In yet another snub, the founder of the Synagogue Church of All Nations (SCOAN), Prophet T.B Joshua for the second time yesterday refused to appear before the Coroner’s Inquest investigating the circumstances which led to the collapsed of a six-storey guesthouse within his church premises on September 12. Instead, the Prophet has asked a Lagos State High Court in Ikeja to stop the proceedings of the coroner's inquest. The inquest was inaugurated by the Lagos State Government under the state Coroner’s System Law No.7 of 2007 to investigate the cause and circumstances resulting in the death of 166 people following the collapse of the six-storey guesthouse and to forward its findings and recommendations to the appropriate authorities. Counsel to Joshua, Mr. Olalekan Ojo yesterday, informed the coroner’s inquest presided over by Chief Magistrate Oyetade Komolafe that the Registered Trustees of the church and the founder, Prophet T.B. Joshua had filed a prohibition suit before Justice Lateefa Okunnu of an Ikeja High Court against the coroner. Joined as respondent in the suit are the Coroner's Court of Lagos State and Magistrate Oyetade Komolafe. Komolafe had at the last sitting on Thursday warned all expected witnesses including Joshua and the collapsed building contractor not to dare the court by not appearing or risked being arrested. According to Ojo, the suit brought pursuant to Order 40 Rule 5 of the High Court of Lagos State (Civil Procedure Rules) 2012 and signed by one O.M Abimbola is praying Justice Okunnu for an order of prohibition, against the Coroner's Court of Lagos State and the presiding magistrate Komolafe from exceeding their jurisdiction in the conduct of coroner's inquest into the death of unknown persons in the collapsed building within the premises of SCOAN on September 12, 2014 The suit marked ID/188MJR/2014 is also seeking “An order of Certiorari to quash the proceedings of the 1st and 2nd respondents in the conduct of the coroner's inquest into the death of unknown persons in the Synagogue tragedy September 12, 2014 in suit number CR/AL/01/2014 concerning matters, issues and circumstances other than what directly caused the death of the victims and the manner of their death for having been conducted without or in excess of the statutory jurisdiction of the 1st and 2nd respondents. "My Lord, we have applied for a judicial review of the proceedings of this honourable court so far. We may be right, we may be wrong, but what we are saying is that this coroner court has been extending and it is still extending its inquisitions into areas outside the statutory jurisdiction of the coroner court. That is our complaint, my Lord. "And what we are saying is, if the High Court agrees with us to set aside such portions of the proceedings that it adjudges to have been conducted in excess of jurisdiction, it should prohibit the coroner from further acting in excess of its jurisdiction. "The strict scope of the coroner's inquest is ascertaining the cause and the manner of death and it would be in the best interest of all of us if the High Court agrees with us. "My Lord, we are also saying that thus court should suspend further proceedings, pending the time when my Lord, honourable Justice Lateefa Okunnu will give her ruling. My Lord has fixed the matter for December 3 and with utmost respect to my Lord, she is an eminent judge that could even deliver the ruling on that day. "My Lord, our prayer is that you should accord the High Court respect and the dignity, so that your Lordship will not been seen to have taken or to intend to take any further action that might amount to prejudising or preempting the High Court." In the suit, the church also wants the court to declare that the decision of the coroner to summon the applicants to give evidence at a time when no materials were placed before the coroner against the applicants is a breach of the applicants’ right to fair hearing. "A declaration that the coroner who relied on his personal knowledge of the facts of the case is not a proper person to preside at the inquest into the death of people at the collapsed building of Synagogue Church of All Nations. "A declaration that the coroner who relied on extraneous matters not borne out of the records to reach his conclusion that the 2nd applicant is a necessary witness when in fact is not, is in breach of the rules of natural justice and fair hearing guaranteed by the 1999 constitution of the Federal Republic of Nigeria. "An order prohibiting the coroner from conducting further inquest/proceedings relating to the construction of the collapsed building which facts are clearly outside the scope of a coroner's inquest. Responding to Ojo’s information on the suit, Komolafe said he had not been served with any court process, adding that he was not obliged to suspend his sittings till the High Court's decision came. Komolafe said was only restraining himself, in the spirit of fairness, to issue a bench warrant against Joshua and urged the clergyman to abide by the laws of the land. Let me give this to you, so that you don't create the impression to the world that anybody is after anybody, because, in fact, you saw me writing, it is the bench warrant for that man. But you see, let me give him a long rope to pull. The court cannot be taken for granted and nobody, I repeat, nobody can do that, not even him. I just want you to advise him accordingly. "I don't even need to listen to this application, just to tell you that nobody is being prosecuted or being put on trial. The point I want to make is that, that fellow, whoever, he