Today, after getting a hold of the speech Professor Osinbajo delivered yesterday at the graduation ceremony of Senior Course 39 of the Armed Forces (Command and Staff College) in Kaduna, we think we may have cracked the first set of codes to figuring it out. In the speech, the Acting President did not just address the graduating class, he addressed the whole nation. And on the issues that are most pressing to us. His admiration for the role of the military did not hinder him from sending a subtle message about the finality of our dictatorial years – an apt nod to the recent murmurs about a coup in Nigeria. His seemingly off-base discourse on ethnic divisions in Nigeria and the real reasons they exist also played well to show off the single mindedness of a man who does things with the intention to see them through completely. After spending a whole week consulting with stakeholders in a bid to put an end to the embarrassing ethnic rancour that has played out nationally through “quit notices” lately, it was only befitting that the Professor deemed it fit to share his final and conclusive thoughts on the matter on Friday, before men of the Force who will now bear the responsibility of ensuring the security of lives and property of all Nigerians regardless of tribe. Still, in the 5-minute-long speech, the Acting President managed to leave the timeless message of living with a global mindset irrespective of whatever platform – virtual or physical – one finds themselves in our constantly evolving world. The occasion of the graduation of the elite corps of our Military, armed services, intelligence and Foreign Service members is one that offers an opportunity for reflection on national issues. We are the identifiable public service elite of our nation, paid for with taxpayers money, and so we must be its foremost think-thank. So, permit me to address you for a short while on the subject — We can build a new Nigeria. In these past few years, more and more, we began to hear expressions such as Nigeria’s ethnic nationalities; we began to see more identification by race and geopolitical zones, Ndigbo people, Arewa people, the Yoruba people, South-South, North-East, South-West, North-West and South-East; and other parochial descriptions that were hitherto unknown. The rise of ethnic chauvinism rode on the wings of several agitations. The narrative of most agitations centres around alleged marginalisation and fears of dominance of one faith over the other. In the 2015 elections, the ruling party repeatedly tried to cast the opposition as a party of Islamists determined to islamise Nigeria. The expression supporter of APC party took root. Most ethnic agitations are centered around getting a larger share of the national cake or more favoured placement in the food chain because they were essentially elite claims: the vast majority of the populations of the ethnic groups that win some concession or the other never really benefit. So, the mere fact that a South-South person became President did not necessarily translate to prosperity for the tribe, neither was it the case when a President from the North-West emerged, nor one from the South-West. Aside from a few individual beneficiaries of some appointments or the other, there is usually nothing to show for the ethnic group of those who emerge in Nigeria’s numerous ethnic contests for power. Yet, the contests of the tribes are heightened by the elite, usually for personal political or commercial ends. When you hear a person say that my tribe has been marginalized usually what he is saying is “appoint me“. The ethnic card is an effective bargaining tool. A major drawback of ethnic chauvinism is the way that it is used to mask wrongdoing and promote impunity. Notice that when people are charged with looting public funds they quickly find a counter narrative. It is because I am Yoruba, Fulani or Igbo; or the Christians or Muslims are after me. Appointments in the public service are no longer even judged on merit. The question is how many are from my own ethnic group. A terrible affliction, when you consider that what we are looking for are men and women of integrity and talent to run our economy and create a future for our children. Why is that when we want to win at football we don’t ask which ethnic group the players are from? But perhaps at its most extreme and dangerous are hate-filled agitations for secession or autonomy. In the past few weeks we have as a nation witnessed the escalation of such agitations usually couched in deliberately intemperate and provocative language. The reckless deployment of hate speech and the loud expressions of prejudice and hate, name calling of those of other ethnicities and faiths is a new and destructive evil in our public discourse. But even more divisive words, expressions, and actions calculated to create fear and uncertainty have also been freely used. Young people in the South-Eastern states under the aegis IPOB, issued a stay at home order as part of actions to prove support for their agitations for secession. In the Northern states young people under the aegis of the Arewa youth, issued an ultimatum to Igbos living in the Northern states to vacate before the 1st of October. The problem with hate-filled and divisive speech is that they tap into some of the basest human instincts, bringing up irrational suspicions, fear, anger, and hatred and ultimately mindless violence. People who have lived together as neighbours and friends suddenly begin to see each other as mortal enemies. The tensions that led to the killing of over 800,000 Tutsis and Hutus, considered Tutsi sympathizers, in the Rwandan genocide, were roused by hate media. The most notorious was