever before united to form a common front in realising our objective of not only capturing Lagos but winning all seats at all levels in the forthcoming 2015 elections. “The Lagos State PDP and indeed Senator Musiliu Obanikoro, Mr. Deji Doherty, Ambassador Tokunbo Kamson and Mr. Babatunde Gbadamosi who were our governorship aspirants have agreed to team up together and work to win Lagos this time around in 2015,” he said. In a swift reaction, the Lagos State Commissioner for Information, Mr. Lateef Ibirogba, said he was surprised by the claim of the VP that people were fleeing Lagos because of high taxation. He said he was disappointed that Sambo could peddle lies when it was glaring that the state government had performed better than the Federal Government in all sectors. He said, “Was it the Federal Government that did the Lekki-Ikoyi Link Bridge or the 10-lane expressway in Badagry? Are they responsible for the light rail? Are they the ones that have been successfully running the economy of Lagos? I really do not know what they want to lay claim to except the bad Oshodi-Apapa expressway which is a source of pain to all Lagos motorists. “What have they ever done in Lagos? I am happy that even Obanikoro has said Bode George and Agbaje hired armed thugs to disrupt the primary. Obanikoro also told us how the federal task force was used to perpetuate violence. “Is that the kind of party that wants to rule Lagos? Look at the conduct of their primary where one of the aspirants even went there with a bulletproof vest. Even a blind man knows that Lagos is the benchmark of good governance. “The PDP has not been able to successfully run the Federal Government in 16 years and they want to rule Lagos. They are just a bunch of shameless people. Former Head of State Buhari has reportedly beaten former VP Atiku Abubakar, current Governor of Kano State, Rabiu Kwankwaso, current governor of Imo State Governor Rochas Okorocha, and the publisher of Leadership newspapers Sam Nda-Isaiah, to win the APC presidential Primary. It was Friday evening and this was our neighborhood version of TGIF. Two of the very young patrons entered and sat down on my table. I use the word; ‘young’ to describe those patrons between the ages of 30 and 35. I have been told that the economic situation of the country is the reason they have become patrons at the local area bar, as this is all they can afford, but that is talk for another day. This evening, as they sat and gave Patience; the service girl cum waitress, their orders, one of them shocked me by referring to me as ‘common ma’. I was indeed very surprised as I had not the slightest inkling that they were interested in the socio-political issues within the country, never mind that they had knowledge of this column. The majority of Nigerian voters are under the age of 55 and thus the language of the spokesperson must be the language this group understands and identifies with and Lai Mohammed does not even begin to fit these criteria, just as he doesn’t fall into the ideal age group. Lai Mohammed is also Muslim in a party that is already being labeled as a Muslim party. The APC urgently needs a spokesperson that is young and looks and acts it and being Christian will be a huge advantage. This person must be pro-active; identifying the many problems affecting Nigerians, bringing these to the fore in press conferences, and proffering the solutions that the APC will give to these problems. The second thing that, I see, that needs to be done, is for Bola Tinubu to retreat deep into the background. Irrespective of the great job done in Lagos state, which is the poster state of the APC, there is no doubt as to the intense corruption and nepotism which is the hallmark of Tinubu’s style and many Nigerians are extremely wary of allowing such on a federal level. To this end, the party needs to be seen or perceived to be distancing itself from the person of Bola Tinubu and this will only happen if Tinubu retreats into the background and let the party chairman, spokesperson and the flag bearers be the faces of the party. The third thing that, I think, is needed is a detailed and comprehensive party manifesto. The APC needs a comprehensive document that lists our most pressing problems with detailed explanations the solutions the party intend to effect, complete with solution schedules. This document should be translated into all the major languages and made easily available. This will be a real game changer for Nigerians; away from the usual ’10 point agenda’ documents that we always get shoved in our faces and which the parties, upon failure, can easily point fingers at previous governments, as is the present situation. Fourth; in a radical move from the norm, the APC seems to be gearing up to have real primaries. For a party that extols its progress qualities, to be seen to encourage internal democracy is absolutely vital to any claims it makes as regards the development of our young democracy. There are unconfirmed reports of several APC politicians currently stockpiling weapons in readiness for the primaries and in a bid to avert the violence; the party hierarchy is contemplating a return to its usual ‘selection’ process. As good a move as this may be to the party hierarchy in staving of violence and internal strife, it will be a wrong move in their quest to achieve the greater goal. The party hierarchy should instead commence investigations into determining their members who are guilty of such unacceptable behavior and to publicly dismiss such persons from the party. A leader of the All Progressives Congress, APC, and senator representing Kwara central senatorial district in the National Assembly, Senator Bukola Saraki, at the weekend said none of the party’s presidential aspirant for the 2015 election will leave the party after its primaries. “These are democrats, who have taken a decision that a victory for any of them is a victory for all because they have not seen the ambition as a do or die affair,” he argued. Kano State Governor, Dr. Rabiu Musa Kwankwaso; former Head of State, General Muhammadu Buhari (rtd) former Vice- President Atiku Abubakar, and Publisher of the Leadership Newspapers, Mr. Sam Nda-Isiah are aspirants of the APC. “We have had discussions with them and if you talk to any of the four of them, they will tell you that who ever emerges at the primaries will be supported. “Tell Nigerians that none of those four presidential aspirants is going any where because we have all come to stay and we have shed those that want to go off,” he said. “It is clear that what we are fighting for is what Nigerians want. We are not doing what Nigerians don’t want. It is only if it is about ambition of the country today.
