The Independent National Electoral Commission, INEC, has formally filed an appeal against the judgment of the Rivers State Governorship Election Tribunal nullifying the election of Governor Nyesom Ezenwo Wike.

The Electoral Body filed her appeal dated 4th of November, 2015 at the Court of Appeal, Abuja Judicial Division on 5th November, 2015.

In a 12-ground appeal filed on behalf of INEC by her counsel, Dr Onyechi Ikpeazu, SAN, the Electoral body challenged the entirety of the tribunal’s judgment.


The reliefs sought by INEC in her appeal include : "an order allowing the appeal, an order setting aside the decision of the tribunal and an order dismissing the petition as lacking in merit ".


According to INEC, the learned justices of the tribunal erred in law when it failed to evaluate the evidence of each of the witness called by the petitioners before reaching its decision.

INEC stated that: "The tribunal was obligated to making findings as to where elections were said to have held on the one part and where they were alleged not to have held on the other part".

The Electoral Body further stated that the tribunal erred when it resorted to generic declaration like "many instances", when the justices were obligated to specify where the evidence elicited under cross examination enhanced the case of the first and second respondents.

The Independent National Electoral Commission, INEC, further stated that the tribunal erred when it used the testimonies of witnesses who were not at polling stations to nullify the Rivers governorship election.

INEC in her appeal stated: "Evidence of reports at an election by persons who did not make them and who did not observe th the proceedings, the subject matter of the reports cannot be substitute for evidence of witnesses in the polling units of Rivers State.

"Exhibits A303-A305, A307 and A2 are documentary hearsay which ought not to be relied upon as proof of the allegations of non-conduct and improper conduct of election in the polling units in Rivers State ".

INEC stated that the tribunal disregarded Section 49 (1) and (2) of the Electoral Act 2010 as amended which is a statutory provision binding on it. The Electoral Body further stated that the decision of the Supreme Court and Court of Appeal on the law were duly cited to the tribunal, but it ignored same.

According to INEC, there was no due evaluation of the 56 witnesses called by the petitioners pointing out that the witnesses who testified did not link their testimonies to the documents tendered.


INEC added that the tribunal erred in law when it failed to indicate that the petitioners failed to prove their case on a polling unit by polling unit basis as required by law.

The Electoral Body added that the tribunal erred when it failed to demonstrate the reasons why it rejected the evidences professed by witnesses of INEC, PDP and Governor Wike.

Troops of 28 Task Force Brigade Nigerian Army deployed at Bitta and Pridang yesterday October 27th, carried out a successful raid on suspected Boko Haram terrorists camps at Bulajilin and Manawashe villages along Bita and Damboa road at the fringes of Sambisa forest. The unit also rescued 338 persons that were held captive by the terrorists in the enclaves. A statement by the Nigeria Army spokesperson, said the rescued persons which comprised of 8 male, 138 female and 192 children have since been evacuated to Mubi.

During the raid, the troops were able to recover arms and ammunitions which include 1 General Purpose Machine Gun and 2 Dane Guns, 150 rounds of 7.62mm (NATO), 6 boxes of 7.62mm (NATO) and 3 cutlasses. In a related development, troops based on a tip off, ambushed and killed 4 suspected Boko Haram terrorists on a suicide bombing mission to Gubula, Madagali Local Government Area, Adamawa State. Apart from 2 AK-47 rifles recovered, the troops also recovered some Unexploded Ordinances (UXOs), mortar bombs and cash sum of N153,385k was retrieved.

The statement added that "having appealed and given the terrorists final warning, we would like to state that from now on troops within bounds of respect for human rights and rules of engagement, we shall continue to decisively deal with Boko Haram terrorists until they are defeated".

Zakky Azzay does not need a lot of introduction, the popular rapper and on-air personality is always on the move with activities surrounding him. However, we have not seen him in public recently and we wanted to know why. Do you know that Don Jazzy once embarrassed him publicly? In a recent interview, he spoke about his life and career.

He said about been absent because he been busy musically, with performances both within and outside the country. And that has not given him enough space to concentrate on recording new songs. The World Bank has said that it needed additional time to provide a comprehensive response on how the loot recovered from former Nigerian leader, General Sani Abacha was disbursed.



The Socio-Economic Rights and Accountability Project (SERAP) had requestedfor information on the spending of recovered assets stolen by the late army general.

However, in a letter dated 15 October 2015 and signed by Ann May of the Access to Information Team, the Bank said that “In response to your request under AI3982, we would like to inform you that we are still considering your request and need additional time to provide you with a more comprehensive response.”

The letter reads in part “In most cases, we will be able to respond within twenty (20) working days from receipt of a request for information. However, we may need additional time in special circumstances, for example, if the request is complex or voluminous or if it requires further review by or consultation with internal World Bank units, external parties, the Access to Information Committee, or the World Bank’s Board of Executive Directors.” it added.

Asides from being in an Industry largely dominated by men, the women in the Nigerian entertainment industry constantly have to endure the speculations and bashing sometimes tossed their way.

And even though some of these things come with the territory, the public would argue that most of the backlash is some sort of chain reaction.

Not one or two female celebrities have been accused of bleaching in the past and even though most of them are usually thought to be Yoruba Actresses, you’d be surprised at who else has been accused of lightening up their skin.

I am not sure there is any female celebrity who has received as much backlash as Cynthia Morgan received when photos of her looking lighter emerged a few years ago.

While working on rebranding herself with a new label, Cynthia found out that the public was not going easy on her when her photos appeared.

And she constantly trended for her supposed skin lightening than her music at the beginning.

The I’m Taken Singer did address the speculations at a time, saying she was taking care of her skin and that was it.

But Nigerians were not buying that.
