I just want to come back here to say thank you to everyone who takes their time to make contributions to this platform. I sought for advice few months ago about my daughter whom I had from a previous relationship and a different surname. I’m here to testify to the goodness of God cos her visa was granted barely 40 hours to the flight date after waiting for close to eight weeks and two emotional paid calls.
Truly what God cannot do, does not exist!

hi. I dont like when we assume we can do our Nigerian way and get away with things. I remember you asked this question MONTHS ago about your child and you were categorically told that only a court order/legal documents showing SOLE responsibility will be the way to go… you could have easily avoided this NSF by getting this done or avoiding this altogether. UKVI can not grant such because u produced consent letter and data page . It’s unfair how u handled this and now u complaining about NSF but u were informed here.
The biological father been informed is not adequate. You need to solve this LEGALLY. Human rights division has nothing to do with this as tomorrow the child’s father can wake up and claim any damages against the UK govt that his child was taken and they aided and abetted. They will not work on inadequate documentation. Pls start the needful

Thank you for response and for your kind observation. I was misled that the process of getting the sole responsibility will take a minimum of 6 months and I didn’t have that time so I thought to try it out but unfortunately I’m here now!

Now back to the solution! Someone offered to help with a genuine court order but it’s from a Kaduna court meanwhile my kids and husband live in Lagos. Please hope location isn’t an issue?

Thank you for your response. How do I get in touch with the human right division. I used to live in Ikorodu Lagos but I’m presently in the UK but my husband can meet with them if there’s a need to? Are they in the court or local government?

The biological father is aware of my intentions to travel with her and he has written a consent letter with his passport Datapage.

The lawyer I contacted said getting a court order will take a minimum of 3-4 weeks. And I’m expected to reply within 10 working days (2 weeks).

Is it possible to upload the court documents that shows the initiation of the court process while requesting for an extension as well?

Step fathers don't always have legal parental responsibility unless declared by the court or adopted/consented/applied for through the court. It's easier for you the mom.

You have only been away for a short time so it's fine. The cover letter will address this and other care arrangements you placed via her step father when you were away


2. BRP and visa page won't have any effect unfortunately since her biological father doesn't have one.

The point is in making sure there is no parent -child abduction and UKVI relies on legal documents to ensure that is the case. Previously there have been consent letters given that didn't come from the said parent. UKVI won't risk that anymore

When it's time to travel you can explore minors travelling alone if you don't want to return home to get her

Get the court order, so it's sorted once

I can imagine how you must feel

Unfortunately,you need to get the court order declaring you sole responsible parent. her father's consent and ID is only additional

A good lawyer should be able to get this sorted without your need to be there and shouldn't take long since her father already consented. whilst that's going on , prepare a secondary arrangement for her to be with a trusted member of the family

Once you have your court order, let us know we can help list out documents and a solid cover letter for her visa application

I type this with tears and sadness in my heart. My first child I had outside wedlock just got this NSF. I’m already in the UK and she’s applying with her stepfather and siblings. I uploaded consent letter from her biological father and my husband did an ffidavit. I didn’t do legal guardianship before leaving and the process takes months before it’s ready.

The UK Decision Making Centre is currently assessing the application submitted by the above named. We are unable to conclude the application at this time as we require additional information.

Please provide the following documents:

Paragraph ST 34.2 States - Child applicant’s parents must each be either applying at the same time as the applicant or have permission to be in the UK (other than as a visitor) unless the parent with permission as a Student is the sole surviving parent or has Sole Responsibility for the child’s upbringing
• Please provide Details of your parents Visa application to travel with you to the UK or proof in the form of an official court document to evidence that the parent that you are travelling with has Sole Legal Responsibility, however this must not be only in the form of an affidavit.

If not you have to go through the legal route of sole custody with the child's father

I initiated form A for him and I used the flywire payment details generated on the school website. Although some banks don’t allow third party beneficiary but Wema bank does and a few others.