the Radio-Television Libre des Mille Collines (RTLMC), which became immensely popular as a young, hip alternative to the official voice of the government. It played popular music, and encouraged the public to phone-in and participate in radio broadcasts. Amongst its listeners, RTLMC attracted the unemployed youth and Interhamwe (Canadian NGO). It was a stunning development for the 79-year-old pioneering black entertainer who had risked spending the rest of his life in prison if convicted on drugging and molesting a woman at his home 13 years ago. Around 60 women have publicly accused Cosby in recent years of being a serial sexual predator alleging that he drugged and assaulted them over a span of 40 years across the United States. But 44-year-old Andrea Constand’s alleged assault was the only criminal case brought against him as most of the alleged abuse happened too long ago to prosecute. But if the man once adored by millions as “America’s Dad” escaped conviction Saturday, prosecutor Kevin Steele said that he intended to seek a re-trial as authorized in such cases under the law. The seven-man, five-woman panel had spent around 53 hours deliberating in Norristown, Pennsylvania, longer than the amount of time dedicated at the trial to testimony and legal arguments. They first informed Judge Steven O’Neill on Thursday that they were deadlocked, but were instructed to return to their deliberation room and try harder, without being given a deadline or timeframe. Less than 48 hours later, and working into the weekend on a Saturday — the 11th day of the trial — the panel informed the judge that they were still deadlocked on all three counts against Cosby. Legal experts had always said the he-said, she-said nature of the case was always going to be difficult to prove in court, not least because it happened so long ago and due to a lack of physical evidence. The trial has irrevocably damaged his legacy as a towering figure in US popular culture, once adored for his seminal role as a lovable father and obstetrician on hit TV series “The Cosby Show.” While the prosecution spent five days, painstakingly trying to build their case, the defense called just one witness to the stand and rested their case in just a handful of minutes. – ‘Humiliated’ – Cosby had faced a maximum sentence of 10 years in jail and a $25,000 fine on each of three counts of indecent aggravated assault. The trial heaped disgrace on the award-winning actor who was lauded a hero by African Americans and revered by whites for smashing through racial barriers in a five-decade entertainment career. Cosby attained his greatest fame for his role as Cliff Huxtable on “The Cosby Show” from 1984 to 1992. One of the most popular television series in history, it jettisoned a man raised by a maid and a US Navy cook into a life of fame and wealth. But behind the celebrity gloss, the role model and years of educational philanthropy, lurked sinister allegations. Constand was composed on the stand under a fierce barrage of cross-examination from the defense, which sought to portray their relationship as consensual, and Cosby’s accuser as a liar. At the time a 30-year-old director of women’s basketball at Temple University, where the actor sat on the board of trustees, she said the assault left her “humiliated” by someone she had thought of as a friend and mentor. The Canadian said Cosby gave her three pills and wine before touching her breasts, putting his fingers in her vagina and putting her hand on his erect penis after she sought his advice about moving to Canada and switching careers. After taking the pills, Constand said, she had trouble talking and difficulty moving and was suffering double vision, before briefly losing consciousness. “In my head, I was trying to get my hands to move, get my legs to move, but I was frozen and those messages didn’t get there,” she said, her voice breaking. Cosby maintained in his original 2005 deposition that he gave Constand the antihistamine Benadryl to relieve stress and had consensual relations, accusing her of lying. The weapons deal collapses in acrimony but instead of a shoot-out, the embittered parties fight it out in court. In this real life saga, Ara Dolarian is the US arms dealer, Hima Aboubakar the weapons contractor and the foreign government Nigeria, which has been locked in a battle with Boko Haram since 2009. The $246 million (221 million euros) order at the height of the jihadists' insurgency in 2014 was for weapons and equipment, including helicopters, bombs and ammunition. It could have given over-stretched and under-resourced Nigerian troops a boost, as the better-armed rebels captured territory across northeast Nigeria, often without a fight. But the deal collapsed in 2015 and the arms never arrived. Aboubakar sued Dolarian for fraud in California. Aboubakar, a national of Niger, claimed the US arms dealer failed to ship $8.6 million worth of bombs and rockets, damaging his reputation as "a trusted arms supplier to the Nigerian military". Dolarian alleges in court documents that he was unwittingly caught up in a "money laundering scheme" and that Aboubakar's arms money was "stolen from the Nigerian government". - Rare glimpse - Campaign group Transparency International described corruption in the defence procurement sector as "the new diesel for Nigeria's kleptocrats". It estimated that more than $15 billion has been stolen, "leaving the military without vital equipment, insufficiently trained, low in morale and under-resourced". "This has crippled the Nigerian military," it added in a new report published on Thursday, which defence spokesman John Enenche rejected and described as "a sweeping allegation". The defence