is, he is not above the laws of the land and he dare not try it. Take that message back to him, that not on earth should he try to rubbish the court and never on earth should he try to use his hand to touch the sword of the state, if he does, he would have himself to blame. "What I am saying is that Joshua should respect himself and not drag the law of the land into the mud." Ex militant commanders in the Niger Delta have warned members of the House of Representatives to refrain from its alleged move to impeach President Goodluck Jonathan, saying that some of the law makers had lost the respect of Nigerians. Speaking under the aegis of Leadership, Peace and Cultural Development Initiative, a forum of the former militant commanders in the region, the President of the group, Mr Reuben Wilson reassured President Jonathan of their support, promising that they would resist any move to embarrass him. He said as former commanders of the militant groups, they were watching the unfolding developments, adding that at the appropriate time they would act within the confines of the law. “They call themselves honourable members. But I can say that for legislators to scale the fence of the National Assembly to gain entry into the hallowed chambers, they have lost the respect of the public. It is only criminals that jump fences to gain entry into places, honourable people do not behave like that. “We are watching what they are doing. Let me inform them that their latest attempt at impeaching the president will fail. The Speaker, Aminu Tambuwal should do the honourable thing by vacating his seat because the law says when you defect to another party; you automatically lose your seat. “How would he eat his cake and still have it? Tambuwal wants to discredit the president so that his new party can gain favour in the eyes of the public. What happened on Thursday was a continuation of their so-called Salvation rally. “You can imagine some APC leaders threatening to take laws into their hands and form a parallel government if their party loses in the 2015 elections. It was not up to 24 hours after that threat that the show of shame was displayed on Thursday. If they wanted to actually go and sit for their legitimate legislative duties, why did they go in a commando style as if they were thugs? “We know what they are doing and we are watching them. They should not push us to the wall, because if they do, we shall react.” This country belongs to all of us and we are equal stakeholders. Former Aviation Minister, Femi Fani-Kayode , has urged the federal government to query Governor Chibuike Amaechi of Rivers State for his recent media remarks where he allegedly said the opposition would form a parallel government if President Goodluck Jonathan won the 2015 presidential election, saying that such statement amounts to treason. Fani-Kayode who made the call Friday in a press conference in Umuahia , Abia State, after his two-day visit to the state also expressed disappointment over the commotion at the National Assembly complex on Thursday, accusing the lawmakers of breaking the law and disgracing the country. “For the first time in the history of our country I saw elected legislators attempting to break down wall, attempting to break down gates. I saw them scaling the gate. I saw some of them in torn clothes, struggling through the police lines, I saw them breaking the law, and I saw them display the highest level of indiscipline and lack of respect for constituted authority. The former Aviation boss said “some public figures may shy away from speaking the truth but I will not, no matter whoever is involved .” “Legislators took the law into their own hands. Broke down gates, jumped through the gates, fought the police and created commotion and shameful acts. “If this were to be in any other country particularly America or Uk that for whatever reasons a line was drawn by the police and security agencies, and individuals no matter how high or how much respected or loved chose to defy them and cross the lines, injured some policemen ( because the IG told me on phone this morning that some police men were injured), and they defied the police , went through the tear gas, and ignored the warnings , the police would have been forced to use a very high degree of force. He commended security agencies for their maturity in handling the situation, and noted it was a testimony to the fact that the Nigerian police were very restrained to have allowed the lawmakers to cross the lines. Kayodey argued that if the lawmakers were not satisfied with their being locked out of the national assembly complex by security agencies, they would have rather gone to seek redress in the court than take the laws into their hands. “Again when you look at the comments made by my old friend, Gov. The All Progressives Congress (APC) has slammed the presidency for its agitated response to the warning that if the 2015 elections are rigged, the party will not recognize the outcome and will go ahead to form a parallel government, saying that represents the stand of the party. In a statement, Friday , in Lagos by its National Publicity Secretary, Alhaji Lai Mohammed, the party said that what Gov. Rotimi Amaechi said at the APC’s Salvation Rally, which has now rankled the presidency into a state of delirium, was simply to reiterate the stand taken by the party before the last Osun State Governorship election. ”Those who are fretting about this statement are those who are planning to rig the elections and they should be warned that Nigerians will no longer accept the outcome of any