Nigerian states have no powers to reject requests filed under the Freedom of Information Act (FoI), the Court of Appeal has ruled. In a March 27 decision at the Akure Division, the Court of Appeal ruled that the requests for information, especially around public expenditure, under the FoI, are made in public interest and should be honoured by all states. The decision came in an appeal filed by Martins Alo, a journalist, against the Speaker of Ondo State House of Assembly and Auditor-General of Ondo State. Mr Alo had demanded the audited report of Ondo State Government between 2012 and 2014 to properly access how public funds are utilised in the state. But the request was rejected, prompting him to seek judicial redress. The Akure Division of Ondo State High Court had previously ruled in 2016 that Mr Alo had no right to demand how the state was spending money, saying the FoI was not applicable to states and the request was not in public interest to begin with. The judge, Williams Akintoroye, also said Mr Alo should pay a damage of N10,000 for wasting time and resources of the state. But Mr Alo’s lawyer, Femi Emodamori, appealed the ruling on behalf of his client, arguing that Mr Akintoroye erred in his judgment and that his client was acting in public interest. A three-member panel at the Court of Appeal rejected Mr Akintoroye’s ruling and agreed with the appellant that the FoI was applicable to states and it was in public interest for the state government to release its audited report. The Court of Appeal judges who sat on the matter included Uzo Ndukwe-Anyanwu, Obande Ogbuinya and Ridwan Abdullahi. Mr Ndukwe-Anyanwu wrote the lead opinion, saying Mr Alo has a right to act on behalf of the public to obtain the information from state authorities. He also quashed the N10,000 fine imposed by the lower court. “In a democratic dispensation, such as the Nigeria’s, the citizens have been proclaimed the owners of sovereignty and mandates that place leaders in the saddle,” Mr Ogbuinya said in his concurring opinion. The citizens have a right to know details of “expenditure of public funds generated from their taxes,” Mr Ogbuinya added. Several states, including Lagos, Adamawa, Akwa-Ibom and Ondo, have been rejecting FoI requests relating to their activities since the law was signed in 2011 by former President Goodluck Jonathan. |

North and South West will vote heavily for him again The issue is that APC is flying a kite that Igbos should vote Buhari in 2019 so they can benefit from a turn by turn arrangement where an Igbo president can emerge as APC candidate in 2023. THE POISONED APPLE DANGLED BEFORE THE IGBOS The Secretary to the Govt of the Federation Mr Boss Mustapha, yesterday told the Ebonyi state delegates of the APC that supporting Buhari's re-election is the shortest way to Igbo presidency and that they should go home and tell the south easterners to support the president to return in 2019. After reading what transpired in Abuja, I asked myself the way forward for the Igbos as a nation. First of all, has producing the president favoured any people in Nigeria? The north has been in power for a longer period of time more than any region since independence, yet the north is the most backward region in Nigeria, with diseases, illiteracy, insecurity, hunger and religious intolerance ravaging the region. The presidency of Obasanjo did not confer any special advantage to the people of Ogun state. Otueke did not become a haven when Jonathan was the president. There is no evidence that Daura or even the entire Katsina state has become better just because Buhari is the president. The way the Nigerian presidency is structured, being a president or producing a president does not confer any special benefit to any region. Although it is true that a president can use his powers to cause a development to his zone, but in Nigeria, how much development can a president unlawfully corner to his region without procuring the wrath of other regions? The truth is that this silent promise to the Igbos which has no seal of official pronouncement, is to me, the kind of promise a man makes to a woman he wants to sleep with. Once the man succeeds in what he wants to do, he forgets the promise. If the woman tries to make him to keep his promise, he will tell the woman that he can't even remember when he made the promise. Any Igbo person who believes that the APC peopled by the likes of Tinubu, Amaechi, Buhari etc will present the presidency to the Igbos after the tenure of Buhari when the Igbos are clearly a minority in the APC, did not suck the breast of an Igbo woman. Those who sucked the breast of Igbo women as their mothers can never be deceived by such fake promise. Also, there is what we call character evidence. Buhari and the APC have never kept any of their electoral promises. If we judge them by their character, why should we believe that they will keep this promise ( if in fact there was any promise binding at all) after the tenure of Buhari? The truth is that such a promise is not likely to be kept. Also, is Buhari and the APC feudal lords that can give the presidency to anyone they wish? Does the Nigerian president or the party in power have the power to give the presidency to whoever they desire? If the president and his party have that power, why did Jonathan lose the election despite the fact that he and his party were in power? The truth and fact is that for anyone to be a president, he needs the cooperation of at least five geopolitical zones in Nigeria to do that and if the APC fields Igbo candidate and the regions in Nigeria reject the candidate, the Igbo presidency will remain a pipe dream. We also forget the fact that the Igbos may not vote that candidate. It happened during the time of Obasanjo when most people of the South West chose not to vote for him. What exactly do the Igbos want? The truth is that most igbos are divided into two thin and blurred lines: those who want an independent country of Biafra and those who want the country to be restructured so the regions can stand and develop on their own without depending on the federal govt for survival. Although the idea of an Igbo presidency is not unwelcome in the south east, it is not the solution to the problem of the people of the region and anyone who is using it to entice, lure, or manipulate the Igbos into voting to continue the most incompetent, sectional and unproductive govt of Muhammadu Buhari should know that majority of Igbos are too intelligent to fall for that prank. |

The incident was said to have occurred late on Saturday night when an Improvised Explosive Device (IED)exploded in a pharmacy along More road in the state. An eyewitness explained that a man who was injured was rescued from the back of the building and rushed to the Obafemi Awolowo Teaching hospital, where he later died in the morning. The community due to this incident was thrown into confusion after residents heard the explosion suspected to have emanated from the building in the neighbourhood. The explosion, however, affected several other adjourning buildings as the Osun State Emergency Service is expected at the scene for evaluation. Meanwhile, only two policemen have been sighted at the scene of the incident. |