ministry now did "government-to-government" deals and no longer used contractors, he added. The court battle between Dalorian and Aboubakar some 12,500 kilometres (8,000 miles) from Abuja offers a rare glimpse into the shadowy world of the arms trade. It could also shed light on how an alleged multi-billion-dollar fraud in the office of former national security advisor Sambo Dasuki might have taken place. Pieter Wezeman, a researcher at the Stockholm International Peace Research Institute, said Dolarian's deal with Aboubakar and his company Societe d'Equipments Internationaux (SEI) "rings alarm bells". Court documents show SEI signed off on the purchase of six Mi-24 and Mi-35 helicopters from Dolarian for $25 million each, which Wezeman said was far above their normal value of $5 million each. Inflated prices open the door to graft, he added. "This is really a ridiculous price," he said. - Endemic corruption - Current President Muhammadu Buhari's predecessor Goodluck Jonathan and his administration were forced to take Boko Haram seriously after the kidnapping of more than 200 schoolgirls from the remote town of Chibok. The mass abduction in April 2014 drew the world's attention to the conflict, sending the government on a shopping spree for weapons. Buhari, a former military head of state, honed in on the notoriously rotten defence procurement sector after coming to power on an anti-corruption platform in 2015. Dasuki has been accused of orchestrating a sprawling embezzlement scheme that saw "phantom contracts" awarded for personal and political gain. - Shocking scale - The scale of the alleged scam and how officials apparently exploited the insurgency shocked even Nigerians wearily familiar with corruption scandals. Dasuki and scores of other defence officials were arrested and put on trial. Buhari's government then went after procurement firms. Last year, a committee set up by Buhari said SEI played a "major" role in the alleged scam after being awarded nearly $1 billion worth of contracts "characterised by irregularity and fraud". SEI deals appear in many ongoing corruption cases in Nigeria. Two top air force officials are charged with bribery for accepting cash and a Range Rover from the company. Aboubakar has not been charged and told AFP: "We continue to work with the Nigerian army. Forget about what the people say, they lie." - 'Excessive secrecy' - Repeated adjournments have become a feature of the separate trials linked to the Dasuki "arms scam". As time goes by without a big name conviction, there are doubts about whether a significant dent will be made in Nigeria's culture of corruption. Buhari himself -- the driving force of the anti-graft campaign -- is wrestling with ill health. Nigeria specialist Matthew Page said Buhari was not reforming a system of embezzlement "codified" by former military rulers such as Sani Abacha. Habits that saw many senior officers get rich over decades of military rule persist, despite the return to democracy in 1999, he said. Nearly two decades later, the defence sector is still secretive, with little or no oversight and transparency, and arms procurement still requires ad hoc approvals from the executive. "Buhari is a dyed-in-the-wool military guy," said Page, a former US State Department official. The committal was because of I-G’s refusal to pay him all his entitlements as ordered by court of appeal, Jos division on May 12, 1997. Joined in the suit were the attorney-general of the federation and the Benue commissioner of police. Agha in his affidavit filed before the federal high court, Makurdi, deposed that he enlisted in the Nigerian police force in 1977, and was unlawfully dismissed from the force in 1988, while serving at 13PMF, Makurdi, Benue. He explained that he was dismissed because he wore a mobile police fez cap to the police headquarters, Makurdi on a day it was drizzling. Agha said an assistant commissioner of police (ASP) asked why he wore a face cap when the then commissioner of police, had banned it a few days earlier. Agha said he explained that he did not know about the ban, but that the ASP took up the issue with him which eventually led to his dismissal. Aggrieved by the treatment, he headed to a Makurdi high court to contest the disciplinary action, but the case was thrown out. Agha appealed the judgment at the court of appeal, Jos, and the it was allowed. He said on May 12, 1997, the appellate court set aside the judgment of the Benue high court and ordered that he be reinstated forthwith and paid all his entitlements. The applicant said all efforts to get the police to comply with the judgment had failed. He therefore, headed to the federal high court, Makurdi, and filed a contempt proceeding against the IG and two others. When the case was called for hearing, Tarfa Achinge, counsel to the applicant, informed the court that the case was for the hearing of form 49 of the judgment enforcement rules. However, Achinge said he got information from Gabriel Ebonyi, counsel to the 1st and 2nd respondents, that there was a window of opportunity for an out-of- court settlement, and asked for adjournment. Ebonyi, who did not oppose the application, promised the court that he would make further effort to get his superiors to comply with the judgment of the court of appeal without necessarily hearing the form 49. Form 49 of the judgment enforcement rules filed before the court required the respondents to show cause why an order of committal to prison should not be made against them. In his ruling, Hassan Dikko, the judge, told counsel to the 1st and 2nd respondents to urge the police authorities to pity the “poor applicant” and comply with the order of the court of appeal.