fraudulent polls. Those who incite the people are those who steal their mandate. ”What we made is a conditional statement. If A happens, then B will follow. That means if elections are not rigged, there will be no problem. It is therefore laughable that anyone will call that statement treasonable,” it said, adding that there is no higher treason than the subversion of the people’s will. APC said it is common knowledge that anywhere in the world where elections have been rigged, the consequences have been dire, and Nigeria will not be an exception. ”Let us remind the presidency, in case it has forgotten, that election fraud triggered a civil war in Algeria in the early 1990s, led to the killing of over 1,000 people in post-election riots in Kenya in 2007/2008 and fired a near revolution in Iran in 2009/2010. Electoral frauds also corrupt democracy and breed dictatorship, and risks making the people to lose confidence in democracy. Why then would any government react violently if warned against election rigging?” the party queried. It said that instead of issuing threats and engaging in name calling, the presidency should simply brace up to ensure that the forthcoming elections are not only free, fair and credible, but are seen to be so by Nigerians and the international community. APC said it is necessary to constantly warn the PDP and the Federal Government not to tamper with the 2015 polls because of their penchant for electoral desperation, which manifests in the intimidation of the opposition and the militarization of election, disposition to anarchy and propensity for impunity. The party said already, the process leading to the 2015 polls are flawed, with moves to disenfranchise millions of Nigerians by making it impossible for them to either register or get their Permanent Voters Cards and the plot to depopulate the strongholds of the opposition. ”PDP and the governments it sired, especially at the centre, are lawless and anarchic. That’s why they can unleash the police against federal legislators in an attempt to force a removal of the Speaker of the House of Representatives. That’s why a state under the control of the PDP will use seven lawmakers to remove the Speaker in a 26-member House of Assembly. ”Because it is said that eternal vigilance is the price of freedom, we will constantly warn the PDP and the Federal Government not to tamper with the 2015 elections. We will constantly chide them for trying to institutionalize impunity. We cannot and will not be intimidated by an uptight presidency,” it said. ”The PDP and the Jonathan Administration are the masters of impunity, and they will not hesitate to exploit any sign of docility in the face of their evil intentions on the part of the opposition. The lessons are there: Had the members of the House of Representatives been docile on Thursday when remote-controlled security agents invaded their premises and barred them from entering, Tambuwal would have ceased to be the Speaker by now. ”For us, the gloves are off. We will no longer engage in any nicety as long as some people are bent on thwarting the will of the people through electoral fraud. All we are demanding is a free, fair and credible election. All we are saying is that no one should incite the people by stealing their mandate. Vice President Namadi Sambo on Friday summoned the Inspector-General of Police, Mr. Suleiman Abba, to the Presidential Villa, Abuja over the Thursday invasion of the National Assembly by policemen. A fracas broke out at the National Assembly while security operatives were preventing the Speaker, Aminu Tambuwal, and some of his loyalists from entering the premises. Sambo was said to have summoned Abba to explain the role of his men in the fracas after he (Sambo) had listened to the version of the incident as narrated by the principal officers of the House of Representatives elected on the platform of the Peoples Democratic Party. The police boss was accompanied to the meeting with the Vice President by some senior police officers. When State House correspondents asked him after the meeting if the order to invade the National Assembly came from him, he said ongoing investigation would reveal the roles played by each person in the fracas. “Who did what and who didn’t do what will be disclosed to you later. You know we work with investigations, investigations are going on and the press officer will address you,” he simply said as he made his way out of the Vice President’s wing of the Presidential Villa. When further asked if he was insinuating that he was not aware of the operation before the fracas broke out, Abba insisted, “I still repeat: who did what, who didn’t do what, you will hear later. It is subject to investigations. We just don’t talk anyhow.” As he made his way to his car, the police boss managed to grant another short interview in Hausa, claiming that he had never seen the actions displayed by some lawmakers on Thursday anywhere in the world. He alleged that while somebody was pushing a policeman from a car, another person was seen removing roadblocks mounted by the police. “Somebody was removing road blocks mounted by police. We have never seen this kind of thing in the whole world. So, we will talk to you later. Just wait, our findings will reveal,” he added. Sambo had on Thursday evening met with PDP principal officers in the House of Representatives because President Goodluck Jonathan had travelled to London to attend a meeting of Nigeria’s Honorary International Investment Council. The lawmakers were led to the meeting by the Deputy Speaker, Emeka Ihedioha.
